At the call of the Mod. Sonsion met at the house of the pastor Deo. 22d 1840 2:00 P.M. present the Mod. and all the Elders except Mr. Bagley opened with prayer, Mr. Ephraim Winchell a member of the Chh presented to cession three charges against Jesse Berker another member of the Chh. Two of which aro the following vist Ist that Mr. Barker aided and assisted in taking and carrying off my buokwheat and potatoes 2d that he Jesse Barker reported that Ephraim Winchell had cheated widow Munson. Mr. Winchell then stated to session that he had tokøn the first step of disipline with Mr. Barker agrocably to the direction given in the 18th cheptor of Mathew and failing to gain him that he had taken the 2d step in presence of Thomas Hitchcock who was present and agreed to the statement of Mr. Winchell in respect to the second step of disipline as unavailing to gain Mr. Barker. Therefore on motion it was resolved that the first two charges of Mr. Winchell brought against Mr. Barker were in order for the cognisanco of the session. The 34 charge session gave Mr. Winchell liberty to withdraw therefore on motion the session authorized and directed the Mod. to josue a citation requesting Mr. Barker appear bofore session

Avery, Samuel Bagley. Opened with prayer. Mr. Barker was present agreeably to notice served by Mr. Paok. The following charges were then read to Mr. Barker as presented by Mr. Ephraim Winchell Vis. lot that he Jeame Barker aided and assisted in taking and carrying off Mr. Winchells buckwheat and potatoes. 2d that he reported that Ephraim Winchell had cheated Widow Munson. fr, Barker was then called upon agreeably to the book of Govern- ment on discipline Chapter 5th section 10th to say whether he is guilty or not guilty of said charges to both of which he plead not guilty, The session then put into the hands of the accused a coppy of the charges together with the nanos of the witnesses by whom they are to be proved. Seosion then authorized and directed the Mod. to issue citations for all the witnesses that wore named by the nooused to substantiate his charges, and also for the sooused if named and desired by him for his exculpation. Mr. E. Winchell not appearing before the Session and the session having boon credibly informed that he had taken the acoused Jesse Barker with a warrnat before a civil court for an assault and battery the session adopted the following preamble and resolution:


Whereas Ephraim Winchell the accused of Jesse Barker before the Session failed to appear before it at the time appointed for the trial of said Barker with a warrant for an assault and battery bofore a civil court at the identical time when the session of the Church were to meet to try his. cause, Therefore resolved that the litigious spirit manifested by Mr. Winchell renders it improper and unconstitutional for the Session to take any further action in hie case at present, And whereas common fame reports the said Jesse Barker and B. Winchell am having been recently guilty of unchristian and abusive conduct in respect to each other, Therefore resolved 2dly that when the cause between them shall be decided in the civil court or courte, session will proceed to take propor action in the ouse. At the call of the Mod. session met at the house of Mr. Orrin Pook March 4th 1841 at evening present tho Mod. and olders H. R. Avery, Lem Hitchcock, Orrin Pock. Oponed with prayer. Mr. Oliver Coc and wife proponted letters of diomission and rocommondation from Hunter Chh to this Chh. they were accordingly examined on doctrinal and experimental religion and cordially received. Adjourned to mot at the meeting house next day March 5th at half past 3 0.C. P.M.

Edmond Avery whom common fame had socusod of using spirituous liquors to eroose ho having previous notice that the cession was about to tolo notice of his conduot. After some conversation with the session Mr. Avery concluded to make a publio confession of his guilt which he did on the following Sabbath. Mr. Darker hoving made the following public confession: I, Vomne Barker hereby confess to the church and to the world that on the 13th day of this month I did neur my house

inflict with a stick of considerable sizo soveral blows on the person of Ephraim Winchell and that by so doing I have sinod against God wounded the cause of Christ, grieved the Church and given sinners occasion to speak reproachfully of the Christian re- ligion which I have profossed, having as I hope been brought to repentance for this offence and as I trust received the pardoning mercy of God I have confidence that I shall be forgiven of the Church Jan. 30th 1841 Anđ Mr. Ephraim Winchell having made the following confession to the session: I Ephraim Winchell hereby confess to the session that in taking Wr. Barker before a civil court at the time when I requested the session to meet for the purpose of trying the case between me and Mr. Barker I showed a disrespect to the session and a contempt of their ecclesiastical authority. I therefore ask their forgiveness. I likewise consider that I did wrong in taking Mr. Barker before a civil court instead of bringing the oase before the session. Feb. 224 1841

Whereas Mr. Edmond Avery has had sufficient time and opportunity to make magiefaction of the offence for which he was suspended from the communion of this Church, In Feb. last, and whereas the session have no reason from his past and present conduot to expect a reformation, therefore Resolved that he be cited to appear before session at a Meeting to be held in the meeting house on wednesday the 12th day of Nov next at 2. 001k P.M. to show cause if he has any why the session shall not proceed to his excommunication. Resolved that the Clark issue to serve the citation. Resolved that Mr. J. Present the Moderator and all the Elders, ex- cepting, Orrin Pook, and O, Coe The Moderator stated to Session that the object of the meeting was to ascertain what should be done in reference to the offences of which Common fome ohargod Mr. Teamo Hull, vis; Absonting himself from the house of God and from the Seoramente of the Lords Supper for several monthe in succession, originating & ofroulating reporte unfavoral to the character of the pastor of the church and also of the Session Session authorized the Moderator to issue a citation requiring Mr. Hull to appear before Session Nov. 17th at One O.olk P.M. H.R. Avery was appointed to serve the oftetion Adjourned to meet in the meetinghouse Nov. 17th 1841 at One 0.01k P.Mi Closed with prayer.


The Session met in the Meetinghouse Nov. 17th 1841 at One Oolk P.M. and was op ened with prayer, Present the Moderator, and all the elders. The Moderator called on Mr. Avery to state whether he had served the citution on Mr. Hull, Mr. Avery stated that he had served it. Mr. Hull being present the Moderator read to him the following charges, of which common fame had accused him vis, 1. Voluntarily absenting yourself from the house of God on the Sabbath, and also from the Sacrament of the Lords Supper for several

months in succession. 2. Originating & oir- oulating reporte unfavorable to the christian & ministerial character of the pastor of the ohurob of which you are a member. 3. Originating & ciroulating reports unfavorable to the char- acter of the Session of the church of which you are a member.


The Moderator then called upon Mr. Hull to soy whether he was guilty of the offon es con- tained in these charges. Mr, Hull replied, they are tros, He proosadod immediately to make a confession, which covered the charges; and then asked the forgiveness of the Moderator or pastor and of the Soppion, Mr. Avery then moved that the confession of Mir. Bull be accepted. In connection with this motion, Mr. Avery stated, thut in makens the motion, ha depides not to suy anything, upon the merits of the confession; but simply to take it into the hands of the Session, with a view to theis deciding what they would do with it. the Motion having been seconded, tho Moderator atetod to Seanion that by voting to accept the confession, they did not say whether they would disapprove or approve of it. They qimply took it into their hands for examination. With this explanation of the mover, and the Mod- erator: the motion to accept the confession was carried. Ad the offences ombrdoed in the charge had been widely opread the Session doomed it ro- quisite for the honor of religion, the satisfaction of the church and the greatest good of the offender that the confession be made publio; After a free discussion on the subject of requiring the con- feusion to be made public, in which all the members participated, Sossion required Mr. Hull to make his confession public. Hull commented and although he did not specify the Sabbath when he would make his confession publio, yet he said he would do it soon. Session authorised the Moderator to ismus a oitation for L. Baldwin a suspended member of the church S. Atwater appointed to oito him. Closed with prayer.


Session met in the study of the pastor Dec. 10th 1841 at 6 0.01k p.m. at call of Moderator And was opened with prayer. Present the Moderator and the following elders. R.R. Avery, 8. Atwater and 0. Peok, absent & Hitohoook L Hitohoook and 0. Coo Mr. Lucius Lewis Baldwin appeared before Session egresably to the oitation thet had been served upon him. On socount of the abmonee of the record touching the case of Mr. Baldwin, and the femmess of the members of Session present, after hearing some statements fron Nr. Baldwin, and requesting him to examine the records in reference to his case, Session adjourned to moet in the study of the pastor Deo, 15th 1841 at & O.Clk P.N. Closedwith prayer.


The Session met in the study of the pastor, Dec. 19th at 2.0.Clk ".8. agreeably to adjournment, and was opened with prayer. Prosent, the Moderator, and all the eldere. Session discussed the case of Mr. Baldwin, but did not decide it. Tho following preamble and resolution, ware adopted in relation to the case of Mr. Full. Whereas common fame accused Mr. Hull a member of this church of persisting in the offences of which he made confession before Session on the 17th of Nov. last and wherene the seid Fr. full, fails after having had omple time to make his confession publio, se Session required him to do, and as he

.consented to do, and whereas session has no evidence of the sincerity of Mr. full's con- fession, by any faoto moet for repentance: therefore resolved that Mr. Hull be cited to appear before Session, et a meeting to be held in the study of the pastor, on the last Monday in Deo. 1841 at 20,01k. P.N. to show cause, if he have any, why the Session should not proceed to carry out the principles of discipline applicable in his oase. Mr. Coo appointed to cite Mr. Hull Closed with prayer. The Session met in the study of the pastor, Deo. 27th 1841 agresably to adjournment, and was opened with prayer. Prosent the Moderator, and all the elders, Aftor ascertaining that Elder Coe had served the citation on Mr. Hull, who being prosent acknowledged, that the oitation has been served on him, the Moderator read to Mr. Hull the charge of persisting in the offences of which common famo had nooused him, and of which he had made confession on the 17th of Nov., and asked him if he were guilty of persisting in thon? Mr, Hull replied in the affirmative; and said he was ready for trial. Ho then made to the Session some statements, in which though he had already confessed the truth of the charges alledgod against him, he endeavored to justify his conduot and oset asporsions on the Session, The Moderator plainly & solemnly informad Hr, Hull what must be the inevitable result of persiating in his present course. Notwithstanding the solemn & affectionate admonitions of the judiciary in respect to the consequences of the course ho was pursuing, Mr. Hull still manifested an entire cot or aversion from making a publick confession

confession of his offences; and expressed a total indifforenoo in relation to whut the Session might do in his omme. The Moderator then solemnly reminded the Session that it was his duty to announce to thom, that they were about to sit in a judicial capacity, and to enjoin on the members, to recollect, and re- gard their high character as judges of a court of Jesus Christ, and the solomn duty in which they wore about to uot, The Session then united with Nr, cos, in prayer for the blessing of God on the offender, and for grace and wisdom, to guide them in the colom duty, before them. The members were then called upon to express their views in respect to the oase before then. Heving expressed their views, it was moved and seconded that Isaac Hull, be and hereby is excommunicated from the Second Presbyterian Church of Windham, The motion passed unani- nously. In accordance with this act, the Session instructed the Moderater to read from the pulpit, at the olese of the services, on the second Sab. in Jan 1842, the sentance of azcommunication. closed with prayer L. Present the Moderator and all the elders, Session appointed Lemuel Hitchcock toattend the meeting of Pres- bytery to be held at Stockport on the 3d Tuesday in April 1842, and Samuel Atwator his substitute. As the Session was about to consider and decide the case of Lewis Baldwin, a suspended member of the church, the Moderator enjoined on the members to recollect, and regard their high character, as judgos of a court of Jesus Christ

It was moved and seconded that the following preamble and resolution be adopted in relation to the ouse of Mr. Baldwin viz; Whereas it appears from the Records of Session found on pages 76, 77 and 78, that Lewis Baldwin was, in 1838, accused by common fame of using profane language, or taking the name of God in vain; that the charge was proved by unimpeached test- imony and sustained by the Bespion; and that Mr. Baldwin, pleading not guilty was conse+ quently suspended. And whereas the Soseion have delayed to take up the onso of Mr. Baldwin again till recently, on account of his absonce from the place; And whereas, Nr, Baldwin haveing recently been before the Session, continuod to dony the charge proved against him in 1838; Therefore resolved that Lewis Baldwin bo and horeby lo oxcommuniostod from tho 24 Prosby- terian Church of Windham, The members were thon called upon individually to express their viovo, with reference to taking the final voto. Having expressed their views, the above proumble and resolution wore adopted. Zalmon Hitohoook & Oliver Coe be a committee to visit Mra, Betts and converse with her respecting reports in circulation which is unfavorable to her Christian character, and report to Session, at its next meeting.
