By a rising VOTE of Yes 97-No 3 it was VOTED that the Town appropriate the sum of $12,500.00 by transfer from Excess and Defi- ciency Account to lay out, construct, operate and maintain a system of sewerage and sewerage disposal on Garden Street, Squire Street and Orchard Street, and across private land, and enter into present system on Main Street, in accordance with plans of Whitman and Howard, Engineers. Two-thirds of the cost of said construction shall be paid by the Town, and the remaining portion of the cost of the construction to be paid by and assessed upon the owners of the estates situated within the territory embraced by said system of sewers and benefitted thereby, shall be made and computed according to the frontage of such land on any way in which a sewer is constructed, as authorized by Chapter Six Hundred Thirteen (613) of the Acts of the year 1912.


Article 13. To see if the Town will vote to raise and appropriate or appropriate from available funds the sum of $1,500.00 to provide for the cost of preliminary plans for future sewer system extensions, to be expended under the direction of the Board of Water and Sewer Commissioners, or do anything relating thereto.


Unanimously VOTED that this article be indefinitely postponed.


Article 14. To see if the Town will vote to raise and appropriate a sum of Six Hundred Dollars ($600.00) to be expended by the Board of Health to hire a plumbing inspector as required by Chapter 142 of the General Laws to enforce a code of Plumbing Regulations and Laws to be approved by the Board of Health and State Department of Public Health; or do anything relating thereto.


Unanimously VOTED that this article be indefinitely postponed.


Article 15. To see if the Town will vote to raise and appropriate a sum of money for extending water main by laying and relaying water mains not less than 6", but less than 16" in diameter, from Washington Street westerly on Prospect Street to residence of S. Kahaian, and determine how the appropriation shall be raised by borrowing or otherwise, or take any action relative thereto.


Unanimously VOTED that this article be indefinitely postponed.

PROCEEDINGS OF THE ADJOURNED ANNUAL TOWN MEETING


March 16, 1950


The meeting was called to order by the Moderator, Romeo Assetta, at 7:30 P. M. George W. Dana, Town Clerk, stated that this meeting was duly called and held for the purpose of election of Town Officers on Tuesday, February 14, 1950, in the Emmons Street Auditorium. The warrant and return of the warrant was read by the Town Clerk. The polls opened at 6 A. M. and closed at 7 P. M. After the closing of the polls and before the adjournment of the meeting, a quorum being present, the following votes were passed.


Article 2. VOTED that the remaining Town Officers be appointed by the Selectmen.


Article 4. VOTED that the Town Treasurer be authorized, with the approval of the Selectmen, to borrow money from time to time in anticipation of the revenue of the financial year, beginning January 1, 1950, and to issue a note or notes therefor, payable within one year, and to renew any note or notes as may be given for a period of less than one year in accordance with Section 17, Chapter 44 of the General Laws.


Following the above votes it was moved, seconded and voted that the meeting stand adjourned to Thursday, March 16, 1950 at 7:30 P. M. in the High School.


Articles 1, 2 and 4 having been acted upon the Moderator read Article 3.


Article 3. To hear a report of the Town Officers and Committees and act thereon.


VOTED that the report of the Town Officers and Committees as printed in the Town Report be accepted.


The following report was submitted by the Committee appointed to study Zoning By-Laws of the Town of Franklin.

REPORT OF COMMITTEE APPOINTED TO STUDY ZONING BY-LAWS OF THE TOWN OF FRANKLIN


It is the opinion of this committee that the principles laid down by the Zoning By-Laws are fundamentally sound. Some of the sections of the law and the zoning map may require amendment. In our opinion such a law will always be subject to revisions as conditions change and whenever special situations arise. We feel that recommendations for such revisions are an important function of the Town Planning Board who are closest to the questions involved.


In the study we have made of the problems connected with the Zoning By-Laws, we have found that most of these involved adminis- tration and enforcement of the law rather than any basic weakness in the law itself.


Our ideas on this subject have been discussed with the Town Planning Board. They have already taken steps toward the solution of some of the zoning problems. It. is only by constant work and intelli- gent action by the Planning Board that Franklin can have sound and effective zoning regulations.


In conclusion we respectfully request that this committee be re- leased from further duties.

1. For general government, including the Compensation and ex- penses of. the Selectmen, Auditor, Moderator, Collector of Taxes, Treasurer, Assessors of Taxes, Town Clerk, Election and Registration, Dog Officer, Planning Board, Advisory Board, Field Driver, Town Hall and other finance accounts.


2. For Protection of Persons and Property, including the payment of Police and Suppression of Illegal Liquor Traffic, Bicycle Registration, Support of Fire Department, Sealing of Weights and Measures, Ex- termination of Gypsy Moths, Elm Beetle and Dutch Elm, etc., Trimming of Shade Trees and for Prevention and Suppression of Forest Fires.

3. For Health and Sanitation, including expenses of the Board of Health, Inspection of Animals, Inspection of Meats and Provisions, Inspection of School Children, Construction and Maintenance of Sewer and Sewer Beds.


4. For Highway and Bridges, including construction and repair of Roads, Bridges, Sidewalks, Street Lighting, Tarvia, Snow Removal and all other Highway Expenses. Also for Union Street and City Mills Cemeteries, Street Lines and Signs and the Maintenance and Opera- tion of Traffic Signals.


5. For Public Charities, for Aid to Outside Poor, Welfare Adminis- tration, Old Age Assistance, Old Age Assistance Administration, Aid to Dependent Children and Aid to Dependent Children Administration.


6. For Veterans' Center and Benefits, including Soldiers' Burials.


7. For Education, including all expenses of School Committee.


8. For the Franklin Public Library.


9. For the Improvement of the Commons, for Swimming Pool and for Playground Maintenance.


10. For Unclassified Accounts, including the Decoration of Soldiers' Graves, Printing and Distribution of the Town Reports, for the Town's share of cost of Maintenance of Norfolk County Retirement System, Foreclosure of Tax Liens, the various Insurance Accounts, including Fire Insurance, Fleet Fire and Theft, Fleet Liability and Property Damage, Workmen's Compensation and also for Rent of Quarters for the Veterans of Foreign Wars, United Spanish War Vet- erans and Disabled American Veterans.


11. For the Maintenance and Operation of the Water Department and the Compensation of the Water Commissioners.


12. For the payment of Interest on Town Debts.


13. For the payment of Municipal Indebtedness.

VOTED that the Town raise and appropriate the sum of One Hun- dred Dollars ($100.00) to purchase eyeglasses and spectacles for children under eighteen years of age and whose parents or guardians are finan- cially unable to provide for them, the same to be expended under the direction of the Selectmen, as provided for in amendment to Section V, Chapter 40 of the General Laws.

To see if the Town will vote to raise and appropriate the sum of Three Thousand Dollars ($3,000) for the purpose of continu- ing the program of surveying and making plans of the Town under the direction of the Town Planning Board, said plans and survey to be used by all departments of the Town, or do anything relating thereto.

Article 15. To see if the Town will vote to raise and appropriate the sum of One Hundred Dollars ($100.00) to be expended by the Tree Warden for buying and planting new shade trees, or do anything re- lating thereto.

Article 18. To see if the Town will vote to raise and appropriate the sum of Two Thousand Dollars ($2,000) for the construction of East Park Street, 500 feet by 24 feet, said sum to be expended under the di- rection of the Selectmen, or do anything relating thereto.

Article 22. To see if the Town will vote to raise and appropriate the sum of Five Hundred Dollars ($500.00) for control work on Dutch Elm Disease. Recent passage of Chapter 761 General Laws Acts of 1949 calls for separate funds for this work and cannot be included with a

general appropriation for Gypsy Moth or other insect work. This money to be expended by the Moth Supt. under jurisdiction of the Department of Conservation, or do anything relating thereto.


VOTED that the Town raise and appropriate the sum of Five Hun- dred Dollars ($500.00) for control work on Dutch Elm Disease, said sum to be expended by the Moth Superintendent under jurisdiction of the Department of Conservation.


Article 23. To see if the Town will vote to raise and appropriate the sum of One Thousand Dollars ($1,000.00) for the salary of a Town Counsel, or do anything relating thereto.


VOTED that the Town raise and appropriate the sum of One Thou- sand Dollars ($1,000.00) for the salary of a Town Counsel.


Article 24. To see if the Town will vote to raise and appropriate a sum of money to establish an auxiliary Water Supply for the swim- ming pool, or do anything relating thereto.


VOTED that this article be indefinitely postponed.


Article 25. To see if the Town will vote to authorize any depart- ment of the Town to sell scrap up to the amount of $100.00, or do any- thing relating thereto.

VOTED that the Town close out and transfer to Excess and Defi- ciency Account the balance of Three Hundred and Eighty-six Dollars and Sixty-nine cents ($386.69) left in the appropriation voted under Article 50 of the 1947 Annual Town Warrant for the installation of orna- mental street lights.

To see if the Town will vote to appropriate the sum of the income of the Fletcher Fund for the construction and equipment of a playground and recreational field on "Fletcher Field," or any other place designated as a Public Playground, to be expended under the di- rection of the Playground Committee, or do anything relating thereto.
