UNDER ARTICLE 39:
Mr. Robert A. McKittrick moved that this article regarding soil, loam, sand or gravel be dismissed. By voice vote motion failed.
William C. Dempster moved that the removal of soil, loam, sand or gravel forming a part of the town, except when necessarily incidental to or in connection with the construction, at the site of removal, of a building for which a permit has been issued within the past six months or for grading or otherwise improving the premises of which such building is a part, shall not be permitted except in accordance with the following conditions:
a. A variance must first be obtained from the Board of Appeals fol- lowing written application and submission of a plan showing existing grades in the area from which the material is to be removed, together with proposed finished grades at the conclusion of the operation. The Board of Appeals is empowered to issue said variance upon proper application of provisions b., c., d., and e. below. The variance shall be subject to and include a time limit as set by the Board of Appeals; and furthermore prior to issuance of the variance, the applicant shall be required to post with the Town a performance bond having a value set at the discretion of the Board of Appeals and sufficient in their judg- ment to insure conformance by the applicant with the applicable pro- visions of this by-law. The Board of Appeals shall hold a public meeting or hearing on the matter, of which public notice shall be given.
b. No soil, loam, sand, or gravel shall be removed from any land lower than one foot above the grade level of any adjacent street or way, except when such removal is incidental to highway improvement or construction at the site of removal.
c. No soil, loam, sand, or gravel shall be removed in any one year to a depth greater than 20% at the place of removal, except for local agri- cultural or horticultural use, or incidental to the construction of dwel- lings or other structures. Material removed for construction or highway improvement purposes must be disposed of within the town. This by-law will not apply to any greenhouse owners in Town.

d. The natural topography surrounding the pit or site of removal shall not be disturbed within 100 feet of any abutting land, road, or way.
e. No bank shall exceed a slope of one foot of vertical rise in three of horizontal distance except in the case of ledge rock.
f. Upon completion of removal and prior to release of the performance bond, a minimum of five (5) inches of top soil shall be applied to the area affected. Trees at least five (5) feet in height and of the hardwood variety shall be planted at a density of 1 tree to every 400 square feet of land, except ledge rock, within the affected area. Shrubs of a suitable variety, as designated by the Tree Warden, shall be planted on all slopes at a density adequate to prevent soil erosion.
g. All necessary measures shall be taken to assure proper drainage during and after the removal operation. The Board of Appeals and the Building Inspector shall be empowered to impose additional specific measures if in their judgment such measures are necessary to assure proper drainage; however failure to impose such specific measures does not relieve the holders of the variance from complying with this pro- vision.
h. Variances for the removal of soil, loam, sand, or gravel, may be amended from time to time at the discretion of the Board of Appeals during the operation, consistent with the provisions of this by-law.
i.
At least two inspections of the removal site shall be made by desig-
nated representatives of the Board of Appeals and the Building Inspec- tor. When the Building Inspector ascertains that the provisions of this by-law have been carried out, or are in the process of being carried out to his satisfaction, he shall so certify in writing to the Board of Appeals. No sooner than eight (8) months, after the date of receipt by the Board of Appeals of the aforesaid certification, another inspection of the re- moval site shall be made as before. If the Building Inspector finds that all provisions not previously carried out have now been satisfied to com- pletion, he shall so certify in writing to the Board of Appeals, who shall then be permitted to release the performance bond. This latter inspection may be waived and the performance bond released if the original in- spection discloses that all other provisions of this by-law have been car- ried out to completion. In such case, the Building Inspector shall certify in writing to the Board of Appeals precedent to release of the perform- ance bond.

ARTICLE 40. To see if the Town will vote to exclude all vehicles whose gross weight exceeds two (2) tons from using Crooked Spring Road without first having obtained a special permit, in writing, from the Board of Selectmen. This by-law shall not apply to Federal, State, County or Town vehicles, or vehicles under hire by the Federal, State, County or Town governments, or moving vans.

To see if the Town will adopt the following: Be it recorded that the Town of Chelmsford is in favor of the inclusion in its by-laws of a provision for the recall of elected officials and that there- fore the Town-Government Study Commission is instructed to report a proposed version or versions of such a by-law for inclusion in the town meeting warrant of March, 1964.
UNDER ARTICLE 41:
William A. Dempster moved that the recall of elected officials, was to have been studied by the Town Government Study Committee, but due to lengthy discussions of other matters this item was not seriously dis- cussed. This article would instruct this committee to discuss his matter in detail, and report a version or versions for consideration by the voters on next year's warrant.

ARTICLE 42. To see if the Town will vote to amend the Chelms- ford Zoning By-Laws now in force and effect by substituting or amend- ing and substituting the Proposed Zoning By-Laws and Zoning Map which were prepared by the Chelmsford Planning Board, as filed in the office of the Town Clerk, advertised in the Lowell Sun on February 8, 1963, and February 15, 1963, and on which a public hearing was held on February 25, 1963; or act in relation ther to.
UNDER ARTICLE 42:
Leslie Dukeshire moved that the Planning Board be directed to make a long study of the proposed Zoning By Laws as filed in the Office of the Town Clerk, advertised in the Lowell Sun on February 9, 1963 and February 15, and on which a Public Hearing was held on February 25, 1963 and to make a final report at the Annual Town Meeting in 1966, (Nineteeen Hundred and Sixty-Six.)
