Article 51. To see if the town will vote to appropriate the sum of one thousand one hundred twelve dollars and fifty cents ($1,112.50) to permit the School Committee to give "instruction in the use of English for adults unable to speak, read or write the same, and in the fundamental principles of government and other subjects adapted to fit for American citizenship," in accordance with the pro- visions of Section 9 and 10 in Chapter 69 of the General Laws and Acts in amendment thereof and in addition thereto.

We recommend that the town transfer from Excess and Defi- ciency the sum of $4,062.02 and said fund credited to current revenue for the year 1924.


Article 53. To see if the town will vote to appropriate the sum of one thousand dollars ($1,000) for the settlement of the petitions brought by Moorfield Storey, et als, trustees of the Maria L. Phil- lips estate, for the assessment of damages caused by the taking of certain easements in land belonging to the petitioners, in connection with the building of the eastern intercepting sewer, as recommended by the Water and Sewerage Board.


The sum asked for in this article is considerably less than the original petition. Agreement has been reached to settle for this amount, which, in the opinion of the Town Counsel, is advisable, and we recommend that the sum of $1,000 be appropriated for the pur- pose as set forth in this article.


Article 54. To see if the town will vote to place a fire alarm box on Puritan road near the Catholic Club, and appropriate money for the same, as petitioned for by C. H. Martin, et als.


We recommend that the sum of $200 be appropriated to be ex- pended by the Board of Fire Engineers for the purpose set forth in this article.

Article 55. To see if the town will vote to appropriate money to transport the school children living in the vicinity of Foster Pond district, so called, to the Machon School, as petitioned for by Bertha E. Day, et als.


The purpose of this article is to transport by bus the younger children in this district attending the Machon School. In inclement weather the roads are practically impassable for small children, due to no fault of the town, as they are private ways. We feel that some assistance should be given them in this matter.


The School Department have in their budget the sum of $800 for transportation requirements, a part of which should be used for the purpose of this article.


We recommend that this article be referred to the School Com- mittee.


Article 56. To see if the town will vote to appropriate the sum of twelve hundred dollars ($1,200) for the construction and enclosing of double tennis courts on Abbott Park, as petitioned for by Walter L. Quinlan, et als.


This article, together with Articles 57 and 58, are the same as were placed on the Australian Ballot last year and were rejected by a substantial majority. Considering the decisive opinion as ex- pressed by the citizens of the town in the vote last year, we rec- ommend that action on this article be indefinitely postponed.


Article 57. To see if the town will vote to appropriate the sum of twelve hundred dollars ($1,200) for the purchase and installation of playground equipment, the same to be expended under the joint supervision of the Park Commissioners and the School Committee, in accordance with the provisions of Chapter 217, Section 1, of the General Laws, as petitioned for by Walter L. Quinlan, et als.


We recommend that action on this article be indefinitely post- poned.


Article 58. To see if the town will vote to appropriate the sum of two thousand dollars ($2,000) for the purchase and installation of portable bleachers for Jackson and Phillips parks, as petitioned for by Harold F. Dow, et als.


We recommend that action on this article be indefinitely post- poned.


Article 60. To see if the town will vote to appropriate the sum of one thousand dollars ($1,000) for the celebration of the Fourth of July, and to appoint a committee, consisting of the Park Commis- sioners and four other citizens, to have charge of the celebration, as petitioned for by Alfred F. Frazier, et als.


We recommend that the sum of $500 be appropriated for the pur- pose of this article.

Voted as recommended by the Finance Committee, be accepted and adopted as follows: Article 5, to require of the Collector of Taxes a bond of $20,000; Article 6, to require of each member of the Water and Sewerage Board a bond of $6,000; Article 7, to require of the Town Clerk a bond of $1,000; Article 8, that the salaries of town officials remain the same as last year.


Voted, Article 10. That the recommendation on page 92 for the erection of a new school building be taken up under Article 50 in the warrant. Voted, that the question on page 95 for the appropri- ation of money for supervised play for our children during July and August be indefinitely postponed.


Voted, Article 11. That the report of the Finance Committee be accepted and adopted as follows: that water mains be replaced in Harrison avenue as recommended by the Water Board for a dis- tance of 935 feet and in Maple avenue for a distance of 600 feet, and that the sum of $5,200 be appropriated, said amount to be raised by notes or bonds of the town. (Unanimous.)


That the unexpended balances from appropriations for Forest avenue, Fuller avenue, Rock avenue, and others amounting to $5,248.77 be transferred to the Water Emergency Fund; that the sum of $300 be appropriated to purchase a set of plans for the Sewer Department as outlined on page 117; that the laying of sewers from Humphrey street through Palmer avenue and Orchard road be taken up under Articles 38 and 39 in the Town Warrant; that the unexpended balances from Humphrey street and Moun- tain avenue sewers, amounting to $1,905.57 be transferred to the Sewer Emergency Fund, to be used by the Water and Sewerage Board so far as practical in construction of sewers voted by the town in any year where the amount appropriated is less than the final cost, or for such other sewer purposes as the town may at any time vote; the remaining matters on pages 117 and 120 to be taken up under Article 17.

Voted, Article 17, 2nd Section. That the report of the Finance Committee be accepted, and their recommendations be adopted as follows: that the town construct jointly with the city of Lynn a concrete culvert over Stacey brook from the end of the present culvert at New Ocean street, northerly for a distance of about 570 feet to the Lynn culvert, the expense to be borne equally between the town of Swampscott and the city of Lynn; and that for the town's share of said expense the sum of $9,500 be appropriated, of which the sum of $4,500 shall be raised in the tax levy of the cur- rent year and the sum of $5,000 be raised by notes or bonds of the town. (Unanimous.)

Voted, Article 19. To accept the report of the Finance Commit- tee, and adopt their recommendations as follows: that the town rescind the vote passed April 3, 1923, at the adjournment of the an- nual town meeting under Article 19 whereby the town voted to borrow the sum of $6,000 and to issue bonds or notes of the town, but that otherwise said vote remain in effect; and that in lieu of the said $6,000 the town now appropriate to be raised by taxation the sum of $7,210 to effect a settlement with the trustees of the Methodist Episcopal Church in full for all damages and interest by virtue of said taking and the sum of $700 be raised by taxation to cover the damages awarded to Isaac W. Chick under said taking. It is not intended by this recommendation or any vote hereunder to effect or in any way invalidate said takings.


Voted, Article 20. That the town accept the report of the Finance Committee, and their recommendations be adopted as follows: that the town rescind the vote taken April 3, 1923, appropriating $5,000 for the purpose set forth in this article.


Voted, Article 21. That the town accept the report of the Finance Committee, and their recommendations be adopted: that the vote taken April 3, 1923, authorizing the town to borrow the sum of $24,000 for the purposes set forth in Article 21 be rescinded.

To accept the report of the Finance Committee, and their recommendations be adopted : that the town accept Orchard circle, formerly called Palmer avenue extension, as laid out on a plan made by W. W. W. condition that the Massachusetts Highway Commission on behalf of the Commonwealth, and the County Commissioners on behalf of the County of Essex, each contribute one-fourth of the expense thereof, the work to be done in accordance with the specifications approved by the Massachusetts Highway Commission. For the town's share of the expense, that the sum of $24,000 be appropriated, of which $4,500 shall be raised in the tax levy of the current year, and $19,500 be raised by notes or bonds of the town, that the Board of Selectmen secure from the Eastern Massachusetts Street Railroad Company, or its representatives, or successors, an agreement to re- pair its present track and raise it to grade using a type of rail and construction satisfactory to the Board, and that all other public serv- ice corporations having rights on or under said portion of Essex street to be notified to install all contemplated, and repair all existing underground construction, before the work is started. (Unanimous.)

SUPPLEMENTARY REPORT


Article 34. To see if the town will vote to build sewers in Aspen road, Arbutus road, Sargent road, Prospect avenue, Ocean View road, Millett road, Wyman road and Forest avenue, for a distance of about six thousand feet (6,000'), and appropriate money for the same, as petitioned for by James C. Soutter, et als.


From the report of the Board of Health, it is evident that this section of the town is badly in need of sewers: and that a start must be made in the near future.


This will involve a large expenditure of money and at present no comprehensive plan is ready upon which definite estimates can be submitted.


We recommend that a study be made of this section as a whole by the Water and Sewerage Board and Town Engineer and that plans and estimates be prepared. We further recommend that a sewer be laid from the sewer terminal on Millett road, through Millett road, to and through Ocean View road and along Sargent road; and that the sum of $9,000 be appropriated for the same, $8,500 of which to be raised by notes or bonds of the town and $500 to be taken from the Sewer Emergency Fund.

Voted, Article 34. Voted, Article 36. To accept the report of the Finance Committee, and their recommendations be adopted: that the sum of $1,300 be appropriated from the Sewer Emergency Fund for the purpose of this article.


Voted, Article 37. To accept the report of the Finance Committee and adopt their recommendations: that a study of this section be made as a whole by the Water and Sewerage Board and the Town Engineer, and that plans and estimates be prepared.
