Article 9. To see if the town will vote that an ap- propriation be made for the erection and maintenance of two additional lights on Depot Road, West Harwich.

Article 10. To see if the town will vote to raise and appropriate the sum of One Hundred and Seventy-five ($175.) Dollars to continue with some hardening material the sidewalk from Francis P. Larkins' on Main Street, Har- wich Center, easterly to the east driveway of Bernard W. Andrews, and act fully thereon.


Accepted and adopted and $75.00 was raised and ap- propriated; with the addition that crushed stone with tar 1 binder be used.

Article 11. To see if the town will vote to raise and appropriate a sufficient sum of money to purchase and supply the materials necessary to harden and improve the sidewalks on the west side of Bank Street, from the foot of Moody's Hill, so-called, in Harwich Center to Main Street in Harwichport, and act fully thereon.


Accepted and adopted and $500.00 was raised and appropriated; with the addition that crushed stone with oil or tar binder be used.


Article 12. To see if the town will appropriate the sum of Twelve Hundred ($1200.) Dollars; this sum to be used for the following purpose :- 1st. For the grading and improving the Town's land at the foot of Central Ave- nue, on shore front. 2nd. For erecting rataining wall on front of said land. 3rd. The Selectmen shall cause to be erected on this land a covered outlook with cement floor. All the above work to be done in the year 1934.


The Finance Committee's recommendation was ac- cepted and adopted : that the amount of $300.00 be raised and appropriated for grading, hardening with loam and building wooden steps and seats under section 1 of this ar- ticle and that sections 2 and 3 be indefinitely postponed.


Article 13. To see if the town will vote to raise and appropriate a sufficient sum of money to brush out and put in passable condition the road known as John Joseph's Road, which was laid out by the town and ac- cepted at a Town Meeting held on May 23, 1855; the, orig- inal lines of said road to be run out and established, said road never having been discontinued.

Article 14. To see if the town will accept the land as a Public Way as shown by a Plan and Deed filed here- with at West Sequattom, Pleasant Lake, from the East Boundary of the New York, New Haven & Hartford Rail-

road to the East boundary of Jennie T. Moody's homestead lot as laid out by the Selectmen, and raise and appropriate One Thousand ($1000.) Dollars for the improvement of the same.


The acceptance of this article was lost by a standing vote of 54 for and 66 against. It was then indefinitely post- poned.


Article 15. To see if the town will vote to accept the set of By-Laws as drawn up by the committee appointed at the last annual Town Meeting.


BY-LAWS FOR THE TOWN OF HARWICH


TOWN MEETINGS


ARTICLE I


The Annual Town Meeting shall be held on the first Monday in February.


ARTICLE II


All warrants for town meetings, whether annual or special, shall be served by posting attested copies in each post office in said town not earlier than 14 days nor later than 7 days before the meeting; and by printing a like copy in one or more newspapers published in said town. ARTICLE III


All articles to be put in the annual town warrant shall be presented to the Selectmen not later than Dec. 31, previous to the town meeting.


ARTICLE IV


All motions and amendments shall be in writing when required by the Moderator.


ARTICLE V


Reports of all committees shall be in writing.


ARTICLE VI


No one but the Moderator shall interrupt another while speaking except to call him to order.

ARTICLE VII


No one shall speak on the same question more than twice nor longer than ten minutes without leave of the meeting.


ARTICLE VIII


No motion, moved, seconded and stated, can be with- drawn without a vote to that effect.


ARTICLE IX


When a vote decided by the Moderator is ques- tioned, it shall be made certain by the voters on either side rising and standing until counted by the Moderator or by tellers appointed by him.


ARTICLE X


No one shall move the reconsideration of any vote unless he voted in the majority, said motion to be made within thirty minutes of the passage of such vote. The Town Clerk shall note in writing the time of the passage of the vote, and also the time when motion of reconsidera- tion was made.


ARTICLE XI


During the legislative session of town meetings the floor shall be occupied solely by voters, and it shall be the duty of the Moderator during the polling of questions to clear the floor of all non-voters.


FINANCES


ARTICLE XII The fiscal year shall end on the last day of December. ARTICLE XIII


After every annual or other town meeting, at which any money is voted to be raised, the Clerk shall make a list of the sums voted, expressing therein the particular purposes to which they are to be applied, and deliver the same to the Selectmen.

ARTICLE XIV


The Selectmen shall report to the annual town meet- ing the financial condition of the town at the close of the fiscal year preceding such meeting. Said report shall state what expenditures have been made, what balances of ap- propriation, if any, remain unexpended; and shall contain the warrant for the next annual town meeting.


ARTICLE XV


All elective or appointive officers and committees shall make a written report to the Town, and such report shall be embodied in the annual Town Report. Such a report shall be itemized to the extent of showing at least the amounts of money, goods, refunds, credits, or abate- ments received by each person from the town excepting such amounts as are prohibited by law from being publish- ed. The Town Clerk's report shall include his record of the annual Town Meeting and all special meetings held during the year for which the report is made. The re- port of the Finance Committee shall be published at least once before the annual Town Meeting in the town news- paper.


ARTICLE XVI


If an appropriation made for a specific year is not applied to the object for which it was designed, it or the ARTICLE XVII


unapplied balance thereof shall revert to the general treas- ury.


If a certain sum of money is appropriated for a special object, and if an occasion should arise requiring a much larger expenditure of money, the Selectmen may call a special town meeting for the purpose of making such further appropriation.


ARTICLE XVIII


The payment of all moneys by the Treasurer shall be made by the order of the Selectmen, or a majority of

them, in writing, which shall indicate the appropriation from which the money is to be paid; but no orders shall be drawn by the Selectmen, and no orders paid by the Treasurer, for any purpose not obligatory by law or not determined by the town.


TOWN OFFICERS


ARTICLE XIX


The Clerk of the town shall notify all committees appointed at the annual town meeting of their appoint- ments.


ARTICLE XX


The town shall have a Finance Committee, whose duty it shall be to submit a budget at the annual town meeting and consider any and all municipal questions for the purpose of making reports and recommendations to the town as provided by Chapter 388 of the Acts of 1923. Said committee to be appointed by the Moderator in open town meeting and to consist of nine members, three to be so appointed every year, and no one of said committee shall be a holder of elective town office at the time of his appointment.


STREETS AND HIGHWAYS


ARTICLE XXI


The official or officials having in charge the streets and highways may grant licenses in writing for the ob- struction of any part of the highways or streets, or for such excavation as may be needful, for the purpose of erecting, repairing, altering or removing any building, or for the laying of drains, water pipes, or for any other purpose which to them may seem reasonable.


ARTICLE XXII


Every person receiving such license shall execute a written agreement to indemnify the town against all damage or cost by reason of any claim for damages, or

by reason of any process, civil or criminal, on account of the existence of such obstruction or excavation; and the road officials may impose such conditions and limita- tions as they shall see fit in respect to maintaining lights and taking other precautions for the safety of travellers.


ARTICLE XXIII


No person or corporation shall break or dig up the ground in any highway or street, or cause any obstruc- tion to be placed thereon, without a written license from the road officials. And any person so licensed who shall break or dig up the ground in any highway or street shall, before the expiration of his license, restore the same to the acceptance of said road officials. The foregoing shall not apply to the temporary deposit of goods in the streets when loading or unloading, providing the articles so de- posited shall be removed.


ARTICLE XXIV


No one shall pasture his cow or other animals in the streets or highways unless such animal has a keeper.


ARTICLE XXV


Every driver of a vehicle or other conveyance trav- elling on any street intersecting any through way here- tofore or hereafter designated as such, shall stop such vehicle or other conveyance at the intersection of such streets; subject, however, to the direction of any traffic control signal, sign or device or the direction of any police officer. Any person violating the provisions of this By- Law shall be punished by a fine not exceeding $20. for each offense.


ARTICLE XXVI


Whoever violates Articles XXIII and XXIV of the By-Laws of the Town of Harwich shall, except where a different provision is made by the laws of the Common- wealth, forfeit to the use of said town a sum not exceed- ing $20. for each offense.

Eldredge Town Pump Trust Fund," the object of said trust fund having been removed and destroyed by previous vote of the town.

Article 17. To see if the town will vote for the ap- pointment of a Fish and Game Warden as provided in Chapter 21, Section 7, of the General Laws of Massachu- setts and raise and appropriate the sum of Two Hundred ($200.) Dollars for the salary of such warden.


Accepted and adopted and $200.00 raised and ap- propriated.


Article 18. To see if the town will vote to raise and appropriate the sum of Twenty-five ($25.) Dollars for the expense of an officer finding and disposing of unli- censed dogs, and act fully thereon.


Accepted and adopted and $25 raised and appro- priated.


Article 19. To see if the town will vote to appro- priate the sum of Three Hundred ($300.) Dollars for the benefit of the Chase Library, West Harwich.

Article 20. To see if the town will vote to appro- priate the sum of Three Hundred ($300.) Dollars for the benefit of the Harwichport Library Association.

Article 21. To see if the town will vote to raise and appropriate a sum of money not to exceed Twelve Hundred ($1200.) Dollars, under the provisions of sub- section 21 of Section 1 of Chapter 371 of the Acts of 1921, and any and all amendments thereof and additions thereto for the employing of a nurse through the Harwich Visiting Nurse Association, Inc.


Accepted and adopted and $1,200.00 raised and ap- propriated.


Article 22. To see if the town will vote to raise and appropriate the sum of Twenty-five Hundred ($2500.) Dollars to be used under the direction of the Selectmen for the promotion of public recreation and amusement in the form of Baseball, in accordance with Legislative Acts of 1930, Chapter 12, Section 1.


Accepted and adopted and $2,400.00 raised and ap- propriated. This action was made legal by a rising vote. 192 for, and none against.


Article 23. To see if the town will vote to appro- priate the sum of One Hundred ($100.) Dollars to defray the expense of the Stonehorse Club in promoting an All Cape Regatta during the summer season of 1934, this money to be spent under the direction of the Race Committee of said Club as seems best suited to bring the greatest possi- ble number of visiting yachtsmen and yachts to the re- gatta.

Article 24. To see if the town will vote to raise and appropriate the sum of Three Hundred ($300.) Dol- lars to pay part of the expense for the Washington Trip of the Harwich High School Senior Class; this money to be expended under the supervision of Principal Paul A. Morris.


Found to be illegal and article indefinitely postponed.


Article 25. To see if the town will appropriate the sum of Seven Hundred ($700.) Dollars (in addition to the State Tax) for mosquito control, or do or act anything thereon. By request.


Accepted and adopted and $700.00 raised and ap- propriated.


Article 26. To see if the town will authorize the Treasurer to assign tax titles owned by the town.


Accepted and adopted.


Article 27. To see if the town will appropriate the sum of One Hundred Seventy-five ($175.) Dollars to reim- burse the Saybrook Dredging Company for work done at Wychmere Harbor.


Accepted and adopted and $150.00 raised and ap- propriated.


Article 28. To see if the town will appropriate the sum of One Hundred ($100.) Dollars to maintain the light at entrance of Wychmere Harbor.

Article 29. To see if the town will vote to raise and appropriate the sum of Five Hundred ($500.) Dollars to reimburse the Department of Public Works, as a con-

tribution of the town toward the increased cost of dredg- ing at Wychmere Harbor, and act fully thereon.


Accepted and adopted and $500.00 raised and ap- propriated.


Article 30. To see if the town will appropriate the sum of One Thousand ($1000.) Dollars, providing the Se- lectmen can get a contribution from the State and County, to complete the East jetty with stone at Allen's Harbor.


Indefinitely postponed.


Article 31. To see if the town will vote to raise and appropriate One Thousand ($1000.) Dollars to dredge Wychmere Harbor and channel to deep water, providing that the State and Federal Governments will contribute sufficient funds to complete the project, and act fully thereon.


Accepted and adopted and $500.00 raised and ap- propriated.


Article 32. To see if the town will vote to raise and appropriate the sum of Seven Hundred and Fifty ($750.) Dollars, providing the state will contribute the same for the purpose of dredging out the entrance to the Round Cove at Pleasant Bay, and act fully thereon.


Accepted and adopted and $750 raised and ap- propriated.


Article 33. To see if the town will vote to grant to the Chatham Water Company, a franchise to install a water system within the town limits; to lay water mains in accordance with plans already drawn by Chase & Gil- bert; to rent at least one hundred (100) hydrants per year at a cost of not more than Fifty ($50.) Dollars each, or to take any other action necessary in the matter and to raise and appropriate a sum of Five Thousand ($5000.) Dollars therefor.


Voted to postpone indefinitely. 163 voted for and 2 against postponement.

Article 34. To see if the town will raise and ap- propriate the sum of Fifteen Hundred ($1500.) Dollars to be used for the purchase of materials on C. W. A. pro- jects, said money to be spent under the supervision of the Selectmen.

Article 35. To see if the town will vote to rescind the vote of the year 1927 whereby One Hundred and Twen- ty-five ($125.) Dollars was appropriated for the improve- ment of the beach at West Harwich, said work having been completed with money from other sources, and that this amount revert back to the Town Treasury.

Article 36. To see if the town will vote to raise and appropriate the sum of Six Hundred ($600.) Dollars to reimburse the Department of Public Works for dredging Herring River.


Accepted and adopted and $600.00 raised and ap- propriated.


Article 37. To see if the town will vote to raise and appropriate a sum not to exceed Five Hundred ($500.) Dollars to be paid to the Cape Cod Hospital for the es- tablishment and maintenance of a free bed in the hospital for the care and treatment of persons certified by the Se- lectmen to be 'residents of the town and unable to pay for such care and treatment, in accordance with Section 74, of Chapter 111 of the General Laws, or take any ac- tion in relation thereto, and act fully thereon.


Accepted and adopted and $500.00 raised and ap- propriated.


Article 38. To see if the town will vote to raise and appropriate the sum of Five Hundred ($500.) Dollars for the use of Harwich Post, No. 292, American Legion, in

the proper observance of Memorial Day and Armistice Day.

Article 39. To see if the town will accept the re- location of Pleasant Street between Lower County Road and Shore Road, West Harwich, as made by the Select- men.
