SPECIAL SESSION.


CARMEL March 12, 1904.


The Board of Supervisors of Putnam County met in Special Session at their rooms in Carmel.


Members all'present except Mr. Mabie. Mr. Hine in the chair. The following call was read and, on motion, adopted.

SIR-You will please call a special meeting of the Board of Super- visors at their rooms on Saturday, March 12, at ten o'clock A. M., for the purpose of making some arrangement to meet the deficiency in the County Treasurer's office rising from the refusal of the City of New York to pay its taxes as levied in several of the towns in Putnam County, and for the transaction of such other business as may properly come before the meeting.

The following statement of County Treasurer was read :

Mr. GEORGE HINE, Chairman of Board of Supervisors, Brewster, N. Y .:


DEAR SIR-The following is a statement of unpaid taxes due from the City of New York:


Town of Kent. $5,741 94


Town of Carmel. 5,437 83


Town of Southeast. 15,317 82


The above amounts include the fees of the collector at two per cent.


The County Treasurer is now borrowing $14,000 from the First National Bank of Brewsters, and that amount, together with the amount collected by the collectors of the several towns, will hardly carry the County until April 1. It is therefore imperative that the Board of Supervisors take immediate steps to supply the deficiency.

On motion, a committee of three members of the Board were appointed to secure counsel and ascertain what plan was best to pursue and report to the Board at some day in the near future.


Mr. Hine, Mr. Clark and Mr. Townsend were appointed such com- mittee.


The bill of the Kings County Penitentiary for boarding prisoners for the year 1903, for $542.89, was presented, and, on motion, allowed as claimed. The Clerk was directed to issue order on County Treasurer for the amount. On motion, the Clerk was directed to issue orders on County Treasurer for the amount of the days' service and mileage of the several Supervisors, also order for his own service and service of Janitor.


On motion, the Board adjourned to meet subject to the call of the Chairman.


SPECIAL MEETING.


MARCH 29, 1904.


The Board of Supervisors of Putnam County met in special session at their rooms on call of George Hine, Chairman.


Present-Messrs. Clark, Townsend, Mabie, Perry, Benjamin and Hine.


The minutes of special meeting of March 12 was read and, on motion, adopted.


The following report was presented to the Board of Supervisors of Putnam County :


Your Committee appointed at the special meeting, held on March 12, 1904, would respectfully report that we have consulted counsel in regard to the matter of issuing County bonds to meet the deficiency existing in the County Treasury, and present to this Board the following resolution for their consideration :

RESOLUTION No. 1.


A resolution to borrow twenty-five thousand dollars, on the credit of the County, for County uses and purposes, by the issue of County bonds there- for, and to authorize the County Treasurer to issue and negotiate said bonds, passed in pursuance of the authority conferred by Sections 12 and 14 of the County Law, and pursuant to the provisions of the General Municipal Law, on the 29th day of March, 1904.


Ayes, 6; nays, none.

Whereas, The City of New York has not paid its taxes upon non- esident real estate situated in the towns of Southeast, Carmel and Kent, nd claims that the assessment of the said real estate is illegal, and has ued out writs of certiorari for the purpose of reviewing the assessment of ts said property in said towns, and has instituted an action in the Supreme Court against the County Treasurer prohibiting and restraining the sale f the real estate of the said city for non-payment of taxes, whereby the County of Putnam has not sufficient money for the following county uses nd purposes, to wit: for the State tax, for Justices of the Supreme Court, or salary of County Judge, for salary of District Attorney, for main- enance of Putnam County road, for support of the poor, for School Com- nissioner's expenses, for Sheriff's salary, for salary of stenographer in Surrogate's Court, for contingent expenses, for the maintenance of inmates n asylums and hospitals, for court expenses, for boarding prisoners, and or County bills ;


Resolved That twenty-five thousand dollars be borrowed on the credit of the County for said County uses and purposes, by the issue of County bonds therefor, in the manner following: to wit: Twenty-five $1,000 coupon bonds, to be numbered in rotation from one to twenty-five Inclusive, bearing interest at four per cent. per annum, interest payable annually at the First National Bank of Brewsters on the 1st day of June, , principal to be paid at the First National Bank of Brewsters on the 1st day of June, 1907.


Resolved, That the County Treasurer be and he is hereby authorized nd directed to issue and negotiate said bonds according to law, and at not ess than the par value thereof, and to the best advantage, and apply the proceeds thereof to the said County uses and purposes.


Resolved, That the form of said bonds shall be as follows :

County of Putnam, State of New York.


Putnam County Bond.


For County Uses and Purposes.


The County of Putnam promises to pay the bearer the sum of one housand dollars on the 1st day of June, A. D. 1907, with interest thereon, t the rate of four per cent. per annum until paid, payable annually on the Ist day of June on presentation and surrender of the interest coupons tereto attached. Both interest and principal payable at the First National Bank of Brewsters, New York.


This bond is issued by the Board of Supervisors of the County of Put- ham, under and in pursuance of Sections 12 and 14 of the County Law, ind of the provisions of the General Municipal Law, and of a resolution of he Board of Supervisors of said County, passed March 29, 1904.


All prerequisites to the issuance of this bond have been duly observed.

The credit of the County of Putnam is pledged for the payment of this bond, principal and interest.


In Witness Whereof, the said County has caused these presents to be attested by the official seal of said Board of Supervisors, and signed by the Treasurer of said County, this day of , nineteen hundred and four.

Resolved, That before any of the bonds authorized by this resolution shall be issued the County Treasurer shall give security to the County of Putnam in the amount of $5,000 for the faithful performance of his duty in issuing the same, and the lawful application of the funds arising there- from, and of the funds which may be raised by tax for the payment thereof, which may come into his hands.


Resolved, That any and all expenses incurred or services rendered by the County Treasurer in carrying out the duties herewith imposed be pre- sented to the Board of Supervisors for audit and allowance.


Resolved, That there be raised annually by tax a sufficient sum to pay the interest and the principal of the said bonds from year to year as the same shall become due.

Mr. Mabie offered the following resolution, which was adopted :


Resolved, That the Clerk be directed to issue an order on the County Treasurer, payable to W. E. Perry, for $28.00, for services on committee January 18, 19 and 20, three days, $12.00; mileage, $16.00.


The Committee bill of Emerson Clark, for $32.00, for services and mileage was presented, and, on motion, allowed as claimed; the Clerk was directed to issue an order for the amount.


Committee bill of Henry Mabie for services and mileage, for $28.00, was presented and, on motion, allowed; the Clerk was directed to issue an order on the County Treasurer for the amount.


On motion, Mr. Hine was authorized to accept the bond of the County Treasurer when presented, necessary in the matter of the bond issue.


On motion, Mr. Clark was authorized to contract with the Hudson River Telephone Company to construct a telephone line to the County Farm from the Village of Carmel at terms submitted by Superintendent J. M. Wiltsie.


On motion, the Clerk was directed to issue orders on County Treasurer to the several Supervisors for the amount of days' service and mileage; also an order for $20.00 for services and expenditures of Clerk and Janitor's service.


On motion, the Board adjourned.

CARMEL, April 9, 1904.


The Board of Supervisors of Putnam County met in special session in their rooms in Carmel.

Whereas, It has come to our knowledge that the fish and game laws are being violated, and whereas there is no special game protector for Putnam County ; now therefore be it


Resolved, That the fish and game commission of the State of New York be requested to appoint Wm. H. Knapp, of the Town of Kent, a special game protector in and for the County of Putnam.


Resolution adopted, all members voting for, none against.


On motion, Mr. Townsend was appointed a committee to take action in the matter of the removal of several old soldiers now in the County House to some soldiers' home.


On motion, the Clerk was directed to issue orders on County Treasurer to the several Supervisors for day's service and mileage; also order for his own service and janitor.


On motion, the Board adjourned.

SPECIAL SESSION

BOARD OF SUPERVISORS.


BREWSTER, April 20, 1904.


The Board of Supervisors met in special session in the Town Hall, in Brewster. Members all present.


The following call was read and, on motion, adopted.


To JOHN W. TOWNER, Clerk of the Board of Supervisors:


You will call a special meeting of the Board of Supervisors, to be held at the Town Hall, Brewster, Wednesday, April 20, 1904, at two o'clock P. M., to take action in the tax case against the City of New York, and such other business as may come before the Board.

On motion of Mr. Benjamin the Committee were authorized to secure additional counsel to assist Abram J. Miller in the case now pending against the City of New York.

Mr. Hine offered the following resolution and moved its adoption, and asked that the roll might be called :


Whereas, The Legislature of the State of New York did, during the last days of its session, pass an act which threatens to take from the Board of Supervisors of Putnam County the power of designating the two papers authorized by the Secretary of State to publish the session laws, and which reposes in the members of the County Committee of the respective political parties the said power of designating such papers ; and


Whereas, The enactment of such a law not only curtails the powers and duties of this Board-a duty imposed by law upon every other Board of Supervisors in the State of New York-but places the power in the hands of a non-elective, irresponsible, partisan body ; and


Whereas, No condition of affairs has arisen whereby public necessity demands this exceptional change of the law in Putnam County; now, therefore, be it

Resolved, That his Excellency, the Governor of the State of New York, the Honorable Benjamin B. Odell, be and he hereby is requested to with- hold his signature from or veto such bill.

Mr. Perry moved that Mr. Mabie be appointed a committee to present above resolution to the Governor, Benjamin B. Odell.

CARMEL, June 7, 1904.


Board of Supervisors met in special session in Carmel Tuesday, June 7. Members all present.


The following call was read, and, on motion, adopted :

SIR-You will call a special meeting of the Board of Supervisors at their rooms, in Carmel, on Tuesday, June 7, 1904, to take further action in the matter of the bond issue authorized by resolution of Board of Super- visors April 9, 1904, and for the transaction of such other business as may properly come before the meeting.

The County Treasurer came before the Board and was heard in regard to the changes necessary to be made to meet the requirements of the pur- chaser.


The following resolution was presented, and, on motion, adopted :


RESOLUTION No. 1.


A resolution amending Resolution No. 2 of the Board of Supervisors of Putnam County, entitled " A resolution to borrow twenty-five thousand dollars, on the credit of the County, for County uses and purposes, by the issue of County bonds therefor, and to authorize the County Treasurer to issue and negotiate said bonds, passed in pursuance of the authority con- ferred by Sections 12 and 14 of the County Law, and pursuant to the pro- visions of the General Municipal Law, on the 9th day of April, 1904," in

respect to the form and execution of the bonds authorized by the said reso- lution of April 9, 1904, and awarding said bonds.


Ayes, 6; nays, none.


Whereas, By a resolution adopted on the 9th day of April, 1904, the Board of Supervisors of the County of Putnam authorized the issuance of $25,000 coupon bonds of said County for County uses and purposes; and


Whereas, Said resolution provided for a form of said bonds to be attested with the official seal of the Board of Supervisors and signed by the Treasurer of the County, and it is deemed desirable to alter said form of bond so as to provide for the execution of said bonds by the Chairman of the Board of Supervisors and the County Treasurer, and for the affixing of the County seal thereto and the attestation thereof by the County Clerk ;


Resolved, That said $25,000 of bonds authorized by the said resolution of April 9, 1904, be signed by George Hine, as Chairman of the Board of Supervisors, and Edward D. Stannard, as County Treasurer, and that the seal of the County be affixed thereto and attested by the County Clerk, and that said bonds be substantially in the following form :

And Be It Further Resolved, That the offer of N. W. Harris & Co. to purchase said $25,000 of bonds for the amount of $25,034.25 and accrued interest, which is the highest and best offer obtainable, be accepted, and the County Treasurer is authorized to deliver said bonds when executed to said N. W. Harris & Co. on receipt of the amount of their bid.


Six for and none against.


Mr. Benjamin moved that the Chairman and Clerk be directed to cancel the twenty-five $1,000 bonds issued by resolution of Board of Super- visors April 9, 1904. Motion carried.


All members voting for, none against.


Mr. Benjamin presented application for appropriation for the burial of J. W. Ridgway and Geo. A. Biker, made by Mary J. Zeliff, of $35.00 each, and moved that the amount be appropriated.


Roll-call.


Aye-Benjamin.


Nays-Clark, Townsend, Mabie, Perry and Hine.


Motion lost.


Mr. Townsend was called to the chair.


The Committee bill of Henry Mabie for services and mileage, for $28.00, was presented; on motion, the bill was allowed, and the Clerk was directed to issue order on County Treasurer for the amount.
