Horton at Old Windham also Lemuel Hitchcock to attond the Spring Session of Presbytery at Catskill also that we would pay two dollars for Commissioners fund session agreed also that ogrtain minutes should not be put on record at prosent. At the same meeting of session we took into consideration the proposition concerning the division of the Presbytery and finally adopted un- animously the following Preamble and resolutione Vis. Whereas the Presbytary of Columbia is sufficiently large to constitute two respectable Presbytorles; and 18 extended over ao wide a territory that most of ita churches and ministers would be better accomodated by adivision than they now are; and, whorone much time and expande of traveling would be saved to ministers and elders to be devoted to better purposec; And, whereas tho Presbytery is yearly increasing and extending ite limite; and as it is extremely difficult unsafe & expensive if not impracticable to cross the North River

at certain seasons of the year; Therefore, resolvod let that in the opinion of this Session a division of the Presbytory of Columbia is expedient, desirable, and would be beneficial to the cause of Christ in this region. 2d resolved that the North River or some parallel noor it be the dividing line, - Big Hollow March 18th 1835 - Attest Alfred Gardner, stod. Lemuel Hitohoook one of the ruling eldere prosonted to session the following charge against Alanson Saxton a member of the Church, Vis. Circulating a report that he Lemuel Hitcheook lied under oath at Johnstown in Nov. 2834 in the case of Rev. William Evans. Mr. Hitohoook havaing stated to the Session that he had taken the first step of discipline with Mr. Saxton agreeably to the direction given in the 18th Chapter of Matthew and failing to gain him that he had taken the second step in presence of Mr. Luther Hayse & member of the Church who was present and agreed to the statement of Mr. Hitchcock in respect to the second step of discipline as unavailing to gain Mr. Saxton. Therefore on motion it was resolved that the charge of Mr. Hitohoook against Wr. Saxton is in order for the oognicanoe of the session. The Session authorized and directed the Moderator to imsus a oitation requesting Mr. Saxton to appear before session at its next meeting. Harry R. Avery a ruling eldar was directed to pervo the oitation. Closed with a prayer. - L. Hitohoook Clk


The Sousion met in the meeting house agreeably to notice of the Moderator June Ist 1835 at 6 Oolook P.M. and was opened with prayer present the Moderator, Lemuel Hitohoook, Zalmon Hitohoook, Harry R. Avery, Samuel Bagley and Samuel Atwater. absent Sam. Chapman. Mr. Avery a ruling elder stated be had served the oitation on Itr. Saxton as directed by the Session. The following charges presented by Lomnel Hitohovolt against Alanmon Saxton was read to Mr. Saxton Vis. ofroulating a roport that he Lomuel Hitohoook lied under oath at Johnstown in November 1834 in the case of Rev, Wa. Evans. Mr. Saxton wao then callod upon agreeably to book of Govorn- ment on Discipline Chapter V Sec X to say whether he is guilty or not. To which he replied, "not guilty

according to my knowledge." The Session then put into the hands of the scoused a coppy of the charge together with the names of the witnesses by whom it le to be proved. The Session authorised and directed the Moderator to issue citations for all the witnesses that were named by the accuser to substantiato his charge, and for all the witnesses that the scoused intends to adduce for his exoulpation. On motion the Session resolved to moet in the meoting house on the first wednesday in July 1835 at 9 Colook A.M. to ary and decide the case between Mr. Hitchcock and Mr. Saxton, The parties were oited to appear bofore Session at that time and place. Mr. Bagley roquested to be excused from sitting and acting with the Session in the case of Hitohcool and saxton and after assigning reasons which were deemed satisfactory by the Session his request was granted. The Session met in the meeting house June 224 1835 at 6 Oclock P.M. agresably to the call of the Moderator and was opened with prayer. Present the Moderator, Lemuel Hitchcock, Zalmon Hitchoook, Harry R. Avory, Samuel Atwator, Samuel Chapman, Samuel Bagloy. Nr. Chapman was called upon to give his regaone for absence from several meetings of the Session. Accordingly Mr. Chapman assigned reasons for abronce which were sustained, The Moderator stated to session that Mr. Sexton had recently called on hin several times and expressos a desire to confess to the Session that on more mature reflection he was convinced that he had done wrong in eiroulating a letter written by Rov. Was. Evana in which Mr. Lemuel Hitchcock conceives that he ia charged with having lied under oath at Johnstom in Nov. 1835 in the case of Rev. Wm. Evane and Mr. Horning. Mr. Saxton personally came before Session und confossed

that he viewed the subject of circulating Mr. Evans letter in a different light from that in which he had viewed it when ho met with the Session at a previous meeting. And that he was now convinced that he had done wrong in circulating said letter. After hearing Mr. Saxton's confession the session passed the following preamble and resolution.


As the accuser Lemuel Hitchcock conceives that he is charged in the letter written by Rev. Wm. Evans withhaving lied under oath at Johnstown in Nov. 1834 in the case of Rev. Wm. Evans with Horning and as Mr. Hitohoook expected to substantiate his charge against Mr. Saxton by proveing that Mr. Saxton had oiroulated said letter, Therefore resolved that Mr. Saxtons con- fession be and hereby is accepted. Wincholl, Therefore on motion it was re- solved that the charges of J. Winohell against E. Winchell aro in order for the cognisance of the Session. Resolved that when the Session adjourn it adjourn to meet in the parsonage on Monday the 4th day of January 1836 at 1 00. P.M. The Session authorized and dirooted

presented by J. Winchell against E. Winchell were read to E. Winchell Viz. dishonesty an deal Nov. 24th 1835 at J. Winchell's barn, and abusive language and conduct at E. Winchell's barn Nov. 25th 1835. Mr. E. Winchell was then called upon agreeably to book of Government on disipline to say whether he is guilty or not. Instead of a direct reply Mr. Winchell requested the privilege of giving what he deemed to be a correct statement of the whole affair. Session granted his request. After which he confessed his gilt in the charge of abusive language and conduct in E, Winchelle barn, and the Session accepted his confession. But he plead not guilty to the charge of dishonest deal.


The Session then put into the hands of the sooused & coppy of the charge of dishonesty together with the names of the witnesses by whom it is to be proved. The Session authorized and directed the Moderator to issue citations for all the witnesses that were named by the accuser to substantiate his charge and for all the wit- nesses that the accused intends to adduce for his ex- culpation. On motion the session voted to meet in the meeting house on Friday January 15th 1836 at 10 00 A.M. to try and decide the case between Jehial Winchell and Ephraim Winchell. The parties were oited to appear before Session at that time and place. Closed with prayer. - L. Hitchcock Clk.


The Session met agreeably to adjournment in the meeting house Jan. 15th 1836 opened with prayer presont the mod L. Hitchcook, Z. Hitchcock, H. R. Avery, S. Chapman, S. Atwater, S. Bagley. It was moved that the minutes of the last meeting should be read, after which Mr. E. Winchell was called upon to say whether he was ready for trial to which he replied in the affirmative. The accuser was then called upon to substantiate his charge. He then called upon Samuel Winchell who was qualified

and testified as follows uncle Ephraim said to Father put on your coat and go up to the barn they had caught three sheep and put them out, I then asked Father why he did not put out thatsmall sheep? Father said he had caught that sheep and he would not have it. Father said he would have the sheep weighed unole Ephraim said he would take his choice. Father said well then I will have them weighed, They then went on and put out the eight sheep uncle Ephraim said you had better tako this fine wooled sheep and let me have that horned sheep because it is heavier and I am going to weigh them. to Mr. Barker Q. by the accuser, Did Ephraim say he would take any sheep that had teeth. A. he said he would he did not care how old nor how coarse the wool if they had teeth. The accused then called on Samuel Avory who was qualified and testified that he went down to Jehial Winohello which he thinks was in December 1835 and heard him say he had let Ephraim have 8 sheep and that they had settled in consideration that the accuser should pay the accused nine pounds of wool next whearing time and he further stated that he would go to Ephraim and attend to weighing the sheep and if they weighed enough to { double ho should not have to pay the 9 pounds of wool and that if he would not have them weighed he would tell him that he would not pay him the wool and then he would have them weighed. Mr. Avery recollecte that Mr. Winohell said that if Ephraim would tako such sheep as they agreed on he would have given him 8 sheep and 9 pounds of wool, The acouged then called on David Miller who was qualifhd and testified as follows that Mr. J. Winchell came to E. Winchells next morning after he had got the sheep home, and said he had concluded to have them weighed Ephraim said thy should not be weighed there had been bargains enough about them Johial said you agreed to have them weighed

yesterday 12 I was a mind to, he further said if you will not have them weighed I will not pay you the wool. The question was the put to the parties whether they had any more testimony. The answer was not any. The session then resolved that the parties should speak in their own defense and that the acoused should first have the floor.


After the parties had spoken the session withdrew and the Clerk called the roll and upon auch member of the session seperately who after speaking in view of the evidence which had beon exhibited unanimously agreed and deglared that the soouser had not sustained his charge against the aoqueed. Whilst the session was miting and before it olosed the Moderator presented a papar to session which had been previously handed to him by Mr. Jemne Barker a member of the Chh, con- taining the following charges against Mr. Ephraim Winchall and Johial Winchell. Vis, quareling and fighting the said E, did twit his brother Johial of being with Nancy Tome of telling a lie and did threaten twigs of beating lashing or spliting out his brothers brain with an ax and did strike him with his fist and did lay violent hands on him and push him out of the barn. The said Jahial did then charge his brother Ephraim of telling a lie of being dishonest and said that was his character throughout the Town of Hunter Lexington and Windham and did pick up a club and call him a little infernal dovil. It was also stated that


those things were very public and that the cause of Christ was greatly slandered. Therefore on motion it was resolved that the charges presented by ur. Barker against said Ephraim and Jehial Winchell are in order for the comisance of the Session, The parties all boing prevent the Moderator rend to them the obargos and ofted them to appear before session on Wednesday 27th January 1836 at 10 0. Session met agreeably to adjournment at the house of Harry R. Avery Jan. 27th 1836 Lemuel Hitchcock, Salmon Hitchcock, Harry R. Avery, Samuel Bagley, Samuel Atwater absent Samuel Chapman opened with prayer. Mr. Ephraim Winchell appeared and threw in his ples which was that he had been tried by the session for the same offences and was acquitted on account of the absence of witnesses who had been cited to appear. It was moved and sebonded that the charges against Ephraim Winchell and Jehial Winohell brought forward by Jesse Barker should be read,' They' were accordingly read, Mr. Ephraim Winchell then handed to the Moder- ator a paper containing a plea. On motion it was carried that Mr. Winchells plea should be read, after which, in reply to question of session Mr. Winchell says he is ready for trial, The socuser Jesse Barker introduced himself as a witness and was qualified, and in reply to question by the session what do you know about Ephraim Winchell persisting in slandering his brother since his trial and acquittal. Answer nothing since that time David Miller was then called upon and qualified and stated that some time he had heard Ephraim Winchell gay while riding in a waggon with him that he was not sorry for what he had done but could not certainly tell whether it was before or after his trial and soquital but in answer to the question by the session what is your opinion my opinion is it was afterward Session withdrew and was unanimously acqui ting Mr. Ephraim Winchell. Mr. Jehial Winchells case was then called on

for investigation. Mr. Winchell plead guilty to all the charges brought against him by ur. Parker but did not give satisfactory evidence to session of humility and repentance. After some consultation sossion resolved unanimously to suspend Mr. Winobell untill he should give satisfactory evidence of re- pontance. Closed with prayer. - L. Hitchcock Clk
