ARTICLE 14. The Annual Town Meeting will be held on the first Saturday following the annual Town Election and will begin at 9:30 A.M. and continue until all articles have been voted upon. This change to become effective with the annual Town Meeting in the year Nineteen Hundred and Sixty-Four (1964).
UNDER ARTICLE 14:
Roger W. Boyd moved the annual Town Meeting will be held on the first Saturday following the annual Town Election and will begin at 9:30 A.M. and continue until all articles have been voted upon. Mr. Arthur Colmer moved that the Town vote to raise and transfer from the sale of graves and lots Account the sum of $2,000.00 for the purpose of hot-topping roads and beautifying sections in the Pine Ridge Cemetery.

To see if the Town will vote to raise and appropriate a certain sum of money for the purpose of building a new garage for the Cemetery Department in the Pine Ridge Cemetery, the cost of which is to be partially or fully paid back to the Town from cemetery income; or act in relation thereto.

ARTICLE 29. To see if the Town will vote to fill the vacancy that presently exists on the Elementary School Needs Committee; or act in relation thereto.

Furness moved that the Board of Selectmen shall an- nually upon their organization appoint a person skilled in the practice of civil engineering who shall be registered under the laws of the Com- monwealth of Massachusetts to serve for a term of one year unless sooner removed who shall be known as Town Engineer; and said town engineer shall, under the direction of said board, perform all civil engi- neering services as shall be required by the various officers, boards, com- mittees of the town, and such other duties as the selectmen may prescribe. He shall keep in a place to be provided by the said Board of Selectmen records of all surveys and other engineering services made and performed by him as such Town Engineer, including all field notes which shall be kept in bound books which shall be suitably indexed; and all original plans as shall be prepared or drawn by him, and all copies of plans which shall have been prepared by others and in any way relate to the Town and required by him in the performance of his duties, shall be properly filed and indexed.

Moderator, Daniel J. Coughlin called the meeting to order at 7:48 P.M. recognizing a quorum present the business of the evening began with Article 38.
ARTICLE 38. To see if the Town will vote to continue the present Chelmsford Town Government Study Committee for the purpose of pre- paring a Selectmen-Town Manager Plan of Administration for the Town, such plan to be presented for consideration by the voters at a Special Town Meeting to be held not later than November 15, 1963; or act in relation thereto.
UNDER ARTICLE 38:
Mr. Royal Shawcross moved that the Town vote to continue the present Chelmsford Town Government Study Committee for the purpose of preparing a Selectmen-Town Manager Plan of Administration for the Town, such plan to be presented for consideration by the voters at a Special Town Meeting to be held not later than November 15, 1963.
It was so voted.
ARTICLE 39. To see if the Town will adopt the following by-laws: The removal of soil, loam, sand, or gravel forming a part of the town, except when necessarily incidental to or in connection with the construc- tion, at the site of removal, of a building for which a permit has been issued within the past six months or for grading or otherwise improving the premises of which such building is a part, shall not be permitted except in accordance with the following conditions:

a. A permit must first be obtained from the Board of Appeals following written application and submission of a plan showing existing grades in the area from which the material is to be removed, together with pro- posed finished grades at the conclusion of the operation. The Board of Appeals is empowered to issue said permit upon proper application of provisions b., c., d., and e. below. The permit shall be subject to and include a time limit as set by the Board of Appeals; and furthermore, prior to issuance of the permit, the applicant shall be required to post with the Town a performance bond having a value set at the discretion of the Board of Appeals and sufficient in their judgment to insure con- formance by the applicant with the applicable provisions of this by-law. The Board of Appeals shall hold a public meeting or hearing on the matter, of which public notice shall be given.
b. No soil, loam, sand, or gravel shall be removed from any land lower than one foot above the grade level of any adjacent street or way, except when such removal is incidental to highway improvement or construction at the site of removal.
c. No soil, loam, sand, or gravel shall be removed in any one year to a depth greater than 20% at the place of removal, except for local agricultural or horicultural use, or incidental to the construction or highway improvement purposes must be disposed of within the Town. This by-law will not apply to any greenhouse owners in Town.
d. The natural topography surrounding the pit or site of removal shall not be disturbed withion 100 feet of any abutting land, road, or way.
e. No bank shall exceed a slope of one foot of vertical rise in three of horizontal distance except in the case of ledge rock.
f. Upon completion of removal and prior to release of the performance bond, a minimum of five (5) inches of top soil shall be applied to the area affected. Trees at least five (5) feet in height and of the hard- wood variety shall be planted at a density of 1 tree to every 40 square feet of land, except ledge rock, within the affected area. Shrubs of a suitable variety, as designated by the Tree Warden, shall be planted on all slopes at a density adequate to prevent soil erosion.
g. All necessary measures shall be taken to assure proper drainage during and after the removal operation. The Board of Appeals and the Building Inspector shall be empowered to impose additional specific measures if in their judgment such measures are necessary to assure proper drainage; however, failure to impose such specific measures does not relieve the holders of the permit from complying with this pro- vision.
h. Variances for the removal of soil, loam, sand, or gravel, may be amended from time to time at the discretion of the Board of Appeals during the operation, consistent with the provisions of this by-law.

i. At least two inspections of the removal site shall be made by des- ignated representatives of the Board of Appeals and the Building In- spector. When the Building Inspector ascertains that the provisions of this by-law have been carried out, or are in the process of being carried out to his satisfaction, he shall so certify in writing to the Board of Appeals. No sooner than eight (8) months after the date of receipt by the Board of Appeals of the aforesaid certification, another inspection of the removal site shall be made as before. If the Building Inspector finds that all provisions not carried out have now been satisfied to completion, he shall so certify in writing to the Board of Appeals, who shall then be permitted to release the performance bond.
