ARTICLE 26. Two INCANDESCENTS ON ATLANTIC AVENUE. Your committee have looked the location over and find there is need of even more than is asked for in two incandescents at this point, and would recommend that an incandescent light be placed near the corner of the road going to the beach, as asked

for, and erecting an arc light in place of an incan- descent near the house known as Mariana, or some- what westerly from there, at the same time changing over the next light easterly of this point (with no ex- pense to the Town of course), would give to this much used thoroughfare ample light, which it certainly does not have now; and we recommend this action.
ARTICLE 27. ARC LIGHT. (Near residence of Charles Knowles, Rockland Street.)
Your committee have also looked over these premises and find there is no real need of more light at this point.
We already have an arc light in front of the James Pope estate, and one at Rockland and Highland Streets, with an incandescent opposite house of Charles H. Joye, and although there is something of a bend in the street between each arc light, the small one seems to fill the space, and we would recommend the petitioners have leave to withdraw.
ARTICLE 28. ARC LIGHT. Your Committee have also looked over this point at the corner of Walker and Grant Roads, near the residence of Mr. John S. Hurley, and would recommend the placing of an arc light at this point as called for by the petition- ers.

RESOLUTION.
Whereas, Many of our honored and respected citizens are being forced into legal complications, by the operation of the Park Act recently accepted by the Town, and administered by the Park Commission- ers ; and
Whereas, said legal contention may possibly in- volve the town to such an extent, as to seriously men- ace the best interests thereof,
Be it Resolved, That it is the earnest will and expression of the citizens in Town Meeting assembled, that the Commissioners be requested to temporarily desist from any further encroachment upon lands taken for Park purposes, to remove or destroy any building or buildings thereon, until such time as a special Town Meeting can be called, immediately after the adjournment of the Annual Town Meeting now in session, for the express purpose of fairly dis- cussing the Park question in all its relations to citizens of the Town, and to take such action as may commend itself to the wisdom of its citizens.
Voted. To adjourn at 10 o'clock P. M.

That the Treasurer be authorized, under the direction of the Selectmen, to hire a sum not ex- ceeding $5,000 and give the note of the Town for the same, for a time not less than eight years, the same to be used for the building of the Chemical Laboratory and the improvement of the Cemetery. REPORT ON CEMETERY LAND.
To the Citizens of Swampscott :
· Your committee to whom was referred the pur- chase of land for cemetery purposes, beg leave to sub- mit the following report :
On looking into the subject, we were surprised to learn that the Town now owns nearly two acres of land adjoining the cemetery and outside the line of the old wall. Added to this, we have considerable land which has not yet been laid out in lots, within the present boundaries of the cemetery. Therefore we have now available for cemetery purposes, suf- ficient land, in all probability, to answer our needs for many years. We believe that very few of our fellow citizens were aware of this condition at the time when this committee received its instructions.
We have interviewed the owner of the land, Alden Southworth, and are as yet unable to agree upon a price. Inasmuch as the Town has already sufficient land for a considerable term of years, we recommend that this committee be instructed to take no further

action, provided that the owner will not accept for his land a sum of money which the committee considers a fair price.

The report of the Selectmen above referred to was read.
Voted. To lay upon the table until the Com- mittee on Future Water Supply had made report.
The chairman of Future Water Supply Commit- tee stated that the Committee desired further time; the form of contract offered by the City of Lynn was read.
Voted. That the Committee on Future Water Supply have power to secure good counsel, and money would be appropriated for the same if necessary.
Voted. To adjourn to Thursday evening, June 10th, at 7.30 P. M.

In the name of the Commonwealth of Massachu- setts, you are directed to notify the inhabitants of the Town of Swampscott, qualified to vote in elections and in Town affairs, to meet at Town Hall in said Swampscott, on Thursday, the thirtieth day of Sep- tember, current, at seven-thirty o'clock in the after- noon, then and there to act on the following articles, viz. :
ARTICLE 1. To choose a Moderator to preside in said meeting.
ART. 2. To hear and act upon the report of the Committee on Future Water Supply, and to see what action the Town will take as to future water supply.
ART. 3. To see if the Town will authorize the Park Commissioners to make additional provision, on the Park Reservation, for the use of certain occu- pants, soon to be removed therefrom by virtue of said Commissioners' order, and make necessary appropria- tion therefor, according to the petition of Benj. W. Shelton and others.
ART. 4. To see if the Town will appropriate the sum of one thousand dollars, to be expended on the public high ways.

Salary of Janitor Town Hall.
Voted. ART. 5. That the salary of the Janitor of the Town Hall is hereby increased to $650 per year, and the sum of $130 appropriated for the Town Hall Department for that purpose.
Appropriati'n for Street Lights.
Voted. ART. 6. To appropriate the sum of $72 for an arc light at the corner of Belmont Avenue and Minerva Street.
Voted. To take up Art. 4.
Appropriati'n for Highway Department
Voted. ART. 4. That the sum of $1,000 be ap- propriated for the use of the Highway Department, making a total of $5,500 appropriated for this depart- ment for the current year.
An Amendment. That the sum of $400 be added to Highway Department appropriation, to be expended under the direction of the Highway Surveyor in the improvement of the streets at Mountain Park, was negatived.
Voted. ART. 2. To accept the report of the Committee on Future Water Supply, as printed, and adopt their recommendations contained in the follow- ing votes, amended to read as follows :
Voted. That the Committee on Future Water Supply be and is hereby directed to make the follow- ing proposition to the Marblehead Water Company for the purchase of its corporate property and all the rights, privileges, easements, lands, waters, water rights, dams, reservoirs, pipes, engines, boilers, ma- chinery, fixtures, hydrants, tools and all appliances owned by said company, at a price to be fixed by three commissioners, each to be appointed by the mutual

agreement of said Marblehead Water Company and the Committee on Future Water Supply, and in case said company and said committee, after conference, shall be unable to agree upon such commissioners, application may be made to the Supreme Judicial Court by said company or said committee, and after notice to the parties, said commissioners shall be ap- pointed by said court or any justice thereof, and said commissioners shall determine the fair value of said property upon the following basis, viz .:
1. The commissioners shall determine the fair value of said property for the purposes of its use by said Town, and their award, or the award of a major- ity of them, when made, shall be final. Such value shall be estimated without enhancement on account of past, present or future earning capacity or good will, or on account of the franchise or any privilege of said company.
2. The expenses of the commission shall be paid equally by the Marblehead Water Company and the Town of Swampscott.
3. Provided this proposition is accepted by the Marblehead Water Company, the acceptance shall be in form satisfactory to the Town Counsel.
4. The proposition shall be void and of no effect unless a satisfactory acceptance thereof shall have been filed with the Town Clerk of Swampscott, or the Chairman of the Board of Selectmen of Swamp- scott, within sixty days after its adoption by vote of the Town.
5. The formal transfer of the said property of the Marblehead Water Company shall not be effected unless such transfer is authorized by special or general legislation, and a good and clear title given, free from all incumbrances.
6. If the proposition is not accepted, the Town's rights and interests in future will not be effected by reason of this offer.

7. All details as to form of agreement, mode and details of reference and hearing, and all terms and conditions not herein specified to be left to the discretion and determination of said committee.
Voted. That the Committee on Future Water Supply be and is hereby directed to confer at once · with the Metropolitan Water Board to see upon what terms a supply of water for all Town, domestic and other purposes can be secured, and to submit at a special meeting to be called, any proposition and all propositions which it may obtain ; and said committee is hereby further directed to prepare, under the direc- tion of the Town Counsel, such bills as will be neces- sary to present to the next General Court to enable the Town to acquire and operate its own water plant ; and said committee is hereby further directed to have prepared estimates of such construction as is necessary to complete and perfect a water system for the Town's immediate needs and for the future requirements.
Motion. That the sum of fifteen hundred dollars be appropriated, said sum to be raised by note of the Town and known as a Park Loan, the same to be placed in the hands of the Park Commission, for the purpose of providing suitable accommodations at or near the Fish House on Blaney's Beach, for the use of such citizens as are or were actively engaged in the fish-dealing business on said beach before the taking by the Town. Such building or buildings shall be ' under the control and regulation of the Park Com- mission, as provided by law (Art. 3); negatived.
Voted. To dissolve at 9.20 o'clock.

RETURN ON THE WARRANT.
Pursuant to the within Warrant to me directed, I have noti- fied the inhabitants of the Town of Swampscott, qualified as herein expressed, to meet at the time and place, and for the pur- poses herein mentioned, by posting up attested copies of this Warrant in fifteen public and conspicuous places in said Swamp- scott, on Saturday, the twenty-third day of October, 1897.

In accordance with the foregoing Warrant, the voters of the Town met in the Town Hall, on Tuesday, Nov. 2, 1897, and called to order at six o'clock in the forenoon by Wilmot R. Hastings, Chairman of the Selectmen and presiding Election Officer. The Town Clerk read the Warrant calling the meeting and the return thereon.
The package of ballots marked " First set of ballots, Town of Swampscott," was delivered to the presiding Election Officer, who receipted therefor.
Benj. F. Rich (Rep. Inspector) and Jas. T. Lyons (Dem. In- spector) were duly sworn as Ballot Clerks.
The ballots were delivered to the Ballot Clerks after the seal had been broken by the presiding Election Officer.
Cards of Instruction and Specimen Ballots were posted in- side the rail and about the hall, in accordance with the law.
The ballot box was opened and declared to be empty; the register was 000. The ballot box was then locked and the keys delivered to the constable in charge.
The polls were declared open at 6.05 A. M. The polls were kept open by vote of the meeting until 4.36 P. M.

In the name of the Commonwealth of Massachusetts, you are directed to notify the inhabitants of the Town of Swampscott, qualified to vote in elections, to meet at Town Hall, in said Swampscott, on Monday, the Fourteenth day of February, cur- rent, at half-past seven o'clock in the evening, then and there to act upon the following Articles :
ARTICLE 1. To choose a Moderator.
ART. 2. To hear and act upon the report or reports of the Committee on Future Water Supply.
