ART. 30. E. H. Kitfield for the Park Commissioners made a verbal report, that, to erect a band stand on the Park Reser- vation, as petitioned for in this Article, such as would be accept- able to the Commissioners and an ornament to the Town, would cost in the vicinity of $400.


M. E. Nies moved to accept and adopt the report of the Park Commissioners on Band Stand on the Park Reservation and that $400 be appropriated for the same. Carried, 43 to 3.


On motion of D. H. Millett, Art. 39 was taken from the table.


It was Voted, That the Town Treasurer be authorized under the direction of the Selectmen, to hire a sum of money not exceeding $7,000 and give the note of the Town, payable in the year 1906. The same to be used for permanent improvements.


Report of the Selectmen on Monument Avenue.


SWAMPSCOTT, April, 1900.


Your Board of Selectmen to whom was referred Art. 37, beg leave to report that, We recommend that Monument avenue be accepted by the Town as laid out by the Selectmen, when all the waivers are signed, and that $500 be appropriated therefor.

On motion of J. B. Earp, it was Voted, That the sum of $400 be added to the Fire Department appropriation to cover the increase of pay of the call firemen.


Voted, On motion of Kendall Pollard, That the Board of Selectmen be authorized to notify the City of Lynn, that within 60 days from date of notification they must discontinue the over- flow of sewage, at or near Herrick's factory, at the foot of Burrill avenue, Lynn, so as to prevent its flow through the old Stacey Brook to the ocean, or on Swamspcott Beach.


Voted at 9.05 P. M. To dissolve the meeting.

In the name of the Commonwealth of Massachusetts, you are directed to notify the inhabitants of the Town of Swampscott, qualified to vote in elections, and in Town affairs, to meet at the Town Hall, in said Swampscott, on Tuesday, the twenty-fourth day of July, current, at seven-thirty o'clock in the evening, then and there to act on the following Articles, viz :


ARTICLE I. To choose a Moderator to preside in said meeting.


ART. 2. To see if the Town will authorize the transferring of the unexpended balance of the appropriation for the collection

And you are directed to serve this warrant by posting attested copies therof at the Town Hall, Depot, Post Office, and three other public and conspicuous places in the Town, seven days at least before the time of holding said meeting.

Special Town Meeting, July 24, 1900.


Meeting called to order at 7.45 P. M.


Warrant read by the Clerk.


ARTICLE I. Moderator. On motion, it was voted that the Clerk cast one vote for John R. Merritt for Moderator. That vote having been cast, John R. Merritt was declared elected Moderator, and was qualified for that duty by the Town Clerk.


ART. 2. Voted, That the unexpended balance of the appro- priation for the collection of ashes be transferred to and for the use of the Board of Health, to be expended for cleaning the brooks of the Town.


ART. 3. The Board of Selectmen submitted the following article, as supplementary to the present By-laws of the Town :


Article II. By-laws, Town of Swampscott.


SECTION I. No person shall carry on the business of a pawn- broker or dealer in or keeper of a shop for the purchase, sale or barter of junk, old metals or second-hand articles in this Town unless he is duly licensed therefor by the Board of Selectmen of the Town, for which license he shall pay the sum of $15.00.


SEC. 2. No person shall engage in buying or collecting junk or old metal unless he is duly licensed therefor by the Board of Selectmen of the Town, for which license he shall pay the sum of $10.00.

SEC. 3. Every pawnbroker of keeper of such shop shall keep a book in which he shall record, at the time of receiving any article as a pawn, or purchasing any article, a description of the same, the name, age and residence of the person from whom, and the day and hour when he received or purchased it; and the book shall, at all times, be open to the inspection of the Chief of Police, the Board of Selectmen and any person by them respect- ively authorized to make such inspection.


SEC. 4. No pawnbroker and no person dealing in said ar- ticles or keeping such a shop, shall directly or indirectly receive any article of pawn, or purchase any article of any minor or apprentice, knowing or having reason to believe him to be such. Every such shop and all articles of merchandise therein shall be exhibited to the Chief of Police or the Board of Selectmen, or to any or either member of said Board, or to any person respectively authorized by said Board or any member thereof, or said Chief of Police, to examine such shop or articles of merchandise when- ever a demand is made by any or either of them for such exhi- bition.


SEC. 5. All licenses granted under this ordinance to any pawnbroker or keeper of such shop shall designate the place where the person licensed may carry on his business (the hours in which such shop shall be closed), and he shall not engage in or carry on his business under his license in any other place than the one designated, and all the provisions of this ordinance shall be corporated into every license which shall be granted under it.


SEC. 6. No person shall carry on the business of a hawker or peddler of any foreign fruit or vegetables in this Town unless he is duly licensed therefor by the Board of Selectmen of the Town, for which license he shall pay the sum of $2.00.


SEC. 7. Any person offending against either of the provis- ions of this ordinance shall forfeit and pay a sum not exceeding twenty dollars for each offence.


Voted, Art. 3, To accept and adopt the By-laws as presented by the Board of Selectmen.

ART. 4. Voted, To appropriate the sum of $250 for the use of the Sewer Commissioners for further investigation of the sys- tem of sewerages as proposed for the Town, and that said Com- missioners report at next annual Town meeting.


ART. 5. Voted, To accept the report of the Committee on Street Lighting as prepared and published by them, and that they be empowered to renew the contract with the Lynn Gas and Electric Company for furnishing street lights for the term of five years, and that the Committee further investigate the matter of municipal lighting.


Voted, At S.55 P.M. to dissolve the meeting.

In the name of the Commonwealth of Massachusetts, you are directed to notify the inhabitants of the Town of Swampscott, qualified to vote in elections, and in Town affairs, to meet at the Town Hall in said Swampscott, on Wednesday, the tenth day of October, current, at seven-thirty o'clock in the evening, then and there to act on the following articles, viz :


ARTICLE I. To choose a Moderator to preside in said meeting.


ART. 2. To see if the Town will authorize the Water Com- missioners to sell or exchange the two lots of land owned by the Town and located between Paradise road and Hampden street.

ART. 2. The Selectmen submitted the following report bear- ing upon this article, which was read :


To the Citizens of the Town of Swampscott :


In relation to Art. 2, your Board of Selectmen have viewed the premises, and the Trustees of the Stetson Land Company have stated their willingness to exchange two lots opposite the street, now known as Ellis road and located between Paradise road and Hampden street, for the two lots now owned by the Town. The Board are of the opinion that in the near future the Town will desire to extend the street now known as Ellis road to the junction of Hampden street and Middlesex avenue, there- by being a great benefit to that section of the Town, bringing a very large tract of land that is being rapidly built upon within five minutes' walk of the railroad station; and if the Town did not desire to extend Ellis road the lots would be as valuable to the Town as the present lots.


The Board, therefore, beg leave to recommend that authority be given to the Board of Water Commissioners to sell or exchange the two lots.

Spirited dis- cussion followed, in which the Chairman of the Board of Health made some extended explanations in answer to questions, refer- ring to the expending of the Board's appropriation, and for what purpose the present asked-for appropriation was required.

mittee of five, consisting of D. H. Millett, John R. Merritt, Martin L. Quinn, Martin E. Nies and Kendall Pollard, to inves- tigate the whole matter of the clearing of the brooks of the Town by the Board of Health, with authority to call for persons, books and papers, and to report at an adjourned meeting.


D. H. Millett having declined to serve on that committee, the name of Amos O. Cahoon was substituted. It having been voted that the motion of Mr. Tuttle be first put, that motion was laid upon the table by a decisive vote, and the amendment of Mr. Sprague was carried.


Voted, At 8.45 P. M. to adjourn to November 7, 1900, at 7.30 P. M.

State Election.


SWAMPSCOTT, November 6, 1900.


In pursuance of the foregoing Warrant, the voters of the Town met in the Town Hall, on Tuesday, November 6, 1900, and were called to order at 6 o'clock A. M. by Edward A. Maxfield, Chairman of the Selectmen and presiding election officer. The Warrant was read by the Town Clerk. The package of 1200 ballots was delivered to the ballot clerks, B. F. Rich, Republican and James T. Lyons, Democrat, who having been duly qualified by the Clerk, receipted therefor. Willis C. Paul was qualified as additional Democratic election officer.


All the requirements of the law having been complied with, the polls were declared open for balloting at 6.05 A. M.


The following had been appointed as tellers by the Selectmen and were duly qualified by the Clerk : Stuart P. Ellis, Frank H. Bradford, James L. Taylor, Charles T. Jackson, Herbert W. Webster and John I. Adams, Republicans; Arthur E. Pecker, Daniel J. Kane, Frank D. Thurston, Bernard McDer- mott, O. A. McIntosh and H. Byron Martin, Democrats.


The polls were closed at 4.30 P. M., 841 ballots having been cast.
