I submit herewith my report of an audit of the general accounts of the town of Berkley for the period from October 8, 1939 to September 24, 1941, made in accordance with the provisions of Chapter 44, General Laws. This is in the form of a report made to me by Mr. Herman B. Dine, Assistant Director of Accounts.

AUDITOR'S REPORT 1939-1941

Sir:
In accordance with your instructions, I have made an audit of the books and accounts of the town of Berkley for the period from October 8, 1939, the date of the previous audit, to September 24, 1941, and sub- mit the following report thereon :
General ledged accounts were compiled, the ap- propriation accounts were analyzed and checked to the amounts voted by the town, and a balance sheet, which is appended to this report, was prepared showing the financial condition of the town on September 24, 1941.
The books and accounts of the town treasurer were examined and checked. The receipts, as record- ed, were compared with the departmental records of payments to the treasurer and with the other sources from which money was paid to the town. The pay- ments were checked with the selectmen's warrants, the cash book was footed, and the cash balance on Septem-

ber 24, 1941, was proved by reconciliation of the bank balance with a statement furnished by the bank in which town funds are deposited and by examination of the savings bank book.
It was noted that on Septeber 24, 1941, the ex- penditures for Chapter 81 highway projects exceeded the amount available by $4,129.86, and the expendi- tures for Chapter 90 highway project exceeded the amount available by $1,999.90. Attention is called to the fact that expenditures for highway projects carried on by the town in conjunction with the State and the County may not exceed the aggregate amount of the appropriation voted by the town, together with the amounts actually received on account of allotments. Whenever the reimbursements from the State and the County are not received in time to provide funds for payment of pay-rolls and materials, temporary loans under the provisions of Section 6A, Chapter 44, Gen- eral Laws should be issued by the treasurer.
The payments made for maturing debt and inter- est were compared with the amounts falling due and with the cancelled securities on file.
The savings bank books representing the invest- ment of the trust and investment funds in the custody of the town treasurer were xamined and listed, the in- come being proved and the transfers to the town being checked with the treasurer's recorded receipts.
The records of tax titles held by the town were examined and reconciled with the collector's and the treasurer's books, being further verified by comparison with the records in the Registry of Deeds.
Attention is called to Section 61, Chapter 60, Gen- eral Laws, as amended, which requires that the collec- tor shall certify to the treasurer on approved forms, not later than September first of the year following that of their assessment, all subsequent taxes to be add- ed to the tax title account, and that the treasurer shall give the collector a certificate stating that the amounts have been added to the tax title accounts.

Overlay deficits for the levies of 1931, 1936, and 1937, appearing on the balance sheet and aggregating $606.42, should be raised by the assessors in accordance with the provisions of Section 23, Chapter 59, General Laws, as amended.
The assessors' warrant for the commitment of pro- perty taxes 1941 to the collector is dated October 16, 1941. In this connection attention is called to the pro- vision of Section 57, Chapter 59, General Laws, as amended, which reads, in part, as follows :
"Taxes shall be payable in every city, town and district in which the same are assessed, in two equal instalments, on July first and on October first of each year, and bills for the same shall be sent out not later than June fourteenth of each year."
It was also noted tha nin 1941 no commitment of motor vehicle excise taxes had been made by the assessors to the collector up to September 12, 1941.
It is recommended that the commitments of poll, property, and motor vehicle excise taxes be made early in the future in order that the town may benefit from earlier collections which would follow.
The books and accounts of the collector of taxes were examined and checked. The poll, property, and motor vehicle excise taxes, as well as moth assessments, outstanding according to the previous examination, were audited, and all subsequent commitments were chceked to the warrants for their collection.
The payments to the treasurer were checked to the treasurer's cash book, the recorded abatements were compared with the assessors' records of abatements granted, and the outstanding accounts were listed and proved.
The outstanding tax and assessment accounts were verified by mailing notices to a number of persons whose names appeared on the books as owing money to the town, and from the replies received it would appear that the accounts, as listed, are correct.

Attention is called to Section 2, Chapter 60, Gen- eral Laws, which provides that the collector shall, once in each week or oftener, pay over to the treasurer all money collected by him during the preceding week or lesser period on account of taxes and interest.
Attention is also called to the outstanding taxes which date back to 1935. ] Immediate action should be taken to bring about a complete settlement of all taxes of prior years.
The financial records of the town clerk were ex- amined and checked in detail. The receipts from dog licenses issued on behalf of the county, and from sport- ing licenses, the proceeds of which are paid to the State, were checked and proved, and the recorded pay- ments to the State and to the town treasurer were veri- fied.
Attention is called to the provisions of Section 40, Chapter 44, General Laws, as amended, requiring the town clerk to cause the audit report or a summary of its essential features to be published.
It was noted that the town clerk's record of appro- priations voted by the town at the annual town meeting held March 10, 1941, was not written up when the record was called for on October 14, 1941. It is recommended that the record of town meetings be written up promptly and legibly after each town meet- ing. In this connection attention is called to the pro- visions of Section 15A, Chapter 41, General Laws, which reads as follows:
"City and town clerks shall, as soon as an order or vote appropriating money be- comes effective, certify, in a city to the treasurer, assessors and auditor or similar offi- cer, and in a town to the assessors and the town accountant, if any, otherwise to the treasurer, each appropriation in detail, and the provisions made for meeting same, if specified in the appropriation order or vote."
