Annual Town Meeting, March 20, 1899.


TOWN WARRANT.


ESSEX, SS.


To either of the Constables in the Town of Swampscott, in said County,


Greeting : ·


In the name of the Commonwealth of Massachusetts, you are directed to notify the inhabitants of the Town of Swampscott qualified to vote in elections, and in Town affairs, to meet at the Town Hall in said Swampscott, on Monday, the Twentieth day of March, current, at six o'clock in the forenoon, then and there to act on the following Articles, viz :


ARTICLE I. To choose a Moderator to preside in said meeting.


. ART. 2. To choose a Town Clerk for one (1) year. To choose a Board of Selectmen for the year ensuing.


To choose one member of the Board of Assessors for three (3) years.


To choose a Town Treasurer for one (1) year.

To choose a Collector of Taxes for the year ensuing.


To choose one member of the School Committee for three (3) years.


To choose one member of the Board of Trustees of the Public Library for three (3) years.


To choose a Board of Auditors for the year ensuing.


To choose one Overseer of the Poor for three (3) years.


To choose one member of the Board of Health for three (3) years.


To choose a Surveyor of Highways for the year ensuing.


To choose three Constables for the year ensuing.


To choose a Park Commissioner for three (3) years. All to be chosen on one ballot.


ART. 3. To vote by ballot "Yes" or "No" upon the question : Shall Licenses be granted for the sale of Intoxicating Liquors in this town.


ART. 4. To hear and act upon the reports of the Auditing Committee, the Board of Selectmen, the School Committee, the Board of Trustees of the Public Library, the Engineers of the Fire Department, the Superintendent of the Cemetery, the Board of Health, the Chief of Police, the Milk Inspector, the Committee on Street Lights, the Water Commissioners, the Surveyor of Highways, the Inspector of Cattle, Provisions, etc., the Committee on Sewerage, and the Park Commissioners.


ART. 5. To raise such sums of money as may be necessary to defray Town charges for the ensuing year and make appro- priations therefor.


ART. 6. To see if the Town will accept the list of names for Jurors as prepared and posted by the Selectmen.

ART. 7. To see what amount of bonds will be required of the Town Treasurer for the ensuing year.


ART. 8. To see if the Town will authorize the Treasurer, with the approval of the Board of Selectmen, to borrow money in anticipation of taxes.


ART. 9. To see what amount of bonds will be required of the Collector of Taxes for the year ensuing.


ART. IO. To see what action the Town will take in regard to the collection of taxes, and what rate of discount, if any, will be allowed for prompt payment on or before a certain date.


ART. II. To see if the Town will appropriate the sum of one hundred ($100) dollars, to be placed in the hands of James L. Bates Post 118, G. A. R., towards defraying the expenses of Memorial Day.


ART. 12. To see if the Town will appropriate a sufficient sum of money to pay balance due American Fire Engine Company for repairs on Fire Engine.


ART. 13. To see if the Town will appropriate a sufficient sum of money to make repairs on Engine House.


ART. 14. To see what action the Town will take toward paying a salary to the Water Commissioners and fix the amount of same.


ART. 15. To see what action the Town will take toward amending the By-Laws.


ART. 16. To see if the Town will appropriate the sum of $50, to be expended under the direction of the Board of Health in removing rubbish which may be washed up on Whale's Beach during the coming season.


ART. 17. To see what action the Town will take toward purchasing more land adjoining the Town Hall lot and make appropriation therefor.


ART. 18. To see if the Town will amend Section 2 of Article 3 of the By-Laws, so as to authorize the payment of

money by the Town Treasurer upon orders drawn by the Water Board or a majority of the members of said Board.


ART. 19. To see if the Town will amend Section I of Article 2 of the By-Laws, so as to authorize the Water Board, as agents of the Town, to institute and prosecute suits, as set forth in a draft of the proposed amendent now on file in the office of the Town Clerk.


ART. 20. To see what rules and regulations the Town will adopt as to the collection of water rates and in cases of failure or refusal to pay such water rates, or to comply with the rules, by-laws, or regulations concerning the water supplied by the Town and payment therefor, according to a draft of said rules and regulations and proposed by-law on file in the office of the Town Clerk.


ART. 21. To see if the Town will authorize the Board of Water Commissioners to adopt rules and regulations, from time to time, hereafter, for the care and protection of the water works and other property of the Town employed in supplying water to the Town and its inhabitants, and for the collection of water rates.


ART. 22. To see if the Town will appropriate a sufficient sum of money to grade Pleasant Street as far as accepted.


ART. 23. To see if the Town will appropriate a sufficient sum of money to furnish and operate an electric arc light at the junction of Middlesex Avenue, Farragut and Paradise Roads.


ART. 24. To see what action the Town will take toward constructing street crossings, as follows : Across Rose Street at Rockland Street; across Rockland Street at easterly corner of Rose Street ; across New Ocean Street at Burrill Street; across Essex Street, at the southwest corner of Burrill Street; across Farragut Road at junction of same with Thomas Road from estate of Walter R. Curtis to estate of Edgar Shaw; across Thomas Road from the church of the Holy Name to the estate of Walter R. Curtis; across Burrill Street from northeast corner of same and Middlesex Avenue to the northwest corner of

Railroad Avenue and Burrill Street, and appropriate money for the same.


ART. 25. To see if the Town will appoint a committee of three to investigate as to the expediency and probable cost of converting our present Pumping Station of the Water Works into an Electric Light Plant for the purpose of supplying electricity for the use of the Town and its citizens, and to report at the next annual Town Meeting.


ART. 26. To see what action the Town will take in relation to the betterments assessed by the Park Commissioners, March 18th, 1898, upon lands bordering on Humphrey Street.


ART. 27. To see what action the Town will take toward accepting a portion of Humphrey Street, as laid out by the Selectmen, and appropriate money for the same.


ART. 28. To see what action the Town will take toward accepting a portion of Orient Court, as laid out by the Select- men, and appropriate money therefor.


ART. 29. To see what action the Town will take toward accepting a portion of Roy Street, as laid out by the Selectmen, and appropriate money therefor.


ART. 30. To see what action the Town will take toward accepting Maple Avenue, as laid out by the Selectmen, and appropriate money for the same.


ART. 31. To see what action the Town will take toward accepting Stetson Avenue, as laid out by the Selectmen.


ART. 32. To see if the Town will vote to request the School Committee to introduce a Business Course at the High School, consisting of the following studies : Arithmetic, English, double- entry bookkeeping, stenography and typewriting, and appro- priate money for the same.


ART. 33. To see what action the town will take in reference to drainage of Norfolk Avenue, as mentioned in the Selectmen's report.

ART. 34. To see what action the Town will take in relation to improvements at Atlantic and Beach Bluff Avenues, as recommended by the Selectmen.


ART. 35. To see if the Town will vote to purchase a Water- ing Cart, as recommended by the Selectmen.


ART. 36. To see if the Town will vote to give E. A. Farn- ham permission to connect a private drain with the Town drain on Humphrey street for the removal of surface water.


ART. 37. To see what action the Town will take relative to the perpetual care of Cemetery Lots.


ART. 38. To see what action the Town will take toward arranging a contract with the City of Lynn for fire protection.


ART. 39. To fix the amount of salary for Town officials for ensuing year.


ART. 40. To see if the Town will vote to instruct the Board of Selectmen to petition the Massachusetts Highway Commission to build that portion of the state highway between the Boston & Maine Railroad overhead bridge on Paradise Road, to Burrill Street on the North Shore Route, so called, with such modifi- cations of said plan as may be deemed advisahle.


ART. 41. To see what action, if any, the Town will take as to paying for land on Blaney's Beach, which John Smith claims to have owned, and which was taken by the Park Commissioners for park purposes, and to take any action on the claim of said Smith which the meeting may determine.


ART. 42. To see what compensation, if any, the Town will award to William C. Stone, and the other Stone heirs, for land of the said William C. Stone or of the Stone heirs, taken by the Town for park purposes, or what action, if any, the Town will take in reference to compensation to said William C. Stone, or said Stone heirs, upon their claim as set forth in petition on file,-and to see whether the Town will appoint a committee to investigate the whole matter relating to the entire taking of property of William C. Stone, and the Stone heirs, for such park purposes.

Pursuant to the within Warrant to me directed, I have notified the inhabitants of the Town of Swampscott, qualified, as herein expressed, to meet at the time and place and for the purpose herein mentioned, by posting up attested copies of said Warrant at the Town Hall, Depots, Post Office, and eight other public and conspicuous places in said Swampscott, on Friday, the tenth day of March, in the year eighteen hundred and ninety-nine, the posting of said notices being seven days before the time of said meeting.

In accordance with the foregoing Warrant, the inhabitants of the Town of Swampscott qualified to vote in elections and in Town affairs, met in the Town Hall on Monday, March 20, 1899, and were called to order at 6 o'clock A. M. by the Town Clerk, who read the Warrant calling said meeting, and the return thereon.


ART. I. Moderator. On motion it was voted that the Town Clerk · cast one ballot for Edmund Russell for Moderator, that ballot having been cast, Edmund Russell was declared elected Moderator, and was immediately qualified for the duty by the Town Clerk. Benjamin F. Rich, (Rep.) and James T. Lyons, (Dem.) having been appointed by the Selectmen to serve as Inspectors, were qualified by the Clerk, and to them were deliv- ered the package containing 1,260 general and 60 special bal- lots. All the requirements of the law having been complied with, the polls were declared open for balloting for Town Offi- cers at 6.15 A. M.


The following having been appointed Tellers, were duly quali- fied by the Clerk, William Herbert Webster, Willard M. Hatch, James L. Taylor and Frank V. Porter, (Rep.) and Frank D. Thurston, Daniel A. Mohan, William H. Collins and Bernard McDermott, (Dem.). It having been voted that the polls be kept open until 5.57 P. M., they were closed at that hour.
