During the year we have disbursed 231,066 pounds of foodstuffs, 18,020 cans of food, and 9501 articles of clothing.
At the present time we have 375 cases representing 1569 persons.
That this department of the government has been a big asset to the town there can be no question.

REPORT OF TOWN COUNSEL
To the Honorable Board of Selectmen:
The following is the report of the Town Counsel for the year 1938:
The following actions against the town were pending in court at the beginning of the year 1938:
1. Trustees under the Will of A. B. Clarke vs. Town of Ipswich. This was a suit for $1800. for gravel and filling tak- en from the Great Neck property at the time of building the new road to Little Neck. This suit has been settled during the

year by the filing in court of an Agreement by both sides of Judgment for neither party.
2. Markos vs. Town of Ipswich. This was a suit for $4000. for damages for injuries received alleged to have been caused by defective condition of Brownville Avenue. This suit has been settled during the year by an Agreement for Judgment for $300. and the judgment has been paid.
3. Helen Pappas of Lynn vs. Town of Ipswich. This was a suit for damages for injuries alleged to have been received at Ipswich Beach. Suit was brought for $10,000. This case is still pending in the Superior Court.
4. George Karalias et al vs. Town of Ipswich. This was a suit for damages claimed on account of change in grade of the sidewalk in front of their property on South Main Street. This case was tried in the Superior Court at Salem during the year. At the trial damages of $3.000. were claimed. After a four-day trial the jury returned a verdict in favor of the town. Attorney for the Plaintiffs asked to have the verdict set aside and Judge Collins gave a hearing on that Petition to both sides and later issued a decree refusing to set the verdict aside.
5. City of Boston vs. Town of Ipswich. This was the suit for claims against the Town of Ipswich on account of aid given to alleged Ipswich citizens in Boston in the Welfare De- partment. This case was reported in my report last year and is still pending in the Superior Court.
6. Hill vs. School Committee of Ipswich. This was a case where the parents of a child demanded that the child be admitted as a pupil in the public schools when the child had not reached the age established by the School Committee to allow the child to be admitted as a pupil. The parents took exception to the rule and placed the matter in the hands of counsel. The School Committee asked the Town Counsel to give them an opinion as to the legality of their rule and their action. He gave them an opinion that both the rule and their action under it were legal. The attorney for the child applied to the Su- preme Court for a Writ to compel the School Committee to

admit the child in spite of the rule and alleged that the child had a legal right to go to school. The Town Counsel, representing the School Committee, appeared at the Supreme Court and de- fended the action of the School Committee and the attorny for the other side presented his case. A little later the Supreme Court handed down a decision sustaining the position taken by the School Committee and the Petition was dismissed.
During the year 1938 I have prosecuted for the Police De- partment 16 cases.
As you know, the Town Counsel is not paid any regular salary. His services are paid for in accordance with the amount of work performed on each case.
During the year 1938 I have been paid a total of $793.00 divided as follows: Karalias vs Town of Ipswich, $150; Skrowonek vs Ipswich, $40.00; Markos vs Ipswich, $25.00; Hills vs School Committee, $75.00; 16 Police cases at $15.00 each, $240.00, a total for court cases of $530.00. Attending hearings for the town, $75.00. All other services including drafting papers, deeds, investigations and opinions, $168.00.
The repeatedly changing laws of the State is the cause of it being necessary for the different town Boards to ask for many opinions as to what the laws mean and what they can do. Mem- bers of the different Boards who have not had a law training feel of course that they ought to have the benefit of the Town Counsel's advice on such matters. On a large number of cases the Town Counsel also has spent considerable time in investiga- tion as to the meaning of the laws before feeling competent to give an opinion on the various questions asked. In those cases written opinions have been furnished the different departments of the town. In addition to that, there is hardlly a day that goes by but what some official or Board is confronted with a ques- tion of perhaps somewhat minor importance on which never- theless they feel they would like an opinion from the Town Counsel. In almost all those cases, especially where the Town Counsel is able to answer the question without research and investigations, verbal opinions have been given. No account

of the number of such opinions is kept because they are of such minor importance that written opinions do not seem necessary.
During the year the Town Counsel has attended a number of hearings at the State House and before various State Boards in presenting matters for the Town.
It will be remembered that last year I reported the result of my appearance before the Board having charge of fixing the automobile rates and that as a result I secured a reduction in the Ipswich rates which was of material value to all those having cars. I am glad to state that the lowered rates then secured have remained in force for the year 1939 and will result in about the same saving that they did in 1938.
In addition to the work outlined above, there are various matters connected with deeds, leases, lay-out of streets, con- tracts, etc. which are referred to the Town Counsel for a legal opinion or for the preparation of the papers. The year 1938 has been a very busy one for the Town Counsel in connection with town work. Some of the cases have been intricate and re- quired considerable investigation and study and it has become necessary at various times to hold consultations with the various town Boards and officials. I have always found all of them ready and willing to cooperate with me and furnish all the in- formation possible in connection with the matters which had been referred to me and I desire to thank them all for the many courtesies shown me during the year.
