TAX HOMESTEAD LANDS.
SEC. 5. This land was originally intended to be held for homestead only, and is a class of land created from delinquent tax land held for more than five years by the auditor general, and under the law then deeded to the state by the auditor general and transferred to the commissioner of the state land office to be disposed of by him. Under amendments to the law these lands are now withdrawn from homestead entry and are appraised and placed in market to be sold. They can be purchased only upon payment of the full amount of the purchase price, such payment to be made when the ap- plication is filed with the commissioner of the state land office. Discretion is given to the commissioner of the state land office and the auditor general to withdraw these lands from sale, and re-open them to homestead entry, and upon filing an applica- tion for a homestead certificate by any party desiring to homestead not more than one hundred sixty acres and upon the payment of the fee of ten cents per acre, the lands, if found to be suitable for agricultural purposes and not merely valuable for the timber that may be growing thereon, will be restored to homestead entry and a certificate, granted to the person applying for the same. Blank forms for application for a home- stead certificate will be furnished upon a request made to this office.
Any person more than twenty-one years of age may homestead any legal subdivision, not exceeding 160 acres that has not been withdrawn from such entry. The lands for which application is made for the purpose of a homestead must be in one body, and a homestead certificate will not be issued for lands that touch at the corner only.
Applicants for homesteads are required to pay at the time of application, ten cents per acre, and reside upon and improve for five consecutive years, when, if the terms of the certificate have been complied with, a deed will be issued by the state.

FORFEITED LANDS.
SEC. 7. The price of forfeited part-paid lands, now held by the state, is the original minimum price per acre and all improvements and unpaid taxes added thereto. ·

Deeds or patents to state lands will not be issued to any party and sent to any bank or other collecting office to be delivered to the purchaser upon his payment at such office of the purchase price.
SEC. 9.
