Voted to take up Articles 4 to 8 inclusive.


Voted, as recommended by the Finance Committee, be accepted and adopted as follows: Article 4, to require of the Town Treasurer a bond of $30,000; Article 5, to require of the Collector of Taxes a bond of $20,- 000; Article 6, to require of each member of the Water and Sewerage Board, a bond of $6,000; Article 7, to require of the Town Clerk a bond of $1,000; Article 8, that the salaries of town officials remain the same as last year.


Voted, that Articles 10, 11, 12 and 13 be taken up together under Arti- cle 17, as recommended by the Finance Committee.


Voted, Article 14. That the report of the Finance Committee be ac- cepted and the recommendations be adopted as follows: That the grounds at the easterly end of Blaney's Beach Reservation, opposite Orient court, be cleared of rubbish, and the Park Board endeavor to prevent the same from being a dumping and storage place; that the town way leading from Puritan road to said reservation be made more passable, the fence repaired and painted where necessary and a board barrier be placed at one or two places where necessary to prevent sand blowing, and that the sum of $100 be appropriated for the foregoing; that the drain leading from Orient court to the easterly end of said town way be discontinued, and the drainage at this point be carried to the cement culvert.


Voted, Article 15 be taken up under Article 28, as recommended by the Finance Committee.


Voted, Article 16. That the report of the Finance Committee be ac- cepted and the several recommendations be adopted as follows: That the unexpended balances from appropriations from water mains on Morton and Francis roads, Lawrence terrace, Elmwood road, Bradlee and Frank- lin avenues, amounting in all to $974.65, be transferred to the Water Emergency Fund; that the unexpended balance from the amount appropri- ated in 1922 for construction of the Cherry street sewer, said balance amounting to $1,433.81, the unexpended balance from Hillcrest circle sewer, said balance amounting to $44.89, be transferred to the Sewer Emergency Fund, to be used by the Water and Sewerage Board, so far as practical, in construction of sewers voted by the town in any year where the amount appropriated is less than the cost, or for such other purposes as the town may vote.


Voted, Article 17. To accept the report and adopt the recommendations of the Finance Committee as follows: That Essex street be reconstructed with cement from the end of the cement road near the freight station to the Salem line, and that for the town's share of the expense the sum of twenty-four thousand dollars ($24,000) be appropriated therefor, to be raised by votes or bonds of the town, upon condition, however, that the Division of Highways on behalf of the Commonwealth and the County Commissioners on behalf of the County of Essex, each contribute one- fourth of the expense therefor, the work to be done in accordance with specifications approved by the Division of Highways. (Unanimous.)


Voted, Article 17, 2nd section. To accept the report and adopt the rec- ommendations of the Finance Committee as follows: That the town con- struct jointly with the City of Lynn, a concrete culvert over Stacey brook, from the end of the present culvert, at New Ocean street, northerly, a distance of about 570 feet, to the Lynn culvert, the total expense not to exceed twenty thousand dollars ($20,000), said expense to be borne equally between the Town of Swampscott and the City of Lynn, and that for the town's share of said expense the unexpended balance from the 1922 Stacey Brook Construction Fund, which amounts to $4,771.16, be used and in addition thereto that the town appropriate the sum of five thou- sand dollars to be raised by notes or bonds of the town, and that the Board of Selectmen be authorized to enter into a contract jointly with the City of Lynn for carrying out of the purposes of this contract, proper waivers from owners of property upon or through which said work is to be done to be first obtained, if in the opinion of said Board the same are necessary for the protection of the town. (Unanimous.)

Voted, Article 18. The report of the Finance Committee be accepted and the recommendation be adopted; that the town appropriate the sum of $900 to be expended by the School Committee for the purpose set forth in this article.

The report of the Finance Committee be accepted and adopted as follows :- That the Selectmen be authorized to take by right of eminent domain for school purposes the premises described in Article 19, and that the sum of $6,000 be appropriated therefor, to be raised by notes or bonds of the town. Voted, Article 20. To accept the report and adopt the recommendation of the Finance Committee, that the town place a fire alarm box at the junction of Sheridan and Elmwood roads, and the sum of $225 be ap- propriated for the same.


Voted, Article 21. To accept the report and adopt the recommenda- tion of the Finance Committee: That the town transfer from Excess and Deficiency the sum of $3,541.59 to care for the overdrawn appropriations carried forward to 1923 by authority of the Department of Corporations, Division of Accounts.


Voted, Article 22. To accept the report and adopt the recommenda- tions of the Finance Committee as follows: That the town accept said bequest under said will, and that the Board of Selectmen be authorized to erect a chapel as therein set forth, provided and upon the condition, however, that upon a design being chosen by said Augustine H. Rich and upon specifications being made and bids called for, bids are received from responsible persons and the Board of Selectmen thereupon deter- mine that such chapel can be erected complete, including any and all heating, ventilating, lighting, seating, grading or any other equipment or fixtures that may be necessary, and including all architect's fees or other expense in connection with such erection, within the amount avail- able under said bequest; and provided that no work shall be done by the town or contract made until said money has been paid over to it; and that in case the Board of Selectmen then determine that said chapel complete and fully equipped cannot be erected within the amount so available, that they thereupon report the matter again to the town to see what further or other action the town will take. This vote and rec- ommendation thereon shall in no way authorize said Rich to bind the town, engage architects or agents in its behalf, create indebtedness against it, or act as its agent.


Voted, Article 23. To accept and adopt the report and recommenda- tion of the Finance Committee, that the town not accept the bequest of $150.


Voted, Article 24. To accept the report of the Finance Committee and adopt their recommendations as follows: That a six-inch water main be laid in Sherwood street, Bond street and Fuller avenue for a distance of about 1,200 feet, and that the sum of $4,000 be appropriated there- for, to be raised by notes or bonds of the town, interest at the rate of six per cent, to be paid on the investment until the water rates of the users are equal to the interest thereon, proper waivers to be obtained from abutters, if in the judgment of the Water and Sewerage Board waivers are necessary for the protection of the town. (Unanimous.)


Voted, Article 25. To accept the report and adopt the recommenda- tions of the Finance Committee as follows: That the Surveyor of High- ways be authorized to purchase a fourteen ton road roller with scarifier and to dispose of the present road roller, in exchange or otherwise, and that the sum of fifty-three hundred dollars ($5300) be appropriated therefor. (Unanimous.)


Voted, Article 26. To indefinitely postpone action under this article as recommended by the Finance Committee.


Voted,. Article 27. To accept the report and adopt the recommenda- tions of the Finance Committee as follows :- That the town build a curb on the north side of Humphrey street, from Phillips Beach station to Forest avenue, for a distance of about twelve hundred (1200) feet, and that the sum of $2,900 be appropriated therefor, waivers from abutters first to be obtained.


Voted, Article 28. To accept the report and adopt the recommenda- tions of the Finance Committee that the Surveyor of Highways be au- thorized to purchase plows and road machines for the Highway Depart- ment and that the sum of one thousand dollars ($1,000) be appropriated therefor.

Voted, Article 30. That the town accept Mountwood road, as laid out on a plan made by W. W. Pratt, Town Engineer, dated 1922, and appro- priate five hundred dollars ($500) therefor when the proper waivers have been signed.


Voted, Article 31. To accept the report and adopt the recommenda- tion of the Finance Committee as follows: That the town accept Roy street as laid out on a plan made by W. W. Pratt, Town Engineer, dated December, 1922, and appropriate three hundred dollars ($300) for same, after the waivers have been signed.


Voted, Article 32. To accept the report and adopt the recommenda- tions of the Finance Committee as follows: That the private way, known as Burpee road, and the private way, known as Bertha street, as laid out on a plan drawn by W. W. Pratt, Town Engineer, dated February, 1921, be accepted and the sum of $5,200 be appropriated therefor, provided and upon condition that such acceptance shall take effect and such ap- propriation be expended only in case, within 90 days from the date of this vote, the Board of Selectmen call for and receive a bid or bids for the construction of a suitable roadway for the entire length of said Burpee road and Bertha street at an expense not to exceed $5,200, and enter into a contract therefor, and that proper waivers are signed by abutters. (Unanimous.)


Voted, Article 33. To accept the report of the Finance Committee and adopt their recommendations, as follows: That the town accept Phillips Circle as laid out on a plan made by W. W. Pratt, Town Engineer, dated December, 1922, and appropriate the sum of $300 therefor, proper waiv- ers first to be obtained from abutters.


Voted, Article 34. To accept the report of the Finance Committee and adopt their recommendations: That the town accept Bradlee avenue, as laid out on a plan made by W. W. Pratt, Town Engineer, and appropriate the sum of five hundred dollars ($500) therefor, proper waivers to be first obtained from abutters.


Voted, Article 35. That the town accept Palmer avenue, so-called, from Humphrey street to Orchard road, when waivers have been signed.


Voted, Article 36. That the town accept Orchard road, from Palmer avenue to Humphrey street, after proper waivers have been signed.


Voted, Article 37. That action under this article be indefinitely post- poned, as recommended by the Finance Committee.

To accept the report and adopt the recommenda- tions of the Finance Committee as follows: That the town lay a sewer in Claremont terrace for a distance of 300 feet to connect private sewer al- ready laid across the town's sewer easement to the main sewer, and that the owner of said private sewer be reimbursed for part of the cost of the same, and that the sum of $425 be appropriated for same.


Voted, to take up Articles 41, 42 and 43 jointly.


Voted, to accept and adopt the reports and recommendations of Articles 41, 42, 43 jointly and severally by the Finance Committee.


Voted, Article 41. That the town build a sewer in Humphrey street, from the Palmer school to Palmer avenue, a distance of about 700 feet, and that the sum of $6,000 be appropriated therefor, to be raised by notes or bonds of the town. (Unanimous. )


Voted, Article 42. That the town extend the present sewer from the corner of Palmer avenue and Humphrey street about 250 feet east on Humphrey street, and that the sum of $1,800 be appropriated therefor, to

be raised by bonds or notes of the town, as recommended by the Finance Committee. (Unanimous).


Voted, Article 43. That the sewer in Mountain avenue be extended a distance of about 270 feet from Beach avenue, and the sum of $1,200 be appropriated therefor, to be raised by notes or bonds of the town, as recommended by the Finance Committee. (Unanimous.)


Voted, Article 44. To accept the report and adopt the recommendations of the Finance Committee as follows: That the town sell to E. R. Grabow Company, Inc., for the sum of $500, the parcel of land described in this article, and that the Water and Sewerage Board be authorized to execute, acknowledge and deliver a deed in conformance with this vote.


Voted, Article 48. That action on this article be indefinitely postponed, as recommended by the Finance Committee.


Fifteen voters requested that the matter of construction and enclosing of double tennis courts on Abbott Park, calling for an appropriation, be placed upon a ballot in accordance with the town by-laws, the question being: Shall the town appropriate $1,200 for construction and enclosing double tennis courts on Abbott Park? The Finance committee recom- mended indefinite postponement of action under Article 49.


Fifteen voters requested that the matter of purchase and installation of portable bleachers for Jackson Park and Phillips Park, calling for an appropriation of $2,000, be placed upon a ballot in accordance with the town by-laws, the question being: Shall the town appropriate $2,000 for the purposes stated in Article 50? The Finance Committee recom- mended that action on this article be indefinitely postponed.


Fifteen voters requested that the matter of playground activities, in- cluding the purchase of equipment calling for an appropriation of $2,200, be placed upon a ballot in accordance with the town by-laws, the question being: Shall the town appropriate $2,200 for the purposes stated in Ar- ticle 51? The Finance Committee recommended that action on this article be indefinitely postponed.


Voted, the committee appointed by the town at the adjourned meeting held February 20, 1923, in accordance with the recommendation of the Park Commissioners on pages 155 and 156 of the town report for the year ending December 31, 1922, to consider the matter of acquiring additional land adjacent to Jackson Park, be accepted as progress, and that the committee be continued in power, and be instructed to make a further report to the next special town meeting.


Voted, Article 52. That the Moderator appoint the Fourth of July Committee.


Voted, Article 55. For the purposes specified in Article 17, relating to the recommendation of the Board of Selectmen concerning the appropria- tion of $24,000 for the reconstruction of Essex street to the Salem line, that the Treasurer, with the approval of the Selectmen, be authorized to borrow a sum not to exceed $24,000, and to issue bonds or notes of the town therefor; said bonds or notes to be signed by the Treasurer and countersigned by a majority of the Selectmen, and shall be issued and payable in accordance with the provisions of Clause 7, of Section 7 and Section 19 of Chapter 44 of the General Laws, so that the whole loan shall be paid in not more than ten years from the date of the issue of the first bond or note or at such earlier dates as the Treasurer, with the approval of the Selectmen, may determine; said bonds or notes shall be denominated on the face thereof "Essex Street Loan, 1923," and shall bear such rates of interest as may be fixed by the Treasurer, with the ap- proval of the Selectmen; provided, however, that the adoption of this recommendation shall not become operative, and no money shall be bor- rowed thereunder until the Board of Selectmen are satisfied that one- fourth of the expense of said work shall be borne by the Commonwealth of Massachusetts through the Division of Highways and one-fourth thereof by the County of Essex through the County Commissioners, and provided, further, that the work shall be done in accordance with specifications ap- proved by the Division of Highways. (Unanimous.)

That for the purposes specified in Article 17, which relates to the rec- ommendation of the Board of Selectmen that the town act jointly with the City of Lynn in building a concrete culvert over Stacey Brook, from the end of the present culvert northerly, a distance of about five hundred seventy feet to the Lynn culvert, that the Treasurer, with the approval of the Selectmen, be authorized to borrow a sum not to exceed five thou- sand dollars and to issue bonds or notes of the town therefor; said bonds or notes to be signed by the Treasurer and countersigned by a majority of the Selectmen and shall be issued and payable in accordance with the provisions of Clause 1, of Section 7 and of Section 19 of Chapter 44 of the General Laws, so that the whole loan shall be paid in not more than thirty years from the date of the issue of the first bond or note, or at such earlier dates as the Treasurer, with the approval of the Selectmen, may determine. Said bonds or notes shall be denominated on the face thereof "Stacey Brook Culvert, 1923," and shall bear such rates of interest as may be fixed by the Treasurer with the approval of the Selectmen; provided, how- ever, that this recommendation shall not become operative and no money shall be borrowed thereunder until the Board of Selectmen has made a. satisfactory arrangement with the City of Lynn, whereby said city shall bear one-half of the expense of the construction of said culvert. (Unani- mous.)


That for the purposes specified in Article 19, which relates to the tak- ing of certain land, with the buildings thereon, located in Redington street and owned by the trustees of the First Methodist Church, and the taking of another lot of land in the rear thereof owned by Isaac W. Chick, that the Treasurer, with the approval of the Selectmen, be authorized to borrow a sum not to exceed six thousand dollars, and to issue bonds or notes of the town therefor ; said bonds or notes to be signed by the Treas- urer and countersigned by a majority of the Selectmen and shall be issued and payable in accordance with the provisions of Clause 3, of Section 7 and Section 19 of Chapter 44 of the General Laws, so that the whole loan shall be paid in not more than twenty years from the date of the issue of the first bond or note or at such earlier dates as the Treasurer, with the approval of the Selectmen, may determine. Said bonds or notes shall be denominated on the face thereof "Hadley School Loan 1923" and shall bear such rates of interest as may be fixed by the Treasurer with the approval of the Selectmen. (Unanimous.)


That for the purposes specified in Article 24, which relates to the ap- propriation of four thousand dollars for the laying of a six-inch water main in Sherwood street, Bond street and Fuller avenue, for a distance of about twelve hundred feet, that the Treasurer, with the approval of the Selectmen, be authorized to borrow a sum not to exceed four thousand dollars and to issue bonds or notes of the town therefor; said bonds or notes to be signed by the Treasurer and countersigned by a majority of the Selectmen, and shall be issued and payable in accordance with the provisions of Section 19, of Chapter 44 of the General Laws, and Chapter 155 of the Special Acts of 1916, as amended by Chapter 252 of the Acts of 1920, so that the whole loan shall be paid in not more than thirty years from the date of the issue of the first bond or note or at such earlier dates as the Treasurer, with the approval of the Selectmen, may determine. Said bonds or notes to be denominated on the face thereof "Swampscott Water Loan, Act of 1916," and shall bear such rates of interest as may be fixed by the Treasurer with the approval of the Selectmen. (Unanimous. )
