Article 54. To see if the Town of Harwich will vote to purchase a seining. pool and appropriate the sum of one thousand dollars ($1,000.00) for same or take any action thereon.
It was voted "That $1,000.00 be raised and appro- priated, to be used by the Herring Committee in conjunc- tion with the Board of Selectmen in securing a suitable seining pool."
ARTICLE 15: COMPLETE ACTION- $750.00 raised and appropriated to meet the town's share of the cost of Chapter 90 Highway Maintenance and that in addition the sum of $1,500.00 be transferred from unappropriated avail- able funds in the treasury, to meet the State's and County's share of the cost of the work; the reimbursements from the State and County to be restored upon their receipts, to unappropriated funds in the treasury.
The completion of the warrant came at 3:45 o'clock and adjournment followed immediately.

SPECIAL TOWN MEETING
APRIL 13, 1945
Article 1. To see if the Town will vote to accept $35,- 000.00 from the executors under the will of the late Susan J. Ulm; under the following two clauses of her will, to wit: Second : I direct my executors to pay to the Town of Har- wich, Barnstable County, Massachusetts, a sum not to ex- ceed ten thousand dollars ($10,000.00) in cash to be used to establish a suitable and fitting memorial in the Town of Harwich in memory of my beloved father and mother, Ben- jamin Johnson and Mary A. Johnson and which memorial shall be so designated in some suitable manner and the de- tails of said memorial and the amount to be expended for such purpose shall be in absolute discretion of my ex- ecutors.

Twenty-third : I direct my executors to establish a suit- able and proper memorial in my memory of a civic or char- itable nature and to expend for that purpose out of my estate a sum not exceeding twenty-five thousand ($25,000 .- 00) dollars the details of which memorial and the amount to be expended for such purpose to be in the absolute dis- cretion of my executors.
And appropriate the land comprising the former site of the Harwich Port grade school on Main St., in that part of the town of Harwich known as Harwich Port on which to establish a memorial to Benjamin and Mary A. Johnson, a park known as the Benjamin and Mary A. Johnson Park and use the aforesaid $35,000.00 to purchase any adjoining land found to be necessary thereto, and to erect in said park as a memorial to Susan J. Ulm a town office building and if approved at the town meeting, to appoint a building com- mitee to prepare plans and specifications for said town office building satisfactory to the executors of the estate of Susan J. Ulm and work out details of the memorial to the satisfaction of the executors, and submit them to the town for their approval and to act fully thereon.
ACTION
The Finance Committee recommended that this article be accepted and adopted as is; except to change the word- ing "town office" to "civic" building.
Thomas H. Nickerson submitted the following motion which was accepted by an unanimous voice vote-unruffled save by one dissenting voice.
"That this $35,000.00 be accepted by the Town of Har- wich with grateful thanks and a committee of ten to con- sist of one from each village and three members at large be appointed by the chair for the purpose of considering this entire matter ; to hold public hearings and later, at a special town meeting to recommend to the town the nature, location, and other details concerning such memorials".
Committee appointed under this article : Cashen, Ralph W., Ryder, Victor S., Chase, Robert W., Sims, Earle L., El- dredge, Mary C., Thompson, Abbie R., Hardacker, Albert C., Tobey. Jr., Arthur W .. Nickerson, John P., Nickerson Thomas H. Thomas HI. Nickerson was designated to call the committee together for organization.
Mr. Charles M. Goldman, executor of the estate of Mrs. Ulm was given the privilege of the floor and explained in detail the requirement of the will relative to the gifts.

Article 2. To see if the Town will vote to authorize the Selectmen to sell at public auction the town owned real estate in North Harwich known as the Chester Cahoon prop- erty and act fully thereon.
Action :
The Finance Committee recommended that this article be accepted and adopted :
This recommendation was unanimously carried by voice vote.
Previously to the meetings close the Moderator, by request, asked the assembly to stand in silence as a token of respect to the memory of President Franklin D. Roosevelt who passed away Thursday afternoon, April 12th.

SPECIAL TOWN MEETING
NOVEMBER 28, 1945
Article I. To see if the Town will vote to raise and appropriate an additional sum of money for old age assist- ance and aid to dependent children and determine whether the money shall be provided for by transfer from the over- lay surplus account or otherwise, or take any action rela- tive thereto.
Action : It was voted to accept the recommendation of the Finance Committee : "That the sum of $4,207.13 be trans- ferred from the overlay surplus account for old age assist- ance and aid to dependent children, as follows: Old Age Assistance $3,607.13, Aid to Dependent Children, $600.00.
Article II. To see if the Town will vote to rescind the action taken under Article 37, at the annual town meet- ing of February 5, 1945, whereby the sum of $1,500.00 was appropriated to build toilets on the Town beach at the foot of Bank St. and act fully thereon.
Action : It was voted "That the report of the Finance Committee be accepted and adopted" : That the action at the

annual town meeting February 5, 1945, whereby the sum of $1,500.00 was appropriated to build toilets at the town beach foot of Bank Street, be rescinded.
Article III. To see if the Town will vote to transfer from the unexpended Town beach toilets account to Board of Health account the sum of $1,500.00, and act fully thereon.
Action : Accepted and adopted.
Article IV. To see if the Town of Harwich will vote to give the Selectmen the authority to grant the Harwich Post No. 292 American Legion, for the sum of one dollar and other consideration the land with buildings thereon known as the Old Harwich School Property, located in West Harwich on School Street, adjacent to the Baptist Church Cemetery.
Action : Under the motion of Winslow B. Sawyer, it was voted to accept this article as read.
Article V. To see if the Town will vote to purchase or take by eminent domain, a twenty-four foot strip of land on the easterly side of and following the easterly boundary of Lot 141 in so-called Ocean Grove, Harwichport, Mass. as far as low water mark, as an extension of Pine Ave.
Action : The Finance Committee recommended that the article be accepted and adopted. A standing vote of 76 for and 13 against confirmed the acceptance and adoption of the Committee's recommendation.
Article VI. To see what action the Town will take to dispose of the Johnson-Ulm Memorial Fund.
Action : Voted to temporarily lay this article on the table, until the disposal of article seven. After the said arti- cle was disposed of; Article 6 was taken from the table and on motion it was indefinitely postponed.
Article VII. To hear the report of the Susan J. Ulm Memorial Committee and act fully thereon.
REPORT OF COMMITTEE:
THE COMMITTEE appointed at the Special Town Meeting, held April 13, 1945, to recommend the nature, loca- tion, and other details, concerning the Memorial Funds in the will of the late Susan J. Ulm, submit the following
REPORT :-
This Committee organized by the choice of Thomas H.

Nickerson, Chairman, and Mary C. Eldredge, Clerk.
The committee has held several public hearings and a number of executive meetings. At the public hearings sever- al ideas were advanced as to the nature of suitable memorials. We have also tried, from talks with our townspeople, to learn their views with relation to this matter. Many ideas have been advanced. Among them have been suggested parking spaces, bathing beaches, public parks, fire stations, teachers' and nurses' homes, granite monuments, recreation rooms, scholarships and other plans. There may be some merit to all of them. But for obvious reasons, some must necessarily be discarded. By the terms of the will, whatever is decided upon, must have the approval of the Executors.
After considering the matter from every angle and giv- ing careful study and thought to all of the plans submitted, the committee unanimously recommend to the Town the following :-
That the land opposite Pilgrim Church, in Harwich Port, extending from Main Street, on the south, to Pleasant Street, on the north, once owned by the late William R. Burgess, and comprising approximately three acres be acquired for this purpose ; that on the Main Street side of this property there be erected a modern building, of attractive Cape Cod design, to serve as a Community Reception Center, wherein could be enjoyed rest and relaxation, the privilege of writing, reading, possibly games and social functions, an opportunity for the registration of summer visitors, information bureau, and many other functions. Also in this building would be provided rest rooms and space for the use of a Historical Society, which, it is felt, would be a valuable asset and add to the pleasures the town has to offer. The grounds would be at- tractively landscaped with beautiful flowers, shrubs, trees and foliage, and seats provided where one could rest and en- joy the beauties of such a setting. The rear of the lot would provide a large parking space to take care of a great number of cars.
We feel that such a project would greatly enhance the charms and attractions of our town and be a source of pride and pleasure to our summer residents and our own native people. If this plan is adopted, it may be necessary for the town to appropriate some money for the up-keep and main- enance of the property, but it should be apparent that it is well worth it. We believe such a place could be developed into one of the beauty spots of Cape Cod, and add much to the prestige of our town. It would be an ideal memorial to the

late Mr. and Mrs. Benjamin Johnson and Mrs. Ulm, whose generosity and desire to beautify our town, must be appre- ciated by all. We recommend that the Moderator appoint a Memorial Committee of three citizens, who shall have com- plete charge of erecting the building, landscaping the grounds, and all other details in connection with this memo- rial.
As an alternative to this plan, the committee suggest a Scholarship Trust Fund, to be known as "The Benjamin .Johnson, Mary A. Johnson and Susan J. Ulm Memorial Scholarship Fund", the administration of the Fund and the investment of the trust funds to be attended to by a Trust Fund Committee of five voters of the Town, to be appointed by the Moderator.
It is obvious that this latter plan would benefit but a few High School pupils, while the former would give pleas- ure and benefit to the entire town.

"That we accept and adopt that part of the Committee's report wherein they recommend we acquire the so-called William R. Burgess land in Harwich Port; that a Cape Cod style of building be erected thereon, that the grounds be appropriately landscaped and a committee of three be ap- pointed by the Moderator to have charge of the entire de- tails pertaining to this particular plan of memorial as out- lined in the Committee's report."
This motion was carried by a rising vote :

Sir :
As directed by you, I have made an audit of the general accounts of the town of Harwich for the period from Janu- ary. 1, 1944, and of the collector's accounts for the period from April 19, 1944, the dates of the previous audits, to December 31, 1944, the following report being submitted thereon :
The financial transactions, as recorded on the books of the several departments receiving or disbursing money for the town or committing bills for collection, were examined, checked, and verified by comparison with the books of the town treasurer.
General ledger accounts were compiled, the appropria- tion accounts were analyzed and checked to the amounts voted by the town as listed from the town clerk's record of town meetings, the recorded transfers from the reserve fund were compared with the records of the finance committee, and a balance sheet, which is appended to this report, was prepared showing the financial condition of the town on December 31, 1944.
