TOWN WARRANT


ANNUAL MEETING, MARCH 7, 1910


COMMONWEALTH OF MASSACHUSETTS MIDDLESEX SS.


To William E. Swain, Constable of the Town of Wilmington, Greeting :


In the name of the Commonwealth of Massachusetts, and in the manner provided by Section 2, Article 1, of the By Laws, you are hereby directed to notify and warn the inhabitants of the Town of Wilmington qualified by law to vote in Town affairs, to meet and assemble at the Town Hall on Monday, the seventh day of March next, at 6 o'clock in the forenoon, the polls to be opened at 6.15 o'clock A. M., and may be closed at 4 o'clock P. M., for the election of officers and to act on the following articles, viz :


Article 1. To elect by ballot a Moderator to preside at said meeting.


Art. 2. To bring in your votes on one ballot for three Select- men, who shall also be Overseers of the Poor and Board of Survey, Town Clerk, Treasurer, one Assessor for three years, Tax Collector, one School Committee for three years, Constable, Auditor, three Fence Viewers, one Sinking Fund Commissioner for three years, two Trustees of the Public Library for three years ; also, to vote on the following question, to wit: " Shall licenses be granted for the sale of intoxicating liquors in the Town ? Yes or No ?"


At 10 o'clock in the forenoon to act upon the following arti- cles :


Art. 3. To choose all other Town Officers for the year ensuing.


Art. 4. To hear reports of Committees and act thereon.

Art. 5. To see how much money the Town will vote to raise and appropriate for the Support of Schools, and School Books and Supplies, and Salary of Superintendent of Schools; for Salary of School Committee ; for Highways, Roads and Bridges; for Support of Poor; for Repairs of Public Buildings; for Care and Improve- ment of Cemeteries; for Support of the Public Library ; for Police ; for Tree Warden; for Salaries of Town Officers; for Printing; for Outstanding Indebtedness; for Notes Payable; for Sinking Fund Payment; for Interest; for Removing Snow; for Miscellaneous Expenses ; for Abatement of Taxes; for Fire Department; for State and County Taxes; and for Suppression of the Gypsy and Brown Tail Moths. .


Art. 6. To see how much money the Town will raise and appropriate for the observance of Memorial Day, and to determine how the same shall be expended.


Art. 7. To see what method the Town will adopt for the collection of taxes, and to determine the compensation of the Col- lector.


Art. 8. To authorize the Town Treasurer, with the approval of the Selectmen, or a majority thereof, to borrow during the municipal year beginning March 7, 1910, in anticipation of the col- lection of taxes of said year, such sums of money as may be neces- sary for the current expenses of the Town, but not exceeding the total tax levy for said year, giving the notes of the Town therefor, payable within one year from the date thereof. All debts incurred under authority of this vote shall be paid from the taxes of the present municipal year.


Art. 9. To see if the Town will vote to accept the Town Way called Lake Ave., as laid out by the Selectmen.


Art. 10. To see if the Town will vote to raise and appropriate the sum of two hundred and fifty dollars ($250) to purchase chairs and desks for the High School, or do anything in relation to the same.


Art. 11. To see if the Town will vote to pay the Town Treasurer a salary of $200, and the Auditor a salary of $100, or do anything in relation to the same.

Art. 12. To see how much money the Town will vote to raise and appropriate to purchase fire extinguishers for the High, Walker and Whitefield Schools and other Town buildings, or do anything in relation to the same.


Art. 13. To see if the Town will vote to place the office of the S. D. J. Carter Lecture Committee, Tree Warden and Trustees of Trust Funds on the official ballot.


Art. 14. To see if the Town will vote to have the plans in the office of the Assessors bound, the expense to be paid from the mis- cellaneous appropriation.


Art. 15. To see if the Town will vote to grant the Com- mittee on Water Supply further time, and appropriate the unex- pended balance from the Board of Survey for the use of said Com- mittee, or do anything in relation to the same.


Art. 16. To see if the Town will vote to authorize the School Committee to take such action as shall lead to a change of Superin- tendent of Schools, or do anything in relation to the same.


Art. 17. To see if the Town will vote to sell to E. S. Lewis a lot of land southerly from said Lewis residence on Church Street, bounded as follows: Beginning at southeasterly corner of said Lewis residence, thence southerly by said Church Street thirty (30) feet, thence westerly by Walker School House lot about one hun- dred and thirty-four (134) feet, thence northerly thirty (30) feet by said Walker School House lot to land of said Lewis, thence easterly about one hundred and thirty-four (134) feet to point of beginning, for the sum of one hundred dollars ($100), or do anything in relation to the same.


Art. 18 To see if the Town will vote to raise and appropriate the sum of one hundred dollars ($100) to be used by the Senior Class to defray the expense of their graduation exercises.


Art. 19. To see if the Town will vote to raise and appropriate the sum of three thousand dollars ($3000) to purchase a portable stone crusher, with screen and power, or do anything in relation to the same.

Hereof fail not, and make due return of this warrant, with your doings thereon, to the Town Clerk, at the time and place of said meeting.

TOWN MEETING


RECORD OF PROCEEDINGS OF THE ANNUAL TOWN MEETING HELD MARCH 7, 1910


In accordance with the directions of the foregoing warrant, the voters assembled on the above date. The votes as declared by the Moderator are as follows :


The meeting was called to order by the Town Clerk, and the warrant read.


Art. 1. Edward N. Eames was elected Moderator, the vote being taken by ballot, and the check list being used.


Art. 2. The Moderator read Art. 2 and then examined the ballot box, which was found empty, the register indicated 0000, the box was locked and the keys delivered to the Constable. The Ballot Clerks and Tellers having been sworn, the official ballots were delivered to the Ballot Clerks, a receipt for the same being taken by the Town Clerk. The Moderator announced that the polls for the election of officers were open and that balloting might proceed. Later on it was voted that the polls for the election of officers be closed at 4 o'clock P. M. At the appointed time the Moderator declared the polls closed. The names checked upon the lists numbered 148, and one special " for School Committee Only," and the ballots as counted from the ballot box numbered 148 regu- lar and one special, and the register indicated 149.

Art. 3. On motion it was voted that a committee of three be appointed by the Moderator to bring in a list of names as nomina- tions for the several offices to be filled under the article. Modera- tor appointed Caleb S. Harriman, Louis T. McMahon and Walter D. Carter, who submitted the following list, which on motion was accepted and adopted and the nominees declared elected :

While the committee were out the meeting elected Oliver A. McGrane Tree Warden, and Dr. Daniel T. Buzzell as a member of the S. D. J. Carter Lecture Committee for five years.


Art. 4. The Committee on Water Supply had no report to make at this time; Committee on Exchange of Fire Engines re- ported as follows:


To the Town Meeting of the Town of Wilmington :


The undersigned were appointed a committee at the Town Meeting held April 17 last to consider the matter of exchanging the fire engines now owned by the Town for automobile fire appa- ratus. The committee has considered the matter and one of the committee has made some systematic investigation of the matter of automobile fire apparatus, and the committee wishes at this time to report that in the opinion of its members nothing could be done at present which would be of benefit. The question of different fire apparatus for Wilmington seems to the committee to be only a part of the larger question of public water supply. For with the pres-

ent lack of public water in the streets no advantage could be gained by using different fire engines f.om the ones the Town now has. It is highly probable that with public water in the streets of Wil- mington under sufficient pressure to throw a stream over any ordinary building, some sort of an automobile equipped with hose and small implements for fire fighting could be used with success ; and one such vehicle would be ample protection to that portion of the town which might be supplied with public water. This, how- ever, is a question for the more or less remote future ; therefore the commiltee would recommend that nothing be done in the way of exchanging the fire apparatus at present.

On motion it was voted to accept the report of the committee.


Art. 5 Under the appropriation for schools, etc., Mr. Harri- man made the following motion : That the Town raise and appro- priate for the support of schools, including the school books and supplies, salary of the Superintendent of Schools and School Com- mittee; also the repairs on school buildings and furnishings for same, the sum of $9000. Amendment by Mr. Folkins that $9900 be the amount. Mr. William E. Gowing made an amendment to the amendment that $8000 be the sum raised. At this time a motion was made that Mr. Harold W. Files, principal of the High School, be granted permission to address the meeting. The vote on the same was unanimous. After considerable discussion on the question, Mr. Harriman withdrew the amount named in his motion and substituted the amount called for in Mr. Folkins' amendment which he withdrew. The vote was then taken on the amendment to raise and appropriate $8000, which was decided in the negative. The vote was then taken on the motion that $9,900 be the amount, and it was voted in the affirmative.

Art. 6. On motion it was voted that the sum of $150 be raised and appropriated, and that a committee of three appointed by the Moderator have charge of expending the same. Moderator ap- pointed Dudley B. Purbeck, Milton T. Holt and Robert H. Gowing as said committee.


Art. 7. On motion it was voted that 2 per cent. be paid the Tax Collector ou all taxes by him collected, and that the same method employed last year be adopted in regard to collecting said taxes, and that postage and stationery be paid from the miscella- neous appropriation.


Art. 8. On motion worded exactly as the article was written, it was voted to so authorize the Town Treasurer. The vote was unanimous.

Art. 9. On motion it was voted to accept the Town Way called Lake avenue as laid out by the Selectmen.


Art. 10. Voted to pass the article.


Art. 11. On motion it was voted to pay the Town Treasurer a salary of $200 and the auditor a salary of $100 annually.


Art. 12. On motion it was voted to raise and appropriate the sum of $100 to purchase fire extinguishers for the High, Walker and Whitefield Schools and other town buildings.


Art. 13. On motion it was voted to place the names of those nominated for the offices mentioned in the article on the official ballot.


Art. 14. On motion it was voted to have the plans bound, the expense to be paid from the miscellaneous appropriation.


Art. 15. On motion it was voted to appropriate the unex- pended balance from Board of Survey appropriation for 1909, for the use of the Committee on Water Supply, and that they report at a future meeting. $200.00.


Art. 16. On motion it was unanimously voted that the School Committee be authorized to take such action as shall lead to a change of Superintendent of Schools.


Art. 17. On motion it was voted to sell to E. S. Lewis the lot of land described in the article for $100.


Art. 18. Voted to pass the article.


Art. 19. Motion to raise and appropriate $2,500 to purchase a Stone Crusher. On a vote being taken it was decided in the negative.


After a declaration of the vote under Article 2 and the admin- istration of the oath of office by the Moderator to the Town Clerk, the ballots were sealed, countersigned, and with check lists used, turned over to the Town Clerk. The meeting then adjourned, sine die.

Meeting called to order by the Town Clerk, the warrant read and under Article 1 Edward N. Eames was elected Moderator by ballot, the check list being used.


Art. 2. Motion : Moved, That it be the sense of this meeting, that it is for the best interests of this Town that we withdraw from the Superintendency District, as composed of the towns of Bed- ford, Burlington and Wilmington. Also, that the School Board of this Town be and hereby are instructed and directed to perform all acts and duties necessary to carry into effect the provisions of this vote. Also, that the Town Clerk be and hereby is instructed to notify the chairman of the Joint Committee of said District of the action taken at this meeting.


A supplementary motion was made that when the vote be taken the check list be used and the vote be yes or no. The fol- lowing is the result : Yes 48, No 2.


On motion it was voted to dissolve the meeting.

In the name of the Commonwealth of Massachusetts, and in the manner provided by Section 2, Article 1, of the By Laws, you are hereby directed to notify and warn the inhabitants of the Town of Wilmington qualified by law to vote in Town affairs, to meet and assemble at the Town Hall on Monday, the sixteenth day of May current, at 8 o'clock P. M., to act on the following articles, namely :


Art. 1. To choose a Moderator to preside at said meeting.


Art. 2. To see if the Town will vote to indemnify the Com- monwealth against claims for land and grade damages which may result from the laying out and constructing of the proposed State Highway, or do anything in relation to the same.


Art. 3. To see if the Town will vote to authorize the Select- men to contract to build the State Highway as laid out by the Highway Commissioners, or do anything in relation to the same.


Art. 4. To see if the Town will vote to rescind the vote taken up under Article 2 of the warrant for the special Town Meeting of April 29, whereby it was voted : "That it be the sense of this meeting that it is for the best interests of this Town that we withdraw from the Superintendency District as composed of the Towns of Bedford, Burlington and Wilmington; also, that the School Board of this Town be and hereby are instructed and directed to perform all the acts and duties necessary to carry into effect the provisions of this vote; also that the Town Clerk be and is hereby instructed to notify the chairman of the Joint Committee of said district of the action taken at this meeting."

Art. 5. To see if the Town will vote to withdraw from the Superintendency District made up of the union of the Towns of Bedford, Burlington and Wilmington, or do anything in relation to the same.


Art. 6. To see if the Town will vote to give additional in- structions to the School Committee relative to the Superintend- ency of the Schools, or do anything in relation to the same.


Hereof fail not and make due return of this warrant with your doings thereon, to the Town Clerk, at the time and place of said meeting.

RECORD OF PROCEEDINGS SPECIAL TOWN MEETING MAY 16, 1910


Art. 1. Mr. Edward N. Eames was elected Moderator by ballot and the check list being used.


Art. 2. For the information of the meeting the chairman of the Board of Selectmen read a letter from the Massachusetts State Highway Commissioners explaining the object of the insertion of Articles 2 and 3 in the warrant. Motion was then made that the Town vote to indemnify the Commonwealth against claims for land and grade damages, which may result from the laying out and con- structing of the proposed State Highway. The vote on the same was in the affirmative.


Art. 3. On motion it was voted to waive the right of the Town to contract to build the State Highway as laid out by the Highway Commissioners and that the Board of Selectmen be so instructed.

Art. 4. Motion to pass the article. The mover of the motion requested leave to withdraw the same; no objection being made it was withdrawn. Motion made to lay the article on the table to be taken up later. Motion carried.
