ARTICLE 63. On motion of Carl H. Amon, Jr. it was voted that the motion of Lawrence Drew to repeal the General By-Laws of the Town of Reading as revised to June 1, 1949, and as amended to date, and to adopt the By-Laws as stated in said Motion, be amended as follows :-


1. By striking out Section 4 of Article VII of the By-Laws recited in said Motion.


2. By changing the numbers of each Section subsequent to Section 4 so that Section 5 as recited in said Motion shall become Section 4, Section 6 shall become Section 5, Section 7 shall become Section 6, Sec- tion 8 shall become Section 7, and and Section 9 shall become Section 8, so that Article VII as recited in said Motion shall read as follows :-


ARTICLE VII. Powers and Duties of Finance Committee


Section 1. There shall be a Finance Committee consisting of fifteen voters of the Town, no one of whom shall be a Town Officer or a mem- ber of a department receiving a salary, but nothing herein shall prohibit a member of such committee from holding office as a Town Meeting Member under any form of representative Town Meeting Government.


The Finance Committee shall be appointed by the Selectmen within thirty days after the final adjournment of the annual town meeting; five shall be appointed annually to serve for three years each. Any vacancy in the committee shall be filled by the Selectmen. The members of the Finance Committee who are in office at the time these by-laws be- come effective shall hold office until the expiration of the terms for which they have been appointed. The Town Accountant shall ex-officio be Clerk of the Committee; eight members shall constitute a quorum.

Section 2. The Finance Committee shall meet at the call of the Town Accountant within fifteen days after the date the new members are appointed and those then taking office shall be sworn to the faithful performance of their duties and at this meeting the Committee shall choose its Chairman and Vice Chairman.


Section 3. If any member of the Finance Committee is absent from three or more successive meetings the other members of the Committee may by the affirmative vote of each of a majority of its members re- quest the Board of Selectmen to remove such absenting member from his membership and the Board of Selectmen may thereafter by a major- ity vote so remove such member and may notify him by mail of such removal. The Board of Selectmen shall then promptly fill the vacancy so created by appointing a successor for the remainder of the term for which such member was appointed.


Section 4. The Finance Committee shall make written recommen- dations to the Town Meeting on all articles contained in any warrant which involve the expenditure, appropriation, and raising and borrow- ing of money.


Section 5. The Finance Committee shall make a written report to all Town Meetings. The report for the Annual Town Meeting shall be filed with the Town Clerk prior to the first Monday of March of each year, for distribution to Town Meeting Members and citizens of the Town. The report for a Special Town Meeting shall be filed with the Town Clerk one week prior to the date of such meeting, for distribution to Town Meeting Members and citizens of the Town.


Section 6. If there be a majority and a minority report of the Fi- nance Committee, the minority report shall have precedence of all other motions to amend the report of the majority and shall be voted upon before any other amendment is considered.


Section 7. The Finance Committee, or its duly authorized agents, shall have authority at any time, and upon the petition of one hundred citizens they shall at once investigate the books, accounts, records, and management pertaining to the finances of any office or department of the Town, and said committee may employ such assistance as it may deem advisable for that purpose but shall have no power to incur any expense payable by the Town without authority for such expense hav- ing first been obtained from the Board of Selectmen.


Section 8. The Finance Committee in making its report upon any subject referred to it shall arrange the report in clear and compact form, and shall divide it into separate propositions whenever in its judgment such divisions may be desirable. The committee shall attach to each proposition its own recommendation.


ARTICLE 63. On motion of Robert E. Turner it was voted that the motion of Lawrence Drew to repeal the General By-Laws of the Town of Reading as revised to June 1, 1949 and as amended to date, and to adopt the By-Laws as stated in said motion, be amended as follows :-


1. By striking out the amount of "One Thousand Dollars" in Sec- tion 3 of Article X and inserting in place thereof the amount of "Two

Thousand Dollars", so that said Section 3 of Article X shall read as follows :-


"Section 3. The officers of the different Town departments shall call for competitive bids on all labor or material to be furnished to the Town, and on all accounts to be given out by the town, where the labor or material to be so furnished, or where the estimated amount under the contract so to be given out exceeds the sum of Two thousand dollars; said call for bids shall be advertised by publishing the same in the lo- cal newspaper, and by posting notices of the same in three or more public places in the Town, or by publishing the same in two Boston daily newspapers, which shall not have less than three insertions in each at intervals of two days; the last publication to be at least two days be- fore the opening of the bids".


2. By adding after Section 4 of Article X the following new Section 5 :-


"Section 5. The officers of the different town departments shall obtain at least three competitive bids on all labor or material to be fur- nished to the Town and on all accounts to be given out by the Town, where the labor or material to be so furnished, or where the estimated amount under the contract so to be given out exceeds the sum of One thousand dollars but is less than the sum of Two thousand dollars".


3. By changing the number of Section 5 of Article X as recited in said Motion, to Section 6 of Article X.


ARTICLE 63. On motion of Carl H. Amon, Jr. it was voted that the motion of Lawrence Drew to repeal the General By-Laws of the Town of Reading as revised to June 1, 1949 and as amended to date, and to adopt the By-Laws as stated in said motion, be amended as follows:


1. By inserting in Section 2 of Article X as recited in said motion after the word "Town", in line 2, the following: "except a Town Meet- ing Member";


2. By striking out in line 7 of Section 2 of Article X as recited in said motion the words "in each of the above cases"; so that said Section 2 of Article X shall read as follows :-


"Section 2. No town officer nor salaried employee or official of the Town except a Town Meeting Member, shall sell materials or sup- plies to the Town, nor receive any compensation or commission, direct- ly or indirectly, for services rendered by him to the Town, except his official salary and fees allowed by law, without obtaining the permis- sion of the Board of Selectmen expressed in a vote which shall appear on their records with the reasons therefor".


ARTICLE 63. On motion of Carl H. Amon, Jr. as amended by R. Tracy Eddinger it was voted that the motion of Lawrence Drew to re- peal the General By-Laws of the Town of Reading as revised to June 1, 1949 and as amended to date, and to adopt the By-Laws as stated in said Motion be amended by adding after Article XX the following Article:

"Article XXI - Amendment.


Section 1. These by-laws may be amended at any annual or special town meeting by a majority vote of the Town Meeting Members present and voting at said meeting, provided that an article or articles for that purpose have been inserted in the warrant for said meeting".


On motion of Lawrence Drew it was voted that the General By-Laws of the Town of Reading as revised to June 1, 1949, and as amended to date, be repealed and that the following By-Laws (as printed in book form attached herewith) of the Town of Reading be adopted, as amended at this meeting.


ARTICLE 4. On motion of Lawrence Drew it was voted to take Article 4 from the table.

The meeting was called to order by the Moderator, Kenneth C. Latham, at 8:15 P.M.


Mr. Latham delivered an invocation.


The warrant was partially read by the Town Clerk when, on motion of Lawrence Drew it was voted to dispense with further reading of the warrant except the Constable's Return which was then read by the Town Clerk.


ARTICLE 1. The Finance Committee wishes to amend its report by striking out under Article No. 6 the words "do not recommend" and inserting in place thereof "Recommend in the amount of $5,000. To be raised from the tax levy."

The Finance Committee further wishes to amend its report by striking out under Article No. 5 the words "do not recommend" and in- serting in place thereof "Recommend in the amount of $1500. To be raised from the tax levy."

On motion of Lawrence Drew it was voted to place Article 1 on the table.


ARTICLE 2. On motion of Lawrence Drew it was voted that the sum of Two Hundred Dollars ($200.00) be transferred from the Police Station Maintenance Account and that the sum of Two Hundred Dollars ($200.00) be transferred from the Police Department Salaries Account, and that said sums aggregating Four Hundred Dollars ($400.00) be ap- propriated for Police Department Maintenance, which appropriation is to be added to the previous appropriation for Police Department Main- tenance, and that the Town Accountant be and he hereby is authorized and instructed to transfer said sums to the account for Police Depart- ment Maintenance to carry out the purpose of this vote.


ARTICLE 3. On motion of Lawrence Drew it was voted that the sum of Two hundred dollars ($200.00) be transferred from Veterans' Benefits Pension Account and be appropriated for Veterans' Benefits Administrative Salaries, which appropriation is to be added to the pre- vious appropriation for Veterans' Benefits Administrative Salaries, and that the Town Accountant be and he hereby is authorized and instructed to transfer said sum to the account for Veterans' Benefits Administrative Salaries to carry out the purpose of this vote.


ARTICLE 4. On motion of Lawrence Drew it was voted that the sum of Three Hundred twenty-five dollars ($325.00) be transferred from Fire Department Maintenance Account and be appropriated for Civil Defense which appropriation is to be added to the previous appropriation for Civil Defense, and that the Town Accountant be and he hereby is authorized and instructed to transfer said sum to the account for Civil Defense to carry out the purpose of this vote.


ARTICLE 5. On motion of Lawrence Drew it was voted that the sum of Fifteen Hundred Dollars ($1,500.00) be raised and appropriated for the construction of a parking area on land owned by the Town ad- jacent to the Community Center and for surfacing said area with bi- tuminous concrete, such sum to be expended under the direction of the Board of Selectmen.


ARTICLE 6. On motion of Lawrence Drew it was voted that the sum of Five Thousand Dollars ($5,000.00) be raised and appropriated for the purpose of the construction of a parking area on land owned by the Town adjacent to the Municipal Building and for surfacing said area with bituminous concrete, and for maintaining said parking area, such sum to be expended under the direction of the Board of Selectmen.

ARTICLE 7. On motion of Coleman J. Donahue it was voted that the sum of Twenty Thousand Dollars ($20,000.00) be raised and ap- propriated for the purpose of effecting channel improvements and re- location on the Aberjona River, otherwise known as Birch Meadow Brook, from Lowell Street to the intersection of West Street, Willow Street and Summer Avenue, including the construcion of a reinforced concrete box culvert or pipe culvert under the Boston & Maine Railroad at the said Aberjona River of a suitable size to accommodate the flood flow of said Aberjona River, and including also all other incidental work relating to said channel improvements. relocation, and culvert con- struction, and for the acquisition of land for said purposes.

ARTICLE 8. On motion of Coleman J. Donahue it was voted that the Town assume liability in the manner provided by Section 29 of Chapter 91 of the General Laws as most recently amended by Chapter 5, Acts of 1955, for all damages to property by the taking of land or of any right, interest or easement therein that may be incurred by work to be performed by the Department of Public Works of Massachusetts for the purpose of effecting channel improvements and relocation on the Aberjona River, otherwise known as Birch Meadow Brook, from Lowell Street to the intersection of West Street, Willow Street and Sum- mer Avenue, in accordance with Section 11 of Chapter 91 of the General Laws, and that the Board of Selectmen of the Town of Reading, be and they hereby are authorized and empowered to execute and deliver on behalf of the Town of Reading an agreement to indemnify the Commonwealth of Massachusetts against all damages that may be sustained by any person whose land or any rights or interest therein is taken for or is injured by said work.


ARTICLE 9. It was moved, by Lawrence Drew, that the General By-Laws of the Town of Reading be amended by inserting after Article XVIII thereof the following new Article to be known as Article XVIIIA :- (This motion was read in its entirety, by the three Selectmen, spelling each other, exactly as it is printed in the Warrant for this Special Town Meeting under Article 9.)


ARTICLE 9. On motion of Carl H. Amon, Jr. it was voted that the motion of Lawrence Drew to amend the General By-Laws of the Town of Reading by adding a new Article XVIIIA be amended by -


(1) striking out in Paragraph 3 of the Regulations of said Article XVIIIA as recited in said motion, the following: "April 15, 1957" and "April 15, 1958"


and by substituting therefor the following: "April 15, 1959" and "April 15, 1960"


ARTICLE 9. On motion of Coleman J. Donahue it was voted that the General By-Laws of the Town of Reading in the new Article XVIII-A,
