ART. 34. Report of the Selectmen in regard to Beach Bluff Avenue.


SWAMPSCOTT, MASS., April 22, 1899. To the Citizens of Swampscott ;


In regard to changing grade at Beach Bluff Avenue, near estates of Means and Burton as printed in Selectmen's Report, we believe that this improvement should be made providing the said abutters would waive all claims for damages, as the improve- ment at Atlantic Avenue is not recommended as at first sug- gested, this improvement would be a separate contract and would probably cost about $650.

Voted, That Maple Avenue, as laid out by the Selectmen, be accepted, and that the sum of $400 be appropriated to grade the same, as soon as all the waivers have been signed.


Voted, To take up Art. 43. On motion of D. H. Millett, it was voted that the Town Treasurer be authorized, under the direction of the Selectmen, to hire a sum of money not exceeding $6,000, and give the notes of the Town for a time not less than eight (8) years, the same to be used for permanent improve- ments.


Report of the Selectmen on Art. 37. Cemetery.


SWAMPSCOTT, MASS., April 22, 1899.


To the Citizens of Swampscott;


In regard to the rcommendations for the Cemetery, as embodied in reports of Selectmen and Superintendent of Cemetery, we beg leave to report that the estimated cost of painting the house is $25. We recommend that this amount be added to the Cemetery appropriation for this purpose.


In regard to perpetual care of Cemetery Lots, we recommend that lot owners be allowed to deposit with the Town Treasurer the sum of $100, the same to be invested under the direction of the Treasurer and the income to be used for the care of any lot designated.


We recommend that the new lots in the Cemetery be sold at about their cost to the Town.

Report of the Sewerage Committee on Art. 33. Drainage of Norfolk Avenue.


To the Citizens of Swampscott :


Referring to Article No. 33 of the Town Warrant, referred to the Committee on Sewerage, your committee has secured the opinion of the Town counsel, and they advise that the Town should not go ahead and restore the old brook course to its former size without an act of the Legislature, and that if the committee made any changes in the brook now without obtaining such act the members of the committee would be personally liable and the Town would also be liable for damages.


The counsel advise us that the remedy is for the property owners residing above the obstruction in the brook course, who are damaged thereby, to bring suits on their own account against the abutters upon whose premises the obstructions exist.


Therefore, your committee respectfully recommends that a 24-inch tile drain pipe be laid from the corner of Norfolk Avenue and Paradise Road to the culvert beyond new Ocean

ARTICLE I. ] Moderator. On motion, it was voted that the Clerk cast one vote for Edmund Russell for moderator. That vote having been cast, Edmund Russell was declared elected moderator, and was qualified for that duty by the Town Clerk.

ART. 3. Voted, To refer Art. 3 to the Board of Fire Engi- neers and the Board of Selectmen, they to report at adjourned meeting.

SWAMPSCOTT, Nov. 7, 1899.


In pursuance of the foregoing warrant, the inhabitants of the Town of Swampscott, qualified to vote in elections, met in the Town Hall in said Town on Tuesday, Nov. 7, 1899, and were called to order at 6 o'clock A. M. by George T. Till, Chairman of the Selectmen and presiding election officer. The Warrant was read by the Town Clerk. The package of 1300 ballots was delivered to the ballot clerks, James T. Lyons (Dem.), and John B. Earp (Rep.), who had been appointed by the Select- men and duly sworn by the Clerk.


All the requirements of the law having been complied with, the polls were declared open for balloting at 6.07 A. M., and were closed at 4.29 P.M.

ART. 5. To see if the Town will adopt a system of Sewerage designed by Rudolph Herring, as shown upon plans and in specifications (known as Project 3 for sewage disposal sub- mitted and filed in February, 1891), and take any and all action necessary to authorize the construction and maintenance, and care of such system of sewerage as the same may be constructed.


ART. 6. To see if the Town will appropriate the sum of $1,000 for the making of further surveys and the preparation of further plans, drawings, and specifications, and for expenses in- cident to securing the approval of the State Board of Health of said system of sewerage and the license of the Harbor Commis- sioners for the construction of that part of the same which is to be in tide-waters.


Art. 7. To see if the Town will authorize the Committee on Sewerage to take all necessary steps to carry out the provisions in the last preceding article, or what authority it will give to said Committee in the premises.


ART. 8. To see if the Town will authorize a petition to be presented to the Legislature for all legislation that may be requi- site to the construction of a system of sewerage in the Town, and to enable the Town to provide such sum of money as may be needed therefor, or to see what action the Town will take in relation to the matter.


ART. 9. To see if the Town will cause to be elected at the annual meeting of the voters of the Town in March next, three persons to constitute a Board of Sewer Commissioners, one of whom shall serve for the term of one year, one for the term of two years, and one for the term of three years, and to annually choose one each year thereafter to serve for the term of three years.


ART. 10. To see if the Town will adopt and confirm the acts of the Sewerage Committee in relation to the matter of securing for the Town a system of Sewerage.


ART. II. To see what action the Town will take in regard to that part of the report of the Park Commissioners relative to the acceptance of the King's Beach Reservation from the Metropoli- tan Park Commissioners.

Town Meeting, Dec. 4, 1899.


Meeting called to order at 7.30 P. M. by the Town Clerk, who read the Warrant.


ARTICLE I. Moderator. On motion it was voted that the Clerk cast one vote for John R. Merritt for Moderator. Having cast that vote, the Clerk declared John R. Merritt duly elected Moderator, and he was immediately qualified for that duty.


ART. 2. Report of the Sewerage Committee.


This report, together with the report and estimates of the engineer in charge, has been published by the committee and is already before the Town.


Voted, That the report of the Sewerage Committee be accepted.


ART. 3. Voted, To accept the provisions of Chap. 50 of the Public Statutes of this Commonwealth, and amendments thereof, as applied to towns ..


ART. 4. Voted, That the provisions of the first seven sec- tions of Chap. 245, Acts of the year 1892, be accepted and adopted.


ART. 5. Voted, That the Town of Swampscott hereby adopts the system of sewerage heretofore designed for the Town by Rudolph Herring, as modified by the report of Engineer Fuller, the same being known as Project No. 3 and more fully set forth, defined, and explained in drawings and specifications submitted by said Herring in February, 1891, and now on file in the office of the Clerk of the Town.


ART. 6. Voted unanimously, That the sum of one thousand dollars is hereby appropriated to be expended by the Committee on Sewerage in defraying the cost of making further experiments and surveys ; for the preparation of further plans, drawings, and specifications ; and to defray any expenses incident to securing the approval of the State Board of Health of such system of

sewerage and the license of the Land and Harbor Commissioners for the construction of such part of said sewer as may be in tide- waters.


Voted, That the Committee on Sewerage be instructed to pre- pare not less than 1,000 copies of their report for distribution not less than two weeks before the annual March meeting in 1900.


ART. 7. Voted, That the Committee on Sewerage is hereby authorized to use and expend the one thousand dollars specified in Art. 6, or so much thereof as may be needed for the purpose set forth in said article, and said Committee is also authorized, in the name and behalf of the Town, to take whatever action may be necessary to procure the approval of the State Board of Health to the system of sewerage specified in Art. 5, and to obtain the license of the Land and Harbor Commissioners for the construc- tion of such part of said system as may be in tide-waters.


ART. S. Voted, That the Committee on Sewerage is hereby authorized to present, in the name and behalf of the Town, a petition to the General Court of the Commonwealth of Massa- chusetts for any and all legislation that may be found necessary or deemed expedient to enable the Town to construct and main- tain said system of sewerage, and to provide a sufficient sum of money to pay for the construction of the same.


ART. 9. Voted unanimously, That in addition to the officers now elected at the annual meeting of the voters of the Town, there shall be chosen by ballot at the annual meeting in March, 1900, three inhabitants of the Town, who shall constitute a Board of Sewer Commissioners, one of whom shall serve for the term of one year, one for the term of two years, and one for the term of three years, and there shall be chosen annually thereafter one who shall serve for the term of three years.


Voted, That Art. 10 be laid upon the table.


ART. II. Voted, as moved by George A. Jackson, That the Town approve the action of the Park Commissioners, as reported at the March meeting, in not accepting the transfer of King's Beach, under the conditions named in the indenture proposed by

the Metropolitan Park Commissioners, said conditions seeming to conflict with rights granted to the Town by the General Court (act approved Feb. 15, 1896), and with the understanding be- tween the Park Commissioners of the Town and the Metropoli- tan Park Commissioners when the clearing of the beaches was agreed upon.


ART. 12. Voted, To accept and adopt the report of the Board of Selectmen on the laying out of Palmer Avenue.
