ARTICLE 16. To see if the Town will vote to accept Chapter 493 of the Acts of 1959 which provides $100.00 increase to pensioners not now receiving in excess of $1500.00 per year, who retired at age sixty years and had at least twenty years creditable service, or, who at retirement had a minimum of twenty-five years of service, and appropriate the necessary money therefor or take any action relative thereto.

ARTICLE 17. To see if the Town will vote to accept Chapter 121 of the Acts of 1959 amending General Laws, Chapter 32, which added Section 99 per- mitting the Town Treasurer to make advance pension payments to a retired employee in an amount not to exceed any retirement allowance actually due such employee at the time.

ARTICLE 18. To see if the Town will vote to petition the General Court of the Commonwealth of Massachusetts to exempt and remove all part time employees and all appointed town officials from Civil Service status, such action to be effective on its passage.

To see if the Town will vote to authorize the Board of Selectmen and their successors in office to sell at public or private sale any property which the Town has acquired or may hereafter acquire through pro- ceedings based upon non-payment of taxes or under proceedings for the sale of lands of low value upon such conditions, restrictions, and/or reservations as are deemed expedient and are in the best interest of the Town or take any action relative thereto.

ARTICLE 20. To see if the Town will vote to authorize the Board of Selectmen to have all By-Laws and/or Traffic Regulations printed in a single edition and appropriate a sum of money therefor or take any action relative thereto.

II BY-LAWS


ARTICLE 22. To see if the Town will vote to amend the General By- Laws by striking out Article IX and inserting in place thereof the following:


ARTICLE IX


JOB CLASSIFICATION AND SALARY PLAN


Section 1. The Plan


There is hereby established a classification and salary plan, herein- after designated as "The Plan" for the Town of Swampscott, under auth- ority of Section 108a of Chapter 41 of the General Laws, and all other acts thereto enabling, for positions in the service of the Town, classifying certain employees other than those filled by popular election and those under the direction and control of the School Committee, into groups and classes doing substantially similar work or having substantially equal responsibilities.


Section 2. - Classification of Jobs


The Official Classification Plan for positions in the service of the Town shall consist of the classes listed by titles in Section 11 of this Article IX which is hereby made a part hereof.


Section 3. - Personnel Board


(a) There shall be a Personnel Board to administer The Plan, con- sisting of five (5) members. They shall be appointed by the Moderator and Board of Selectmen of the Town of Swampscott. Two (2) members shall be selected from among employees covered by The Plan. The term of members shall be as follows: Two (2) members for three years, two (2) members for two years, and one (1) member for one year. Not later than April 1, of the year in which the term of a member expires, the Moderator and the Board of Selectmen shall appoint his successor.


(b) If a member resigns or his office becomes vacant by his removal from the Town, or other cause, the Moderator and the Board of Select- men shall appoint a successor for the balance of the unexpired term of such member.


(c) The Personnel Board shall administer The Plan and shall estab- lish such procedures as it deems necessary for the proper administration of The Plan.


(d) Forthwith after appointment and thereafter annually, the Board shall meet and organize by electing a Chairman and Clerk. A majority of the Board shall constitute a quorum for the transaction of business. A majority vote of the Board shall determine the action the Board must take on all matters upon which it is authorized or required to pass under The Plan. The Personnel Board may employ assistance and incur expenses as it deems necessary, subject to appropriation of funds therefor. The Personnel Board shall serve without compensation.


(e) The Board shall maintain adequate personnel records of all em- ployees subject to this Plan, said records shall be kept in the custody of the Personnel Board. Department Heads shall provide such information as the Personnel Board shall request.

Section 4. - Adjustment Policy


All regular full time permanent employees in the service of the Town holding positions subject to the classification and compensation plan pro- vided herein shall be eligible for consideration for advancement to the next higher step until such time as the employee is receiving the maxi- mum rate for such position in accordance with the following rules:


(1) Annual Salary Schedule


After serving one year at the minimum and one year in each intermediate step rate until reaching a maximum rate after comple- tion of the 5th year.


(2) Single-Rate Positions


Employees occupying positions for which single rates have been established in the compensation Plan shall not be eligible for step- rate increases.


COMPENSATION PLAN


Section 5. - Salary Schedule


(a) As provided hereinafter, the schedule entitled "Classification and Pay Scales" sets forth the job classification, the grade assigned to it, the minimum step rate and successive step rate increases, concluding with a maximum step rate. Salary range of a group shall be the salary range for all positions classified in such group.


(b) All employees shall continue to be paid on an hourly, weekly, monthly, or other basis, as at present, unless otherwise authorized by the Personnel Board or by subsequent amendment of the Salary Plan.


(c) No board, officer, or head of a department shall fix the salary of any employee in a position so classified except in accordance with such Plan.


(d) No person shall be appointed, employed, or paid as an employee in any position, or permitted to perform duties under any title other than as provided in the Classification and Pay Scales schedule. The job title in The Plan shall be the official title for the position and shall be used in all administrative and employment records.


(e) All employees included in The Plan shall be eligible for reclassi- fication and pay adjustment, subject to the recommendation of the Board or authority having immediate jurisdiction over such employees and the approval of the Personnel Board.


(f) Promotions from minimum to maximum salaries shall be succes- sive steps annually.


The wage or salary established in The Plan for each position shown on the schedule hereinafter provided, will become applicable to each per- son who is an employee immediately upon the effective date of this By- Law.


Overtime compensation shall be paid on the same basis as at present until such time that it is reviewed by the Personnel Board. However, overtime shall not be paid to any employee whose duties include author- ization and approval of overtime pay for subordinates.


Section 6. - Sick Leave and Vacation


Sick leave allowance and vacation pay shall remain in its present status until reviewed by the Personnel Board.

Section 7. - Reserves in Police and Fire


Policemen and Firefighters shall be placed in the next higher step on the day that their regular, plus reserve services, reaches one year.

Reserves in Police and Fire Departments shall be given credit for the equivalent of each year of service prior to appointment. One year of service shall be defined as 260 days of service for which pay was received. A reserve with one year of service shall start at Step Two and a reserve with two years of service shall start at Step Three, etc., when appointed as a regular (permanent appointment ).


Section 8. - Classification of Present Town Employees


An employee promoted to a higher rated position shall enter it at the minimum rate of the range for the appropriate compensation grade; how- ever, if his existing rate is the same or higher than the minimum for the higher rated position, he shall be moved to the next higher step above his present salary.


The Board shall, from time to time. review the salary and wage sched- ules and policies pertaining to the administration of the Classification and pay Plans. It shall keep informed as to pay rates and policies outside the service of the Town. It shall recommend to the Town Meeting any action which it deems desirable in order to maintain a fair and equitable pay level.


Upon recommendation of a Department Head, supported by a writing satisfactory to the Personnel Board, setting forth special reasons and ex- ceptional circumstances, the Board may authorize an entrance rate higher than the minimum rate for a position, and such other variance in The Plan as it may deem necessary for the proper functioning of the services to the Town. No variance shall become effective unless, or until, the necessary funds have been appropriated therefor. The Board shall make an annual report in writing to the Board of Selectmen on, or before, De- cember 31st of each year.


Section 9. - Amendment of the Classification and Pay Plans


(a) The Classification and Pay Plans may be amended in the same manner that other By-Laws may be amended; provided, however, that no amendment shall be made unless a request therefor, in writing and signed by the petitioner, or petitioners, is addressed to and submitted to the Per- sonnel Board, and a copy thereof filed with the Town Clerk.


(b) Upon receipt of such request, the Board shall hold a hearing thereon at which all persons interested shall be entitled to be present and heard. Written notice of such hearing will be given, not less than three days preceding the date thereof, to the petitioner, or petitioners, and to heads of departments and employees affected.


(c) The Board shall, after such hearing, submit a report with recom- mendations to the Annual or to a Special Town Meeting.


(d) The Board may of its own motion, after like notice to all per- sons interested and after a hearing, submit to the Town Meeting a pro- posal for amending the Plans.


Section 10. - Civil Service Laws


Nothing in this By-Law shall be construed to conflict with Chapter 31 of the General Laws of the Commonwealth of Massachusetts.

ARTICLE 23. To see if the Town will vote to amend Article XI of its General By-Laws by striking out the last sentence thereof and substituting therefor the following: "The listing, description and payment of all such fees shall be transmitted to the Town Treasurer within thirty days of receipt of any such fee by such officer."

ARTICLE 24. To see if the Town will vote to amend the General By-Laws of the Town, by inserting therein the following provisions:


ARTICLE XII OVERSIGHT COMMITTEE


Section 1. An Oversight Committee is hereby established, consisting of six (6) members, one (1) member from each precinct.


Section 2. Members of this Committee shall be appointed by the Board of Selectmen, in the first instance, two (2) for terms of one (1) year, two (2) for terms of two (2) years, and two (2) for terms of three (3) years, and their successors shall be appointed for three (3) year terms . Any vacancy shall be filled in like manner by the Selectmen.


Section 3. Members of this Committee shall serve without pay, but shall, subject to an appropriation, be reimbursed for their legitimate expenses.


Section 4. The objectives of this Committee shall be:


(a) To discuss by means of a regularly published quarterly Town Bulletin, made available at the Town Clerk's Office, in mimeographed form, (1) some current administrative practices, that might be improved, (2) possibilities of more clear disclosure of unit-costs in various depart- ments of town government, and (3) other matters related to town economy.


(b) To encourage the citizens to express in the Bulletin, their in- dividual views concerning town government, through "letter-box" com- munications, thereby overcoming at least some public apathy towards town affairs.


(c) To compile significant statistics on town operations, and to supply where practical, comparative figures from other communities, to appear in the Bulletin.

(d) To suggest in the Bulletin, drafts of new by-laws, which would better effectively regulate the operations of the Town, and its several departments.


Section 5. The Committee shall have full authority to carry on its investi- gations, and to inspect and make notations from all papers, contracts, books, etc., of the Town, that appear of value to the Committee, and shall receive the assistance of the department heads in obtaining such data and desired information.

ARTICLE 25. To see if the Town will vote to amend Article III, Section 4, of the Zoning By-Laws, by striking out sub-paragraph 4, as appearing there- in, and inserting in place thereof the following:


4. Advertising signs, as regulated by law and by-laws, but no signs or other advertising devices shall be erected with a display area greater than 60 square feet. However, a display area up to and including 120 square feet in size may be used when the sign is a physical part of the building and designed as part of the architectural decor of the building, provided that such building has a set-back distance from the highway line of at least 75 feet, and provided further that permit for one or more signs is obtained from the Board of Appeals as provided in Article VI, Section 5. ARTICLE 26. To see if the Town will vote to amend Article IX of the General By-Laws to authorize the Personnel Board to classify all temporary and part-time employees of the Town or take any action relative thereto.

ARTICLE 27. To see if the Town will vote to amend Article V of the General By-Laws of the Town by adding the following section:


Section 11. Any vehicle, truck or trailer transporting dirt, soil, sand, small pebbles or stones, or gravel on any Town way, or, way to which the public has access, must have the load properly covered.

ARTICLE 28. To see if the Town will vote to amend Article II, Section 7, of the General By-Laws by striking out the first two sentences thereof and substituting in place thereof the following:


"The meeting may decide to vote by ballot upon any motion properly before it, and, upon the request of twenty or more town meeting members, the meeting shall vote by ballot upon any motion properly before it to amend the recommendation of the Finance Committee. In any such case, the Moderator shall state the question, and the Town Clerk shall prepare and distribute ballots to enable the town meeting members to vote YES or NO upon such question.'

ARTICLE 29. To see if the Town will vote to purchase three-way radio equipment for the Police Department and appropriate the necessary money therefor or take any action relative thereto.

IV PUBLIC WORKS DEPARTMENT


ARTICLE 31. To see if the Town will vote to acquire or take by emin- ent domain certain land lying between the accepted portions of Sherwood Road and Millett Lane for the purpose of laying out said land in order to join and connect said streets as a public way and appropriate the necessary money therefor or take any action relative thereto.

To see if the Town will vote to authorize the Board of Public Works to replace existing water mains and lay new mains of not less than fourteen inches in diameter and for lining such mains with linings of not less than one-sixteenth of an inch and to erect a pumping station equipment and appropriate the necessary funds therefor by transferring from available funds, by borrowing or otherwise, or take any action relative thereto.
