Know all men by these presents that we Joseph Howell and Edward Howell both of the towne of Southampton in the coun- ty of Suffolk, coopers, haveing upon the 5th day of Inne 1702 mutually chosen Christopher foster, and John Howell being our neighbors to make a devision of our land in ye little plaines bounded South by ve land of Iohn Jessup, and N by the land of Isaac Halsey E by Frog pond & W by highway and to make a finall ishue of all diferances In and abont ye said land, and the said Christopher Foster and lohn Howell upon ve same day did divide ye said land to our content, and satisfaction. At a town meeting held ye 3d day of April 1705 It was then granted to John Wick liberty to lay downe to the towne for ever a 50 allotment of land in the 40 acre devision with Sam- vel Cooper and Thomas Cooper in the lot No 12 drawne by John Cooper deceased, and that he shall have soc much in lew thereof laid out to him and his heires for ever (or less) As Left. Pierson Capt Theophilus Howell and Iohn Cook, three of the proprietors of the undivided lands shall see canse to allow him, adjoining to Iohn Wicks land at Brushe plaines* that was form- erly lohn Beswicks land, at the charge of him the said John Wick, and that the said John Wick be at the charge of the said men surveying ye land.

EDMUND ANDROS, ESQR., Seigneur of Saus- marez, Lieut and Governo Genall under his Royall Highness JAMES Duke of Yorke and Albany &e. of all his Territorys in America To all to whom these presents shall come sendeth Greeting. WHEREAS there is a certaine Towne in the East Riding of York shire upon Long Island commonly called and knowne by the name of SOUTH HAMPTON, scituate, lying and being on the South side of the said Island, toward the Maine Sea, having a certaine Tract of Land, thereunto belonging, The Eastward Bounds whereof extend to a certaine place or plaine, called Wainscott, where the bounds are settled betwixt their Neighbours of the Towne of East Hampton, and them : Their Southern bounds being the Sea and so runs westward to a place called Seatuek, where a Stake was sett as their farthest extent that way : Then Crossing over the Island to the Northward to Peaconock great River (not contradicting the Agreement made between their Towne and the Towne of South Hold after their Tryall at the Court of [L. Whereas wee the Subscribed the Inhabitants of the sd Southton doe understand that our honrble Governor Genl Lovelace is to come down into the Cuntry amongst vs this Spring, wee doe at this Town meet- ing apoynt ffirstly that his honr bee reed and entertained with the greatest respect whereof wee are possibly capable and soe conducted to the place appointed for his residence comfort & most conveniency, nextly whereas our sd Town of Southamp- ton have by right of equity & of law alsoe, many previlidges which many plantations on the Island hath not, as not only Indian Interest of or plantation but alsoe Pattent right therein, and whereas it seems to vs as if wee were like to be deprived of those ovr privilidges which at great rate wee have procured with much dificulty and danger wee have soe many years possessed. Whereas there is In ve boundes of ye Town of Southamp- ton, a certaine Tractt of Land Commonly Called and knowne by ye name of the Great plaine which at ye first Settlement of said Towne was sed To have layne in one Generall ffield and by resson of divers overtures and Alterations which since hath happened and bine made by ye Respective proprietors thereoff and no substantiall Record or Settlement can be ffonnd, where- by Greate devisions Inconveniencies and damage Doth dayly accrue unto ye proprietors of ye same for want of a due and Regular Settlement,
Know all men by these presents that wee the proprietors of said Land whose names are hereunto subscribed, do heereby formly binde ourselves, onr haires Executors administrators and assignes for ever heere after, Equally by ye number of Acres Contained therein, to make and maintaine a good Sub- stantiall flive Rayled fence for ye beter secureing and Improve- ing the same In the places and under such circumstances as is heere after mentioned and expressed, videlicet to begine ye afore said ffence att a branch or creek of water belonging to shinecock bay which devides the land of Major Lohn Howell and Isaac Halsey Sen. att ve west end of said plaines and so to Rune Said fence Eastward on the North side of ye highway which devides the north and South devissions Comonly knowne by the name of ye oxpasture devision until it comes to range with the west Line of ye parsonage land and there to turn north ward to ye Sowest Corner thereof, and then Rune Eastward upon the South line of both peeces of said parsonage land Into the Towne pond, which fence is to bee the north bounds of said Generall ffield, and East bounded by the said pond, And from ye Sowwest corner there of to run a good fence as aforesaid one the South side of Iohm Jaggers beatch lot, Into the said Shin ecock baye which is to bee the west bounds of said Generall ffield, and all the Land within Said Limitts is for ever heere atter to be accounted and knowne by the name of a generall ffeeld In Southampton, and whereas ye proprietors of said

ffeeld have occation for various ways of Improveing said land any person or persons therein interested have liberty to make whatt particular Inclosures he or they see best and convenient for them selves butt not to pasture the same until ye said ffeeld be open, provided always he or they soe fenceing and Improv- ing In particular doe continue to make and maintaine their eqnall proportion of Said Generall fence according to their Respective quantitys of land, Contained within the bounds and limitts aforesaid, and to ye end that some particular persons May have the care and management of said ffeeld wee hereby firmly binde our selves our haires and assigns for ever yearly and every yeare upon the first Tuesdaye of April being ye Election day for chuseing the needfull officers in said Towne Annually to chuse two ffitt men, one to be A heward and the other a vewer ot ye said ffence which two men so chosen ffor the time being shall yearly Every spring publish by Riting sett. upon the meeting house a certaine and Seasonable daye ffor shutting up said feeld, and a certaine day at ye fall of ye yeare when said ffeeld, that is to say that part which lays in generall shall be improved for pasturing by the owners of said land so lying in generall as aforesaid, with a just number or stintt what shall bee alowed by the Acre, and the said Generall Bence be- ing kept up, all Creatures found in that part of said land lying in Generall nott allowed as aforesaid shall be accounted tress- pass, And lyable to be Impounded by any of said proprietors Except such as are driveing to and from, or In said partienlar Inclosures in ye aforesaid generall feeld, and if any of us shall Att any time or times hereafter neglect or Refuse to make and maintaine our Respective part of Generall fence as atore said then the heward and vewer for the time being shall canse the same to be done att the charge of the Said owners of said fence so found defective or wanting to be made, and for as much as there will be a yearely publieke charge happen tor Gates water ffences Cleareing said ffeelds and a Reasonable alowance of said heward and fence vewer, they shall make a Reate by the acre of all said land lying in sd Generall feeld as well for the par-
