Report of the City Solicitor

Gentlemen :


The following is a report, filed in compliance with Chapter 14 of the Revised Ordi- nances of the City of Newburyport (1937), of my conduct of the office of City Solicitor from the date of my appointment, July 12, 1941, to the expiration of the term on Janu- ary 5, 1942.


When I assumed office, the cases listed below were pending against the City in courts of the Commonwealth.


Brooks Construction and Lumber Company:


An action of contract, in the Essex Superior Court, for labor and material allegedly due the plaintiff. This case has not been tried.


Susie F. McCurdy :


An action of tort, in the Essex Superior Court, based upon a claim for damages for personal injuries. This is still pending.


City of Medford:


A soldier's relief case, in the Middlesex Superior Court, in which the plaintiff city claimed that the veteran had a settlement in Newburyport. With the approval of the agent and the Committee on Soldiers' Relief, I settled this case for $150.00.


June Day:


An action of tort, in the Suffolk Superior Court, arising out of an alleged defect in a sidewalk. This case had not been reached for trial when I left office.


Errol Rolfe and Lillian Rolfe:


Actions of tort, in the District Court of Newburyport, to recover for personal in- juries and property damage, claimed to have resulted from a highway defect. This case has not been tried.


Depositors Realty Corporation:


An action of contract, in the Essex County Superior Court, in which the plaintiff seeks to recover for rent which it claims is owed by the city. This is still pending.


George Bowman and George Bowman, Jr.


These actions of tort, previously tried to a jury in the Essex County Superior Court, had already been taken to the Supreme Judicial Court when I took office. They have been heard in the latter with the result that the judgment is for the city in the first case and for the plaintiff in the second case.

ANNUAL REPORT


Since July 12, 1941, two actions have been entered against, the city. One is that of Eleanor Quill to recover for personal injuries as a result of an alleged defective condition in a highway, and the other is that of Hannah G. Robinson, administratrix of the estate of John E. Norton, for injuries claimed to have been received by the deceased as a result of a fall on a sidewalk on Merrimac Street. Both cases are awaiting trial in the Essex County Superior Court.


At the request of the Old Age Assistance Department, I brought an action in the name of the city against the Inhabitants of the Town of Salisbury to recover a sum of money furnished to a recipient who is believed to have a settlement in that town. This is in the District Court of Newburyport, and has not been tried.


I represented the city in the tax appeal cases of Philadelphia and Reading Coal and Iron Co., Ella M. Johnson and Nathaniel N. and Jennie U. Jones. Two of these cases were settled before hearing and the third was tried before the Appellate Tax Board in Boston.


Several tax foreclosure proceedings, brought by my predecessor, were pending in the Land Court when I came into office. Some of these have been completed during my term. The others will probably be finished within a few months.


In addition to the foregoing problems, I have attended to the numerous routine duties of the office, including the investigation of claims, the preparation of opinions, the drafting of contracts, deeds and other documents required from time to time by the various municipal departments.
