Was nomi- nated for judge of Superior Court, 1902, under law of 1901 creating 6 additional judges for that court, but name was not on ballot because law was de- cided unconstitutional; nominated for judge of Cir- cuit Court on so-called Provisional ticket, 1903, and was elected by a large majority, but Supreme Court again decided that law under which he and col- leagues were elected was unconstitutional.
