venient, and it is alsoe provided, that if at any time hereafter any Indian to whome the sd vpland belongeth chalengeth the sd ypland to plant on hee or they the sd Indians shall have liberty to plant the sd ypland & gather or reap the corne with- ont interuption or molestation by him the ad Robert or any in his name.


It is ordered that Christopher flester and Henry Pierson shall assist Mr lohn Ogden or Samuel Cleark to lay out the land which, (according to a vote passed or order made lan. 22. 1666), was granted vnto the Northsea Inhabitants, whoe are to satisfy the sd men tor their labonr in laving out ye sd land, and what ever the sd layers ont act and doe in laying out any pt or parcell of land as atoresaid it being according to theire discretion, it shall stand anthentiek forever to them to whom it Shall in particular belong.

[PAGE 23.] At a towne meeting May the 1st 1663 were chosen for magistrates Ist Mr Thurston Raynor, 2 Mr John How- el!, 3 Richard Barret, Henry Pierson to bee Register, Iohn Woodruff Iunr to be enustable, who had ye cunstables oath administered to him.


Samuel Cleark allsoe chosen cunstable, who had ye said oath administered vnto him wth this addition, that hee is bound to execute according to warrant vpon the water as well as at land, wthin or limits.


Chosen for townsmen for ye following yeare lohn Cooper Thomas Topping lobn lessup.


And it is ordered that the said Townes men have and shall have like power as other townes men have formerly had from veare to yeare, Which power is to make all rates or levvies yt are to bee made to pay the townes debts, And to act in, and order all Towne affaires according to their best understanding, But not to dispose of any lands to any person.


It is by this Towne Meeting confirmed vnto Wm Russell that he shall have that land namely 4 acres, & 6 which was granted & given by the towne formerly vnto him, weh land did sometime belong vnto Joseph Sutton.


It is further ordered that Mr lohn Howell and loshna Barnes have power and are authorized to meete with the com- mitties of Sonthold and East Hampton, to consult wth them concerning sending an answer to Capt Leverit, vnto ye propo- sitions hee made to vs of late when he was here amongst vs.

May 1, 1633 At the towne meeting, it is ordered that the 3 rail fence set vp between the Indians and vs, weh is or should bo zp shall be maintained sufficient this yeare, and the rest of the fence in that line to be maintained, proportionable there- vnto at least, each inhabitant his share as was formerly allot - ted vnto him, And the said fence afore said is all to bee finish - ed by the 6th of this instant may vpon penalty of IS pence per pole, for all that shall afterward bee found deficient, And it any great cattell be found wthin the said fence after the 8th ot this present month the owners shall pay Cd per head to those that impound them, and it sheepe or goats bee impounded thence, the owners shall pay 2d per head, if any hoggs bee in- pounded from Shineeock or Seaponack after the said 8th day the owner, shall pay 12d per hogg to them that shall impound [ PAGE 34 ] them, and if the owners have notice and redeeme not their hoggs or sheepe or goats wthin 24 houres, by paying poundidg as aforesaid then the impounder of such creatures shall repaire vnto Isack Willman and James Herrick who have hereby power to apprize soe many of the said creatures as shall pay the said impoundidg, And themselves 6d a peece for their pains. rail tence against the plaines shall be reviewed from time to time, as shall bee apoynted, and in whatsoever pt of ye said fence shall bee determined by those soe appoynted to bee in- sufficient, shall be so accompted by all. And the owners of such deficient fence haveing notice of it, if after such notice given damage come to be done through their said fence, then ye owners of such said deficient fenee shall pay yt damage, But whatsoever pt of the said 3 raile fence passeth as good wth those apoynted as aforesaid to view, though harmes bee done through any pt of ye same, then the owners of ye cattell that doe the spoyle shall pay that damage, and this notwithstanding any former order. Allsoe it is ordered that noe unruly, or un- lawful oxen that are wont to break fence shall bee permitted to goe in ye oxpasture.


John Iessup is appoynted to view the said fence with the plaine fences according to former order, allsoe to view Shine- cock fence ,once in 14 days.


lohn Rose hath liberty to sett his gun any where at Seapon- ack to kill wolves, and if thereby hee kill any swine, hee shall not suffer damage, but if hee kill any other cattell thereby hee engageth to pay for them to the owners.

Iames Herrick makes over and imparteth one acre and a halfe of land lying in Haliseys neck in ye plaine, with what thereto belongeth, unto Iohn Woodruff Junr, tor or in Exchange of one aere sometime bee- longing vnto Mr. Iohn Ogden, and lying by ye side of the said James Herrick his home lot .* Vnto which exchange the said lohn Woodruff consenteth.

Sept 22 1663 By ye major voat it is ordered and concluded that lonas Holdsworth shall have thirty five pounds for his schooleing per annum, for the terme of two years, at least, and his pay to bee answerable to ye pay ingaged to him by Hemp- sted, with ye allowance of 12 days in ye yeare liberty for his own partienlar occations,

Oct. 18 1663 Mr Thurston Raynor acknowledgeth to have given freely and for ever vnto his grand child namely Arthur Howell Jun, all that his twenty acres of land lying and beeing on ye west side of a Creek (comonly called Swan Creek) at Meacocks wch said 20 acres became his vpon ve devisson of land in the towne wherein every fifty lb accomodation was to have five acres, Witness Henry Pierson.

At a town meeting November 10 1663 It is ordered and concluded by ye maior voat that noe hoggs shall be found or put or permitted to bee ypon ye comons belonging to this towne after the first of Jannary next come 12 months, and if any swine bee soe found they that finde them shall have half of them, & the other half shall bee to the townes vse. But if any man's swine break forth of his inclosure, then hee shall (as soone as he misseth them) forthwith aeqnaint the magistrates with it, and yt shall save them from being forfeit as aforesaid, vet if any finde the said hoggs in the comon it shall be lawful for any to impound them & have 6d per head of the owners, [N te added] At a towne meeting December 15 1664 The above written order concerning hoggs is repealed & made void. [Abstract ] Mr lohn Ogden acknowledges to have sold to Ellis Cooke the land he benght of William Indlam, the land being at Mecoeks, one parcel being atl that field that vpon the laying out of that division lay betweene the highway, next the millers and the next creek on the east, or southeast, the other parcel lying on little neck, on the west side of the creek which is on the west side of Arthur Howells land, and was sometime in possession of Richard Woodhuil.
