Annual Town Meeting


MARCH 9, 1929


Annual Town Meeting assembled in the Assembly Hall of the High School at one o'clock P. M. according to call of War- rant. Warrant was read by the Town Clerk, and under


Article 1. To choose a Moderator to preside in said meeting.


Clarence H. Granger was elected Moderator by a vote of 40 to 3 scattering.


Article 2. To choose two or more Fence Viewers, and two or more Field Drivers.


Dwight E. Bailey and Thomas A. Kerr were chosen fence viewers. William S. Halladay and Frankie H. Campbell were chosen Field Drivers.


Article 3. To hear and act upon the reports of the Town Officers.


Voted: To accept the reports of the Town Officers as printed, typographical errors and omissions excepted.


Article 4. To see what method the Town will adopt for the support of the poor for the ensuing year.


Voted: To leave the care of the Poor in the hands of the Board of Public Welfare.

Article 5. To see if the Town will appropriate a sum of money for the observance of Memorial Day, and provide for its expenditure.


Voted: To appropriate the sum of one hundred and fifty dollars for the observance of Memorial Day.


Article 6. To see if the Town will appropriate a sum of money for the payment of a proper charge of an insurance com- pany, for acting as surety on the official bond of its officers.


Voted: To appropriate the sum of five hundred dollars for the payment of a proper charge of an insurance company, for act- ing as surety on the official bond of its officers.


Article 7. To see if the Town will appropriate a sum of money for liability insurance of its employees.


Voted: To appropriate the sum of five hundred and fifty dollars for Liability Insurance of Town employees.


Article 8. To see if the Town will appropriate the sum of $400 to the Trustees for County Aid to Agriculture, to be expend- ed for Agricultural and Home Economics Extension Service in this County and Town, in accordance with the provisions of Sec- tions 40 to 45, Chapter :128 of the General Laws of Massachusetts.


Voted : To appropriate the sum of $400. to the Trustees of County Aid to Agriculture to be expended for the Agriculture and Home Economics Extension Service in this County and Town in accordance with the provisions of Section 40 to 45, Chapter 128 of the General Laws of Massachusetts.


Article 9. To see if the Town will authorize the number- ing of houses upon any of the streets of the Town, and make an appropriation for the same.


Voted : To appropriate the sum of one hundred dollars for the numbering of houses by order of the Selectmen.

Article 10. To see if the Town will appropriate the sum of $250. for the Board of Health to use in taking measures for the prevention of diphtheria in children of the Town.


Voted: To appropriate the sum of one hundred and fifty dollars for the use of the Board of Health for prevention of diphtheria in children of the Town.


Article 11. To see if the Town will appropriate the sum of $1,500, for the payment of land damage incurred in the reloca- tion and widening of Leonard Street.

Article 12. To see if the Town will take any action re- garding the installation of additional electric lights on any of the streets of the Town.

Article 13. To see if the Town will appropriate any sum of money to be used for the establishment and construction of side- walks and curbing on any of the streets of the Town.


Voted: That the sum of $2000.00 be appropriated for the purpose of constructing sidewalks and such curbing as is neces- sary on Springfield and Walnut Streets in North Agawam, the said sum to be raised by taxation during the current municipal year. It being intended that a reasonable amount, not exceeding one half of the total cost be assessed upon the abutting estates.


Article 14. To see if the Town will appropriate the sum of $10,000. or any other sum, to be raised by taxation for the con- tinuation of pavement on School Street, or take any action relating thereto.


Voted: That the sum of ten thousand dollars be appropri- ated for the construction of so called permanent highway on School Street, the same to be raised by taxation during the current municipal year.

Article 15. To see if the Town will appropriate the sum of $12,000. provided the State, the County and the Agawam Air- port, Inc. will each appropriate a like sum for the rebuilding of Silver Street from the present macadam on Elm Street to the Aga- wam Airport, Inc. with stone, block, brick or other pavement of similar lasting character and provide for raising the money by taxation or other wise, or take any action relating thereto.


Voted: To appropriate the sum" of twelve thousand dol- lars for rebuilding of Silver Street from the present macadam on Elm Street to the Agawam Airport, Inc. with stone, block, brick or other pavement of similar lasting character, providing the State, County and Agawam Airport, Inc. each contribute a like amount.


Article 16. To see if the Town will accept any street in Town as a Public Highway.


Voted: To leave the subject matter in the hands of the Selectmen.


Article 17. To see if the Town will appropriate any sum of money and provide for raising the same for a survey of drainage conditions (surface and sanitary) on any of the Streets of the Town.

Committee on Board of Survey reported as follows: "We, the undersigned committee of three appointed to consider the matter

of a Board of Survey and report at a future town meeting do hereby respectfully submit this report.


After due consideration our finding is in favor of the Town of Agawam Massachusetts adopting a Board of Survey in accor- dance with the General Laws of Massachusetts, Chapter 41 Sec- tion 73-81 inclusive.

Voted: That the town of Agawam, Massachusetts adopt a Board of Survey by acceptance of Chapter 41, Sections 73-81 in- clusive of the General Laws.


Article 20. To see if the Town will appropriate a sum of money for the care of North Cemetery.


Voted: To appropriate the sum of twenty-five dollars for the care of North Cemetery.


Article 21. To see if the Town will authorize its treasurer with the approval of the Selectmen, to borrow during the current municipal year beginning January 1, 1929, in anticipation of the revenue of said year such sums of money as may be necessary for the current expenses of the Town.


Voted: That the Treasurer with the approval of the Select- men be and is hereby authorized to borrow money from time to time in anticipation of the revenue of the municipal year beginning January 1, 1929 to an amount not exceeding in the aggregate the sum of the tax levy of 1928, and to issue a note or notes therefor payable in one year : any debt or debts incurred under this vote to be paid from the revenue of said municipal year.

Voted: That the town hereby does authorize its School Committee to spend from the funds annually appropriated for School purposes such amounts for the vocational education pro- gram as they may consider necessary.


Voted: That the Water Commissioners be hereby authoriz- ed to appoint one of their members as Superintendent for the en- suing year at a salary from water revenue not to exceed $1800.00.

ture meeting so that a moderator shall be elected at the annual election to hold office for one year.

Special Town Meeting


MAY 22, 1929


Article 1. To choose a Moderator to preside in said meet- ing.


Clarence H. Granger was elected Moderator.


Article 2. To see what action the Town will take in re- gard to reimbursing Emma I. Reed of said Agawam for installing certain sidewalks on both sides of Reed Street in said Agawam, extending from Main Street at the intersection of said Reed. Street and running along on said Reed Street, and including there- in 1920 lineal feet and appropriate any sum necessary for the same.


Voted: To pass over.


Article 3. In regard to reimbursing Emma I. Reed of said Agawam for the installation of an 8 inch sewer main and drain in said Reed Street at the intersection of Virginia Avenue in said Agawam at a distance of 1380 feet and appropriate any sum nec- essary for the same.


Voted : To pass over.


Article 4. To see what action the Town will take in regard to reimbursing Emma I. Reed of said Agawam for installing side- walks on Main Street in said Agawam beginning at the property owned by the said Town of Agawam being the Southerly line of the High School and extending to the home of said Emma I.

Reed at 116 Main Street in said Agawam and containing about 340 lineal feet more or less.


Voted: To pass over.


Article 5. To see what action the Town will take in re- gard to reimbursing the said Emma I. Reed for opening grading and surfacing Reed Street in said Agawam and being in distance about 1380 feet.


Voted: To pass over.


Article 6. To see if the Town will adopt a by-law regulat- ing the speed of motor vehicles within thickly settled districts of the Town.


Voted: To adopt the following by-law: It shall hereafter be unlawful for any motor vehicle to travel over thirty-five miles an hour over any of the highways of the Town.


All persons violating this ordinance shall be subject to a fine not exceeding twenty dollars ($20.00).


Article 7. To see if the Town will vote to amend Section 3 General of the Zoning By-laws by adding the following:


Paragraph L. Application for permit to build.


Before any person, owner, agent, builder or building mover shall erect, alter, repair or move any building, or structure or com- mence excavation therefor he shall make application in writing to the Board of Selectmen.


The Board of Selectmen shall grant permits for the erection, alteration, repairing or moving of any building or structure pro- vided the work contemplated in the application for permit to build, is in conformity with the provisions of these By-laws but not other- wise.

Voted: To adopt the following amendment to Section 3 General, of the Zoning By-laws, two thirds of those voting, voting in the affirmative.


Application for permit to build.

Voted : That the office of Moderator of Agawam be placed upon the ballot at the annual town election to be held the first Monday in March next, and to be elected thereafter annually by ballot.


Article 9. To transact any other business that may legally come before the meeting.

Special Town Meeting


NOVEMBER 25, 1929


Article 1. To choose a Moderator to preside in said meeting.


Clarence H. Granger was unanimously elected Moderator.


Article 2. To see if the Town will appoint a committee to investigate the need of accommodations for Town officers and re- port at the next Annual Town meeting.


Voted : To pass over.


Article 3. To see if the Town will take any action regard- ing the celebration of the 75th anniversary of the incorporation of the Town.


Voted: That a committee of six, two from each Precinct to be appointed by the Moderator, to make plans for the celebra- tion of the 75th anniversary of the incorporation of the Town with power to appoint sub-committees.


Article 4. To see if the Town will vote the sum of $2000.00 from Excess and Deficiency for sidewalks, to cover an error in the tax levy.


Voted: That we appropriate the sum of two thousand ($2000.00) dollars for sidewalks from the Excess and Deficiency account. The same being to cover the amount provided for said

work at the last annual town meeting, but not included in the tax levy.


Article 5. To see if the Town will amend its Zoning By- laws adopted on April 6, 1928, by changing such parts of the dis- trict bounded South by High Street, West by Bridge Street and Northerly and Easterly by the Agawam River, as is now in Res- idence B to Business.


Voted : To amend the Zoning By-laws adopted April 6, 1928 by changing such parts of the district bounded on the South by High Street, West by Bridge Street, and North and East by the Agawam River, as is now in Residence B to Business. (Unani- mously voted ).


Article 6. To see if the Town will amend its Zoning By- laws adopted on April 6, 1928 by changing from Residence A to Residence B that strip of land on School Street, Easterly of the Business Section at the corner of Main Street, for a distance of one hundred and forty feet, and one hundred and fifty feet in depth.


Voted: To amend the Zoning By-laws adopted April 6, 1928 by changing from Residence A to Residence B, that strip of land on School Street Easterly of the Business Section at the corner of Main Street, for a distance of one hundred and forty (140) feet and one hundred and fifty (150) feet in depth. (Un- animously voted ).


Article 7. To see if the Town will amend its Zoning By- laws adopted on April 6, 1928 by changing from Residence A to Industrial, the section of property described as follows : Commenc- ing at a point two hundred feet Northerly of a stone bound on the North side of Meadow Street 1196 feet Westerly of the South End Bridge, running Northerly one hundred seventy-six and 11/100 (176.11) feet to an iron pipe thence Westerly eighty and 74/100 (80.74) feet to an iron pipe: thence Northwesterly one hundred twenty-four and 74/100 (124.74) feet to an iron pipe : thence Southerly two hundred fifty-two and 95/100 (252.95) feet, thence Easterly to point of beginning approximately two hun- dred and six (206) feet.

To see if the Town will amend its Zoning By- laws adopted on April 6, 1928 by changing from Residence A to Business the section of property described as follows: Commencing at a point four hundred and twelve feet (412) Westerly of an iron pipe at the angle on Garden Street located at the property of one Zerra; thence running two hundred (200) feet westerly along Garden Street; thence running at right angles two hundred (200) feet Northerly; thence at right angles Easterly two hundred (200) feet ; thence Southerly about two hundred (200) feet, thence to place of beginning.


Voted: To amend the Zoning By-laws adopted April 6, 1928 by changing from Residence A to Business the district describ- ed as follows: Commencing at a point four hundred and twelve (412) feet westerly of an iron pipe at the angle in Garden Street located at the property of one Zerra, thence running two hundred (200) feet Westerly along Garden Street; thence running Nor- therly at right angles two hundred (200) feet; thence at right an- gles Easterly two hundred (200) feet; thence Southerly about two hundred (200) feet to place of beginning.
