ARTICLE 55.


To see if the Town will vote to accept from Fred E. Varney title to a certain parcel of land situated adjacent to the Varney Playground in North Chelmsford; or act in relation thereto.

Cemetery Lots and Graves" the sum of Five Hundred Dollars ($500), or some other sum, for the purpose of the care, improvement and embellishment of some or all of the cemeteries in the Town; or act in relation thereto.


AND YOU ARE DIRECTED to serve this Warrant by posting attested copies there- of at the Post Offices in the Centre of the Town, South Chelmsford, North Chelms - ford and West Chelmsford, and at the School House in East. Chelmsford, and the Golden Cove School House, Westlands, seven days at least before the time appointed for holding the first meeting aforesaid.

ANNUAL BUSINESS MEETING March 10, 1941


The annual business meeting was held in the Upper Town Hall in Chelmsford Centre on Monday, March 10, 1941 at 10 A.M. The meeting was called to order by Moderator Walter Perham and Town Clerk Harold C. Petterson was requested to read the Warrant. After the Warrant was partly read, a motion made by Arnaud Blackadar, to waive the further reading of the Warrant was carried and further reading of the Warrant was waived.


Under Article 1.


On a motion made by Luther W. Faulkner, it was voted to correct two typo- graphical errors on page 79 of the town report, this correction made in the re- port of the Town Forest Committee. These corrections having been made, it was voted to accept the Town Report.


Under Article 2.


A motion was made by Edward L. Monahan to lay this article on the table until after the noon recess and it was so voted. After the noon recess the following action was taken under article two. Voted to raise and appropriate the following sums of money to defray Town charges for the year 1941.

On a motion made by Karl M. Perham, it was voted , to authorize the Selectmen to act as its agent in any suit or suits which may arise during the current year, with authority to settle and adjust claims or demands for or against the Town; and to employ counsel whenever in their judgment it is necessary.

Under Article 4 .


On a motion made by Harold C. Petterson, it was voted to authorize the Treas- urer, with the approval of the Selectmen, to borrow money in anticipation of the revenue of the current financial year, from time to time, beginning January 1, 1941, and to issue a note or notes therefor, payable within one year, and to re- new any note or notes as may be given for a period of less than one year in ac- cordance with Section 17, Chapter 44 of the General Laws.


Under Article 5.


On a motion made by Sidney E. Dupee it was voted to transfer from the Over- lay Reserve Fund the sum of Two Thousand ($2000) Dollars to be used as a Reserve Fund at the descretion of the Finance Committee, as provided in General Laws, Chapter 40, Section 6.


Under Article 6.


On a motion made by James A. Grant it was voted, to raise and appropriate the sum of $2,366.29 with which to meet unpaid bills of previous years.


Under Article 7.


On a motion made by Luther Faulkner it was voted, to use the following lots of land, now owned by the Town, or any part of them, for the purpose of forest conservation under the Town Forest Act as provided in General Laws, Chapter 132, Section 35 as adopted by the Town at its annual meeting February 8, 1926. The R. Hodgman Lot, off Concord Road, 24 acres. The A. Hodgman Lot, off Concord Road, 14 acres. The Gage Estate Lot, off Mill Road, 60 acres. The Gage Estate Lot, off Mill Road, 10 acres. The Town Farm Wood Lot, Turnpike and Mill Roads, 34 acres. The Town Dump Lot, on Swain Road, 17 acres.


Under Article 8.


On a motion made by Frank J. Lupien it was voted, to raise and appropriate the sum of $600.00 for the purpose of enlarging remodeling and equipping the kitchen in the Lower Town Hall.


Under Article 9 .


On a motion made by John McAdams it was voted, to raise and appropriate the sum of $235.48 to complete the Town's share of the cost of the addition to the High School.


UNDER Article 10 .


In regard to the purchase of equipment to improve the fire protection at the High School, on a motion made by Leslie Adams it was voted to dismiss this article.


Under Article 11 .


On a motion made by Stewart Mackay, it was voted, to raise and appropriate the sum of $450.00 for the purpose of purchasing an automobile for the Police Department, said purchase to be made under the supervision of the Board of Select- men.

Under Article 12.


On a motion made by Stewart Mackay, it was voted, to authorize the Select- men to transfer by good and sufficient Bill of Sale, title to the Plymouth auto- mobile now used by the Police Department.


Under Article 13.


On a motion made by Stewart Mackay, it was voted, to raise and appropriate the sum of $450.00 for the purpose of purchasing a radio to be used in the police car.


Under Article 14.


On a motion made by James A. Grant, it was voted, to raise and appropriate the sum of $6,000.00 for the purpose of carrying on Federal and State Projects, the cost of administration and the cost of materials and supplies for the same.


Under Article 15.


On a motion made by Walter Merrill, it was voted to raise and appropriate the sum of $100.00 for the purpose of purchasing a flag for the use in the Centre Village.


Under Article 16.


In regard to the purchase of certain land adjacent to the High School, on a motion made by John H. Valentine, it was voted to dismiss this article.


Under Article 17.


On a motion made by Karl M. Perham, it was voted, to raise and appropriate the sum of $1,074.06 to reimburse the Chief of Police for a judgment obtained against him by certain claimants in Middlesex County Superior Court.


Under Article 18.


On a motion made by James A. Grant, it was voted to raise and appropriate the sum of $200.00 to pay the Town Counsel for services and expenses in defending the Chief of Police in a law suit and for the prosecution of an action in equity to enforce the Zoning Laws of the Town.


Under Article 19.


On a motion made by Karl M. Perham, it was voted to raise and appropriate the sum of $800.00 for the reconstruction of the Lowell Road, contingent upon the State and County contributing to the cost of said reconstruction.


UNDER Article 20.


in regard to an appropriation for the Boston Road, on a motion made by James A. Grant, it was voted to dismiss this article.


Under Article 21.


On a motion made by Stewart Mackay, it was voted to raise and appropriate the sum of $3,000.00 for the reconstruction of the North Road, contingent upon the State and County contributing towards the cost of said reconstruction.

Under Article 22.


On a motion made by Harold C. Petterson, it was voted to raise and appropriate the sum of $900.00 for the purpose of defraying the cost of foreclosing tax titles, held by the Town.


Under Article 23.


On a motion made by Harold C. Petterson, it was voted to authorize the Board of Assessors to use a sum of money, in the amount such as the Commissioner of Corporations and Taxation of the Commonwealth may approve as free cash, not in excess of $10,000, said sum of money to be used in determining the tax rate for the year 1941.


Under Article 24.


On a motion made by James A. Grant, it was voted to raise and appropriate the sum of $5,000.00 for the purpose of purchasing an automobile truck or trucks for the use of the Highway Department.


Under Article 25.


On a motion made by James A. Grant, it was voted to authorize the Selectmen to transfer by good and sufficient bill of sale to either the Ford Truck, the Chevrolet Truck or both that are now used in the Highway Department.


Under Article 26.


On a motion made by Harold C. Petterson, it was voted to appoint a committee of four persons to confer with the Lowell Electric Light Corporation for the pur- pose of procuring a decrease in the light and power rates in Chelmsford, The Com- mittee to be Royce M. Parker and the Board of Selectmen.


Under Article 28.


On a motion made by James A. Grant, it was voted to raise and appropriate the sum of $200.00 to be added to the existing fund already created which is to be used for paying claims made against the Town for personal injuries.


Under Article 27.


In regard to a by-law that the Supt.of Streets be elected for a term of three years, it was voted to dismiss this article.


Under Article 29.


On a motion made by Karl M. Perham, it was voted to raise and appropriate the sum of $200.00 for the purpose of surveying existing roads or highways for which there are now no proper layouts or plans.


Under Article 30.


On a motion made by Edmund Welch, it was voted to instruct the Moderator to appoint a committee of five to confer with the Eastern Massachusetts Street Rail- way Company for the purpose of procuring lower bus fares and better service on the various lines in Chelmsford. The Moderator appointed the following members Edmund Welch, John I, Manahan, Ralph A. Knight, Karl M. Perham and Raymond Osborn.

Under Article 31.


On a motion made by Royce M. Parker, it was voted to adopt the following by-law, "The Annual business meeting of the Town of Chelmsford Shall be held on the second Monday in March at 7:30 P.M."


Under Article 32.


On a motion made by James A. Grant, it was voted to raise and appropriate the sum of $2,500.00 for the purpose of repairing highways that have been dam- aged through and because of the instalation of water mains.


Under Article 33.


On a motion made by Clifford Hartley it was voted to authorize the Moderator to anpoint a Committee of four persons to work in conjunction with the School Committee for the purpose of obtaining plans, specifications and costs of erect- ing an addition and making necessary repairs and renovations to the Westlands School; and to raise and appropriate the sum of Fourteen Hundred ($1400.00) Dol- lars to be expended by said Committee to procure plans, specifications and costs of said addition, repairs and renovations and said Committee is to make a full and complete report at the next Town Meeting. The Moderator appointed the fol- lowing Committee to work in conjunction with the School Committee, Clifford Hartley, C. Luther Cashin, Clarence G. Audoin and Donald A. Dunsford.


Under Article 34.


On a motion made by Stewart Mackay, it was voted to raise and appropriate the sum of $1,888.53 to pay the Town's share of the net cost of the care, main- tenance and repairs to the Middlesex County Tuberculosis Hospital as assessed in accordance with the provisions of Chapter 111 of the General Laws.


Under Article 35.


In regard to the collection of ashes and waste, it was voted to dismiss this article.


Unde. Article 36.


On a motion made by Stewart Mackay, it was voted to raise and appropriate the sum of $1,250.00 for the purpose of purchasing an automobile truck for the use of the Forest Warden's Department.


Under Article 37.


On a motion made by Stewart Mackay, it was voted to authorize the Selectmen to transfer by a good and sufficient Bill of Sale, title to the Federal Truck now used by the Forest Warden's Department.


Under Article 38.


In regard to the acceptance of Strawberry Hill Road, it was voted to dismiss this article.


Under Article 39.


In regard to the reconstructing Strawberry Hill Road it was voted to dismiss this article.

On a motion made by James A. Grant, it was voted to accept Miland Ave. as laid out by the Selectmen, as shown by their report and plan duly filed in the office of the Town Clerk.


Under Article 41.


On a motion made by James A. Grant, it was voted to raise and appropriate the sum of $150.00 for the purpose of reconstructing Miland Ave.


Under Article 42.


On a motion made by Karl M. Perham, it was voted to accept Ideal Ave. as laid out by the Selectmen, as shown by their report and plan duly filed in the office of the Town Clerk.


Under Article 43.


On a motion made by Karl M. Perham, it was voted to raise and appropriate the sum of $450.00 for the purpose of reconstructing Ideal Ave.


Under Article 44.


On a motion made by Stewart Mackay, it was voted to accept Beech Street, as laid out by the Selectmen as shown by their report and plan duly filed in the office of the Town Clerk.

On a motion made b. Stewart Mackay, it was voted to raise and appropriate the sum of $400.00 for the purpose of reconstructing Beech Street.

On a motion made by Stewart Mackay it was voted to dismiss this article per- taining to Ash Street.


Under Article 47.


In regard to reconstructing Ash Street, on a motion made by Stewart Mackay it was voted to dismiss this article.


Under Article 48.


On a motion made by Stewart Mackay it was voted to accept Arbor Road as laid out by the Selectmen as shown by their report and plan duly filed in the office of the Town Clerk.


Under Article 49.


On a motion made by Stewart Mackay, it was voted to raise and appropriate the sum of $200.00 for the purpose of reconstucting Arbor Road.


Under Article 50.


On a motion made by James A. Grant, it was vo ted to accept Dunstan Road as laid out by the Selectmen as shown by their report and plan duly filed in the office of the Town Clerk.

On a motion made by James A. Grant it was voted to raise and appropriate the sum of $500.00 for the purpose of reconstructing Dunstan Road.


Under Article 52.


On a motion made by James A. Grant it was voted to accept Clinton Ave. as laid out by the Selectmen as shown by their report and plan duly filed in the office of the Town Clerk.


Under Article 53.


On a motion made by James A. Grant, it was voted to raise and appropriate the sum of $500.00 for the purpose of reconstructing Clinton Ave.


Under Article 54.


On a motion made by Karl M. Perham, it was voted to raise and appropriate the sum of $400.00 for the purpose of defraying the Town's share of the expense of Surplus Commodities Division of the Commonwealth of Massachusetts.


Under Article 55.


On a motion made by Stewart Mackay, it was voted to accept from Fred E. Varney title to certain land in North Chelmsford to be used as a playground under the provisions of Section 14 of Chapter 45 of the General Laws.


Under Article 56.


On a motion made by Stewart Mackay, it was voted that a Committee of three be elected to supervise the Varney Playground in accordance with Section 14, Chapter 45 of the General Laws. The Committee elected was Leslie H. Adams for three years; Arnaud R. Blackadar for two years and Clifford Hartley for one year.


Under Article 57.


It was voted to instruct the Moderator to appoint a committee of six persons to investigate the advisability of the enactment of building laws, and to report the result of their investigation and conclusions at the next Town Meeting. The Moderator appointed as this committee, H. Chadbourne Ward, Thomas D. O'Donnell, Thomas Dunn, Charles A. Pierce, Robert W. Barris and John G. Parker.


Under Article 58.


On a motion made by Arthur W. House, it was voted to transfer from the fund called "Sales of Cemetery Lots and Graves" the sum of $500.00 for the purpose of the care, improvement and embellishment of some or all of the cemeteries in the Town.

Upper Town Hall Chelmsford Centre Monday Evening, June 2, 1941


COMMONWEALTH OF MASSACHUSETTS

To Vinson C. Reid, a Constable of the Town of Chelmsford


Greeting:


In the name of the Commonwealth as aforesaid, you are hereby required to notify and warn the legal voters of said Chelmsford to meet in the Upper Town Hall at Chelmsford Centre on Monday the Second day of June, 1941, at eight o'clock in the evening, then and there to act on the following articles, viz.


Article 1.


To hear the report of the Building Law Committee, appointed under Article 57 of the Warrant for the Annual Town Meeting held on March 10, 1941; and to see if the Town will vote to adopt a Code of Building By-Laws as recommended by said Committee; or act in relation thereto.


Article 2.


To see if the Town will vote to raise and appropriate a certain sum of money for the purpose of caring for the public dumps; or act in relation thereto.


Article 3.


To see if the Town will vote to raise and appropriate a certain sum of money for the use of the Forest Fire Department; or act in relation thereto.


Article 4.


To see if the Town will vote to raise and appropriate the sum of Fifty Dol- lars ($50) or some other sum, to be used by the Chelmsford Committee on Public Safety for stationery, postage and other miscellaneous expenses; or act in re- lation thereto.


Article 5.


To see if the Town will vote to accept Delwood Road as laid out by the Se- lectmen, as shown by their report and plan duly filed in the Office of the Town Clerk; or act in relation thereto.


Article 6.


To see if the Town will vote to raise and appropriate a sum of money for the purpose of reconstructing Delwood Road; or act in relation thereto.
