Section 3. No sand or gravel shall be removed from place to place within the Town of Harwich, except that a sand and gravel pit may be opened and used for such pur- poses if it is located 100 feet or more from a street line and no more than one entrance and exit can be used. If such sand and gravel pit is opened and used the owner shall burn or cart to the town dumping area all dead trees and stumps when any area thereof amounting to more than 5,000 square feet becomes unsuited for furthur use, and in such cases, such area shall be replanted with trees or shrubs to prevent soil erosion.


Section 4. The foregoing By-Law shall not apply to land in public use nor shall it apply to the case of materials removed or excavated for purpose of improving, grading, landscaping, cultivating the ground, nor for construction of buildings and the making of public or private improvements.


Section 5. Any person violating the provision of this By-Law shall be punished by a fine not to exceed twenty dol- lars ($20.00) for each offense, and to act fully thereon. By request of the Harwich Conservation Commission.


Article 32. To see if the Town will vote to raise and ap- propriate the sum of two hundred and fifty dollars ($250.00) to be expended for miscellaneous administrative expense for the Conservation Commission. By request of the Harwich Conservation Commission.

To see if the Town will vote to accept the layout of Moss Hill Road as a Town Road, located in Harwich Center, leading off Allen Street south to a dead end as re- ported and recommended by the Selectmen under date of February 2, 1961, and to authorize and instruct the Selectmen to purchase or take by eminent domain the lands or interest in the lands within said layout and to act fully thereon. Article 58. To see if the Town will vote to accept the layout of Old Mill Lane as a Town Road, located in Harwich Center, leading off South Street in an easterly direction as reported and recommended by the Selectmen under date of February 2, 1961 and to authorize and instruct the Selectmen to purchase or take by eminent domain the land or interest in the lands within said layout and to act fully thereon. Article 59. To see if the Town will vote to accept the layout of Harden Lane as a Town Road in East Harwich, leading from Church Street, southeasterly to a turn around as reported and recommended by the Selectmen under date of February 2, 1961 and to authorize and instruct the Selectmen to purchase or take by eminent domain the lands or interests in the lands within said layout, and to act fully thereon. To see if the Town will vote to accept the layout of Sequattom Road (or First Avenue) as a Town Road in Pleasant Lake, from Pleasant Lake Avenue (Rte 124) east- erly to the residence of Russell E. Bailey et ux as reported and recommended by the Selectmen under date of February 2, 1961 and to authorize and instruct the Selectmen to purchase or take by eminent domain the lands or interest in the lands within said layout and to act fully thereon. To see if the Town will vote to accept the layout of Allen Street as a Town Road, between South Street and Sisson Road, located in Harwich Center as reported and recommended by the Selectmen under date of February 2, 1961 and to authorize and instruct the Selectmen to purchase or take by eminent domain the land or interest in the lands within said layout and to act fully thereon. Article 74. To see if the Town will vote to raise and appropriate the sum of thirty thousand dollars $(30,000.00) to be used with whatever State and County funds are avail- able for Chapter 90, Road Construction, and to act fully thereon. Customary article.


Article 75. To see if the Town will vote to raise and appropriate the sum of three thousand dollars ($3,000.00) to be used with whatever State and County funds are available for Chapter 90, Highway Maintenance, and to act fully thereon. Customary article.


Article 76. To see if the Town will vote to raise and appropriate the sum of nine hundred dollars ($900.00) for the purpose of painting the exterior of the Recreation Build- ing, and to act fully thereon. By request of the Harwich Recreation Commission.


Article 77. To see if the Town will vote to raise and appropriate the sum of seventeen hundred dollars ($1,700.00) to install a hard top area for skating and other activities behind the Recreation Building, and to act fully thereon. By request of the Harwich Recreation Commission.


Article 78. To see if the Town will vote to instruct the Selectmen to investigate the feasibility of acquiring by pur- chase any lands available in the vicinity of West Harwich in order to establish playground facilities and to prepare neces- sary information and plans and to report at the next annual Town meeting, and to act fully thereon. Article 79. To see if the Town will vote to raise and appropriate the sum of fifteen hundred dollars ($1,500.00), said sum to be used for the purpose of building a retaining wall, erecting fences, constructing a platform and diving board, purchasing fill for the beach, and to make other im- provements at Sand Pond, and to act fully thereon. By re- quest of the Harwich Recreation Commission.


Article 80. To see if the Town will vote to raise and appropriate a sufficient sum of money to purchase and/or take by eminent domain a certain piece of property in Har- wich Port bounded and described as follows: northeasterly by Pleasant Street one hundred thirteen and eighty-four hundredths feet (113.84'); southeasterly by sundry adjoining owners, as shown on plan hereinafter mentioned, six hun- dred ninety-four and ninety-eight one hundredths feet

(694.98'); southwesterly by the State Highway one hundred eleven and five one hundredths feet (111.05') and north- westerly by land now or formerly of William H. Eldredge and Lillian D. Look seven hundred three and fifty-two one hun- dredths feet (703.52'). All of said boundaries are determined by the Court to be located as shown upon Plan 19881A filed with the original certificate of title issued to Phineas O. Baker et ux, the same being compiled from a plan drawn by Benjamin P. Chase, Surveyor, dated April 16, 1946, and ad- ditional data on file in the Land Registry, all as modified and approved by the Court for recreational and playground facilities as called for under Article 35 of the last Annual Town Meeting warrant, and to act fully thereon. Article 81. To see if the Town will vote to raise and appropriate the sum of one thousand dollars ($1,000.00) to be expended under the direction of the Selectmen for rec- reation and amusement in the form of baseball, and to act fully thereon. By request of the Board of Selectmen.


Article 82. To see if the Town will vote to authorize the Selectmen to enter into a lease with Douglas P. Allison of Harwich (Port) for the use of, during the months of June, July, August and September of 1961, a portion of his beach property which lies adjacent to the Town Beach at Bank Street and to raise and appropriate the sum of five hundred dollars ($500.00) for this purpose, and to act fully thereon. By request of the Board of Selectmen.


Article 83. To see if the Town will vote to raise and appropriate a sufficient sum of money to erect a comfort station at the foot of Deep Hole Road, South Harwich on the high land owned by the Town, and to act fully thereon. By request of the Harwich Planning Board.


Article 84. To see if the Town will vote to raise and appropriate the sum of five hundred dollars ($500.00) to remove certain trees and improve the area at the public beach at the east end of Long Pond, and to act fully thereon. By request of the Park Commissioners.


Article 85. To see if the Town will vote to authorize the Board of Park Commissioners to perform day labor in the parks at the rate of not less than one dollar and thirty-five cents per hour ($1.35 per hr.), and to act fully thereon. By request of the Park Commissioners.

Article 86. To see if the Town will vote to raise and appropriate the sum of seven hundred dollars ($700.00) to build up the tennis court with clay and stone dust, and to grade and roll the same, and to act fully thereon. By request of the Park Commissioners.


Article 87. To see if the Town will vote to expend the refunded Dog Tax for the support of Brooks Free Library, and to act fully thereon. By request of the Trustees of the Broadbrooks Free Library.


Article 88. To see if the Town will vote to raise and appropriate the sum of fifteen hundred dollars ($1,500.00) for the purpose of painting Brooks Block, and the neces- sary minor repairs relating thereto, and to act fully thereon. By request of the Trustees of the Broadbrooks Free Library


Article 89. To see if the Town will vote to raise and appropriate the sum of nine hundred and fifty dollars ($950.00) for the purpose of completing the shingling of the roof of Brooks Block, and to act fully thereon. By request of the Trustees of the Broadbrooks Free Library.


Article 90. To see if the Town will assume liability in the manner provided by Section 29 of Chapter 91 of the General Laws, as most recently amended by Chapter 5, Acts of 1955 for all damages that may be incurred by work to be performed by the Department of Public Works of Massachusetts for the improvement, development, maintenance and protection of tidal and non-tidal rivers and streams, harbors, tidewaters, foreshores and shores along a public beach in accordance with Section 11 of Chapter 91 of the General Laws, and authorize the Selectmen to execute and deliver a bond of indemnity therefor to the Commonwealth, and to act fully thereon. Article 91. To see if the Town will vote to instruct the Selectmen to continue the Waterways Study Committee, which hereafter shall be known as the "Waterways and Beach Committee," to study, plan and bring in recommendations to Town Meetings for the development, protection and improve- ments of the beaches, jetties, breakwaters, channels, wharves, bulkheads, docks, slips, Marinas, Town Landings and other improvements of interest in the Town and to raise and ap- propriate the sum of two thousand dollars ($2,000.00) to cover the costs of such surveys and reports the Committee may prepare and to act fully thereon. Article 92. To see if the Town will vote to raise and appropriate the sum of twelve hundred dollars ($1,200.00) to be used for dredging the channel at Round Cove, East Har- wich, and to act fully thereon. By request of Roger W. Mun- sey and others.


Article 93. To see if the Town will vote to raise and appropriate the sum of twelve hundred and fifty dollars ($1,250.00) for improvements of the dock at Round Cove, East Harwich, and to act fully thereon. By request of Roger W. Munsey and others.
