COMMONWEALTH OF MASSACHUSETTS

TO WILLIAM E. SWAIN, CONSTABLE OF THE TOWN OF WILMINGTON, GREETING :


In the name of the Commonwealth of Massachusetts, and in the manner provided by Section 2, Article 1, of the By-Laws, you are hereby directed to notify and warn the inhabitants of the Town of Wilmington qualified by law to vote in the Town affairs, to meet and assemble at the Town Hall on Monday, the first day of March next, at 6 o'clock in the forenoon, the polls to be opened at 6.30 o'clock A. M., and may be closed at 4 o'clock P. M., for the election of officers and to act upon the following articles, viz .:


Article 1. To elect by ballot a Moderator to preside at said meeting.


Art. 2. To bring in your votes on one ballot for three Selectmen, who shall also be Overseers of the Poor, and Board of Survey, Town Clerk, Treasurer, one Assessor for three years, Collector of Taxes, one School Committee for three years, Constable, Auditor, three Fence Viewers, one Sinking Fund Commissioner for three years, two Trustees of the Public Library for three years; also, to vote upon the following question, to wit: "Shall licenses be granted for the sale of intoxicating liquors in this Town? Yes or No."


At 10 o'clock in the forenoon to act upon the following articles :

Art. 3. To choose all other Town Officers for the year ensuing.


Art. 4. To hear reports of Committees and act thereon.


Art. 5. To see how much money the Town will vote to raise and appropriate for the support of Schools, and School Books and Supplies, and Salary of Superintendent of Schools; for Salary of School Committee; for Highways, Roads and Bridges; for Support of the Poor; for Repairs of Public Buildings; for Care and Improvement of Cemeteries; for Support of the Public Library; for Police; for Printing; for Outstanding Indebtedness; for Notes Payable; for Sinking Fund Payment; for Interest; for Removing Snow; for Miscellaneous Expenses ; for the Abatement of Taxes; for Fire Department; for State and County Taxes; and for Suppression of the Gypsy and Brown Tail Moths.


Art. 6. To see how much money the Town will vote to raise and appropriate for the expenses of the Board of Survey.


Art. 7. To see how much money the Town will vote to raise and appropriate for the observance of Memorial Day, and to determine how the same shall be expended.


Art. 8. To see what method the Town will adopt for the collection of taxes, and to determine the compensation of the Collector.


Art. 9. To authorize the Town Treasurer, with the ap- proval of the Selectmen, or a majority thereof, to borrow during the municipal year beginning March 1st, 1909, in an- ticipation of the collection of taxes of said year, such sums of money as may be necessary for the current expenses of the Town, but not exceeding the total tax levy for said year, giving the notes of the Town therefor, payable within one year from the date thereof. All debts incurred under authority of this vote shall be paid from the taxes of the present municipal year.

Art. 10. To see if the Town will vote to accept and allow the Town Way called Railroad Avenue, as laid out by the Selectmen under the provisions of Chapter 48 of the Revised Laws, to be established.


Art. 11. To see if the Town will vote by separate ballot to accept the provisions of Chapter 209 of the Acts of 1908, in regard to protection of forest and sprout lands from fire. 9


Art. 12. To see if the Town will vote to reorganize the Fire Department, or do anything in relation to the same.


Art. 13. To see how much the Town will vote to raise and appropriate for the salary of the Chief of Fire Department, or do anything in relation to the same.


Art. 14. To see if the Town will vote to appoint a committee to examine into the subject of a Town water supply including estimate of cost, and report at a future meeting.


Art. 15. To see if the Town will vote to appoint a committee to examine iuto the subject of remodelling the present Town Hall including estimate of cost, and report at a future meeting.


Art. 16. To see if the Town will vote to appoint a committee to examine into the subject of street lights and including estimate of cost, and report at a future neeting.


Art. 17. To see to what the Town will vote to apply the money received from the State Corporation Tax in the future.


Art. 18. To see if the Town will vote to accept the bequest contained in the will of the late Sarah D. J. Carter, and to determine how the same shall be cared for.


Art. 19. To see if the Town will vote to reimburse Mrs. Susan S. Prentiss for money paid by reason of illegal tax sale and subsequent assessments.

Art. 20. To see how much the Town will vote to raise and appropriate to purchase new furniture for Walker School.


Art. 21. To see how much the Town will vote to raise and appropriate to purchase pianos for Walker and Whitefield Schools.


Art. 22. To see how much the Town will vote to raise and appropriate for grading the school house lots.


Art. 23. To see if the Town will vote to fix the salaries of members of the Fire Department, and to see how much money the Town will vote to raise and appropriate for the same.


Art. 24. To see if the Town will vote to accept the provisions of Sections 178-179-180 Ch. 102 of the Revised Laws in regard to licensing picnic groves.


Hereof fail not and make due return of this warrant, with your doings thereon, to the Town Clerk, at the time and place of said meeting.

TOWN MEETING


RECORD OF PROCEEDINGS OF THE ANNUAL TOWN MEETING HELD MARCH 1, 1909.


In accordance with the directions of the foregoing war- rant, the voters assembled on the above date. The votes as declared by the Moderator are as follows:


The meeting was called to order by the Town Clerk, the Warrant read as far as Article 2, when on motion it was voted to dispense with reading the remaining articles, and proceed to elect a Moderator.


Article 1. Edward N. Eames was elected Moderator, the vote being taken by ballot, and the check list being used.


Art. 2. The Moderator read Art. 2 and then examined the ballot box, which was found empty, the register indicated 000; the box was locked and the key delivered to the Con- stable. The Ballot Clerks and Tellers having been sworn, the official ballots were delivered to the Ballot Clerks, a receipt for the same being taken by the Town Clerk. The Modera- tor announced that the polls for the election of officers were open and that balloting might proceed. Later on, it was voted that the polls for the election of officers be closed at 4 o'clock P. M. At the appointed time the Moderator de- clared the polls closed. The names checked upon the list numbered 212 and one special "for School Committee only," and the ballots as counted from the ballot box numbered 212 regular and one special, and the register indicated 213.

Art. 4. The Chairman of the Board of Selectmen, Mr. John W. Hathaway, reported that with the exception of some omissions the Reports as printed were correct, and explained one important omission, viz: that the report of the Sinking Fund Commissioners of the Whitefield School was mislaid or lost, but that a leaf would be printed and circulated during the day containing a full report which could be placed in the Town Report; after said report on motion it was voted to accept the Reports as printed.


Art. 5. On motion it was voted to take up the recom- mendations of the Selectmen on page 116 of the printed Report. On motion it was voted to lay on the table the appropriations for Fire Department and Forest Fires until after Art. 13 of the Warrant had been acted on.

Art. 6. On motion it was voted to raise and appropriate $200.


Art. 7. On motion it was voted that the sum of $150 be raised and appropriated, and that a committee of three, ap- pointed by the chair, have charge of expending the same, and that they secure the services of a good orator. Committee appointed were Joseph M. Hill, Joseph Patchett and Robert H. Gowing.


Art. 8. On motion it was voted that two per cent. be paid the Collector on all taxes collected by him; and that the same method employed in the past be adopted; amendment made that the Collector be reimbursed for postage to an amount not to exceed $50. The amendment was put to a vote and declared carried. The question recurring on the original motion as amended, it was declared carried.


Art. 9. On motion it was voted by a majority vote of the legal voters present and voting that the Treasurer be, and hereby is, authorized, with the approval of the Selectmen or a majority thereof, to borrow during the municipal year begin- ning Mar. 1st, 1909, in anticipation of the collection of taxes, such sums of money as may be necessary for the current expenses of the Town, but not exceeding the total tax levy for said year, giving the notes of the Town therefor, payable within one year after the date thereof. under the authority of this vote shall be paid from the taxes of the present municipal year. The vote as declared was Yes 28, No 1.


Art. 10. On motion it was voted to accept and allow the town way called Railroad Avenue to be established.


Art. 11. On a ballot being taken, the check list being used, it was voted to accept the provisions of Chap. 209 of the Acts of 1908, by the following vote: Yes 51; No 0; Blank 1.


Art. 12. Motion made that a committee of three be appointed by the Moderator to examine into the subject of re-organizing the Fire Department, and report its doings and recommendations at a future meeting. Amendment made that the committee retire and report to the present meeting. After some remarks the amendment was voted on and decided in the negative; the original motion was then voted on and it was declared carried. The Moderator appointed as said committee: Caleb S. Harriman, George C. Hill and Charles B. Osbon.


Art. 13. On motion it was voted to raise and appro- priate the sum of $100. At this time the appropriation for Fire Department and Forest Fires was taken from the table, and on motion it was voted to raise and appropriate the sum of $700 for the Fire Department.


Art. 14. Motion that the Chairman appoint a committee of three to examine into the subject of a town water supply and report at a future meeting. On being put to a vote it was declared in the affirmative. The committee appointed by the Chairman were Caleb S. Harriman, Joseph M. Hill and Albert D. Butters.


Art. 15. Motion made that a committee of three be ap- pointed by the Chair to examine into the subject and report

at a future meeting. On being put to a vote the motion was declared not carried.


Art. 16. On motion it was voted to pass the article.


Art. 17. On motion it was voted to pass the article.


Art. 18. On motion it was unanimously voted that the Town of Wilmington accept the legacy of Mrs. S. D. J. Carter, and that the same be placed in the hands of the Board of Trustees of Trust Funds for investment, and that the income derived therefrom be paid annually to a committee consisting of five (5) members to be ehosen at this meeting, and who shall have the expending of said income to carry out the intentions of Mrs. Carter's will; and that the Moderator ap- point a committee of three to retire and nominate and bring in a list of five (5) to be elected to serve on said committee: One whose term shall expire March, 1910; another whose term shall expire March, 1911; another whose term shall ex- pire March, 1912; another whose term shall expire March, 1913; another whose term shall expire March, 1914; and that in 1910 and each year thereafter one (1) member be elected at the annual Town meeting to serve for five (5) years. The Moderator appointed as the nominating committee of three: Joseph Stack, Arthur T. Bond and Thomas T. Sidelinker. Said committee reported the following five names as the com- mittee on expenditure of said income-

On motion it was voted that the committee's report be accepted and the nominees be declared elected for the several terms.

Art. 19. After some remarks in explanation, on motion it was voted to reimburse Mrs. Susan S. Prentiss by appro- priating $44.52 for the reasons set forth in the article.


Art. 20. On motion it was voted to raise and appro- priate the sum of $500.


Art. 21. On motion it was voted to raise and appro- priate the sum of $150.


Art. 22. On motion it was voted to raise and appro- priate the sum of $275, to be expended as follows: $150 on Walker School lot, $75 on Whitefield, and $50 at District Schools.


Art. 23. Voted to pass the article.


Art. 24. On motion it was voted to accept the provisions of Sections 178, 179, 180 of Chapter 102 of the Revised Laws.


After a declaration of the vote under Article 2 the meet- ing adjourned sine die.

In the name of the Commonwealth of Massachusetts, and in accordance with the By-Laws of said Town, you are hereby directed to notify and warn the inhabitants of said Town qualified by law to vote in Town affairs, to meet and assemble at the Town Hall in said Town on Saturday, the seventeenth day of April current, at eight o'clock P. M., to act upon the following articles, namely :


Article 1. To choose a Moderator to preside at said meeting.


Art. 2. To see how much money the Town will raise and appropriate to erect a building for the Moth Department, or what they will do in regard to the same.

Art. 3. To see how much money the Town will vote to raise and appropriate for salaries of Town Officers, or what they will do in regard to same.


Art. 4. To hear the report of the Committee on the Fire Department and act thereon.


Art. 5. To see how much money the Town will raise and appropriate for the suppression of Forest Fires, and de- termine how the same shall be expended.


Art. 6. To see if the Town will vote to raise and appro- priate the sum of two hundred ($200) dollars to be used by the Committee on Water Supply.


Art. 7. To see if the Town will vote to raise and appro- priate the sum of one hundred ($100) dollars to be expended under the direction of the Tree Warden, or what they will do in regard to the same.

To see if the Town will vote to instruct the Selectmen to add to the present police force a competent watchman for general patrol duty during the night-time, ex- clusively; and authorize said Selectmen to use such unex- pended balances (not exceeding $750) as may be on hand from accounts of 1908, with which to properly equip and pay such patrolman.


Art. 9. To see if the Town will vote to authorize the Assessors and Collector of Taxes to examine into the tax title to all lots or parcels of land now standing in the name of the Town, and after the same have been revised and corrected, that the Selectmen be instructed to sell said lots, giving to the purchaser in the name of the Town a quitclaim deed of the same; and that the expenses incurred under this article be paid from the proceeds of any sale made by the Collector of Taxes or the Selectmen during the year 1909.

Art. 10. To see what action the Town will take relative to the settlement of claims for land damages on Woburn and Adams Streets.


Hereof fail not and make due return of this warrant, with your doings thereon, to the Town Clerk, at the time and place of said meeting.

RECORD OF PROCEEDINGS OF SPECIAL TOWN MEETING APRIL 17, 1909


Meeting called to order by the Town Clerk, the Warrant read, and under Article 1 Edward N. Eames was elected Moderator by ballot, the check list being used.


Art. 2. Motion made to raise and appropriate six hun- dred dollars for the purpose of erecting a building for the Moth Department, the same to be located in the centre of the Town; the vote on the same was in the affirmative.


Art. 3. On motion that two thousand dollars be appro- priated from the corporation tax of 1909 for salaries of Town Officers, the vote on the same was in the affirmative.


Art. 4. The chairman of the Committee, Caleb S. Har- riman, read the following report:


Your committee appointed at the annual Town meeting on re organi- zation of the Fire Department respectfully submit the following :--


We recommend that :


I. The Board of Selectmen annually appoint a Board of Engineers consisting of two-Chief and Assistant Chief; the Chief to receive a salary of $100 per year, the Assistant Chief a salary of $50 per year. (The salary of the Chief has been already appropriated for the year 1909).
