By a rising vote of those present 85 for and none op- posed, this Article was accepted and adopted and to raise and appropriate $5,000.00.


Article 2. To see if the Town will vote to raise and appropriate the sum of Five Hundred Dollars ($500.) for the Chief of Fire Department and Forest Warden Salary and Two Hundred and Fifty Dollars ($250.) for Chief of Fire Department and Forest Warden's expense.


The Finance Committee recommended that the Fire Chief be paid a flat salary of $650.00 a year from January 1, 1937, to include his expenses while within the town. Recom- mendation accepted and adopted and $650.00 be raised and appropriated.


Article 3. To see if the Town will vote to maintain one street light on Lower County Road, West Harwich oll the fifth (or last) pole east from Pleasant Road and raise and appropriate a sufficient sum of money for the same.


It was voted to accept and adopt this Article and to raise and appropriate $9.00 for the maintenance of this light during the summer season.


Article 4. To see if the Town will vote to raise and appropriate the sum of Two Hundred Dollars to stock ponds and streams with fish, and for the feeding and propagation of game within the Town limits and that a Committee of three be appointed by the Chair to have charge of the work.


Accepted and adopted and $200.00 was voted to be raised and appropriated. Committee appointed by the Chair was Howard C. Cahoon, H. C., Charles H. Taylor, H. P., Ralph W. Doane, H. P.


Article 5. To see if the Town will vote to elect a Surveyor of Highways at the next annual election, for the term of one year, or take any other action thereon.

SPECIAL TOWN MEETING WARRANT AND ACTION


Friday, July 23, 1937


Article 1. To see if the Town will vote to authorize the Selectmen, so far as such authority may be necessary, to re-convey to Edith Sears and Henry C. Cahoon, land and buildings on Depot Street, North Harwich, which were con- veyed to the Town in 1934-1935 by said Sears and Cahoon and to cancel and rescind any and all agreements which were entered into as consideration for which said properties were conveyed to the Town.

Article 2. To see if the Town will vote to rescind the action taken at the Annual Town Meeting last Feb. 2nd, whereby it voted to accept articles 39, 40 and 41, and the sum of $1,200 was appropriated for the preparation of a zoning system.

Article 3. To see if the Town will vote to make a Town ordinance that no building shall be erected, recon- structed or moved onto any premises in the Town of Har- wich without a building permit obtained from the Board of Selectmen of the Town of Harwich. The Board of Select-

men shall not grant building permit if in their judgment said proposed building operation will depreciate the value of the adjoining or neighborhood property.


Article 4. To see if the Town will vote to raise and appropriate or transfer from surplus revenue a sum not to exceed twelve thousand, five hundred dollars for the pur- pose of furnishing and equipping the new Harwich Junior- Senior High School and for laying out and grading the School grounds or take any action relative thereto.


That the sum of $12,500. be transferred from surplus Revenue, for the purpose of furnishing and equipping, and for laying out and grading the grounds of the Harwich new Junior-Senior High School. So much of this appropriation as is expended for the laying out and grading the School grounds, may be expended in conjunction with Federal W. P. A. or other assistance.


Article 5. To see if the Town will vote to accept the following rules and regulations for the Water Depart- ment :-


Supt. of Water Works; how choosed.


The Water Commissioners may make rules and regu- lations for their Government and that of the Officers ap- pointed by them ; they shall annually elect, but not one of their own number, a Supt. of Water Works; they shall fix the compensation of such Officer ; may appoint subordinates and assistants and fix their compensation ; and may remove any appointee at any time ; they shall have the exclusive and entire charge, superintendence and oversight of all lands Structures, Works, apparatus, pipes and fixtures, designed and provide for obtaining and supplying Water for the Town or to Consumers and of the use, repairs, extensions and improvements of such Water Works, structures and ap- paratus Pipes and fixtures ; they shall have control and jur- isdiction over all sources of supply possessed by the Town

and all lands appurtenant thereto owned or Lawfully con- trolled by the Town, and they may exercise all rights the Town has or may have, as to entry upon and passage over premises of the Town connected with or appurtenant to such works or supply.


The Commissioners shall have power to determine and assess Water rates and establish rules and regulations for the introduction supply, and use of Water, and to cut off the supply of Water from consumer who fails to observe and comply with the same, they shall not supply Water to any Building unless the Pipes and fixtures are conformable to their rules and regulations. A separate connection shall be required for each Estate.


The Town shall have the right to put in a Meter, in any case, at its own cost, and charge for water by measure instead of by Schedule rates.


Under the direction of the Commissioners, the Supt. shall have charge of the works and property connected with the Water Department, and shall perform all services in re- lation thereto required of him by the Commissioners; he shall immediately inform the Chief of the Fire Department of any stoppages or breaks in the Water Mains. He shall annually report to the Commissioners upon such matters as they require.


The Clerk of the Board shall perform such services as may be required of him.


He shall annually report to the Board detailed state- ments of receipts and expenditures in the department for the year preceding; the number of water takers; the num- ber of cases in which water has been shut off, the number and amount of rebates, and give such other information as the Commissioners may require. He shall under the direc- tion of the Commissioners, make, and send to water takers or owners of premises on which water is used Statements of amounts due for water, on or before the first days of April

and October in each year and such other times as the Com- missioners shall direct; he shall have charge of the keeping of the Books and accounts and Records of the Board, the collection of moneys due it and the preparation of such re- turns and reports as it may be required to make. He shall immediately after receipt thereof pay over to the Treasurer all money collected by him.


All rates for use of water shall be payable in advance. In any case of non-payment of a bill for water for Thirty days after the same is due, the Clerk may send a notice to the delinquent, and unless said bill is paid within three days thereafter, together with twenty-five cents for said notice the supply may be cut off ; and the water shall not be let on again until the amount due together with the fee for said notice and two dollars for shutting and letting on, is paid; provided also that no owner or occupant, and provided al- so, that in case of specific supply or where water has been let on for fractional parts of the term, the notice may be served and the water shut off immediately, and it shall not be let on again except upon the condition heretofore men- tioned.


The Commissioners may make abatements in water rates in all cases proper.


The Clerk shall keep in suitable books the names of all persons who take water, the Name of the Street on which it is taken the nature of the number of takers, the amount charged, and the amounts of rebates these books shall be open at all times to the inspection of the Commissioners.


The following regulations and orders are established regarding Town water its supply introduction and use.


All persons using the water shall keep service pipes within their premises in good repair and protected from frost at their own expense and shall be liable for all dam- ages which may result from their failure to do so they shall provide a Stop and waste cock to be properly located inside

the building, and have the pipes so arranged that water can be drawn from them to prevent freezing they shall prevent all waste of water, there shall be no concealment of the pur- pose it is used and water shall not be allowed to run to pre- vent freezing.


All service pipes shall be laid at least four and one- half feet deep.


The board shall restrict the use of water by those Fountains and otherwise as they deem necessary, and for violation of such restrictions the occupants of the premises shall be liable to have the water turned off from the prem- ises and to the penalties imposed in the preceding section of waste or improper use of water.


No connection shall be made between a street Main and a building or private premises ; or water introduced to a building or such premises without a written application made by the owner of said building or his authorized Agent. in such form and including such things as the commissioners may prescribe and including also an agreement on the part of the applicant to observe and comply with and be bound by such By-Laws and orders as the board may have estab- lished and such rules regulations as the commissioners there- after may establish or adopt or may thereafter adopt relat- ing to water or the supply introduction or use thereof.


When any extension of a water main is requested up- on any Street or way the Commissioners unless otherwise determined by the Town by a two-thirds vote, shall require before such extension a bond shall be given to the Town in such amount and form and with sureties as they shall ap- prove conditional that the obligors shall pay to the Town for such time as the commissioners determine at the times ap- pointed for payment of water rates such sums as shall amount in the aggregate annually to six per cent upon the cost of such extension subject to diminution by the amounts

that the Town shall receive annually from rates paid for water by consumers connected with such extension.


The amount of such cost shall be determined by the board of Commissioners.


The Clerk shall give surety Company bonds for the faithful performance of his duties; the form amount and sufficiency to be approved in writing upon the Bond by the Water Commissioners in whose sole custody it shall remain the expense of such bond shall be paid by the department.


They shall keep a Cash book in which shall be entered each day the receipt of the day, they shall also keep a rec- ord of all money paid out with the name of each person to whom it is paid and whether it is for labor or material.


Their annual report shall contain a Statement of the condition of the Water Works and land and property con- nected therewith.


A detail account of receipts and expenditures.


All reports of the condition of the Town Water made by the State board of Health during the year.


The number of water takers.


The number of cases where water has been cut off.


The number and amount of rebates.


The amount of Water rates, collected and paid over to the Treasurer and the rate charged for the use of Water.


No alterations in any water pipes or Water fixtures, whereby the consumption of water is increased, shall be made without giving notice to and obtaining a permit from the Clerk of the Water Commissioners; and no Plumber or other person, shall make any alteration in or addition to a Water pipe or fixture except under said permit and only to the extent stated therein.


No abatement or rebate shall be made for a less term or period than three months.

In all occupied premises, every fountain Water clos- et, set basin, sink or other fixtures, whether used or not will be deemed and held to be used, and shall be charged for, so long as the same shall be connected with the water pipes.


The Commissioners or Superintendent or any author- ized agent of the Commissioners may enter the premises of any water taker to examine the quantity used, fixtures, man- ner of use and to shut off the water for non-payment of rates or violation of rules and regulations.


No claim shall be allowed for lack of water or dam- age caused by shutting off the water in the main pipes to make extensions, connections or for any other reason found necessary by the board.


The owner of any premises, or his Agent when in the opinion of the Board a waste of water occurs shall be warned thereof in writing if such waste is not stopped in one week from the time said warning is given, the owner shall be liable to a fine of two dollars and the water shall be shut off from the premises, and not be let on for the same owner until the waste is stopped and the fine together with the sum of two dollars for shutting off and letting on the water are paid ; and in case of a subsequent offence the water shall be shut off and not be let on again except by vote of the com- missioners and a payment of a fine of not exceeding ten dol- lars the board shall have the power to decide what is waste or improper use of water.


All bills contracted by the water commissioners or Supt., shall be approved by the Selectmen.


The Moth Supt., may take water for spraying pur- poses from such hydrants as the Water Commissioners may direct.

Ed., and all acts and amendments thereto, as to its regular Police Force, for the purpose of bringing the Police Department of the Town of Harwich under the classified civil service, or take any action in relation thereto and act fully thereon.

Article 1. To see if the Town will raise and appro- priate an additional sum of money for Old Age Assistance and Aid to Dependent Children; determine how the same shall be raised, or take any action relative thereto.


Voted that Six Thousand Dollars be raised and ap- propriated for Old Age Assistance and Twelve Hundred Dollars for Aid to Dependent Children, and that the Treas- urer, with the approval of the Selectmen, be authorized to borrow Seventy-two Hundred Dollars for these purposes under the provisions of Chapter 107 of the Acts of 1937, and to issue the note or notes of the Town therefor, said notes to mature during the calendar-year 1938.
