ART. 25. To see if the Town will vote to accept that portion of Banks road, so called, as laid out by the Selectmen, and shown on plan, Section 2, drawn by Eastman & Bradford, Civil Engineers, dated September 18, 1908, and filed with the Town Clerk, October 2, 1908, as soon as the waivers are signed, appropriate money for the same, and authorize the Treasurer with the approval of a majority of the Selectmen to borrow money to meet said appropriation.

ART. 26. To see if the Town will by vote authorize the borrowing of ten thousand dollors ($10,000) or such other sum as it may be expedient to borrow or expend for the purpose of laying and connecting drains and sewers within the streets and ways of the Town under Chapter 86, of the Acts of 1902, and under Chapter 401 of the Acts of 1903, or under either of said acts, the sum so borrowed to be used for such of the purposes authorized by either of said acts as the Town may by vote direct, and to rescind if deemed necessary, the vote heretofore passed authorizing the borrowing of three thousand dollars ($3,000) upon the vote of the Town, and another vote authorizing the borrowing of ten thousand dollars ($10,000) upon the bonds of the Town, which note and bonds have not been issued, as petitioned for by the Sewer Commissioners.


ART. 27. To see if the Town will by such vote or votes as may be necessary, and appropriate, authorize the issuing of bonds for any sum authorized to be borrowed under the last pre- ceding article, and if so, to prescribe the form, terms and condi- tions, of such bonds, the time for which they shall run, the rate of interest thereon, and pass any other vote necessary to enable the Town to issue and sell such bonds, as petitioned for by the Sewer Commissioners.


ART. 28. To see if the Town will accept the plan prepared by F. H. Eastman, Town Engineer, under the direction of the Sewer Commissioners, defining Section 3, in accordance with Chapter 401, Acts 1903 and instruct the Sewer Commissioners to assess the average price per foot on all sewer and drain con- nections in said Section 3, as petitioned for by the Sewer Com- missioners.


ART. 29. To see if the Town will vote to construct a sewer in Farragut road near the residences of Alex. McC. Currier and Sarah P. and Harriet F. Wyzanski and appropriate money for the same, as petitioned for by Alex. McC. Currier and others.

To see if the Town will authorize the Board of Sewer Commissioners to have constructed a sewer from Burrill street, through Monument avenue to Elmwood road and through Elmwood road to a point opposite the property of William G. Earp, and to appropriate money for the same, as petitioned for by William G. Earp and others.


ART. 31. To see if the Town will construct a sewer for con- tinuation on Redington street, through Highland to King street, and appropriate money for the same, as petitioned for by Fred W. Newcomb and others.

To see what action the Town will take, if any, to install a compressed air whistle to take the place of the steam fire whistle now in use and appropriate money for the same, as petitioned for by the Board of Fire Engineers, and to authorize the Treasurer, with the approval of a majority of the Selectmen to borrow whatever amount may be necessary to meet said appropriation.

ART. 49. To see what action the Town will take with rela- tion to the recommendation of the Park Commissioners, as con- tained in the Annual Report, January 31, 1910, of the Town, pages 143, 144, 145 and 148.


ART. 50. To see if the Town will appropriate the sum of $450 to issue the Assessors' Valuations of Estates in accordance with Chapter 3, Section 7 of the Town By-Laws.

ART. 6. Voted, unanimously, that for the purpose of pro- curing a temporary loan to, and for the use of the Town, in anticipation of the taxes of the present year, the Town Treasurer is hereby authorized and directed to borrow from time to time with the approval of a majority of the Board of Selectmen, a sum or sums in the aggregate not to exceed $125,000, and to execute and deliver the note or notes of the Town therefor, pay- able within one year from the time the loan is made, and any debt or debts incurred by a loan or loans to the Town, under this vote shall be paid from the taxes of the present year.


ART. 7. Mr. W. W. Johnson moved to amend Article 7, by striking out words "duly authenticated " and add after word " Town " " bearing the authenticating certificate of the Old Colony Trust Co. of Boston, Mass." so making article read as follows :


To see if the Town will authorize and direct the Treasurer, with the approval of a majority of the Selectmen to borrow money upon the notes of the Town, bearing the authenticating certificate of the Old Colony Trust Company of Boston, Mas- sachusetts, to meet the appropriations voted at the Annual Meet- ing for nineteen hundred, and ten (1910) or any adjournment thereof. Carried


Voted, to lay Article 7 upon the table as thus amended.


ART. S. Voted, that the Town Treasurer's bond be $15,000.

Voted, as recommended on page S5 of said report, that in future all sidewalks which the abutters pay a portion of the cost, be laid under the continuous Sidewalk Act, that the recon- dations on page S6 of said report. relating to Street Signs, and that on page S7 relating to providing more suitable quarters for the Library, be referred to the Ways and Means Committee. and that those on page 93 be thus referred together with Article 20.


Voted, to refer Articles 23, 24, 25, 26 and 27 to Ways and Means Committee.


ART. 28. That the Town hereby accept Section 3 as out- lined in the report of the Sewer Commissioner filed with the Town Clerk, and as outlined upon the plan referred to in said report and filed with the Town Clerk, and that within said Section 3 the Sewer Commissioner shall determine the average cost for such connecting sewers and drains upon the estates benefited, and when so assessed by the Sewer Commissioners, such assessment shall constitute a lien upon the property thus benefited in the same manner as other sewer assessments in accordance with Chapter 401 of the year 1903.

Adjourned Annual Town Meeting April 20, 1910.


Meeting called to order at 7.45 P. M. by the Moderator. Records of last meeting read and declared approved. Mr. Walter W. Johnson, Chairman of the Ways and Means Com- mittee, read and submitted their report upon the recommenda- tions of the several Boards, and the Articles of the Warrant which had been referred to them.


Mr. Moderator and Gentlemen :


Your Committee find that the financial condition of the Town is in a satisfactory condition. We have notes amounting to $14,945 due this year against $12,000 last year, and are pleased to note that with the exception of Removal of Snow, the depart- ments have kept very close within their appropriation. The over-draft in department of Removal of Snow a year ago was $162.39, while this year it is $1,038.74, accounted for by the severe storms during the winter. Your departments report to our Committee that they have no outstanding bills unpaid.


For our fixed items from recommendation of Selectmen we recommend the following amounts be appropriated.

Article 12.


We recommend the salaries as last year except as follows :


Chief of Fire Department raise from $18 to $21 per week.


Engineer of steamer from $16.50 to $18 per week. Two Captains from $50 to $60 per year.


Two Lieutenants from $50 to $55 per year.


Two Assistant Engineers from $50 to $75 per year.


Raise the Policeman to $18 per week and that $624 be added to appropriation for Police Department.


Articles 16 and 17.


There being no one stated in these warrants to advocate them or to vouch for them as specified in Section 4 of Chapter 2 of By-Laws, we recommend no action be taken on these articles.

Article 18.


Your Committee have devoted considerable time to this Article, and while we are convinced a new school-house is a necessity, yet we are not satisfied that the present location, even with the additional land, is the proper site for a sixteen room school, and we would recommend that a Committee of four be appointed by the Moderator to act in connection with School Committee to inquire into different locations, the cost of same, also whether a two eight room one sixteen room school would be better, the cost of same and report to a Town Meeting to be called by them.


Article 19.


We have visited the Phillips School, and have heard all the arguments and suggestions offered, and are of the same opinion as the Ways and Means Committee of last year and recommend no action be taken at this time.


Article 20.


In our report on this Article, we wish it distinctly understood that we do not believe there is anything wrong in our finances, but as there is a great deal of criticism about Town accounts in the state, we believe it to be policy, not only for the good of the Town's standing and credit, but that we are not afraid to have an expert examine our books and tell us how we can improve in our bookkeeping, and therefore recommend the adoption of this Article and appropriate $300 for same.


Article 22. Pages 78 and 86 are answered in Articles 5 and 47.


Page 87. Your Committee find the library to be in a crowded condition as stated, and see no objection to a committee being appointed as requested, and therefore recommend its adoption, and said committee report at next Annual Meeting.


Page 93. This matter of duplicate invoices would naturally be looked into by an expert accountant, if the Town decide to engage one, and we therefore recommend it be referred to him.

Article 23.


We recommend the acceptance of this article, and appropriate $150 to be borrowed, and Town Treasurer be authorized to issue a note for same, with approval of Board of Selectmen.


Article 24.


We recommend the acceptance of this Article, and appropri- ate $100 to be borrowed, and Town Treasurer be authorized to issue a note for same, with approval of Board of Selectmen.


Article 25.


We recommend the acceptance of this Article, and appropriate $800 to be borrowed, and Town Treasurer be authorized to issue a note for same, with approval of Board of Selectmen.


Article 26.


We recommend both the votes in this Article be rescinded.


Article 27.


We recommend the Town authorize the Town Treasurer to borrow the sum of fourteen thousand dollars by issuing bonds for the purpose of laying and connecting drains and particular sewers within streets and ways of Swampscott, and for any and all the purposes set forth in Chapter 86 of the Legislative Acts of 1902, such bonds to be issued under authority granted said Town by Chapter 401 of the Acts of the year 1903 entitled " An Act to authorize the Town of Swampscott to make an Additional Sewerage Loan, and to construct particular sewers in any street or way," and that coupon bonds of the Town to said amount of fourteen thousand dollars ($14,000) be forth- with issued dated May 1, 1910; that each bond be of the denom- ination of one thousand dollars ($1,000) payable in gold coin, numbered respectively from one to fourteen, marked Series H ; that the bond numbered one be payable May 1, 1922, and that one of the other bonds shall be payable in their numerical order

Said bonds shall have the right of exchange for registered certificates of one thousand dollars ($1,000) and shall bear interest at the rate of four per cent (4 per cent) per annum, payable semi-annually at Old Colony Trust Company, Boston, Mass., and shall be signed by the Treasurer of the Town and countersigned by the Water and Sewerage Board, and each of said bonds shall bear on the face thereof, the words, "Town of Swampscott, Sewerage Loan, 1910," and that the Treasurer is hereby directed to affix to each of said bonds the Seal of the Town, and to sell or negotiate said bonds, but not below par, and that the proceeds realized from the sale of said bonds shall be applied to defraying the expenses and liabilities incurred by the Town in carrying out the provisions of said Chapter 401 of the Legislative Acts of the year 1903, said bonds to bear authen- ticating certificate of the Old Colony Trust Company, Boston, Mass. Said bonds shall be sold under direction of Town Treasurer, either at public or private sale.
