It was moved that the present North Main Street parking lot be ex- panded; that in connection therewith, the Selectmen be authorized and empowered to acquire land by deed, gift, or by eminent domain under Chapter 79 of the General Laws; that for this purpose the sum of $25,- 000.00 be appropriated; and to meet this appropriation, the sum of $4,- 000.00 be raised by taxation and that the Treasurer, with the approval of the Selectmen be authorized to issue $21,000.00 in bonds or notes of the Town, payable over a period of 5 years under the provisions of General Laws. (Ter. Ed.) Chapter 44.


This motion was lost.


An amendment to this motion to increase the appropriation to $27,- 500.00 was also lost.

Article 12: To see if the Town will vote to purchase the property of the Peirce Trustees on Jackson Street from the easterly side of the Police Station lot and running the entire length of Jackson Street, bounded Northerly by the Playground land for the sum of $25,000.00 and to raise and appropriate said sum by taxation, by transfer or by borrowing under the provisions of Chapter 44 of the General Laws: all in accordance with a proposal contained in a letter of the Peirce Trustees dated August 23, 1957, under the terms of which proposal the Peirce Trustees would reimburse the Town, out of the income of the trust, for payments of the interest on the notes and the principal as they mature.


Voted that the Town accept from the Trustees under the will of Thomas H. Peirce, such sums of money as are paid by the said Trustees in reimbursements for such sums as are paid by the Town pursuant to the previous vote taken under Article 12, and in accordance with a proposal contained in a letter from said Peirce Trustees dated August 23, 1957.

Peirce, et al to Town of Middleborough dated April 11, 1898, and recorded with Plymouth County Registry of Deeds in Book 757, Pages 568-570, and act anything thereon.

Article 15: To see if the Town will vote to accept the provisions of General Laws (Ter. Ed.), Chapter 40, Sec. 8A and to establish a Business and Industrial Commission to promote business and industry and to raise and appropriate a sum of money by taxation or by transfer from avail- able funds for the purpose of maintaining the same, and act anything thereon.

Article 20: To see if the Town will vote to develop an additional well field on the so called Vasel site off of East Main Street, including gravel packed well, or wells, pipes original pumping station equipment and other necessary appurtenances, and for this purpose to raise and appropriate a sum of money by taxation, transfer or by borrowing under the provisions of Chapter 44 of the General Laws, and act anything thereon.

Voted that the sum of thirty-seven thousand seven hundred twenty six and 29 cents ($37,726.29) received from the Commonwealth of Massa- chusetts under the provisions of Chapter 718 of the Acts of 1956, be trans- ferred from the Highway Bond Fund and appropriated for the purpose of reconstructing High Street and parts of Union Street and South Main Street, including sidewalks, together with necessary surface drainage.


Article 22: To see if the Town will vote to raise and appropriate a sum of money by taxation, by transfer and by borrowing under the pro- vision of Chapter 44 of the General Laws, for the purchase of a bull dozer, and act thereon.


The motion was made to appropriate the sum of $16,000.00 for the purchase of a bull dozer, and to meet such an appropriation, to raise the sum of $4,000.00 by taxation, and that the Treasurer, with the approval of the Selectmen, be authorized to issue $12,000.00 in bonds or notes of the Town, payable over a period of three (3) years, under the provisions of General Laws, (Ter. Ed.) Chapter 44.


The result of this vote: Yes 44, No 219, therefore the motion was lost.

Article 2: To see if the Town will vote to reconstruct the dam across the Nemasket River at Wareham Street, pursuant to provisions of Chapter 91 of General Laws, and for this purpose to raise and appropriate a sum of money by taxation, borrowing, transfer from available funds or otherwise, and act anything thereon.

Voted that the Town construct a dam across the Nemasket River at Wareham Street pursuant to provisions of Chapter 91 of the General Laws, and for this purpose to raise by transfer from funds of the Gas and Electric Department the sum of $12,500.00 as the Town's share of this work.


Finance Committee recommends favorable action.


Article 3: To see if the Town will vote to construct a fishway in the Nemasket River at or near Wareham Street and that monies received in 1958 from sale of ale wives, be appropriated to pay the cost of said construction and act anything thereon.


Voted that the Town construct a fishway in the Nemasket River with an access road at or near Wareham Street and to appropriate $3,- 467.75 by transferring said sum from monies received from the sale of herring in 1958 and now on the hands of the Town Treasurer.


Finance Committee recommends favorable action.


Article 4: To see if the Town will vote to raise and appropriate a sum of money for the repair and maintenance of the Fire Alarm System, in addition to the amount appropriated at the annual Town Meeting, and act anything thereon.


Voted to appropriate the sum of $800.00 for repairs and maintenance of the Fire Alarm System and that said sum be raised by transfer from available funds in the hand of the Treasurer.

Article 6: To see if the Town will vote to extend the water main from junction of West Grove Street and Oak Avenue southerly on Oak Avenue to the terminus of water main in Clark Street, approximately 568 feet, and to authorize the Selectmen to take necessary easements by purchase, eminent domain or otherwise, and to appropriate a sum of money by taxation, transfer from available funds or otherwise, and act anything thereon.


Voted to extend the water from the junction of West Grove Street and Oak Avenue southerly in Oak Avenue to the terminus of water main in Clark Street approximately 568 feet, and to authorize the Selectmen to take necessary easements by gift, purchase, eminent domain or other- wise, and appropriate the sum of $4,022.61 by transfer from balance now remaining in the water extension fund.

ANNUAL REPORT


We conducted a Public Hearing on June 2, 1958 at 8:00 P.M. at the Middleborough Town Hall after giving due notice of said hearing in the May 29th, 1958 issue of the Middleboro Gazette. This Public Hearing pertained to the proposed Zoning By-Law that is before you for con- sideration.


We recommend that the voters present adopt the Zoning By-Law as set out under Article 1 of the Warrant for this Special Town Meeting with the following changes.


1. In Section IV after the word "hereof" strike out the words "no dwelling, building, or structure shall be constructed, altered or extended, and".


2. In Section IV-A-1-k-3 strike out the period after the word "public", insert a comma after the word "public" and add the words after the comma "except with approval of the Board of Appeals."


3. In Section IV-B-1-c strike out the words "with accessory Struc- tures," and place a period after the work "dwelling."


4. In Section VI-A-5 strike out the word "non-conforming dwelling, building, or structure," and insert in their place the words "dwelling, building, structure, or land in nonconforming use."


5. In Section VI-B-1 insert the words "and B" before the word "hereof", and the words "between a height of three feet and eight feet above the finished surfaces of the streets" that appear after the word "intersection" to be inserted after the word "vision" and add the words "or in the case of a rounded corner the point of intersection of such lines if projected," after the above-mentioned word "intersection".


6. In Section VII-C-5 insert the words "a special permit or" before the word "a", and strike out the words "or special permit" before the word "from".


7. Include in the General Use District the land bounded by the center lines of the railroad, Wood Street, Fall Brook, and the Nemasket River.


We wish to take this opportunity to thank the Board of Selectmen, Town Counsel, Town Moderator, and various civic organizations for their assistance and cooperation.


Voted that the report of the Committee be accepted.


Voted to adopt the Zoning By-Law as set out under Article 1 of the Warrant for this Special Town Meeting with the above amendments.


Joseph Riley read a resolution for the Industrial Board expressing their approval of the adoption of the Zoning regulations.


The result of the vote was: Yes 150, No 98, thus declared adopted.

ZONING BY-LAW FOR THE TOWN OF MIDDLEBOROUGH


SECTION I. PURPOSE


The purpose of this By-Law is to promote the health, safety, con- venience, morals and general welfare of the inhabitants of the Town of Middleborough, to conserve and improve the value of property by avoid- ing congestion, reducing fire hazards, and providing for orderly growth of the community under the provisions of the General Laws of the Commonwealth of Massachusetts, Chapter 40A and any amendments thereof.
