ARTICLE 12. To see what sums of money the Town will vote to l'aise and appropriate or transfer from available funds to provide off the street coasting, or take any action relative thereto .- Voted no action.


ARTICLE 12-A. To see if the Town will vote to repeal Section 8 of Article XIII of the "Revised By-Laws of the Town of Braintree, Massachusetts, 1940" which reads as follows: "No person shall coast upon or across any sidewalk or street in the Town except at such times and in such places as may from time to time be designated by the Se- lectmen."-Voted no action.


ARTICLE 13. To see what sums of money the Town will vote to raise and appropriate or transfer from available funds for the eradica- tion and prevention of "Dutch Elm" disease, so-called, or take any ac- tion relative thereto .- Voted no action.


ARTICLE 14. To see what sums of money the Town will vote to raise and appropriate or transfer from available funds for site improve- ment or completion at "Union Village" so-called and other expenses not chargeable to Federal Funds, or take any action relative thereto.'


Voted: That there be raised and appropriated the sum of $300.00 to be used for playground supervision at Union Village, to be expended under the direction of the Union Village Project Manager.


ARTICLE 15. To see if the Town will vote to amend Article XIII of the "Revised By-Laws of the Town of Braintree, Massachusetts 1940" by inserting after Section 17 the following new section: "Section 18. No person shall behave himself in a rude or disorderly manner, nor use indecent, profane or insulting language in any street, public place, or public building in this town, nor be or remain upon any doorstep, por- tico or other projection thereto, to the annoyance or disturbance of any person; nor shall any person willfully frighten any horse or other ani- mal, nor engage in any game, sport or amusement in any street of the town, whereby the free, safe and convenient use thereof, by travelers thereon, shall in any way be interrupted, or the occupants of adjoining estates unreasonably annoyed and disturbed."-Voted no action.


ARTICLE 15-A. To see if the Town will vote to amend Article 1, Section 4 of the Town By-Laws by striking out of said section the word "ten" and substituting therefor the word "twenty", so that, as so amended, said Section 4 will read as follows: Section 4. Notice of every Town Meeting shall be given by a Constable of the Town by posting

attested copies of the warrant in one or more public places in each vot- ing precinct twenty days at least before the day fixed for the meeting, also by publication of a copy of the warrant once each week for two successive weeks in one or more newspapers published in the Town, if there be any, the first publication to be at least eight days before said meeting."


Voted: That 'Article 15-A be taken up in conjunction with Article 15-B.


ARTICLE 15-B. To see if the Town will vote to amend the perti- nent section of its existing by-laws by providing in appropriate lan- guage that the warrants for Annual Town Meetings shall be posted twenty days at least before such meetings.


Voted: That Article 1, Section 4 of the Town By-Laws be amended so as to read as follows: "Section 4. Notice of every Annual Town Meeting shall be given by a Constable of the Town by posting attested copies of the warrant in one or more public places in each voting pre- cinct twenty days at least before the day fixed for the meeting, also by publication of a copy of the warrant once each week for two successive weeks in one or more newspapers published in the Town, if there be any, the first publication to be at least eight days before said meeting. Notice of every Special Town Meeting shall be given in like manner except that such posting shall be ten days at least before the date fixed for such Special Town Meeting."


ARTICLE 16. To see if the Town will vote to strike out Section 5 of Article VI of the "Revised By-Laws of the Town of Braintree, Massachusetts 1940" and substitute therefor the following: . "Every contract for construction work, whether for alterations, repairs or original construction, the estimated cost of which amounts to $500.00 or more, shall be accompanied by a suitable bond for the performance of same, or by the deposit of money or security to the amount of the esti- mated cost."-So voted.


ARTICLE 17. To see if the Town will vote to amend the Building Code by inserting after Section 7 of Part 1 the following new section: "Section 7-A. No person shall install wires, conduits, apparatus, fix- tures, or other appliances for carrying or using electricity for light, heat, or power within, or connected to any building, without first noti- fying the inspector of wires, in writing, on forms provided for the purpose, of the proposed installation."-So voted.


ARTICLE 18. To see if the Town will vote to further amend the Building Code by inserting after Section 4 of Part 1, the following new section: "Section 4-'A. Notwithstanding any other provision of this By-Law no permit to erect, construct, extend, alter or restore any build- ing shall be issued under the provisions of the preceding section unless and until a permit therefor has been issued by the Board of Health."- Voted no action.


ARTICLE 19. To see if the Town will vote to amend Paragraph 1, Section 1 of the Zoning By-Law by substituting for "Zoning Map dated May 2, 1940" as previously amended, the "Zoning Map revised Decem- ber 10, 1947," or make any lesser change.


Voted: That Paragraph 1, Section 1 of the Zoning By-Law be amended by substituting for "Zoning Map dated May 2, 1940" as previ- ously amended, the "Zoning Map revised December 10, 1947," or make any lesser change.

ARTICLE 20. To see if the Town will vote to amend Section VIII, Paragraph 5 of the Zoning By-Law to read: "LOT SIZE. No building, except one-story buildings of accessory use, shall be erected in a Resi- dence A District on a lot containing less than fifteen thousand square feet or less than one hundred feet wide; and no building, except one- story buildings of accessory use, in a Residence B or C District and no dwelling, in a Business or Industrial District shall be erected on a lot containing less than seventy-five hundred square feet or less than seventy feet wide, the lot width in each case to be measured through that part of the building to be erected where the lot is narrowest; pro- vided that one building may be erected on any lot which, at the time this by-law is adopted, either is separately owned or contains five thou- sand square feet, is fifty feet wide and is shown on a recorded plan of lots. In a Residence A or B District not more than thirty-five per cent of the area of any lot shall be occupied by a building or buildings, and in a Residence C, Business or Industrial District not more than fifty percentof any lot occupied by a dwelling shall be occupied by a build- ing or buildings, provided that on any corner lot an additional four hun- dred square feet may be occupied."-So voted.


ARTICLE 21. To see if the Town will vote to amend the Zoning By-Laws and the Zoning Map dated May 2, 1940, by providing that the following described area shall be included in the Business Zone: an area bounded Northerly by Washington Street, Easterly by Church Street, Southerly by the Old Colony Railroad and Westerly by a line parallel to and approximately 475 feet from the Northerly side of Washington Street .- So voted.


ARTICLE 22. To see if the Town will vote to so amend its Zoning By-Law as to change to a Business District the area on both sides of Washington Street between President Road on the East side and Com- mon Street on the West side and Capen's Bridge in each instance, to an appropriate depth from said Washington Street or make any lesser change in the zoning of said area.


Voted: That the Zoning By-Law and the Zoning Map dated May 2, 1940, be amended to provide that the following described area be changed to a Business District Zone: The area bounded by the easterly side of Washington Street between President Road and the present business area at Capen's Bridge and to the depth of the lot or lots from said Washington Street.


ARTICLE 23. To see if the Town will vote to so amend its Zoning By-Law as to change to a business district the area, to an appropriate depth, on the North side of Pond Street between Town Street and the Farm River or make any lesser change in the zoning of said area.


Voted: That the Zoning By-Law and the Zoning Map dated May 2, 1940, be amended to provide that the following described area be changed to a Business District Zone: The northerly side of Pond Street, from Town Street to the Farm River and to the depth of 100 feet :rom said Pond Street.


ARTICLE 24. To see what sums of money the Town will vote to raise or borrow and appropriate for the maintenance and operation of the Water Department, the same to be taken from the revenue of the

Department, and the unexpended balance of 1947, or take any action relative thereto .- No action necessary.


ARTICLE 25. To see what sum of money the Town will vote to appropriate from the income of the Water Department for the salaries of the Water Commissioners .- No action necessary.


ARTICLE 26. To see if the Town will vote to appropriate from the income of the Electric Light Department, the sum of Three Hundred ($300.00) for the salaries of the Electric Light Commissioners .- No action necessary.


ARTICLE 27. To see if the Town will vote to include in the tax levy for electricity used for street lighting, the sum of Ten Thousand Five Hundred dollars ($10,500.00) as appropriated under Article 7 of the warrant for the year 1948 Annual Town Meeting, and that said sum together with the income from sales of electricity to private consumers or for current supplied to Municipal buildings or for Municipal power, and from the sales of appliances and jobbing during the current fiscal year be appropriated for the use of the Municipal Light Plant the whole to be expended under the direction and control of the Municipal Light Board for repairs, renewals, new construction and operating expenses of the Plant for the fiscal year, as defined in Section 57, Chapter 164 General Laws and that if said income shall exceed the expense for the fiscal year such amount of excess as is deemed. necessary by the Muni- cipal Light Board shall be transferred to the construction fund of said plant and appropriated and shall be used for such additions to the plant as may thereafter be authorized by the Municipal Light Board and any remaining amount paid into the surplus of the Town Treasury .- So voted.


ARTICLE 28. , To see if the Town will vote to raise or borrow and appropriate or transfer from available funds any sum or sums of money, to be expended by the Board of Sewer Commissioners, for the construction of sewers for sanitary purposes, or take any action rela- tive thereto.


Voted: That there be raised and appropriated the sum of $150,- 000.00 for the construction of additional sewers for sanitary purposes under the direction of the Sewer Commissioners, and that to meet said appropriation the sum of $50,000.00 shall be included in the tax levy· of the current year and that the Treasurer, with the approval of the Select- men, be and hereby is authorized to borrow the sum of $50,000.00 and to issue bonds or notes of the Town therefor, payable in accordance with the provisions of Chapter 44 of the General Laws, so that the whole loan shall be paid in not more than 10 years from the date of issue of the first bond or note, or at such earlier time as the Treasurer and Selectmen may determine.


ARTICLE 29. To see if the Town will take action to re-determine the uniform rate to be charged to abutters for the construction of sewers, the present rate having been determined at the Special Town Meeting of November 27, 1933.


Voted: That in accordance with Section 7 of Chapter 17 of the Acts of 1930 and the provisions of Chapter 83 of the General Laws as most recently amended by Chapter 52 of the Acts of 1948 the uniform rate charged to abutters for the construction of sewers shall be as follows: Assessments shall be made upon owners of the land according to the frontage of such land on any way in which a sewer is constructed at the rate of $1.75 per linear foot of such frontage, and according to

the area of such land within a fixed depth of 100 feet from such way at the rate of $0.0175 per square foot of such area, these rates having been found and determined to be each one-half of the estimated re- maining cost. This redetermination shall not apply to assessments levied prior to the date of this vote.


ARTICLE 30. 'ON PETITION. To see if the Town will vote to raise and appropriate or transfer from available funds a sum or sums of money for the construction of sewers on Magnolia, Beech, Linden, Cypress and Front Streets and Nickerson Road, or any of them, or take any action relative thereto .- Voted no action.


ARTICLE 31. To see what sums of money the Town will vote to raise and appropriate or transfer from available funds for conveying pupils to and from the public schools, including pupils attending certain private schools, including the purchase of buses or other vehicles, or take any action relative thereto .- Voted no action.


ARTICLE 32. To see what sums, in addition to funds already appropriated, the Town will vote to raise and appropriate or transfer from available funds for the support of adult evening schools, or take any action relative thereto .- No action necessary.


ARTICLE 33. To see what sums of money the Town will vote to raise and appropriate for the purpose of constructing an addition or additions to one or more of the elementary school buildings and for originally equipping the same; determine whether the money shall be provided for by borrowing, by appropriation from available funds in the Treasury, by appropriation from the Post-War Rehabilitation Fund and/or from the Stabilization Fund, or take any action relative thereto. (Taken up in conjunction with 'Article 34).


ARTICLE 34. To see if the Town will vote to raise and appro- priate a sum of money for the purpose of reniodelling, reconstructing or repairing one or more of the elementary schools; determine how the money shall be provided for, by borrowing, by appropriation from available funds in the Treasury, by appropriation from the Post-War Rehabilitation Fund, and/or from the Stabilization Fund, or take any action relative thereto.


Voted: That a committee of seven be appointed by the Moderator, three of said committee to be School Committee Members, to make a study and recommendation to be presented at the next Annual Town Meeting, based on the report to be made by Dr. Wilson to the Town early this summer.


ARTICLE 35. To see what sums of money the Town will vote to raise and appropriate or transfer from available funds for the elimi- nation of ragweed and poison ivy from public ways in the Town and land adjacent thereto, or take any action relative thereto.


Voted: Reference to the Highway Department.


ARTICLE 36. To see if the Town will vote to raise and appro- priate a sum of money for the purpose of constructing a new highway garage located on land of the Town off Union Street on the site of the present highway garage and for originally equipping and furnishing same or for either of the above purposes; determine how the money shall be provided for, by borrowing, by appropriation from available funds in the Treasury, by appropriation from the Post-War Rehabilita- tion Fund, and/or from the Stabilization Fund, or take any action rela- tive thereto.

Voted: That there be raised and appropriated the sum of $75,000.00 for the purpose of constructing a new highway garage located on land of the Town off Union Street on the site of the present highway garage and for originally equipping and furnishing same or for either of the above purposes, and that to meet said appropriation the sum of $8,000.00 shall be included in the tax levy of the current year, and that the Treasurer, with the approvabl of the Selectmen, be and hereby is authorized to borrow the sum of $67,000.00 and to issue bonds or notes of the Town therefor, payable in accordance with the provisions of Chapter 44 of the General Laws, so that the whole loan shall be paid in not more than 10 years from the date of issue of the first bond or note, or at such earlier time as the Treasurer and Selectmen may determine, and that a committee consisting of the Selectmen and the Highway Superintendent be and hereby is authorized to act for and in behalf of the Town with full power to employ architects, secure bids and let contracts in the name of the Town and do all and any acts necessary to construct and equip said garage within the aforesaid appropriation.


ARTICLE 37. To see what sums of money the Town will vote to raise and appropriate or transfer from available funds for the purchase or taking by eminent domain for municipal purposes that land off Union Street now known and used as the "Town Dump" said being the property of the New York, New Haven & Hartford Railroad or the Old Colony Railroad, or take any action relative thereto.


Voted: That the sum of $1,000.00 be raised and appropriated for the purchase, or taking by eminent domain by the Selectmen for muni- cipal purposes and for present use as the Town Dump, of 35 acres of land, more or less, said to belong to the New York, New Haven & Hartford Railroad or to the Old Colony Railroad, bounded on the north by Union Street, easterly by the meadow and southerly and easterly by land now or formerly of one or both of said railroads.


ARTICLE 38. To see what sums of money the Town will vote to raise and appropriate or transfer from available funds for the con- struction of Storrs Avenue Extension. so-called, running between the present location of Storrs Avenue and Walnut Street, or take any ac- cion relative thereto.


Voted: That there be raised and appropriated the sum of $680.00 for the construction of Storrs 'Avenue Extension, so-called, running be- tween the present location of Storrs Avenue and Walnut Street. -


ARTICLE 39. To see if the Town will vote to accept as and for a Town Way, Gordon Road, so-called, as laid out by the Selectmen, and to appropriate a sum of money for the improvement of same, or take any action relative thereto .- Voted no action.


ARTICLE 40. To see if the Town will vote to accept as and for a Town Way, Sheraton Avenue, so-called, as laid out by the Selectmen and to appropriate a sum of money for the improvement of same, or take any action relative thereto.


Voted: That Sheraton Avenue, so-called, as laid out by the Select- men, be accepted as and for a town way, that the sum of $1,500.00 be raised and appropriated for the improvement of the same and that betterments be assessed to the extent of 66 2/3% of the cost of said improvement.


ARTICLE 41. To see if the Town will vote to accept as and for a Town Way, Thayer Road Extension, so-called, as laid out by the Select- men and appearing on plan by "John J. Drinkwater, Town Engineer"

dated January 15, 1948, and authorize the Selectmen, in the name of the Town, to take by eminent domain such land as may be required in con- nection with said acceptance, or take any action relative thereto .- Voted no action.


ARTICLE 42. ON PETITION. To see if the Town will vote to accept as and for a Town Way that portion of Hoyle Avenue as laid out by the Selectmen and shown on plan by "John J. Drinkwater, Town Engineer" dated December, 1947, or take any action relative thereto.


Voted: That there be accepted as and for a town way that portion of Hoyle Avenue as laid out by the Selectmen and shown on plan by John J. Drinkwater, Town Engineer, dated December, 1947.


ARTICLE 43. To see what sums of money the Town will vote to raise and appropriate or transfer from available funds for the widening of Liberty Street as appearing on "Plan showing Widening of Portion of Liberty Street," John J. Drinkwater, Town Engineer, dated December, 1947, on file in the office of the Town Clerk, and empower the Selectmen to purchase or take land by eminent domain for said purpose, or take any action relative thereto.


Voted: That there be raised and appropriated the sum of $7,080.00 for the widening of Liberty Street as appearing on "Plan showing widening of portion of Liberty Street," John J. Drinkwater, Town Engineer, dated December, 1947, on file in the office of the Town Clerk, and for the purchase of taking by eminent domain of land for said purpose, which purchase or taking is hereby authorized.


ARTICLE 44. To see if the Town will vote to accept as and for a Town Way, King Hill Road, so-called, running Westerly from Granite Street to a distance of about 3,000 feet as laid out by the Selectmen and authorize the acquisition of land within the limits of said layout, or take any action relative thereto.

ARTICLE 46. To see what sums of money the Town will raise and appropriate or transfer from available funds for construction of a sidewalk on the West side of President Road, or take any action relative thereto .- No action.


ARTICLE 47. . ON PETITION. To see what sums of money the Town will raise and appropriate or transfer from available funds for con truction of a paved sidewalk from Crawford Road to the store located at 170 Pearl Street, or take any action relative thereto .- No action,


ARTICLE 48. ON PETITION. To see what sums of money the Town will raise and appropriate or transfer from available funds for

construction of a sidewalk on the south side of Elmwood Park, or take any action relative thereto .- No action.


ARTICLE 49. To see if the Town will vote to permit the 'ex- penditure of the money heretofore voted under Article 46 of the 1947 Annual Town Meeting for construction of a sidewalk on the East side of Pond Street without the limitation specified in the vote under said article that the amount was "to be expended only if the Selectmen in their order for said construction provide for the assessment of 50% of the cost thereof upon the abutters," or take any action relative thereto.


Voted: That the expenditure to be made from the money appro- priated under Article 46 of the 1947 Annual Town Meeting be limited to $2,000.00, the same to be expended without the limitation specified in said vote.


ARTICLE 50. To see what sums of money the Town will vote to raise and appropriate or transfer from available funds for the con- struction and maintenance of a dog pound, so-called, or take any action relative thereto.


Vote: That the sum of $450.00 be raised and appropriated for the construction and maintenance of a dog pound to be located in the rear of the Infirmary Garage, said sum to be expended under direction of the Selectmen.


ARTICLE 51. To see what sums of money in addition to those heretofore appropriated the Town will vote to raise and appropriate or transfer from available funds for the purpose of constructing a com- fort station, so-called, at Sunset Lake, or take any action relative thereto.


Voted: That the sum of $2,500.00 be raised and appropriated which sum, together with the sum of $5,000.00 heretofore appropriated, be expended under the supervision of the Selectmen for the construc- tion of a comfort station, so-called, at Sunset Lake; said sum of $2,500.00 to be raised by transfer of $1,556.00 from the Pond Street Sidewalk Account and $944.00 from Sale of Real Estate Funds Account.


'ARTICLE 52. To see what sums of money the Town will vote to raise and appropriate or transfer from available funds to purchase or take by eminent domain, for municipal purposes, land on the Southerly side of Plain Street bounded on the east by land now or formerly of Caroline Mansfield, on the south by said Street and westerly and north- erly by land of the Armstrong Cork Company containing approximately 7,500 square feet of land, or take any action relative thereto.


Voted: That the sum of $50.00 be appropriated for the purchase, for extending the Electric Light Plant, of about 7,500 square feet of land on Plain Street substantially bounded: Easterly by land now or formerly of Caroline Mansfield; Southerly by Plain Street and Westerly and Northerly by land of Armstrong Cork Company, said sum to be raised by transfer from the funds of the Electric Light Department.
