· Moved that the following amendment to Article 11 of the By.laws be adopted, viz. :


"Or so that the town shall elect two trustees biennially, and the trustees of Thayer Academy three for life."


Voted, That the above motion be indefinitely postponed.


Voted, To proceed to the choice of two trustees of the Thayer Public Library.


Moderator appointed Ansel O. Clark to check the list, and he was sworn by the Town Clerk.


The ballot having been taken, the Moderator declared the result as follows, namely : Nathaniel H. Hunt had 87 votes ; N. F. T. Hayden had 83 votes; scattering, 3 votes. And the Moderator declared Nathaniel. H. Hunt and N. F. T. Hayden elected Trustees of the Thayer Public Library for two years.

Voted, To discontinue that part of Plain street commencing near the property of Michael Brandley and running to a point near the house of N. H. Hunt, authority being given to the Selectmen to perform such acts as may be required by law for the purpose : as far as it can legally be done.

Voted, That the sum of $190 be raised and appropriated for the Thayer Public Library, in addition to the sum already raised and appropriated.


Voted, That the sum of $1,500 be raised for the repairing of Quincy avenue, it being the same that was appropriated April 4, 1887.

Voted, That article 9 be indefinitely postponed.

Voted, That the sum of $100 be raised and appropriated for the completion of Sterling street.

Voted, To widen and straighten Commercial street, as ordered by the County Commissioners, and that the sum of $5,500 be raised and appropriated to pay the expense of the same.


Article 21 being in order, it was voted not to take it up.


Article 19 taken from the table.


The Selectmen made a verbal report on the claim of E. Bannon, and it was voted to refer the subject to a committee of three, to be appointed by the chair, who shall examine the case and report the result of their deliberations at some future meet- ing.


Moderator appointed for said committee, Charles C. Mellen, E. Alden Belcher and Andrew J. Bates.


Article 20 taken up.


Voted, That the Selectmen be instructed to change the drain so as to prevent the flow of water through the culvert under Washington street, upon the premises of the Misses Pratt, on the corner of Holbrook avenue, and draw the expense thereof from the treasury of the town.

Voted, That all taxes assessed the current year, shall be pay able on or before the first day of December, 1887; and on all

taxes not paid on or before the said first day of December, inter- est at the rate of 6 per cent. per annum shall be charged and col- lected from the said first day of December, until the tax is paid ; and that the Collector is required, immediately after the first day of January, 1888, to exert all the power vested in him by law for the collection of all unpaid taxes.

Voted, To amend the By-laws by the addition of the following article, namely : "The Town Clerk shall, at the end of each fiscal year, transmit to the Selectmen an attested copy of the record of all-town meetings held during the year, which record shall be printed with the annual report of town officers."

Voted, That the sum of $200 be raised and appropriated for the purpose of painting the almshouse.

Voted, That the sum of $43,475 be raised in the aggregate, for the expenses of the town during the current fiscal year.


Voted, That the Surveyors are hereby instructed to pay not less than $1.75 per day for labor performed on the highways.


Voted, That the Surveyors of Highways be instructed to em- ploy no person on the highways except a citizen of the town, or one who shall give notice of his intention to become a citizen.

January 12th, one thousand eight hundred and eighty-seven (1887), to purchase the franchise, corporate property, and all the rights and privileges of the Braintree Water Supply Company, accord- ing to the provisions of Section ten (10), of Chapter two hundred and sixty-nine (269), of the acts and resolves of the Legislature of the Commonwealth of Massachusetts of the year one thousand eight hundred ånd eighty-six (1886).


ART. 3. To see if the town will vote to proceed forthwith, under the provisions of Chapter two hundred and seventeen of the Acts of the year eighteen hundred and eighty-five of the Commonwealth, entitled, " An Act to supply the towns of Brain- tree, Randolph and Holbrook with water."


ART. 4. To elect a board of water commissioners in accord- ance with the provisions of said act.


ART. 5. To see if the town will vote to authorize and instruct its treasurer to issue, from time to time, bonds, notes, or scrip of the town to an amount not exceeding in the aggregate one hundred thousand dollars, subjeet to the approval of the Water Commissioners, pursuant to the provisions of said act of the year eighteen hundred and eighty-five, whether standing alone or as modified by any of the provisions of said act of the year eighteen hundred and eighty-six.


ART. 6. To see if the town will vote to take the waters of Great Pond by a separate conduit, as provided in Secton 17 of Chapter 269 of the acts and resolves of the year 1886.


You are to give notice of the meeting by posting true and attested copies of this warrant in not less than nine public places in this town, seven days at least before the time of said meeting, and by publishing the same at least once in the Brain- tree Observer before said meeting.


Hereof fail not, but make return of this warrant, with your doings thereon, to the Town Clerk, before the time of said meeting.

Voted, That article 3 be taken up.


Voted, That it is expedient for the town to proceed forthwith under the provisions of Chapter two hundred and seventeen of the acts of the year eighteen hundred and eighty-five of the Commonwealth entitled an act to supply the towns of Braintree, Randolph, aud Holbrook with water.


Voted, That article 5 be taken up.

Voted, To proceed to the consideration of article 2.


Voted, That we proceed to ballot, Yes or No, by the use of the check list on the second article of the warrant, viz: To see if the town will rescind its vote passed January 12, 1887, to pur- chase the franchise, corporate property, and all the rights and privileges of the Braintree Water Supply Co., according to the provisions of Section ten (10) of Chapter two hundred and sixty- nine (269) of the acts and resolves of the Legislature of the Commonwealth of Massachusetts of the year one thousand eight hundred and eighty-six (1886).


The ballot having been taken, the Moderator announced the result of the ballot as follows, namely :

For Water Commissioner for three years, James T. Stevens had 187 votes; Asa French had 237 votes, and Asa French' was declared elected.


For Water Commissioner for two years: Scattering, 13; Hor- ace Abercrombie, 59; Albion C. Drinkwater, 326, and Albion C. Drinkwater was declared elected.


For Water Commissioner for one year : Scattering, 3; Henry A. Johnson, 200 ; Cranmore N. Wallace, 217, and Cranmore N. Wallace was declared eleeted.


Voted, To adjourn sine die.

To vote Yes or No, by ballots, with the use of the check list, on the following proposition, namely : Will the town vote to rescind, annul, and declare void, any and all votes passed by the town, as recorded upon the books of the Town Clerk, during the years 1886 or 1887, whereby the town assumed or in any way incurred any liability of whatever nature, relative to a water supply ; any and all votes making appropriations for that purpose; discharge any committee having the water matter under consideration, and instruct the Selectmen to enter such negotia- tion as may be necessary to secure an amicable settlement of all legal proceeding now pending, without litigation and without cost or expense to the town ; conferring upon the Selectmen full power and authority to act for the town in the premises.


You are to give notice of this meeting by posting true and attested copies of this warrant, in not less than nine public places in this town, seven days at least before the time of said meeting.

Charles A. Pitkin, Abijah Allen and Elisha Thayer were ap- pointed to assort and count the votes, and they were sworn by the Town Clerk.


After the ballot for the choice of moderator, it was found that H. A. Monk had 164 votes and Edward Avery had 309 votes ; and Edward Avery was declared elected to preside over this meeting, and was sworn by the Town Clerk.


Moved, that the town proceed to vote Yes or No, by ballots, with the use of the check list, on the propositions contained in the second article of the warrant.


Moved, that the above motion be indefinitely postponed.


The ballot having been taken on the indefinite postponement, the check list having been used, and the vote having been by Yes or No, the Moderator declared the result of the ballot as fol- lows, namely :

To determine whether the town will vote to establish a sinking fund for the payment of its water bonds, or provide for the payment thereof in such annual proportionate payments as will extinguish the same within the time prescribed by Chap. 217 of the acts of the year 1885, as required by said act, or what other method the town will adopt to pay said bonds, and to determine the rate of interest to be paid thereon.


ART. 3. To see if the town will vote to adopt a common seal, and take any action that may be necessary in regard thereto.


You are to give notice of the meeting by posting true and attested copies of this warrant in not less than nine public places in this town, seven days at least before the time of said meeting, and by printing at least once in the Braintree Observer before said meeting.

BRAINTREE, November 5, 1887.


In accordance with the foregoing warrant, the meeting was called to order and the warrant read by the Town Clerk.


Ansel O. Clark was appointed to check the list and was sworn by the Town Clerk.


Upon ballot, with the use of the check list, Josephus Shaw was chosen moderator and sworn by the Town Clerk.


ART. 2. Voted, That the bonds, heretofore authorized by the town for its water loan, be issued in denominations of not less than $500 nor more than $1,000 each, bearing interest at the rate of 4 per centum per annum, and running for such periods, respectively, not exceeding thirty years, as the Board of Water Commissioners shall determine.


Voted, That the town will, at its next annual meeting and at every annual meeting thereafter, so long as it shall be necessary, raise and appropriate such a sum for the establishment and maintenance of a sinking fund as, with its accumulations, shall be sufficient for the payment of said bonds at their maturity. '


The above votes were passed without a dissenting vote.


ART. 3. Voted, That the following seal be adopted as, the common seal of the town, namely :


"Town of Braintree, Massachusetts, incorporated 1640, with the state crest," as per copy attached to this page, and certified by the Town Clerk.


Voted, That Asa French be a committee to procure the seal as adopted by the last vote.


Voted, To adjourn this meeting, sine die.

In the name of the Commonwealth of Massachusetts you are hereby directed to notify and warn the inhabitants of the Town of Braintree, qualified to vote in elections, to meet at the Town Hall, in said Braintree, on Tuesday, the eighth day of Novem- ber, 1887, at seven and one-half o'clock in the forenoon, to give in their votes to the Selectmen, for Governor of the Common- wealth ; Lieutenant Governor; Secretary of the Commonwealth ; Treasurer and Receiver General ; Auditor of the Commonwealth ; Attorney General; Councillor for District No. 2; Senator for the First Senatorial District of the County of Norfolk; one Representative to the General Court from District No. 6, of the County of Norfolk, and one County Commissioner for the County of Norfolk.


The names of the candidates for all of the above named officers must be borne on one ballot, to be presented open or unfolded, or enclosed in a sealed envelope, at the option of the voter.


The polls shall be kept open until one o'clock, P. M.


And you are directed to serve this warrant, by posting true and attested copies of the same, in nine or more public places, within this town, and by printing once in the Braintree Observer, seven days at least before the time appointed for said meeting.

In accordance with the foregoing warrant, the meeting was called to order by Ansel O. Clark, Chairman of the Board of Selectmen, who presided at the meeting, and who also read the warrant.


The Town Clerk announced that the ballot box, provided for the town, was in good condition and ready for use.


he chairman declared the polls open at 7 hours, 35 minutes A M.


Voted, That the polls be closed at five minutes past one o'clock F. M., and at that time they were accordingly declared closed.


The ballot box was opened nine times during the balloting, by the unanimous consent of the officers.


At the close of the polls the Town Clerk announced that the box had only registered 426 votes, but that the names checked were 743, that number having voted.
