the application, and a Patent is not to be considered as any evidence of the efficacy or goodness of the invention, discovery or improvement, nor any exclusion of the rights of others. It only secures rights from infringe- ment .- A patent can only be granted for one invention, discovery or improvement. It is granted for fourteen years. The applicant, if a citizen, takes legally, an oath or affirmation, ' that he does verily believe that he is the true inventor or discoverer of the said improvement ;? if not a citizen, but having resided two years in the country, he adds, ' and that to the best of his knowledge, the same hath not been used or known in this or any foreign coun- try.'-He transmits a certificate signed by any respect- able individual, of his citizenship, or residence for two years. He gives in writing a specification of the disco- very, invention or improvement, as short but explicit as he can ; explaining by words, not only the invention or improvement, but its use and advantage, without any re- ference to a drawing or model, for the specification en- ters into and makes part of the letters patent .- This must be signed before two witnesses. A drawing must also be sent if the subject admit of one, with explanatory references : and if the complexity of the invention or im- provement should render the drawing and explanation, insufficient for the full comprehension of the subject, a model will also be required. It is material that these be executed in a manner not unworthy public inspection ; for at the expiration of the patent, they may, if thought wor- thy, be made public. If two persons apply at the same time for patents, and the Secretary of State thinks their discoveries, inventions or improvements interfere, an ar- bitrator may be chosen by each of the applicants, and if they cannot agree, an umpire may be chosen by the Sec'y of State, to determine who is the first inventor.

The fees and emoluments of consuls, as established by law, (excepting those in the Barbary States, ) and which of course extends to commercial agents, are as follows, viz.


For authenticating under the consular seal, every pro- test, declaration, deposition or other act, which any tap- tain, master, mariner or other citizen of the United States may respectively choose to make, the sum of two dollars.


For the taking into possession, inventorying, selling and finally settling and paying, or transmitting the ballance due on personal estate, left by any citizen of the United States, who shall die within the limits of his consulate, five per cent. on the gross amount of such estate.


For taking into possession, and otherwise proceeding on any such estate which shall be delivered over to the legal representative, before a final settlement of the same, two and a half per cent. on such part delivered ever as shall not be in money, and five per cent. on the gross amount of the residue.


For administering oaths or affirmations to the principal officers of a vessel confirming the landing of merchan- dise where he shall reside, twenty-five cents for each ; and for certifying the delivery of such merchandise, from every such vessel, one dollar.
