ANNUAL APPROPRIATION
Resolved by the City Council of the City of Rochester :
That for the support of the various departments for the year 1916, there be raised by taxation the sum of one hundred fifteen thousand, three hundred sixty-three dollars, and sixty-three cents ($115,363.63) and the assessors are directed to assess that amount with such overlay as may be thought necessary.

TO PROVIDE EMPLOYMENT FOR THOSE APPLY- ING FOR AID
Resolved by the City Council for the City of Rochester :
That the sum of one hundred dollars ($100.00) be, and the same is hereby appropriated to be placed at the disposal of the Overseers of the Poor to provide employ- ment for those who are, or who may be dependent upon the city for aid, and who are able to perform some work, and be it further resolved, that the Mayor, with the unanimous approval of the Overseers of the Poor, is hereby authorized to designate the department in which employment may be given in such cases and to have the general supervision over such employment, and that the same shall be paid out of the regular appropriation for the Miscellaneous department.

PROVIDING CHECKING RACKS HOUSE

Resolved by the City Council of the City of Rochester :
That the Committee on Public Buildings, with the approval of the manager of the Opera House, be author- ized to suitably equip the room in City Hall, known as Gentlemen's Room, as a check room, at an approximate expense of fifty dollars, to be paid from the Opera House department.

RELATING TO THE SALARY OF THE CHIEF ENGINEER OF THE FIRE DEPARTMENT
Be it ordained by the City Council of the City of Roch- ester as follows :
Amend paragraph 16 of section 1, Chapter XXIV, by striking out the words "sixty dollars per month " and inserting in place thereof the words "seven hun- dred and eighty dollars per year" so that said paragraph as amended shall read as follows :- "The Chief Engi- neer of the Fire department, seven hundred and eighty dollars per year, payable monthly from the Fire department."

RELATING TO CONSTRUCTION OF ISINGLASS BRIDGE
Resolved by the City Council of the City of Rochester :
That the Committee on Finance be authorized to hire on note or notes of the city a sum of money not exceed- ing three thousand dollars ($3,000.00) for the purpose of constructing a bridge over the Isinglass river on the Rochester Neck road, and that the Committee on Roads, Bridges, and Drains be authorized to complete the same as per plans and specifications submitted by Edward N. Sheffield, civil engineer, of Nashua, and according to the design approved by said Committee on Roads, Bridges and Drains, and at a cost not to exceed the amount appropriated. Amended as follows :- That the

RELATING TO BUILDINGS IN FIRE PRECINCT
Be it ordained by the City Council of the City of Roches- ter as follows :
Chapter IX, Section 1 of the Ordanances of the City of Rochester is hereby amended by inserting after the word "incombustible" in the fifth line of said section the following :- "nor hereafter re-cover the roof of any dwelling house or building with combustible material," so that the part of said section as amended shall read as follows :
Section 1. No person, without the consent of the City Council, shall hereafter erect, or cause to be erected any building unless the walls and roof shall be incom- bustible, except dwelling houses, the roof of which shall be incombustible, nor hereafter re-cover the roof of any dwelling house or building with combustible material, within the following limits of the city, to wit :

REGARDING INSTALLATION OF POLICE ALARM SYSTEM WIRES
Resolved by the City Council of the City of Rochester :
That the Committee on Police be and the same is hereby authorized to negotiate with the New England Telephone and Telegraph Company for the installation of a police telephone system along the lines recom- mended by representatives of said company, and that a sum not exceeding one hundred and fifty dollars ($150) be placed at the disposal of said Committee for said purpose, the same to be paid out of the regular appro- priation for the Miscellaneous department.

RELATING TO SALARY OF CLERK OF POLICE COURT
Be it ordained by the City Council of the City of Roch- ester as follows :
Section 1. The salary of the Clerk of the Munici- pal Court of Rochester shall be two hundred dollars ($200.00) payable quarterly.
Section 2. All ordinances and parts of ordinances inconsistent with this ordinance are hereby repealed and this ordinance shall take effect July 1, 1915.

to be drawn, move or cause to be moved upon any pub- lic highway or street in said Rochester, any harrow, plough, or other instrument or implement liable to cause injury to the surface of said public highway or street, unless the same is being carried or transported upon a drag, vehicle or other conveyance.
Section 2. Any person convicted of said offense shall be fined a sum not less than five dollars ($5.00) nor more than twenty dollars ($20.00.)

ACCEPTING TRUST DEED OF DOMINICUS HAN- SON PARK
Resolved by the Mayor and Council of the City of Rochester :
That the Trust Deed of Dominicus Hanson Park, by Charles A. C. Hanson to the City of Rochester, is hereby accepted upon the terms and conditions therein stated : and, be it further resolved, that we hereby express our satisfaction and appreciation of the public spirit, the

foresight and the liberality, which prompted the earlier wishes of Dominicus Hanson to provide such a valuable gift for the benefit of the whole public, and which, agreeably to said wishes of the father, the pains- taking care and thoughtfulness of the son, in the prepa- ration of the present physical condition of the property, and the careful and thorough manner in which the Trust Deed has been executed, has been so faithfully consummated : and be it further resolved, that the City Clerk attend forthwith to the recording of said Trust Deed in the Strafford County Registry : and be it fur- ther resolved, that this resolution be spread upon the records and a copy of the same transmitted to Charles A. C. Hanson, by the City Clerk, with the sincere thanks of this body in behalf of the City of Rochester.

That the sum of twelve hundred dollars ($1,200.00) be, and the same is hereby appropriated, to liquidate, in part, the deficiency in the amount of money on hand, from the appropriation for schools, and other receipts including the Literary Fund, Dog License, and Tuitions, on account of additional expenses already contracted, together with the ordinary expenses of running the schools to the end of the school year ; in order that the schools shall not be closed, and the bills necessary to be paid to December 31, 1915, taken care of ; the remainder of the deficiency going over to next year, when the appropriation of 1916 will be available, and that said sum of twelve hundred dollars be paid out of the regu- lar appropriation for the Miscellaneous department.

Dominicus Hanson Park
Know All Men By These Presents
That I, Charles A. C. Hanson of Rochester, County of Strafford and State of New Hampshire, bachelor, agreeably to the earlier wishes of my father, Domini- cus Hanson, late of said Rochester, and as a memorial from him, and in consideration of the sum of One Dol- lar to me in hand, before the delivery hereof, well and truly paid by the City of Rochester, Trustee, in said County, the receipt whereof I do hereby acknowledge, have granted, bargained and sold, and by these presents do give, grant, bargain, sell, alien, enfeoff, convey and confirm unto the said City of Rochester, Trustee, its successors and assigns in said trust, the following de- scribed property for the purposes, and upon the condi- tions hereinafter specifically set forth.
The said property consists of one certain tract of land situate in said Rochester upon the northeasterly bank of the Cocheco River, and lying between said river and the location of the Boston & Maine Railroad, for- merly the Dover and Winnepesaukee Railroad and known as the Hanson Pines, together with an approach fifty feet (50 ft.) in width as designated by said Charles A. C. Hanson from the Chestnut Hills Road, so called, which tract is more particularly described as follows :
Bounded northeasterly by land of the Boston & Maine Railroad, formerly known as the Dover and

Winnepesaukee Railroad: southeasterly by land of Jedediah Morrill, commencing at the Boston & Maine Railroad and running by the face of two stone monu- ments set in the ground on said tract to the Cocheco River; southwesterly by said Cocheco River; north- westerly by land of Frank Smith, beginning at said River and running by the face of two stone monuments set in the ground on said tract to the land of said Rail- road Company.
Which said tract has been improved by said Charles A. C. Hanson since the decease of his father, Dominicus Hanson, at an expense of over One Thous- and Dollars ($1,000) by cutting and removing over three hundred loads of bushes, trees and maples, and in constructing avenues, drives, walks and paths,-all agreably to the earlier suggestions of said Dominicus Hanson,-the purpose being to afford to the public a park, wooded with health-giving pines, covering the ground with a carpet of pine-needles, excluding maples and other trees which yield only leaves and mold, but retaining some nut-bearing trees,-also affording to the public opportunities in connection with the park for water sports upon the beautiful Cocheco River already used for canoeing and boating, giving a beau- tiful sail from Duval Park and Silas Hussey Bridge by boat to the Hanson Park landing, which river may be later used for regattas.
The growth of pine should be encouraged and to that end said grantor advises that the pine-spills and pine-cones be allowed to remain upon the ground as the pine-spills are the only fertilizer that the pines have and by their removal the life of the pines would be sacrificed, while the pine-cones are largely used by the squirrels for food.

Said City of Rochester, its successors and assigns under this trust shall forever hold said property in trust for the benefit of the public as a wooded and tim- bered park, and a place of recreation for the people not only of Rochester and surrounding towns and cities, but of the world at large.
Said City shall have full control and management of said park and may make such rules and regulations as seems best governing the use of said park for the purposes herein specified.
This conveyance is made upon the following express conditions :
First. The said City of Rochester shall by a vote of its Mayor and Council accept this deed as trustee to serve without pay and upon the other conditions herein stated, and if necessary to the proper execution and fulfillment of said trust shall seasonably seek and obtain any legislative authority necessary to the carrying out thereof.
Second. . Any trustee appointed under this deed shall accept the trust to serve without pay.
Third. That said Park shall be forever known as the Dominicus Hanson Park.
Fourth. That the evergreen and nut-bearing timber and trees standing and growing upon said premises shall be kept standing thereon and permitted to grow, except so far as a reasonable and advantageous use of said premises as a wooded park requires the con- struction of parkways and paths thereon, fountains, pavilions and buildings for public use, including other art embellishments as well as animal dens and en- closures, aviaries, etc., and no evergreen or nut-bearing trees shall be cut upon said premises except for said purposes until they have died and it is apparent from

their age and decay that they are no longer advan- tageous for the purposes of a park. It is my purpose that the question of the profit from the sale of lumber in any of the trees shall not be given any weight in the administration of this park except so far as the timber can be utilized when it has ceased to be of advantage as a covering and shade to said park, which shall be maintained by said trustee as a perpetual public park forever.
The City may make such improvements as it deems necessary to carry out the purpose and intent of this deed to make said tract a perpetual park forever.
Fifth. That no trees whatever unless dead or dangerous to the public, shall be cut upon said premises during my lifetime without my personal approval.
Sixth. There shall be no highways across the park, but there may be a park-way of the same width as a substitute for the same use.
Seventh. Whatever proceeds may come from the timber cut and removed from said premises under the conditions hereinbefore enumerated shall be kept and used as a fund for the improvement and for beauti- fying said park.
If for any reason there should be a failure of this trust then for the consideration of One Dollar to me in hand before the delivery hereof, well and truly paid by the Protestant Churches of the City of Nashua in said State, the receipt whereof I do hereby acknowledge, I do give, grant, bargain, sell, alien, enfeoff, convey and confirm unto the said Protestant Churches of the City of Nashua, their successors and assigns forever all of the property hereinbefore described and all property thereon and all improvements thereon that shall have been made.

I am depending upon my Catholic friends in Rochester, to see that the Protestant Churches of Nashua do not get any part of said property and upon my Catholic and Protestant friends in Rochester to see that the purpose of the trust for the benefit of the public is faithfully carried out.
If more than Five Hundred Dollars ($500) in value of trees be cut at any time, except in case of damage by fire or hurricane, or if at any time the un- expended fund arising from the cutting of any trees or growth upon said premises (except in case of damage by fire or hurricane) exceeds the sum of Five Hundred Dollars ($500), under the provisions of clause four, I direct that said sum be paid by my said Trustee to the said Protestant Churches of Nashua. If at any time the park is injured by fire or hurricane, however, the proceeds from the sale of trees actually blown down or killed by fire, may be held by said Trustee as a special fund, the income on which shall be used for the improvement and beautification of said park without limit to the amount thereof.
This trust shall not fail however for the want of a trustee, but the Superior Court of said County is given power to appoint a trustee in case of a vacancy in said trusteeship.
This deed shall be recorded in the Registry of Deeds for said County of Strafford.
The City of Rochester shall be exempted from giving bond for the faithful performance of said trust.
No celebration is required at the acceptance of this deed as the donor of this valuable gift is reposing in the cemetery where all will later rise when the Trumpet sounds, from their long sleep.

TO HAVE AND TO HOLD the said granted premises with all the privileges and appurtenances to the same belonging, to the said City of Rochester, Trustee, and its successors and assigns, to its and their only proper use and benefit during the continuance of a valid trust hereunder and forever if the conditions hereinbefore set forth are kept.
But if there be a failure or termination of said trust, then, and then only, the entire property shall pass to the said Protestant Churches of Nashua and be owned by them with all the improvements then thereon ; to have and to hold the said granted premises with all the privileges and appurtenances to the same belonging to the said Protestant Churches of the City of Nashua, their successors and assigns to their only proper use and benefit forever.
And I, the said Charles A. C. Hanson, and my heirs, executors, and administrators do hereby cov- enant, grant, and agree, to and with the said City of Rochester, Trustee, and the said Protestant Churches of Nashua, and their several successors and assigns that until the delivery hereof I am the lawful owner of said premises, and am seized and possessed thereof in my own right in fee simple; and have full power and lawful authority to grant and convey the same in man- ner aforesaid; and that the premises are free and clear from all and every incumbrance whatsoever, and that my heirs, executors and administrators shall and will warrant and defend the same to the said grantees, their successors and assigns as hereinbefore set forth, against the lawful claims or demands of any person or persons whomsoever.
