Paine, Allen F. Whitney Jr., and Ruth E. Doane; on the east by land of Howard C. Cahoon; on the north again by said Cahoon; on the east again by land of Anna M. Wixon; on the south, by land of the Town of Harwich 492.9 feet; on the west, by land of said Town; on the north again by land of Mildred B. Paine; and on the west again by land of Mildred B. Paine. All rights of way to the same to be over the present school lot. Seventy- eight one-hundredths acres of land stands in the name of Mildred B. Paine and 1.36 acres in the names of said Paine, Grace L. VonSoosten, Eleanor K. DeMello, and Dorothy E. Bassett and to act fully thereon.

To see if the Town will vote to raise and appropriate the sum of fourteen hundred dollars ($1,400) for the purpose of purchasing a new pick-up truck for the High- way Department and to authorize the Highway Surveyor to trade the old pick-up truck now owned by the Town and the sum from same to be used toward the purchase of a new pick- up truck and to act fully thereon.

Article 76. To see if the Town will vote to raise and appropriate the sum of three hundred and fifty dollars ($350) for the purpose of purchasing a new snow plow for the High-

way Department and to authorize the Highway Surveyor to trade the old snow plow and the sum from same to be used toward the purchase of a new plow and to act fully thereon.

Article 77. To see if the Town will vote to raise and appropriate the sum of forty-five hundred dollars ($4,500) for the purpose of widening and resurfacing Division Street from Rte #28 in West Harwich and to act fully thereon.

Article 78. To see if the Town will vote to raise and appropriate a sufficient sum of money to grade and surface Trumet Road in West Harwich leading from Kelley Road northerly to Joe Lincoln Road and to act fully thereon.

Article 79. To see if the Town will vote to raise and appropriate the sum of seventeen hundred dollars ($1,700) to purchase a new police cruiser and equipment and to auth- orize the Chief of Police to trade the 1953 Chevrolet cruiser now owned by the town, the sum received from said trade to be used toward the purchase of the new car and to act fully thereon.


Accepted and adopted. Voted to transfer the sum of $1,700.00 from unappropriated available funds in the Treasury.


Article 80. To see if the Town will vote to raise and appropriate the sum of three hundred and fifty dollars ($350) to erect appropriate signs at the various entrances and exits of the seven villages of Harwich and to act fully thereon.

Article 81. To see if the Town will vote to raise and appropriate the sum of three thousand dollars ($3,000) to be spent for the purpose of advertising the resources and ad- vantages or attractions of the Town of Harwich, this money so appropriated to be expended under the direction of the Selectmen and to act fully thereon.

Article 82. To see if the Town will vote to raise and appropriate the sum of eight hundred and seventy-five dol- lars ($875) for the purchase of 500 feet 21/2 inch double jacket fire hose and to act fully thereon.

Article 83. To see if the Town will vote to raise and appropriate the sum of five hundred dollars ($500) to pur- chase a parcel of land from William C. Chase, bounded as follows: Northerly by the Town of Harwich, and land of Margaret Hunt; easterly by land of Margaret Hunt; southerly by the land of A. D. Makepeace Co. and westerly by the land of William C. Chase, being a part of land conveyed to William C. Chase by deed of Laura H. Kendrick recorded with Barn- stable County Deeds in Book 365, page 251, said parcel to be used for a parking and drill area and to act fully thereon.

Article 84. To see if the Town will vote to raise and appropriate the sum of twenty-three hundred and sixty-nine dollars ($2,369) for the purchase of a new car, ranch wagon style for the Fire Chief and Fire Department. Said purchase to be made by the Fire Chief and Selectmen and to act fully thereon.


Accepted and adopted. Voted to transfer the sum of $2,369.00 from unappropriated available funds in the Treasury.


Article 85. To see if the Town will accept the layout of Northern Avenue in Harwich Port leading from Wyndemere Bluffs Road westerly to Hiawatha Road as reported and recommended by the Selectmen under date of January 21, 1955, and to authorize and instruct the Selectmen to take by purchase or eminent domain the lands, or interests in the lands, within said layout, and to raise and appropriate a sufficient sum of money for this purpose and to act fully thereon.


Accepted and adopted by a unanimous vote.


Article 86. To see if the Town will vote to transfer from surplus revenue or available funds a sum of money for the purpose of reducing the 1955 tax rate and to act fully thereon.

Article 87. To see if the Town will vote to raise and appropriate a sufficient sum of money for unpaid bills of 1954 as provided for in Chapter 179 of the Acts of 1954 and to act fully thereon.

Report of the Special Town Meeting Held June 3, 1955


Barnstable, SS.


To either of the Constables of the Town of Harwich, in said County, Greetings :-


In the name of the Commonwealth of Massachusetts, you are hereby directed to notify and warn the inhabitants of said Town qualified to vote in elections and town affairs, to meet in the Exchange Hall in said Town on Friday, June 3, 1955 at 7:30 p.m., then and there to act on the following articles:


Article 1. To see if the Town will vote to raise and ap- propriate a sufficient sum of money, either by transfer from available funds in the treasury, or by issuance of a loan or both for the purpose of extending the water mains "in West Harwich on Division Street, and in North Harwich on Kelley Street and Depot Road, and in Harwich and Harwich Port on South Street, Robbins Road, Forest Street, Park Street, Oak Street, Old County Road, Lover's Lane, Bank Street, Long Road and in South Harwich on Depot Road, and in East Har- wich on Depot Road, Route 39, Queen Anne Road, Church Street, and Pleasant Bay Road, and connecting with two new wells and pumping plants to be located north of the existing pumping station," as shown on a plan drawn by Whitman & Howard, Engineers, 89 Broad Street, Boston, Massachusetts,

dated April 25, 1955, copy of which is on record in the Select- men's office and at the Water Department, and to further provide for the establishment of two additional wells and pumping plants and equipment as proposed on said plan.


It was voted that the sum of $379,000.00 be appropriated to be used as specified under this article, all of said mains to be not less than 6-inches in diameter, and the Treasurer with the approval of the Selectmen is authorized to borrow $379,000.00 and issue bonds therefor payable in not more than fifteen years from their date of issue. The motion was ac- cepted by standing vote. In favor 195. Opposed 1.


Article 2. To see if the Town will vote to transfer from available funds the sum of $800.00 to be used in conjunction with the $1,300.00 appropriated under Article 41 of the an- nual Town Meeting of 1955 for the purchase of a ranch type station wagon for the Water Department, said vehicle to be purchased by the Board of Water Commissioners, and to act fully thereon.


Accepted and adopted as read.


Article 3. To see if the Town will vote to transfer from available funds the sum of $8,000.00 to be used for the purpose of making test wells and to act fully thereon.


It was moved that the Town vote to transfer from avail- able funds the sum of $6,000.00 to be used for the purpose of test wells. Accepted by a standing vote. In favor 79, opposed 8.


Article 4. To see if the Town will vote to accept and adopt the following changes in and amendments to the PRO- TECTIVE BY-LAW of the Town of Harwich:


Under Section 2-USE REGULATIONS. In paragraph 3, delete the following:


"In Residential and Agricultural Districts, no buildings, structures, or premises hereafter erected or altered may be used for any except"


and insert the following :-


"In Residential and Agricultural Districts, no buildings, or premises shall be used, and no building therein shall be erected or structurally altered except"

Article 5. To see if the Town will vote to accept and adopt the following changes in and amendments to the PRO- TECTIVE BY-LAW of the Town of Harwich:


Under Section 2-USE REGULATIONS. In paragraph 3, delete the following:

"(a) Detached one or two-family dwelling with privilege for renting of rooms to summer guests, but shall not extend to include public restaurant service".


and insert the following :-


"(a) Detached one or two-family dwelling with privilege for renting of not more than (5) rooms to paying guests, but shall not extend to include public restaurant service."

Article 6. To see if the Town will vote to accept and adopt the following changes in and amendments to the PRO- TECTIVE BY-LAW of the Town of Harwich:


Under Section 5-ADMINISTRATION. Delete paragraph (a) reading as follows:


"(a) Board of Appeals. There shall be a Board of Ap- peals of seven members, one from each Post Office area in Harwich, appointed by the Selectmen, said Board to act in accordance with General Laws, Chapter 40, 25-30b and sub- sequent amendments thereto."


and insert the following :-


"(a) Board of Appeals. There shall be a Board of Ap- peals consisting of seven regular members and, in addition, seven associate members, one regular and one associate mem- ber from each Post Office area in Harwich, all to be appointed by the Selectmen, said Board to act in accordance with Gen- eral Laws, Chapter 40, 25-30b, and subsequent amendments thereto."

Article 7. To see if the Town will vote to authorize the Selectmen to appoint one member from the Harwich Plan- ning Board to act with other Cape Cod Towns having Plan- ning Boards, in forming a Regional Planning District, to plan jointly to promote with the greatest efficiency and economy the co-ordinated and orderly future development under a Master Plan the areas within their jurisdiction, if and when the Regional Planning Law becomes effective.
