ARTICLE 14. To see if the Town will vote to transfer from the Surplus Reve- nue Account of the Town to the account of Current Revenue a sum of money to be used and applied by the Board of Assessors in the reduction of the tax levy or take any action relative thereto.

To see if the Town will vote to petition the General Court for legislation to allow the Board of Asses- sors to include the following items per- taining specifically to schools in the por- tion of the tax rate labelled "Schools" and remove them from the "General Government" category: principal and in- terest costs of school construction; in- surance costs on school property; group insurance costs for school personnel; and costs of work or services performed spe- cifically for the School Department by all other Town departments.

Voted: The Finance Committee recommended favorable action in the words of the article.


Mr. Blatchford moved to amend by substituting: That the Town vote to authorize and direct the Town Accountant to assemble in a segregated section of his annual re- port to the Town a breakdown sepa- rating all direct and indirect costs applicable to "General Government" and to "Schools".


On Mrs. Klein's motion, the words, "and receipts" were inserted after "costs".


The amended substitution was adopted, and the Town voted: To authorize and direct the Town Ac- countant to assemble in a segre- gated section of his report to the Town a breakdown separating all direct and indirect costs and receipts applicable to "General Government" and to "Schools". Unanimous.

ARTICLE 18. To see if the Town will vote that a general 5% increase in all salaries, retroactive to January 1, 1963, be granted to all full time employees presently employed under the Job Clas- sification and Salary Plan, including Di- vision Superintendents within the Public Works Department, and appropriate the necessary money therefor or take any action relative thereto.

Voted: That the Town grant a general 5% increase in all full time employees presently employed un- der the job classification and salary plan, including division superinten- dents within the Public Work De- partment, five (5) Welfare and Old Age Assistance employees and the Town Clerk and Tax Collector and that the sum of $46,552.03 be appro- priated as follows:


That the sum of $44,064.36 be appropriated from the tax levy.


That the sum of $2,487.67 be transferred from water receipts for the purpose of this article.

Further Voted: On the motion of Mr. Sargent: I move this amend- ment to Item #135, listing salaries in the school budget; that the ap- propriation of $102,725.00 for full time custodial salaries be increased by $5,136.00 to $107,861.00, and the appropriation of $27,685.00 for full time secretarial salaries be increased by $1,000.00 to $28,685.00, making the total for salaries $1,209,281.00 and the total for the budget $1,425,- 066.00.

ARTICLE 19. To see if the Town wil vote to authorize and direct a commit tee of three to consist of the Chairmer of the Election Commissioners, Planning Board, and Selectmen, to restudy exist ing precinct lines, taking into account present and future population trends and submit by June 1, 1963, a recommenda- tion for revision of said lines to th: proper authority, or take any action rela- tive thereto.

Voted: That the Town authorize and direct a committee of three to consist of the Chairman of the Election Commissioners, Planning Board, and Selectmen, to restudy existing precinct lines, taking into account present and future popula- tion trends and submit by June 1 1963 a recommendation for revision of said lines to the proper authority Unanimous.


ARTICLE 20. To see if the Town wil vote to require peddlars to have a Towr license if they do not have a State license since they no longer require a County license.

ARTICLE 22. To see if the Town will vote to petition the General Court for legislation to transfer the office of Town Accountant upon the retirement of the present incumbent to the jurisdiction of the Finance Committee and combine the office with that of the Secretary of the Finance Committee or take any action relative thereto.

ARTICLE 23. To see if the Town will vote to put questions on ballot for 1964 of whether or not Board of Selectmen shall act as Board of Public Works and, if so, increase number of Selectmen to five with staggered three year terms.

ARTICLE 24. To see if the Town will vote to amend its By-Laws to extend the terms of the Selectmen to three years as of March, 1964, by electing one for for three years, one for two years, and one for one year initially and petition the General Court for necessary legisla- tion if any, or take any action relative thereto.

to amend the General By-Laws by inserting, at the end of Section 1 of Article 11, the following :


"At the Annual Town Meeting for 1964 the Town shall elect three Selectmen on one ballot: the candi- date receiving the highest number of votes to serve for three years; the candidate receiving the second highest number of votes to serve for two years, and the candidate receiving the third highest number of votes to serve for one year. There- after the Town shall elect one Se- lectman each year for a term of three years."


The Town voted that action on this Article be postponed.


ARTICLE 25. To see if the Town will vote to amend its By-Laws to transfer the Engineering Division from the Board of Public Works to the Board of Select- men or take any action relative thereto.


Petitioned for by Town Government Study Committee.


Voted: That this article be re- ferred back to the Town Govern- ment Study Committee for further study, and that said Committee is to report back to the next Annual Town Meeting.


ARTICLE 26. To see if the Town will vote to petition the legislature to repeal or to amend Chapter 300 of the Acts of 1927 by:


(A) Reducing the number of Town Meeting Members.


(B) Authorizing Moderator to appoint

members of the Finance Committee from the registered voters of the town without restriction to Town Meeting Members.


(C) Require the Town Clerk in the event that a member fails to attend two successive meetings, to call a meeting of the members from his precinct for the purpose of considering a motion to de- clare his seat vacant and filling the vacancy or take any action relative there- to.

ARTICLE 27. To see if the Town will vote to change or include a By-Law to prohibit any Boards or Committees from changing or altering original plans or spe- cifications re: any construction work or exceeding an original appropriation of Capital Investment as voted by the Town Meeting without first securing approval of the Town Meeting for said additional changes in plans or specifications or addi- tional expenditures to be made. And fur- ther to amend the By-Laws to require the return to the Town Treasurer all previously appropriated funds not spent for specific purposes under articles, and that this requirement shall be effective forthwith, or take any action relative thereto.

ARTICLE 28. To see if the Town will vote to amend the Zoning By-Law of the Town by providing that in a business B-1 district and in a residence A-3 dis- trict the maximum height of buildings may be eight (8) stories and seventy- two (72) feet, or will otherwise amend and adopt said proposed amendment, or take any action relative thereto.

ARTICLE 29. To see if the Town will vote to accept Chapter 740 of the Acts of 1950, an act authorizing pay-roll de- ductions on account of Union dues in the case of certain State, County, or Mu- nicipal employees.

ARTICLE 30. To see if the Town will vote to adopt the following By-Law for regulating the installation of Gas Appli- ances and Gas Piping, or take any action relative thereto:


Town of Swampscott By-Laws for Installation of Gas Appliances and Gas Piping


Section 1. The Swampscott By-Laws regulating the installation of Gas Appli- ances and Piping shall be the Massachu- setts Code for Gas Appliance and Piping as established by the General Court of Massachusetts under Chapter 737 of the Acts of 1960 and any amendment there- to.


Section 2. The local authority having

jurisdiction and responsibility for admin- istering this By-Law shall be the Board of Health acting through the Gas Inspec- tors who shall be the Plumbing Inspec- tors.


Section 3. All Gas Fitters installing Gas Appliances and Piping in the Town of Swampscott must obtain a permit from the Gas Inspector, except those in- stances where gas heated plumbing fix- tures or appliances are installed by the same plumber who installs the Gas Pip- ing.


Section 4. A fee of $5.00 (five dol- lars) will be charged for all Gas permits.


Section 5. The invalidity of any por- tion of this By-Law shall not affect the validity of any other portion thereof.

ARTICLE 31. To see if the Town will vote to amend its Building By-Laws to require each new dwelling hereafter con- structed to be equipped with an approved fire detection system.

ARTICLE 32. To see if the Town will vote to amend the Job Classification and Salary Plan by inserting therein the fol- lowing provisions:


To strike out Paragraph 1 of Section 8 and insert in place thereof the following:


Section 8 - Classification of Present Town Employees


An employee promoted or reclassified to a higher rated position or grade shall enter it at the minimum rate of the range for the appropriate compensation


grade; however, if his existing rate is the same or higher than the minimum for the higher rated position, he shall be moved to the next higher step above his present salary.


By adding to Section 6 of the General By-Laws the following:


Full time employees selected for Jury Duty shall be granted leave for the dura- tion of such duty. Upon presentation of an affidavit of jury pay granted, the Town will pay the difference between jury pay and the employee's regular salary.

That the Town amend the Job Classification and Salary Plan by striking out Paragraph 1 of Section 8 of the General By-Laws and in- serting in place thereof the follow- ing :

Junior Clerks and General Library As- sistants from Grade 1 to Grade 2.


Senior Clerks and Library Secretaries from Grade 2 to Grade 3.


Health Nurse from Grade 5 to Grade 6.


Police Lieutenant be added to Grade 7.


Town Accountant and Head Librarian from Grade 7 to Grade 8.


Superintendent of Public Works from Grade 12 to Grade 13.


Grade 13 to be: Step 1, $8,613.28; Step 2, $8,912.80; Step 3, $9,216.48; Step 4, $9,518.08; Step 5, $9,819.68.


Public Works Craftsmen MEO-L and Public Works Craftsmen MEO-M be placed in Grade 4A - such grade to consist of five steps, each step to be $104.00 per year more than the corre- sponding step in Grade 4.


And appropriate the necessary money therefor or take any active relative there- to.

Voted: To accept the reports of the Personnel Board and the Fi- nance Committee and adopt their recommendations :


That the sum of $4,378.32 be ap- propriated from the tax levy, and that the sum of $451.36 be appro- priated from Water Receipts for the year 1963.


ARTICLE 34. To see if the Town will vote to amend Article IV, Section 3, paragraph 4, sub-paragraphs (a) and (b) of the Zoning By-Law by striking out in sub-paragraph (a) in line four the word "fifteen", in line five the word "twenty" and in line six the word "twenty" and


insert in place thereof in line four the word "twenty", in line five the word "thirty" and in line six the word "thirty", and strike out in sub-paragraph (b) in line four the word "ten", in line five the word "fifteen", and in line six the word "fifteen", and insert in place thereof in line four the word "fifteen", in line five the word "twenty" and in line six the word "twenty", - so as to read as follows:


(a) In the Residence A-1 or A-2 Dis- trict, a dwelling need not set back more than the average of the set-backs of the buildings on the lots adjacent thereto on either side, but in no case may any part of a building extend nearer to any street line than twenty feet. A vacant lot or lot occupied by a building set back more than thirty feet shall be considered as though occupied by a building set back thirty feet.


(b) In the residence A-3 District, a dwelling need not set back more than the average of the set-backs of the build- ings on the lots adjacent thereto on either side, but in no case may any part of a building extend nearer to any street line than fifteen feet. A vacant lot or a lot occupied by a building set back more than twenty feet shall be considered as though occupied by a building set back twenty feet.

FIRE DEPARTMENT


ARTICLE 35. To see if the Town will express its will in the following resolve:


Be it resolved that the Board of Select- men shall act as the Board of Fire Engi- neers if pending legislation creating such a Board is successful in the General Court this year and shall again petition for identical legislation should it be un- successful.

Voted: That the Selectmen be in- structed to petition the General Court again for legislation to estab- lish a Board of Fire Engineers, in accordance with the vote of the Town under Article 21 of the War- rant for the Annual Town Meeting of 1962.


ARTICLE 36. To see if the Town will vote to purchase a new car for the Chief of the Fire Department and to appro- priate the necessary money therefor or take any action relative thereto.

ARTICLE 39. To see if the Town will vote to authorize and direct the Board of Selectmen and the Transportation Com- mittee to take by eminent domain pro- ceedings or otherwise acquire, the Boston and Maine property, land and buildings, approximately 40,000 square feet of land on Railroad Avenue, and 20,000 square feet on Columbia Street, and authorize disposal of the land and buildings by the Selectmen should Boston and Maine passenger service at a later date be dis- continued, or take any action relative thereto.

ARTICLE 40. Chapter 40, Section 8C as amended, Plate 8, Lots 5, 7, 8, 9, and 10; Plate 8, Lot 11, to the Conserva- tion Commission, or take any action rela- tive thereto.

The area containing approximately 50 acres, bounded northeasterly by Vinnin Street, northwesterly by Essex Street, and easterly and southeasterly by Paradise Road and shown as Lots 9, 12, 13, 14, 15, 16, 17, 18, 19, 20, and 21 on Plate 17 of the plans of the Board of Assessors of Swampscott, and also on plan entitled "Plan of Lillian A. Little Trust", dated November 19, 1960, Bradford & Weed, Civil Engineers.

To see if the Town will vote to authorize and direct the Modera- tor to appoint a committee to study the acquisition by the Town of the New Ocean House Garage for possible use as Town Field House, auditorium and/or other Town purposes and a portion of the New Ocean House golf course area for parking for sports events and users of Blaney Beach, both to be under the jurisdiction of the Board of Selectmen for restriction to use by Townspeople of either or both facilities or take any ac- tion relative thereto.

ARTICLE 44. To see if the Town will vote to authorize and direct the Trans- portation Study Committee to study and investigate the possibility of removal of railroad bridges over Stetson and Bradlee Avenues and Walker and Paradise Roads and report its recommendations to the next Special or Annual Town Meeting.

On motion of the Transportation Study Committee, the recommenda- tion was amended as follows:

ARTICLE 45. To see if the Town will vote to authorize the Board of Select- men to assign custody or title to the


Board of Public Works, Conservation Committee, Waste Disposal Committee or other Town Boards or Committees when requests are made for certain par- cels of tax title land for public purposes or take any action relative thereto.
