The meeting was called to order at 8 o'clock by Milton D. Porter, Town Clerk, who read the Warrant and the return thereon.

On motion, it was Voted, That the Town Clerk cast one vote for John R. Merritt for Moderator. That vote having been cast, John R. Merritt was declared elected, and was immediately qualified for the duties of Moderator by the Town Clerk.


Noted. That Art. 2 be passed over, as it had been ascer- tained that it was not competent to act on same at this meeting.


Voted. That Art. 3 lie on the table, to be taken up in course, after the election of Water Commissioners.


Voted. To take up Arts. 4, 5 and 6 together.


W. R. Hastings offered the following :


That for the purpose of paying for the property of the Mar- blehead Water Company, and the necessary expenses and liabili- ties incurred by the Town under the provisions of Chap. 293 of the Acts of the Legislature of the year 1898, entitled, "An Act relative to the purchase and sale of the property of the Marble- head Water Company," there be issued Coupon Bonds of the Town of Swampscott, with the privilege of registration, to the amount, at par value, of One Hundred Thousand Dollars ($100,000), in sums of One Thousand Dollars ($1,000) each, bearing upon their face the words, "Town of Swampscott Water Loan," signed by the Treasurer of the Town of Swampscott and countersigned by the Water Commissioners to be hereafter elect- ed under said Act ; said bonds to be issued under the Seal of the Town, and to bear date August 1, 1898, payable at the Manu- facturers National Bank of Boston, Mass, or at the Office of the Treasurer of the Town of Swampscott, at the option of the holder, on the first day of August, 1928, with interest at four per cent. per annum, payable semi-annually, on the first days of February and August, principal and interest payable in gold coin of the United States, or its equivalent, and that the Treas- urer of the Town, and said Water Commissioners, at their dis- cretion, cause such bonds to be prepared, offered and disposed of, in such manner, at such time or times, and for such prices as they shall determine, subject to the provisions of said act. Further, and that a sinking fund be, and it is hereby established, for the payment of the bonds authorized by the foregoing vote, and that any of said bonds or any remaining proceeds thereof,

not needed for the payment of the expenses and liabilities afore- said, be paid and contributed to said fund. And that such other and further payments and contributions be made thereto, from time to time, as are required by the provisions of said Act of 1898, Chap. 293, and other provisions of law. Which said sink- ing fund shall remain inviolate, and pledged to the payment of said loan, and shall be used for no other purpose.


M. E. Nies offered the following amendment :


Resolved, That when the Board of Selectmen negotiate the bonds necessary to pay for the plant of the Marblehead Water Co. the said bonds shall be made payable at maturity, principal and interest, in the legal tender money of the United States.


Resolved, That there shall be no specific nomination of any particular currency written in said bonds.


Voted. As further amended by Mr. Foster, that the whole matter of Articles 4, 5 and 6 be laid upon the table until after the election of Water Commissioners.


ART. 7. The Chief Engineer of the Fire Department sub- mitted a proposition from the American Steam Fire Engine Co. of Seneca Falls, N. Y., to make the necessary repair's on the Steam Fire Engine for the sum of Fifteen Hundred Dollars ($1,500).


A motion by J. F. Keefe, that the sum of $1,800 be appro- priated for repairing the Steam Fire Engine, was amended by Mr. Bunting, that the sum of $1,500 be appropriated.


The amendment prevailed and the sum of $1,500 was appropriated for the purpose.


Voted. That when we adjourn, it be to Monday evening, July 25th, at 8 o'clock, P. M.


Voted. At 9.05 P. M., to adjourn.

Greeting :


In the name of the Commonwealth of Massachusetts, you are directed to notify the inhabitants of the Town of Swamp- scott, qualified to vote in elections and in Town affairs, to meet at the Town Hall, in said Swampscott, on Monday, the twenty- fifth day of July, current, at twelve o'clock, noon, then and there to act on the following Articles, viz :


ARTICLE 1. To choose a Moderator.


ART. 2. To choose by ballot three Water Commission- ers, as provided in Chapter 293 of the Acts of the Year 1898.


The polls to be kept open until 4.30 o'clock.


And you are directed to serve this Warrant by posting at- tested copies thereof at the Town Hall, Depot, Post Office, and three other public and conspicuous places in the Town, seven days at least before the time of holding said meeting.

RETURN ON THE WARRANT.


Pursuant to the within Warrant to me directed, I have no- tified the inhabitants of the Town of Swampscott, qualified, as herein expressed, to meet at the time and place and for the pur- pose herein mentioned, by posting up attested copies of said Warrant, at the Town Hall, Depots, Post Office, and nine other public and conspicuous places in said Swampscott, on Saturday, the sixteenth day of July, in the year 1898, the posting of said notices being seven days before the time of said meeting.

In accordance with the foregoing Warrant, the voters of the Town met in the Town Hall, on Monday, July 25, 1898, and were called to order at 12 o'clock, noon, by the Town Clerk, who read the Warrant calling said meeting, and the return thereon.


The polls were immediately declared open for the reception of votes for Moderator.


On motion, it was voted, that the Town Clerk cast one vote for John R. Merritt for Moderator.


That vote having been cast, John R. Merritt was declared elected Moderator, and was immediately qualified for that duty by the Town Clerk.


Voted. That the polls be kept open until 6.30 o'clock.


John F. Keefe, (Rep.) and James T. Lyons, (Dem.), who had been appointed Inspectors by the Selectmen, were qualified to serve as Ballot Clerks, by the Town Clerk.


The package containing 1425 Ballots, which had been pre- pared by the Town Clerk, was delivered to the Ballot Clerks, who receipted therefor.


Cards of Instruction, and Penalties, also Specimen Ballots were posted inside and outside the polling place, as required by the laws of the Commonwealth.


'The ballot box was shown to be empty, the register denoting 000; the keys of the ballot box were delivered to the Constable in charge, and the Polls were then declared open for balloting.

The following having been appointed by the Selectmen as Tellers : William H. Collins, Abram G. Stone, Charles T. Jack- son and Frank V. Porter, were qualified for their duties by the Town Clerk.


The ballot box was opened several times by the Moderator, for the purpose of counting the votes.


At the close of the Polls, the register of the ballot box stood at 385. There were 415 ballots cast, both check lists showed the same number of checks, as the number of ballots cast.


The Polls were closed at 6.30 p. M.


The result of the balloting for Water Commissioners was an- nounced at 7.15 p. M, as follows :


For Water Commissioner for three years-Arthur F. Foster, 111; Benjamin G. Ingalls, 256, elected ; Blanks, 48.


For Water Commissioner for two years-Charles S. Has- kell, 294, elected ; Arthur F. Foster, 1; Geo. H. Holden, 1; Blanks, 119.


For Water Commissioner for one year-Martin V. B. Stone, 194, elected ; Frank J. Linnehan, 192; Blanks, 29.


Voted. To dissolve at 7.30 p. M.


Then personally appeared before me, Benjamin G. Ingalls, Charles S. Haskell and Martin V. B. Stone, and were duly sworn as Water Commissioners, for the several terms for which they were chosen.

ADJOURNED SPECIAL TOWN MEETING, JULY 25, 1898.


In accordance with the previous adjournment, the voters of the Town assembled at the Town Hall on Monday evening, July 25, 1898.


The meeting was called to order by John R. Merritt, Mod- erator, at 8.05 o'clock.


The records of the previous meeting were read and declared approved.


Voted. That the amendment of M. E. Nies, (declaring for the payment of the principal and interest of the Water Bonds about to be issued, in the legal tender money of the United States, ) which was laid on the table at the last meeting be taken up.


HI. B. Sprague offered as an amendment, that the bonds about to be issued for the payment of the property of the Marble- head Water Company, bear interest at the rate of three and one- half per cent. per annum.


Voted. To lay Mr. Sprague's amendment on the table, un- til the main question be reached.


Voted. That the vote on Mr. Nies' amendment be taken by a rising vote.


Mr. Nies' amendment was lost, 11 voting in the affirmative, and 35 in the negative.


Noted. That the original motion of Mr. Hastings, relative to the Water Bonds and the Sinking Fund, be taken from the table.


Voted. To take from the table the amendment offered by Mr. Sprague.


Voted. That the Water Bonds be issued in denominations of $500 and $1,000, respectively, and that they bear interest at the rate of three and one-half per cent., per annum.


An amendment offered by W. A. Stubbs, that the bonds be issued as Coin Bonds instead of Gold Bonds, was negatived.

Voted. That the place of payment of the bonds be stricken out of the original motion, and that they be made payable at place optional with the Town Treasurer and the Water Commis- sioners.


Voted. That when we adjourn this meeting, it be to Mon- day evening, August 15th, 1898, at 7.30 o'clock.


The following, being the original motion of W. R. Hastings, as subsequently amended, was passed by a rising vote, 44 in the affirmative, and 6 in the negative.


Voted. That for the purpose of paying for the property of the Marblehead Water Company, and the necessary expenses and liabilities incurred by the Town under the provisions of Chap. 293 of the Acts of the Legislature of the year 1898, en- titled, An Act relative to the purchase and sale of the property of the Marblehead Water Company, there be issued Coupon Bonds of the Town of Swampscott, with the privilege of regis- tration, to the amount, at par value, of One Hundred Thousand Dollars ($100,000), in sums of Five Hundred Dollars ($500), and One Thousand Dollars ($1,000), respectively, bearing upon their face the words, "Town of Swampscott Water Loan," signed by the Treasurer of the Town of Swampscott, and countersigned by the Water Commissioners elected under said Act. Said bonds to be issued under the Seal of the Town, and to bear date Au- gust 1, 1898, payable at such place as the Town Treasurer and the Water Commissioners may determine, on the first day of August 1928, with interest at three and one-half per cent., per annum, payable, semi-annually, on the first days of February and August, principal and interest payable in Gold Coin of the United States, or its equivalent, and that the Treasurer of the Town and said Water Commissioners, at their discretion, cause such bonds to be prepared, offered and disposed of, in such man- ner, at such time or times, and for such prices as they shall de- termine, subject to the provisions of said Act. And that a sinking fund be, and it is hereby established for the payment of the bonds authorized by the foregoing vote, and that any of said bonds, or any remaining proceeds thereof not needed for the payment of the expenses and liabilities aforesaid, be paid and

contributed to said fund, and that such other and further pay- ments and contributions be made thereto, from time to time, as are required by the provisions of said Act of 1898, Chap. 293, and other provisions of law. Which said sinking fund shall re- main inviolate and pledged to the payment of said loan and shall be used for no other purpose.


Voted. That the matter of Art. 3 be laid over to the ad- journed meeting.


Voted. That the consideration of the propositions of the Metropolitan Water Board be left with the Water Commission- ers to report at the adjourned meeting.


Voted. To adjourn at 9.25 P. M.

Notice having been served upon the Town Clerk calling for a recount of the votes cast for Water Commissioner, for one year, at the election held July 25, 1898, the Board of Registrars of Voters, having given due notice in conformity to law, met at the Town Hall on Saturday, July 30, 1898, at 2 o'clock, and carefully canvassed said vote, with the following result :


For Water Commissioner for one year, Frank J. Linnehan, 191; Martin V. B. Stone, 193 ; Blanks 31.


The previous count of the tellers being verified, one vote for each candidate being thrown out on account of the + being placed to left of, instead of in, the square. Previous result not changed.

In the name of the Commonwealth of Massachusetts, you are hereby directed to notify the inhabitants of the Town of Swamp- scott, qualified to vote in elections, and in Town affairs, to meet at the Town Hall, in said Swampscott, on Monday, the twenty- fourth day of October, A. D., 1898, at seven and one-half o'clock in the evening, then and there to act on the following Articles, viz :


ARTICLE 1. To choose a Moderator to preside' in said meeting.


ART. 2. To see if the Town will authorize the Board of Water Commissioners to make application to the Metropolitan Water Board for water to be furnished to the Town, also to see if the Town will authorize the Board of Water Commissioners for a period of years, to pay such sum as may be required for water, and to enter into such agreements as may be deemed nec- essary for further payments and relative to the delivery of water, and to take such other action in the premises as may be deemed necessary or proper.


ART. 3. To see if the Town will authorize said Water Commissioners to borrow in the name and behalf of the Town, the sum of Twenty Thousand Dollars ($20,000), such sum being necessary to enable the Town to contract with the Metropolitan Water Commissioners for a supply of water for the Town and its inhabitants.


ART. 4. To see if the Town will issue the bonds of the Town, and if so, to fix the time the same are to run, and deter- mine all other terms and conditions of said bonds, and to pass

any other vote or votes necessary to enable the said Water Com- missioners to execute, issue and negotiate such bonds in the name and behalf of the Town.


ART. 5. To see if the Town will provide for the establish- ment of a sinking fund for the payment of the bonds, if any are authorized to be given by the Town, under the fourth article in this Warrant, and if so, to pass any other vote or votes necessary to the establishment of such sinking fund.


ART. 6. To see if the Town will authorize the settlement of the case of Captain John Smith against the present Park Commissioners of this Town and the inhabitants of said Swamp- scott, and settle the suit of the said Capt. John Smith against this Town.


ART. 7. To see whether or not this Town will give and grant to Capt. John Smith in fee a lot of land upon Blaney Beach in this Town.


ART. 8. To see what action the Town will take toward fix- ing the price of Cemetery Lots.


ART. 9. To see if the Town will vote to pay one-half the expense of brick side-walks.

The meeting was called to order by the Town Clerk at 7.30 o'clock. The Warrant calling the meeting was read by the Town Clerk, and the return thereon.


On motion of W. R. Hastings it was voted, that, the Clerk cast one vote for John R. Merritt, for Moderator. That vote having been cast, and Mr. Merritt having been declared elected, he was immediately qualified for the duties of Moderator by the Town Clerk.


Voted. Art. 2. Nearly unanimous.


That the Board of Water Commissioners of the Town of Swampscott be requested to make, in the name and behalf of the Town, written application to the Metropolitan Water Board for water to be furnished to the said Town from such date as the said Board may be able to supply the same until the thirty-first day of December in the year 1908, in accordance with the pro- visions of Chapter 488 of the Acts of the year 1895 and Acts amendatory thereto, and in accordance with Chapter 293 of the year 1898; that the Board of Water Commissioners be author- ized to pay to the Commonwealth of Massachusetts, on or before the first day of December, 1898, the sum of Twenty Thousand Dollars ($20,000), that being the sum required by the said Met- ropolitan Water Board to be paid in advance, and that the Board of Water Commissioners be authorized to execute, seal with the

. corporate seal, acknowledge and deliver, in the name and behalf of the Town of Swampscott, an agreement with the Common- wealth of Massachusetts and the Metropolitan Water Board, that said town shall make, thereafter, annual payments, on or before the first day of May in each year, of sums as follows: In 1899, Fifteen Hundred Dollars ($1,500) ; in 1900, Two Thousand Dol- lars ($2,000) ; in 1901, Twenty-five Hundred Dollars ($2,500) ; in 1902, Three Thousand Dollars (3,000); in 1903, Thirty-five Hundred Dollars ($3,500); in 1904, Forty-one Hundred Dollars ($4,100) ; in 1905, Forty- six Hundred Dollars ($4,600) ; in 1906, Forty-eight Hundred Dollars ($4,800); in 1907, Forty-eight Hundred Dollars ($4,800); in 1908, Forty-eight Hundred Dol- lars ($4,800) ; it being understood, however, that the Town shall not be required to make any annual payment until after the first day of the month succeeding that on which the Metropolitan Water Board begins to furnish water to the Town, and that there be deducted one-twelfth of the assessment for the current calendar year for each full calendar month which shall elapse after December 31, 1898, before the Board begins to furnish water ; and that the Board of Water Commissioners be further authorized to execute, seal with the corporate seal, acknowledge and deliver, in the name and behalf of the Town, an agreement that the water so to be furnished may be supplied to said Town through such main pipe, built or to be built, as may be deemed necessary by the Metropolitan Water Board for the supply of the towns of Swampscott and Nahant, and through a pressure regulating valve reducing the pressure beyond the valve to that due to a head of 200 feet above Boston city base, or to such smaller head as the Town may from time to time by its Board of Water Commissioners request, and that the pipe through which such supply be furnished may be used for the supply of the Town of Nahant and also for the supply of other communities, at the discretion of the Metropolitan Water Board, to the extent that it can be so used without reducing the pressure beyond the valve during the daytime on ordinary occasions below that due to the 200 feet head, or other head substituted therefor, as afore- said.

Said Bonds to be issued under the seal of the Town and to bear date August 1st, 1898, payable at the Manufacturers National Bank, Boston, Massachu- setts, on the first day of August, 1928, with interest at three and one-half per cent. (3 1-2 %) per annum, payable semi-annually on the first days of February and August, principal and interest payable in gold coin of the United States, or its equivalent. And the Treasurer of the Town and the said Water Commis- sioners are hereby authorized, at their discretion, to cause such bonds to be prepared, offered and disposed of in such manner, at such time, or times, and for such prices as they shall deter- mine, subject to the provisions of said act.
