Yor Honrs of the 27th of May last being read here att Councile Board wherein you intimate to us that the Left Govern' of his Majests Province of Massachusetts Bay has given accott that the avowed Eni- mies and Indians to his most sacred Majesty might be prevented of Supplies wch yearly comes to them to St Johns &c and that it would be for his Majests Service and defence of his Subjects here and the Safety and quiett of them in these territories, by afording supplies to fitt out his Majests two Friggetts for Cruzing in the Bay of ffunday, and of the Dificulty of fitting out sd men of warr wth men sutable, so that there is desired fortie men to be employed in that Service from this Province. Wee offer that wee are ready to assist in all things both by land & sea to the uttmost ability of this his Majests Province, but such has been the great charge and expence of keeping out 40

men for the Guard of our ffrontires, and the scarcity of Land men (not fitt for that service) that the Province in the first place'is not in a Capacity of Sparing Land men, and as for Seamen, the men of warr has prest soe many out of vessells belonging to this Province that the shipps must lie still for want thereof, thay having imprest out of one ship which belongs to this place between 20 & 30 men wch is very Considerable, besides those that have been taken out of Smaller Ves- sells. So that at present wee are wholly uncapable of giving ye Supply desired.

I George Jaffrey of Portsm° one of his Majties Justices of the peace for this Province & one of those appointed by L' Governour Usher, to admister ye oathes Appointed instead of the oathes of Allegiance & Supremacy to ye Inhabitants of this Town, doe Testifie & declare : That William Vaughan & Richard Waldron Esqrs late of his Majties Councill for this Province did come to mee & desire me to send for m' Packer, another of ye Justices appointed to administer ve sd oathes, that they might take ye sd oathes accordingly, but m' Packer not being then at home, ye sd Vaughan & Waldron, desired me the said Jaffrey -when we mett again aboute yt busines, to give them notice, and they would attend it, But m' Packer being often out of Town, wee agreed yt either of us in ye others Absence should Administer the said oathes to any persons yt had not yet taken ym Soe it happened yt William Vaughan and Richard Waldron Esqrs came againe, & ten- dered to take ye sd oathes which I administered to them Accordingly : and they did afterwards say to m' Packer & my selfe yt if mr Usher, when he come into ye Province were not satisfied with their taking ye oathes before one Justice of Peace, they would take them againe, an

And understanding yt George Jaffrey & Tho' Packer Esqrs were Comision- ated by the Leiv' Govern' to Administer ye sd oathes to ye Inhabitants of Portsmº : accordingly wee went to ye next [nearest] of them viz George Jaffrey, Esqr & desired him to send for m' Packer yt wee might take said oathes accordingly, But mr Packer not being then at home, wee desired m' Jaffrey when they mett againe about yt busines to give us notice, And wee would attend it, but haveing no further Notice wee went againe to m' Jaffrey who told us that considering m' Packers occasion to be often a broad, they had agreed that either of them, in ye others absence should Administer said oathes to any person yt had not yet taken them, upon which wee forthwith took sd oathes before Justice Jaffrey, but afterwards understanding by mr Jaffrey & m' Packer that Let Govern' Usher was displeased that they were not both present at ye Administration of sd oathes to us wee told them that wee were not willing to multiply oathes Inteaine [?] yet if Levt Govr Usher (when he came in ye Province) were dissatisfied wee would take said oathes againe - And as to ye signing ye Associ- ation when it was offered us, our answer was, wee expected it would be done by ye Govr & Councill & we would sign it there not judging it proper for us as Members of ye Councill to sign an Association wth ye Rabble, but rather in our own stations wth ye Govr & Council, & for evidence of this wee herewth send ye declaration of Geo Jaffrey Esq one of the Justices of Peace Appointed to Administer the Oaths aforesd who was the only person present wth Lt Govr Usher & the Sec- retary w" the sd Lt Gov' was pleased to give us or Suspension - Wm Vaughan Richd Waldron
