Proceedings of Presidential Primary


COMMONWEALTH OF MASSACHUSETTS Norfolk, ss.


At a legal meeting of the inhabitants of the Town of Franklin, qualified to vote at the Presidential Pri- mary for the Election of Candidates of Political Par- , ties to the National Convention on Tuesday, the twen- ty-seventh day of April, 1920, in pursuance to the foregoing warrant. The meeting was called to order at four o'clock in the afternoon by Jacob F. Geb, Chairman of the Selectmen, and the warrant and re- turn thereon were read by the Town Clerk.

On April 9, 1920, Owen H. Morrissey and Harry Simon were appointed Ballot Clerks by the Select- men, and they were sworn to the faithful perform- ance of their duties by the Town Clerk before the opening of the polls. Freeman G. Knowlton and David W. Corson were appointed election officers and they were sworn as such before the opening of the polls, by the Town Clerk.


Thirteen voting compartments were provided by the Town, according to law, and a guard rail was erected six feet or more from said compartments. One'box of official ballots said to contain 1050 Re- publican and 950 Democratic ballots were delivered by the Town Clerk to Jacob F. Geb, Selectman, and his receipt taken therefor in the following form:


Franklin, Mass., April 27th, 1920. Received from Michael J. Costello, Town Clerk of Franklin, one box said to contain 1050 Republican and 950 Democratic ballots, to be used at the Presidential. Primary held in this Town this day.

The official ballot box was publicly opened and shown to be empty, and was examined by the Select- men and Town Clerk, and the register was set at 000 and then locked, and the key thereof given to Officer Freeman G. Knowlton.


The sealed boxes of ballots were delivered to the Ballot Clerks by Jacob F. Geb, Chairman of the Se- lectmen, and the cards of instruction and specimen ballots were posted, according to law, after which the polls were declared open.


The ballots were given to each voter by the Bal- lot Clerks, after the name of such voter and the po- litical party to which he had registered, or wished to be registered, had been publicly announced. The ballot so delivered to each voter was by him marked in one of the voting compartments, and thereafter deposited by such voter in said ballot box, after his name had been publicly announced and duly checked upon the voting list.

On April 9, 1920, the Selectmen appointed Wil- liam S. Johnson and D. Francis Pendergast as Tellers, and they were sworn by the Town Clerk to the faith- ful performance of their duties as such Tellers.


The polls were closed at eight o'clock P. M., due notice having been given, when the registers on the ballot box showed 171 ballots cast therein, and upon complete count of all the ballots cast therein it was found that there were 171 ballots cast into said box. and canceled thereby. The whole number of ballots delivered to voters by the Ballot Clerks was-171.


The ballots of each political party were can- vassed as required by law, and total result of said canvass was recorded on blank forms provided for that purpose. The names checked upon the voting lists used as aforesaid were counted audibly in the presence of election officers and the public, and the two check-lists used each showed 171 names checked thereon.


The check-lists used as aforesaid by the presid- ing officers and the Ballot Clerks were furnished by the Registrars of Voters for the purpose of said pri- mary. After the completion of the canvass of all votes and the whole sorted, counted and recorded, declaration thereof was made, according to law, in open Town Meeting, as follows, viz :-

To either of the Constables of the Town of Franklin, in the County of Norfolk :


Greeting.


You are hereby required in the name of the

Commonwealth of Massachusetts to notify and warn the qualified voters of said Town of Franklin, to as- semble in their Town Hall, on Tuesday, the eleventh day of May, A. D., 1920, at 8.00 o'clock in the after- noon, then and there to act on the following article :


Article 1. To see if the Town will vote to accept the provisions of Chapter 240, Acts of 1920, entitled "An Act to permit under public regulation and con- trol, certain sports and games on the Lord's Day," or do anything relating thereto.


And you are directed to serve this warrant by posting attested copies thereof seven days, at least, before the time of said meeting as directed by vote of said Town. Hereof fail not and make due return of this warrant with your doings thereon, at the time and place of said meeting. Given under our hands this thirteenth day of April, A. D. 1920.

By virtue of the within warrant, I have notified and warned the inhabitants of the Town of Franklin to assemble in their Town Hall on Tuesday, May 11th, A. D. 1920, at eight o'clock in the afternoon, for the purpose within mentioned, by posting attested copies of the within warrant in each of the postoffices in said Town, and in 10 other public places, seven days at least before the day of meeting, in compliance with Section 2 of Article I of the By-Laws of the Town of Franklin.

Proceedings of Special Town Meeting May 11th, 1920.


Pursuant to the foregoing warrant, a special meeting of the inhabitants of the Town of Franklin, qualified to vote in Town affairs, was held in the

Town Hall, in said Town, on Tuesday, the eleventh day of May, A. D. 1920, there being more than 75 voters present. The meeting was called to order at the time and place stated in said warrant, by the Moderator, and the warrant and return thereon were read by the Town Clerk. The recommendation of the Finance Committee appointed by the Moderator at the adjourned Annual Town Meeting, Feb. 24, 1920, was read and acted upon at the same time as the ar- ticle in the warrant to which it referred, and the meeting took action as follows: The Finance Com- mittee recommended that Article 1: To see if the Town will accept the provisions of Chapter 240, Acts of 1920, entitled "An Act to permit under public reg- ulation and control, certain sports and games on the Lord's Day," be accepted by the Town, and that the vote on said acceptance be taken by "Yes" or "No" ballot.


Motion made that the meeting adjourn to May 25, two weeks from tonight. Motion defeated.


Motion made that the report of the Finance Com- mittee be accepted and amended to read that the vote be taken by acclamation. Martin J. Donahue and Albert H. Martin were appointed Tellers by the Mod- erator and they were sworn as such by the Town Clerk. On the vote on amendment the Tellers did ascertain that 365 voted in the affirmative and 30 in the negative.


Motion 'made that the recommendation of the Finance Committee as amended be accepted and adopted and it was so voted.


Motion to adjourn at 8.40 P. M.

In the name of the Commonwealth you are here- by required to notify and warn the inhabitants of said Town who are qualified to vote in Primaries, to meet in Town Hall, Tuesday, the seventh day of Septem- ber, 1920, at 2.00 o'clock P. M., for the following purposes :


To bring in their votes to the Primary Officers for the Nomination of Candidates of Political Parties for the following offices :

The meeting was called to order at 2 o'clock P. M. by Edward S. Cook, Selectman, and the warrant and return thereon were read by the Town Clerk.


On Aug. 20th, William S. Johnson, D. Francis Pendergast, Harry Simon and Bernard W. McCabe were appointed Election Officers. Sept. 3rd, Herbert L. Metcalf, Thomas F. Keefe, Cornelius Greenway, John F. Conroy, Freeman G. Knowlton and David W. Corson were appointed election officers by the Selectmen and were sworn as such by the Town Clerk.


Voting compartments were provided by the Town, according to law, and a guard rail was erected six feet or more from said compartments. The cards of instructions and specimen ballots were posted ac- cording to laws. One box of official ballots said to contain 1400 Republican and 1100 Democratic bal- lots were delivered by the Town Clerk to Edward S. Cook, Selectman, and his receipt taken therefor in the following form:

The seals of the ballots were broken by Edward S. Cook, Selectman, who delivered the ballots to the Ballot Clerks, after which the polls were declared open.


The ballots were given to each voter by the Bal- lot Clerks after the name of such voter and the polit- ical party to which he had registered, or wished to be registered, had been publicly announced.

Petition For a Recount.


Franklin, Mass., Sept. 10, 1920.


We, the undersigned voters of Franklin, have reason to believe and do believe that the records or copies of records of the vote returned for Republican Candidates at the Primaries held on Sept. 7th last, are erroneous, and particularly with reference to the Candidates for Senator in the Fourth Worcester Dis- trict in that William L. Johnson of Uxbridge received more votes than were counted and returned, and that Charles W. Gould of Milford received fewer votes than were counted or returned, and that a recount of said votes will affect the result; wherefore we re- spectfully petition for a recount of said votes.
