Auditor's Report.
SWAMPSCOTT, MASS., Feb., 20, 1911.
To the Citizens of the Town of Swampscott :
Herewith is submitted the annual report for the fiscal year ending January 31, 19II.
We have examined and audited the accounts of the various officials and Departments of the Town, and have compared the Items of receipts and expenditures and find correct balances and vouchers for same.
The Treasurer's accounts have been audited each quarter and correct balances found.
We have audited the accounts of the Collector of Taxes also the Bonds of the Water Department Sinking Fund and the Trust Funds.
Bank cashiers certificates shows the Treasurer's balance as correct each quarter.

To either of the Constables of the Town of Swampscott, in GREETING:
said county,
In the name of the Commonwealth of Massachusetts, you are directed to notify the inhabitants of the Town of Swampscott, qualified to vote in elections and in Town affairs, to assemble in the Town Hall, in said Swampscott, on Monday, the twentieth day of March, current, at six o'clock in the forenoon, then and there to act on the following articles, viz. :
ARTICLE I. To choose a Moderator for one (1) year.
ART. 2. To choose a Town Clerk for one (1) year. To choose a member of the Board of Selectmen for one (1) year.
To choose a member of the Board of Selectmen for two (2) years.
To choose a member of the Board of Selectmen for three (3) years.
To choose one member of the Board of Assessors for three (3) years.
To choose a Town Treasurer for one (1) year. To choose a Collector of Taxes for one ( 1) year. To choose one member of the Board of School Committee for three (3) years.
To choose one member of the Board of Trustees of the Public Library for three (3) years.
To choose a Board of Auditors for one (1) year.

ART. 3. To vote by ballot "Yes" or "No" upon the ques- tion : Shall licenses be granted for the sale of intoxicating liquors in this Town?
ART. 4. To hear and act upon the reports of the Selectmen, the School Committee, the Water and Sewerage Commissioners, the Board of Health, the Library Trustees, the Park Commis- sioners, the Overseers of the Poor, the Board of Assessors, the Board of Auditors, the Surveyor of Highways, the Tree Warden, the Committee on Street Lighting, the Committee on Ways and Means, the Board of Fire Engineers, the Chief of Police, the Superintendent of the Cemetery, the Inspector of Plumbing, the Inspector of Animals, the Inspector of Milk, the Sealer of Weights and Measures, the Town Accountant, the Committee on Air Whistle, the Committee on Bathing Facilities, the Committee on Stacey's Brook, the Committee on July 4th, the Committee on increased accommodations for the Library, the Committee on the Inspection of Wires and Buildings, the Town Engineer and the Superintendent of Moth Work.
ART. 5. To raise such sums of money as may be necessary to defray Town charges for the ensuing year, and make appro- priations therefor.

ART. 6. To see if the Town will authorize the Treasurer, with the approval of a majority of the Board of Selectmen, to borrow during the current municipal year, beginning March 20, 1911, in anticipation of the taxes for said municipal year, such sums of money as may be necessary for the current year expenses of the Town, giving the notes of the Town therefor, payable within one year from date thereof.
ART. 7. To see if the Town will authorize and direct the Treasurer, with the approval of a majority of the Selectmen, to borrow money upon the notes of the Town, duly authenticated, to meet the appropriations voted at the Annual Meeting for nineteen hundred and eleven ( 1911) or any adjournment thereof.
ART. S. To see what amount of bonds will be required of the Town Treasurer for the ensuing year.
ART. 9. To see what amount of bonds will be required of the Collector of Taxes for the ensuing year.
ART. 10. To see what amount of bonds will be required of the Water and Sewerage Commissioners for the ensuing year.
ART. II. To see what action the Town will take in regard to the collections of taxes and what rate of discount, if any, will be allowed for the prompt payment on or before a certain date.
ART. 12. To see what action the Town will take in relation to salaries for Town Officials for the ensuing year.
ART. 13. To see if the town will vote to amend the follow- ing sections of its By-Laws, viz :-

Section 15 of Chapter 6., as follows :
Section 1 of Chapter 2 : By striking out the word "March" in the fourth line and inserting in place thereof the word "February." By striking out the following in the ninth line " a Moderator of said meeting " and inserting in place thereof the words " Town Officers." By striking out the word "seven"' in the tenth line and inserting in place thereof the word " six." By striking out the following in the eleventh and twelfth lines "after the election of a Moderator " and by striking out the fol- lowing in the thirteenth and fourteenth lines " for the election of Town officers," so as to read as follows :
The annual town meeting for the election of town officers shall be held on the third Monday of February in each year. The warrant for said annual meeting shall contain such articles as are required for raising and appropriating moneys, and for general and special town purposes. For the election of Town officers, the polls shall be opened at 6 o'clock in the forenoon, and they shall remain open until half past four o'clock in the afternoon, after which time a vote may be passed to close them in not less than ten min- utes. After the declaration of the votes for town officers, the meeting shall be adjourned to the Tuesday next there- after at such time as the meeting may determine, when the remaining articles of the warrant shall be acted upon.
Section 5 of Chapter 2 : By adding at the end thereof the fol- lowing : "and no action shall be had upon any article involving the appropriation or expenditure of money, the creating of a debt or the disposal of any town property, other than a reference to the Committee on Ways and Means, unless not less than one hundred qualified voters of the town are present at said meeting." So as to read as follows :

Whenever the Warrant for any Town Meeting contains an Article appropriating or involving the expenditure of money, the creating of a debt or the disposal of any town property, the Selectmen shall, six days at least before the day named in said Warrant for holding said Town Meeting, send a copy of the Warrant containing such Article to the Com- mittee on Ways and Means, who shall consider the same and make a report thereon with their recommendations to the Town Meeting ; and no action, other then a reference to the Committee on Ways and Means, shall be had upon any Article involving the appropriation or expenditure of money, the creating of a debt or the disposal of any town property, unless not less than one hundred qualified voters of the Town are present at said meeting.
Section 4 of Chapter 3 : By striking out the words "for the construction of any public building " and inserting in place thereof, " any public work " so as to read as follows :
No contract or change of contract or order for labor or materials involving the expenditure of over $500 from any appropriation shall be valid until countersigned by a majority of the Board of Selectmen and recorded in a book kept for the purpose. This Section shall be written or printed upon every contract for the construction of any public work.
Section 1 of Chapter 4 : By striking out the entire Section and inserting in place thereof the following :
The Selectmen shall, once each third year, or whenever there is a vacancy in the office of Town Accountant, appoint a competent Accountant in accordance with the provisions of Chapter 624 of the Acts of 1910, who shall perform the duties prescribed by said Chapter.
Section 4 of Chapter 4 : By striking out all of said Section after the word " Selectmen " in the sixth line thereof, so as to read as follows :
If he shall approve a bill or demand he shall cause it to be entered in a book kept for that purpose, and shall prepare a Warrant or order for its payment for the signature of the majority of the Selectmen.

Section 8 of Chapter 4: By striking out all of said Section after the ninth line, and inserting in place thereof the following. Such statement shall be arranged, as far as practicable, to con- form to the classification prescribed by the Bureau of Statistics and Labor, and shall be accompained by a schedule of the prop- erty belonging to the Town. So as to read as follows :
He shall in his Annual Report include a statement of all the receipts and expenditures of the Town for the past finan- cial year, giving in detail the amount of each specified appropriation and the expenditure therefrom, the receipt from each source of income, the reduction, if any, in the Town debt and the change, if any, in the sinking funds. Such statement shall be arranged as far as practicable to con- form to the classifications prescribed by the Bureau of Statistics and Labor, and shall be accompanied by a schedule of the property belonging to the Town.
Section I, of Chapter 5 : By striking out the first ten lines and inserting in place thereof the following : There shall be appointed a standing Committee on Ways and Means to consist of six citizens, no one of whom shall hold Town office at the time of his appointment, or while serving on this Committee ; election to Town office shall terminate his membership on said Committee on Ways and Means. Upon the adoption of this article the Moderator shall appoint the members of the Com- mittee to serve for the following terms: Two for one year, two for two years and two for three years, and at each Annual Town Meeting thereafter the Moderator shall appoint two members to serve for a term of three years. The members of this Committee shall serve without pay. So as to read as follows :

The financial year of the Town shall begin the first day of January and close the thirty-first day of December next ensuing and during the interval between the thirty-first day of December in each year and the time of making the next annual appropriations, the Selectmen, in order to meet the liabilities of the several departments incurred in the carrying on of the work entrusted to them, shall have authority to make expenditures and payments from the treasury from any available funds therein and the same shall be charged against the next annual appropriation, but such expenditures and liabilities incurred shall be for the sole purpose of carrying on the actual running expenses of each department.
Section 8 of Chapter 6 : By striking out the words "except state and county taxes and principal and interest of legally authorized notes and all payments authorized by the laws of the Commonwealth " so as to read as follows :
No money shall be paid by the Town Treasurer without a written or printed warrant for the same, bearing the signatures of a majority of the Selectmen and stating the appropriation against which such warrant is drawn.
Section 13 of Chapter 6. By striking out the words "at a rate to be fixed annually by the town pursuant to Chapter 12, Section 72 of the Revised Laws," in the sixth, seventh and eighth lines and inserting in place thereof "six per cent per annum " so as to read as follows :

All taxes assessed in each year shall be paid on or before the first day of November in the same year and on all such taxes as shall not be paid on or before said day, interest shall be charged at the rate of six per cent per annum. In all cases where the tax bills are not paid at the time specified above, it shall be the duty of the Collector forthwith to issue a summons to each delinquent and if such delinquent does not pay the amount of his tax within fourteen days after the issuing of the summons, the Collector shall forthwith proceed to collect the amount due in manner provided by law and the Collector shall be authorized to use all means of collect- ing taxes which the Town Treasurer, when appointed Collector, may use.
Section 15 of Chapter 6 : By striking out the words "except county tax" in the third line thereof, so as to read as follows :
Every collector shall pay over to the Town Treasurer all taxes by him collected, at least once in each week, until the collection is completed.
ART. 14. To see if the Town will vote to sell the Chemical Fire Engine now stationed at Phillips Beach, and purchase an Auto Chemical Engine to take the place of the old one.
ART. 15. To see if the inhabitants of the Town of Swamp- scott will vote to ratify, confirm supplement and amend the vote of the Town passed at the Special Meeting on Tuesday, the first day of November, A. D., 1910, which was as follows :
"That the report of the Committee on School-houses and School-house sites be accepted and their recommendations be adopted ; that the Board of Selectmen be and hereby are directed and instructed to proceed as provided by law to make a taking of the land therein described, and that the Committee be instructed to procure plans and estimates both for an eight and a sixteen- room school-house and report at the next Town Meeting." And now vote to take in fee the following described parcels of land. bounded and described as follows :-

First : A certain parcel of land with the buildings thereon, situate at the corner of Redington street and Mapledale place in said Swampscott, belonging now or formerly to Clarence B. Delano, bounded southerly by Redington street · eighty-four and 8-100 feet ; southeasterly by a curved line at the junction of said Redington street and Mapledale place seventeen and 45-100 feet ; easterly by Mapledale place seventy-eight and 8-100 feet ; northerly by land now or for- merly of Lottie M. Delory, about ninety-four feet ; westerly by land now or formerly of Samuel M. Kehoe, eighty-two feet. Said land is shown as Lot A on a plan to be herein- after mentioned.
Second : A certain parcel of land situate on Mapledale place in said Swampscott, belonging now or formerly to Lottie M. Delory and bounded and described as follows : Easterly by Mapledale place one hundred and twenty feet : northerly by land now or formerly of H. Scott Tuttle about ninety-four feet; westerly by land now or formerly of Samuel M. Kehoe, about one hundred and twenty feet ; southerly by land now or formerly of Clarence B. Delano about ninety-four feet. Said land is shown on Lot "B" on the aforesaid mentioned plan.
Third : A certain parcel of land situate on Redington street in said Swampscott, belonging now or formerly to Samuel M. Delano and H. Kehoe, one hundred fifty-nine and 68-100 feet ; northeasterly by land now or formerly of Essex Land Trust about twenty- six feet ; northeasterly, northerly and northwesterly by a curved line having a radius of twenty-five feet and bounded on land of the Essex Land Trust about sixty-five feet ; northwesterly by a curved line having a radius of twenty- one feet and still bouuding on land of said Essex Land Trust about twenty feet; northwesterly by a straight line thirty feet from and parallel to first mentioned line, and bounded on land now or formerly of Essex Land Trust, about one hundred feet ; southwesterly by Sheridan road about thirty-one feet ; said land includes Sheridan road terrace and lot "D" as shown on the aforesaid mentioned plan.
All of said land is shown on a plan drawn by F. H. East- man, Town Engineer, dated December 12, 1910, and on file at the office of the Selectmen of the Town of Swamp- scott, and is entitled "Plan of land in Swampscott, Mass., for the purpose of erecting thereon a building to be used for a public school.

ART. 27. To see if the Town will vote to appropriate the unexpended balance of $800.00 for the construction of Banks Road, section two, as recommended by the Selectmen.
ART. 28. To see if the Town will vote that all unexpended balances, Feb. 1, 1911, revert to the Treasury, and that all money expended by each department between Feb. 1, 1911 ·to March 20, 1911 be charged to this year appropriations as recommended by the Selectmen.
ART. 29. To see if the Town will vote to place an incan- descent light on Monument avenue, near Hardy road, and appro- priate money for the same, as petitioned for by William H. Bates and others.
ART. 30. To see what action the Town will take to erect and maintain an electric street light on Humphrey street corner of Harrison avenue, and appropriate money for the same as peti- tioned for by Fred E. Wheeler, and others.
ART. 31. To see if the Town will vote to construct a gran- olithic sidewalk on the south side of Elmwood road from a point opposite the estate of Mercena J. Proctor to a point opposite the estate of Sasette J. Luther, to be paid for out of the continuous sidewalk appropriation and assess the abutters for one-half the cost of same, as petitioned for by Fred L. Tarr and others.
ART. 32. To see what action the Town will sake in relation to taking a certain plot of land on the northerly side of Essex street for park purposes, and appropriate money for the same as petitioned for by Martin L. Quinn, and others.
ART. 33. To see what action the Town will take toward granting an increase of twenty-five cents per day to all employees of the Highway, Moth, Water and Sewer Departments as petitioned for by John A. Finnegan and others.

ART. 34. To see what action the Town will take toward granting an increase for double teams to $5.50 and for single teams to $4.00 per day, as petitioned for by George W. Curtis and others.
ART. 35. To see what action the Town will take in relation to the proper observance of the Fourth of July, and appropriate money for the same, as petitioned for by Martin L. Quinn and others.
ART. 36. To see what action the Town will take toward petitioning the Metropolitan Park Commissioners to extend the boulevard from the Monument to Atlantic avenue, as petitioned for by W. L. Fay and others.
ART. 37. To see if the Town will vote to instruct the Board of Park Commissioners to ascertain if the Phillips swamp prop- erty on Humphrey street, bounded on the east by land of Curtis et al. and on the west by the Ocean House property, can at this time be purchased for a public playground, and if not, authorize them to make a taking of this property according to law under the Park Act, and appropriate money for the same, as petitioned for by William P. Bergin and others.
ART. 38. To see what action the Town will take in relation to purchasing land on Rock avenue owned by Ellen A. Collins and appropriate money for the same, as petitioned for by Martin L. Quinn and others.
ART. 39. To see if the Town will appoint a committee to consider the advisability of and formulate plans for, increasing the width of Humphrey street between the Monument and the Fish House, and report to the Town not later than the next Annual Town Meeting, as recommeded by the Selectmen.
ART. 40. To see what action the Town will take in relation to increasing the salary of the Collector of Taxes to $600 per year and appropriate money for the same as petitioned for by Martin L. Quinn and others.

ART. 41. To see what action the Town will take in regard to granting the members of the permanent Police Department of the Town, one day off in fifteen with pay, as petitioned for by Elward A. Maxfield and others.
ART. 42. To see what action the Town will take, if any, toward granting a Saturday half holiday with pay for the High- way, Water, Sewer, Health and Moth Departments, for the months of April, May, June, July, August and September, as petitioned for by John B. Cahoon and others.
ART. 43. To see what action the Town will take in relation to building a ten or twelve room school building on the present school-house site on Redington street, taking the additional land necessary for the same, and appropriate money for the same, as petitioned for by Martin L. Quinn and others.
ART. 44. To see if the Town will appropriate the sum of $500.00 for the painting and repairing of the Town Hall, as recommended by the Selectmen.
ART. 45. To see if the Town will vote to have Granolithic sidewalks put in place in the public streets in Swampscott on the same terms as tar concrete sidewalks have been put in in past years, namely : The Town to pay one-half of the expense and the abutters to pay the other one-half, and to make an appro- priation for the same, as petitioned for by M. McDonough and others.
ART. 46. To see if the Town will appropriate the sum of $8,500.00 for Sewer Construction as recommended by the Water and Sewerage Board.
ART 47. To appropriate and raise by borrowing or other- wise such sum or sums of money as may be necessary for all or any of the purposes mentioned in the foregoing articles.
