Report of the High School House Committee.
The undersigned, a Committee charged with the purchase of a lot of land and the erection and equipment of a new High school house, submit the following report : -
At a legal meeting of the Town of Plymouth, held on the 7th of June, 1890, the following article in the warrant was laid before the Town for consideration : -
" Article 4. To take such action as the Town may see fit concerning the building of a new High school house, and make such an appropriation as may be necessary to carry said action into effect."
Under said Article the following vote was passed : -
"That a Committee of seven be chosen, three of whom shall be members of the School Committee and two mem- bers of the Board of Selectmen, 'with full power to select and purchase a site for a new High school house, and erect a High school house thereon, at a cost not exceeding, for land, building and equipment, ready for occupancy, $40,000; and that the Selectmen be authorized to condemn for school purposes the lot so selected, if necessary ; and that the Selectmen be authorized to draw their warrant on the Treasurer for such sum, not exceeding $40,000, as may be necessary to carry into effect this vote ; and that they be authorized to borrow money from time to time for said

purpose ; and they are hereby authorized to issue notes or bonds therefor, upon such terms and for such time as they shall deem expedient within the requirements of law."
When the question had been taken on the above vote, the record of the Town Clerk states that the Moderator declared that 105 had voted in the affirmative and 27 in the negative, and that the vote was adopted, two-thirds of those present and voting having voted therefor.
Under the same Article it was voted "that the members of the Committee from the School Committee and Selectmen be chosen by their respective boards, and that the five so chosen select the remaining members from outside the boards.
On the 13th of June, 1890, Charles I. Litchfield, James Millar and John W. Churchill were chosen members of the Committee by the School Committee, and on the 14th of June, William T. Davis and Leavitt T. Robbins were chosen members of the Committee by the Selectmen. On the 16th of June, at a meeting of the five members of the Committee thus chosen, James D. Thurber and Charles H. Howland were chosen members of the Committee outside of the Boards of Selectmen and School Committee.
On the 7th of August, 1890, the Committee purchased for the sum of $1,000 a lot of land on Barnes' Lane, so-called, of William R. Drew, taking a deed in the name of the in- habitants of the Town of Plymouth in their corporate ca- pacity, and said sum was paid by the Treasurer of the Town at the above date on a warrant drawn by the Selectmen.
At a later date plans for a High school house were asked for and received by the Committee, and on the 3d of Sep- tember, 1890, it was voted by the Committee to adopt plans submitted by Rotch & Tilden of Boston, and to accept said Rotch & Tilden as the architects of said building.

At a legal meeting of the Town, held on the 27th of Sep- tember, 1890, after the purchase of the site, the adoption of plans and the acceptance of architects by the Committee, the following Article in the warrant was laid before the Town for consideration : --
" Article 2. To consider the business of locating and building the High school house now in contemplation and review all action in the past pertaining thereto and act thereon."
Under said Article the following vote was offered :-
"That the Town reconsider the vote passed June 7, 1890, in relation to purchasing a site and erecting a new High school house."
The vote as recorded by the Clerk was adopted by a vote of 73 in the affirmative and 63 in the negative. A motion was immediately made to reconsider the vote just passed, and after some debate the motion to reconsider was carried by a vote of 123 in the affirmative and 47 in the negative.
In the opinion of the Committee the whole matter was thus left precisely as it stood at the opening of the meeting, and the original vote passed on the 7th of June authorizing the appointment of the Committee, the erection of a school house and the appropriation therefor, remained in full force. They deemed it expedient, however, before further action in view of the necessity of negotiating a loan and of possible doubts on the part of capitalists as to the legality of the authorization to obtain the opinion of a lawyer whose opinion would be looked upon as final in the premises. A statement of all the facts bearing on the matter was pre- sented to William G. Russell and an answer requested to the question, "does the vote passed by the Town on the 7th of June, 1890, remain in full force?" An elaborate written opinion was given by Mr. Russell concluding with the dec-

laration, "I am therefore clearly of opinion that the vote of the Town of Plymouth, of June 7th, remains in full force, unaffected by any action of the meeting of September 27th." The statement of facts and the opinion are on file in the office of the Town Clerk and may there be seen.
On the receipt of the opinion the Committee advertised for proposals to furnish materials and erect the school house, and the contract was awarded to George W. Brad- ford and Ephraim D. Bartlett at the price of $31.350. Sub- sequently a contract was made with the Fuller-Warren Com- pany to furnish and construct the heating, ventilating and sanitary apparatus for the sum of $2,600.
Extra work was done by Mr. Bradford and Mr. Bartlett in their respective departments of mason work and carpen- ter work, and the sums paid for this will appear in the de- tailed statement below. On the first of April, 1892, the building was surrendered by the Committee to the Select- men completed and fully equipped at a cost to the Town of $43,673.66, as follows :-

GENTLEMEN - The Board of Fire Engineers respectfully present their annual report for the year ending December 31st, 1892.
The force of the Department consists of a board of seven engineers and 128 men as follows: Two steamer companies of thirty men each; one hook and ladder company, sixteen men; one hand engine company, twenty men; one chemical engine company, eight men; four hose companies of six men each.
