Article 59. To see if the Town in accordance with

Chapter 17, Section 3 and Section 5 of the Acts of 1930, will vote that the Selectmen shall act as a Board of Sewer Commissioners, or will vote to elect a Board of three Sewerage Commissioners, or will vote to appoint and authorize a committee to carry on the construction of the system of sewerage authorized by said Chapter 17 of the Acts of 1930 until the Board of Sewer Com- missioners shall have been elected as provided in said act or the Selectmen have first been authorized by vote to act as such Board, as the case may be, or will take any action relative thereto.


Article 60. To see if the Town will vote to raise and appropriate any sum or sums of money to be ex- pended under the direction of the Committee on Sewer- age for revision of plans or other necessary purposes or will vote to raise and appropriate any sum or sums of money for the purpose of paying any necessary ex- penses and liabilities incurred under Chapter 17 of the Acts of 1930, as the same may be accepted by the Town, and to authorize the Treasurer, with the appro- val of the Selectmen, to borrow all or any part of said sums in accordance with the provision of any general or special act authorizing the Town to borrow for such purposes, or take any action relative thereto.


You are directed to serve this Warrant by posting true and attested copies thereof in three public places in each voting Precinct in said Town of Braintree, ten days at least before said third day of March, 1930, and by publishing the same once each week for two successive weeks in the Braintree Observer and the Braintree Citizen, the first publication to be at least eight days before said meeting.

ANNUAL TOWN MEETING, 1930 COMMONWEALTH OF MASSACHUSETTS


Norfolk, ss.


Pursuant to the foregoing warrant, at a legal meeting, the inhabitants of Precinct 1, of the Town of Braintree, qualified to vote at elections, met in the Town Hall, in said Braintree, on Monday, the third day of March, 1930, at five forty-five o'clock in the forenoon, and the inhabitants of Precinct 2, of said Town of Braintree, qualified to vote at elections, met in the Legion Building, Hollis Avenue, and the inhab- itants of Precinct 3, of said Town of Braintree, quali- fied to vote at elections, met in the Allen Street Fire Station, in said Town of Braintree, at the same hour and date, to bring in their votes for the officers as called for in said warrant.


The meeting at Precinct 1 was called to order by J. Frank Lane, Warden of said Precinct, who acted as presiding officer. He was assisted by the following election officers: Dudley P. Howland, Clerk; James M. Cutting, Michael P. Novelline, Edward J. Sullivan, Harry S. Snow, Frank M. O'Rourke, H. Parker Hobart, Walter B. Robbins, G. Dallas Willis, Charles H. Tobey, Leo E. Halpin, Henry W. Grady, Charles P. Morse, W. Phillips Woodsum and Thomas Slavin, Constable.


The meeting in Precinct 2 was called to order by George A. Arnold, Warden of said Precinct, who acted as presiding officer. He was assisted by the following election officers: Virgie Sears, Clerk, Justin W. Shrader, George E. Sampson, Nelson Hollis, Frank J.

The meeting in Precinct 3 was called to order by Winfred G. Waite, Warden of said Precinct, who acted as presiding officer. He was was assisted by the fol- lowing election officers: Thomas Cassidy, Clerk, John A. Ryan, Thomas F. Mulligan, William J. Quinlan, John Riley, William D. Levangie, Charles D. Sheehee, George S. McCarthy, Thomas Lyons, Walter C. Briggs, Bennett H. Swinimer, Russell L. Burton, Preston P. MacDonald, Jr., Alexander Bullock and W. Gordon Stackhouse, Constable.


The meetings in each precinct were conducted in like manner and in accordance with the law. The bal- lot boxes in the three different precincts were inspected and found to be empty and the registers set at zero (0), and the keys to the ballot box in Precinct 1 were placed in charge of Thomas Slavin, Constable of said Precinct 1, and the keys to the ballot box in Precinct 2 were placed in charge of Clarence R. Bestick, Con- stable of said Precinct 2, and the keys to the ballot box in Precinct 3 were placed in charge of W. Gordon Stackhouse, Constable of said Precinct 3.


After the close of the polls at 3 P. M., when all votes had been canvassed and the results determined in accordance with the provisions of law, declaration thereof was made in open Town Meeting and was as follows :

The Annual Town Meeting was called to order at 7.55 P. M. by Moderator, William F. Rogers.

Article 1. Voted to elect three Measurers of Wood and Weighers of Hay. Charles G. Sheppard, Wilford F. Woodsum and Fred W. Piercy elected.


Voted to elect three Measurers of Lumber. Her- bert W. Borden, Charles O. Miller and Shelley A. Neal elected.


Voted to instruct the Selectmen to appoint one Pound Keeper, three Field Drivers and three Fence Viewers.


Article 2. Voted that the Town Treasurer with the approval of the Selectmen be and hereby is author- ized to borrow money from time to time in anticipa- tion of the revenue of the financial year beginning January 1, 1930, and to issue a note or notes therefor, payable within one year. Any debt or debts incurred under this vote to be paid from the revenue of said financial year.


Article 3. Voted, that the Town Treasurer be and is hereby made custodian of all moneys of the sev- eral departments of the Town. The Board of Water Commissioners are hereby instructed to elect the Treasurer of the Town, Treasurer of the Water De- partment. The Electric Light Commissioners are here- by instructed to elect the Town Treasurer, Treasurer of the Electric Light Department. The Selectmen are hereby instructed to require from the Treasurer such a bond as in their judgment is necessary for the safety of such moneys; that the Treasurer be held harmless on his bond from any loss caused by the failure of any National Bank or Trust Company in which the funds of the Town may be on deposit, with the approval of the Board of Selectmen.

Article 4. Voted that the Tax Collector be held harmless on his bond from any loss caused by the failure of any National Bank or Trust Company in which the funds of the Town may be on deposit with the approval of the Board of Selectmen.


Article 5. Voted, on motion of Mr. Aitken, to take this article up in conjunction with the other articles in the warrant.


Mr. Fitzgerald offered the following motion (8.07) : In view of the fact that the Finance Commit- tee has failed to obey the instructions given it by vote of the Town at the last Annual Town Meeting with regard to its annual report, it is moved that this meet- ing adjourn until 7.45 P. M. one week from tonight in order that the voters may have proper opportunity of studying the recommendations of the Finance Com- mittee which should have been available at the open- ing of this Annual Town Meeting, March 3, 1930. Not carried.

The adjourned Town Meeting was called to order at 7.48 P. M. by Moderator Rogers. Voters checked.


Notice served by the Moderator of the desire to reconsider the vote of the Town under Article 12- For removal of trees caused by construction and re- pairs of town ways and sidewalks.


On motion of Mr. Aitken, the reading of the minutes of the previous meeting was dispensed with.


Article 15. Voted that there be appropriated from the income of the Electric Light Department the sum of $18,497.17 for Depreciation Fund; and the sum of $306,202.83, together with the unexpended balance of $2,263.09 of the year 1929, for operating expenses, renewals, repairs and new construction. Carried (7.51).


Article 16. Unanimously voted that the Select- men take by right of eminent domain for public pur- poses in connection with the Municipal Electric Light Plant, the land on Allen Street, East Braintree, adjoin- ing the Municipal Electric Light Plant, now owned by Benjamin F. Torrey, as recommended by the Municipal Light Board, and that $8,000.00 for this purpose be appropriated to be taken from the income of the Elec- tric Light Department. Carried (7.52).


Article 17. Voted that there be raised and appro- priated the sum of $62,260.00 for the purpose of lay- ing a water main not less than six inches in diameter

from Little Pond to the yard of the N. Y., N. H. & H. Railroad and from there to Quincy Avenue at a point opposite the plant of the Cities Service Company, and for the purpose of acquiring land and constructing a standpipe thereon and that to meet the said appropria- tion the sum of $32,260.00 shall be taken from the sur- plus water revenues, and the Treasurer, with the ap- proval of the Selectmen and Water Commissioners, be and he hereby is authorized to borrow the sum of $30,- 000.00 and to issue bonds or notes of the town there- for, the said bonds or notes to be issued pursuant to the General Laws, c. 44, and to be payable in accord- ance with the provisions of section 19 thereof, so that the whole loan shall be paid in not more than fifteen years from the date of issue of the first bond or note or at such earlier dates as the Treasurer with the ap- proval of the Selectmen and Water Commissioners may determine. Unanimously carried (7.55). The Mod- erator declaring more than 200 present.


Voted further that the Water Commissioners shall fix sufficient rates to meet the expense of maintaining and operating the water supply system, including the interest and the debt charges as they mature and the indebtedness herein authorized. Unanimously carried, (7.56).


Article 18. Voted to appropriate the sum of $6,400.00 for bonds and interest and $91,800.00 for the maintenance and operation of the Water Supply System, laying and relaying of water mains, the same to be taken from the surplus of water revenues as shown on the books for the year 1929 and from reve-

nues of the department for year 1930. Carried (7.57).


Motion of Mr. Avery to take the section of Article 8, pertaining to the Expenses of the Fire Department, from the table. Carried.

Article 21. Motion of Mr. Kelley that the ques- tion of appropriation for the Zoning Committee be re- ferred to the Zoning Committee to take up with the Finance Committee and report at the next session of this Annual Town Meeting. Carried (8.44).


Article 22. Motion of Mr. Justice that the amount $32,500.00 be appropriated for the purchase of the land on the easterly side of Washington Street between Holbrook Avenue and Union Street, as recommended by the Planning Board-$6,000.00 to be included in the tax levy of the current year and the Treasurer, with the approval of the Selectmen, be authorized to bor- row $26,500.00 and to issue bonds or notes of the Town therefor, the said bonds or notes to be issued pursuant to the General Laws, Chapter 44, and payable in ac- cordance with the provisions of Section 19 thereof, so that the whole loan shall be paid in not more than 20 years from the date of issue of the first bond or note or at such earlier dates as the Treasurer, with the approval of the Selectmen, may determine. Article 23. Voted to raise and appropriate for the expenses of the Planning Board in the preparation

Article 24. Voted that the Selectmen be author- ized to sell at auction or private sale the school build- ing-South School, so-called-and land located on the east side of Washington Street, second lot north of the intersection of Standish Avenue with Washington Street. Carried (9.23).


Article 25. Voted indefinite postponement. Carried (9.28).


Article 26. Substitute motion of Mr. Fitzgerald that this be referred again to the Finance Committee. Not carried (10.01).


Motion of Mr. Higgins that the sum of $7,000.00 be raised and appropriated for unforeseen contingen- cies of the Braintree Highlands School. Carried (10.02).
