ANNUAL TOWN MEETING


March 11, 1961


The Annual Town Meeting of the Inhabitants of Carver was held at the Governor John Carver School on March 11, 1961. The meeting was called to order at 2:00 o'clock, P. M., by the Moderator, Bradford H. Cole. Article 1, relating to the election of officers, having been disposed of at a prior meeting, the meeting proceeded to act upon the Articles in the Warrant, beginning with Article 2, as follows:


Article 2. VOTED to authorize the Town Treasurer, with the approval of the Selectmen, to borrow money from time to time in anticipation of the revenue of the financial year beginning January 1, 1961, and to issue a note or notes therefor, payable within one year, and to renew any note or notes as may be given for a period of less than one year in accordance with Section 17, Chapter 44, General Laws.


Article 3. VOTED to appropriate the sum of $1500.00 from free cash in the town treasury for the sole purpose of meeting charges against the Cemetery funds in the Town Treasury.


Article 4. VOTED that the Dog Fund in the sum of $313.26 be transfered to the Library Account.


Article 5. VOTED to raise and appropriate the sum of $100.00 for the use of Plymouth County Trustees for County Aid to Agriculture. Mr. Earl E. Boardway was unanimously elected Town Director, County Aid to Agriculture.

Article 6. VOTED to transfer the sum of $5,000.00 from the Overlay Reserve Account to the 1961 Reserve Account.


Article 7. Voice vote was questioned and the Mode- rator appointed Dana E. Thomas and Louis A. Bryant, Jr. as Tellers to count the votes. Thereupon, vote by show of hands being had, 30 voting in the affirmative and 23 in the negative, it was VOTED to raise and appropriate the sum of $1,100.00 and to transfer the sum of $2,900.00 from the Road Mach- inery Fund for the purpose of purchasing a new dump truck for the use of the Highway Department.


Article 8. VOTED to fix the salary and compensation of all elective officers of the Town as provided by General Laws, Chapter 41, Section 108, as follows:

Moderator, $20.00 for the Annual Town Meeting,


and $5.00 for each Special Town Meeting. Members of the School Board, $3.00 for each meeting, plus $1.50 per hour for all meetings of over 2 hours. All other elective Town Officers $1.50 per hour.


Article 9. VOTED to choose all necessary Town Offi- cers not elected by ballot. Thereupon the following officers were unanimously elected: Field Drivers and Pound Keepers: Dana E. Thomas, Raymond A. Parent and Louis A. Bryant, Jr .; Surveyors of Lumber and Measurers of Wood: Toivo O. Kallio, Bradford H. Cole and Homer F. Weston; Herring Committee: Frank R. Mazzilli, Clark A. Griffith and Gordon W. Fountain.


Article 10. VOTED to raise and appropriate the sum of $8,000.00 for Chapter 90 Highway Construction, and to trans- fer the sum of $24,000.00 from free cash in the Treasury to

meet the State's and County's shares of the cost of work, the reimbursements from the State and County to be restored, upon their receipt, to free cash in the Treasury.


Article 11. VOTED to raise and appropriate the sum of $6,600.00 for Chapter 81 Highways, and to transfer the sum of $18,150.00 from free cash in the Treasury to meet the State's share of the cost of the work, the reimbursements from the State to be restored, upon their receipt, to free cash in the Treasury.


Article 12. VOTED to authorize the Cemetery Com- missioners and the Park Commissioners to employ themselves as laborers in the cemeteries and parks.


Article 13. VOTED to raise and appropriate the sum of $650.00 to be used to pay for all private work and material in Town Cemeteries, such as, opening graves, building foun- dations, etc., as according to General Laws, Chapter 44, Section 53.


Article 14. Under this Article Mr. Alan I. Dunham, Chairman, presented a report of the Building Code Com- mittee wherein it was set forth that public hearings will be held on the proposed Code and that it would soon be pre- sented to the voters for action at a Special Town Meeting. Mr. John A. Shaw reported as to the progress made by the Town "Beach Committee", stating that a proposal regarding sale of land by Federal Cranberry Company had been sub- mitted to the Selectmen. Both reports were unanimously accepted.


Article 15. VOTED to raise and appropriate the sum of $3,000.00 for Assessors' Plans, such sum to be used and ex- pended by the Board of Assessors.


Article 16. VOTED to appropriate from the Lakenham Cemetery Sale of Lots Fund the sum of $300.00 for the pur-

pose of filling in deep walks around burial lots - Loam, Fer- tilizer, Lime, Lawn seed and Labor.


Article 17. Unanimously VOTED to raise and appro- priate the sum of $1,141.86 to pay the following unpaid bills, namely: (1960) Plymouth County Electric Co. (Gen- eral Highway ) $21.00; (1958) Warren Brothers Co. (Chapter 90) $1,120.86.


Article 18. VOTED to raise and appropriate such sums of money as may be necessary to defray town charges for the ensuing year, as follows:

Article 19. VOTED to take from available funds in the Treasury the sum of for the purpose of reducing the tax rate.


Article 20. VOTED to accept Section 42 of Chapter 48 of the General Laws of this Commonwealth which provides for the establishment of a Fire Department and appointment of a Fire Chief under the direction of the Selectmen.


Article 21. VOTED to raise and appropriate the sum of $900.00 for the purpose of purchasing and installing a 2,000 gallon capacity underground gasoline storage tank, together with pump, said tank and pump to be located on Town prop- erty adjacent to the Town Hall. (Vote was by show of hands, 37 in the affirmative and 26 in the negative).


Article 22. Motion by Frank R. Mazzilli, duly seconded, to amend the original motion for adoption of the Article, as appearing in the Warrant, by inserting after the words "with all the powers and duties thereof", the following words and figures: "provided, however, that the subdivision control law

as provided in sections 81K through 81GG of Chapter 41 of the General Laws not be accepted". After considerable dis- cussion it was VOTED, 44 to 24, to adopt the amendment as set forth above. Thereupon, it was VOTED, 54 in the affirmative and 1 in the negative, to establish a Planning Board of Five members under the provisions of Section 81 A of Chapter 41 of the General Laws, with all the powers and duties thereof, provided, however, that the subdivision con- trol law as provided in Sections 81 K through 81 GG of Chapter 41' of the General Laws not be accepted, and that said five members be elected from the floor, one for a term of one year, one for a term of two years, one for a term of three years, one for a term of four years, and one for a term of five years, and thereafter in accordance with the provisions of statute and by official ballots.


Article 23. VOTED to proceed with the nomination and election of five members of the Planning Board estab- lished under Article 22. The following persons were duly nominated and elected: Philip H. Gibbs, for 1 year, Simon F. Majahad for 2 years, Alan I. Dunham for 3 years, Russell A. Trufant for 4 years, and John A. Shaw for the term of five years.


Article 24. VOTED, by rising vote, 37 in the affirm- ative and 34 in the negative, to authorize the Board of Selectmen to negotiate a lease for a police cruiser car and purchase a radio upon such terms and conditions and from such person or persons as the Board of Selectmen deems advisable and to appropriate the sum of $2500.00 therefor.


Article 25. VOTED to postpone indefinitely any action on Article 25. (This Article called for the appropriation of a sum of money for the purchase of a new police cruiser ).

Article 26. VOTED to purchase from the heirs of the Hugh Bailey Estate, Plymouth County Probate No. 77272, a parcel of land on Church Street in South Carver containing about .45 of an acre to be used for playground purposes for the Benjamin Ellis School, and appropriate the sum of $500.00 therefor.


Voted to adjourn. Adjourned at 5:58 P. M.

SPECIAL TOWN MEETING March 25, 1961


A Special Town Meeting was held at the Governor John Carver Schoolhouse on March 25, 1961, pursuant to a War- rant of the Selectmen dated March 14, 1961. The meeting was called to order at 8:00 o'clock, P. M., by the Moderator, Bradford H. Cole. Raymond A. Parent and Robert H. Telless were appointed to serve as Tellers to count the votes, and were duly sworn to the faithful performance of their duties.


The meeting then proceeded to act on the Articles in said Warrant, as follows:


Article 1. VOTED, unanimously, to establish a Stabil- ization Fund in accordance with the provisions of General Laws Chapter 40, Section 5 B, as amended, and to appro- priate therefor the sum of $12,000.00 from available funds in the Treasury.
