LAT DEPARTMENT


From: James P. Reardon To: His, Honor, The Mayor, and the City Council Subject: City Solicitor's report for the year 1955


Sirs :


In compliance with Section 4, Chapter 14, of the Revised Ordinances of the City of Newburyport, I am submitting herewith my report for City Solicitor for the year 1955. During the year 1955, I submitted numerous opinions to the Mayor, City Council, and various department heads. During the year 1955, I settled a case, Lillian M.J. Whitcomb vs City of Newburyport, which was an action brought against the City of Newburyport in the sum of Four Thousand ($4000.00) Dollars for defect on the sidewalk. I settled this case for Three


Hundred ($300.00) Dollars. Another case which was tried in the Superior Court was the case of Joseph F. Crowley against the City of Newburyport in the amount of Four Thousand ($4000.00) Dollars. The jury brought in a judgment for the Plaintiff in the sum of Two Hundred Fifty ($250.00) Dollars. The Court felt that the amount of the judgment was grossly inadquate due to the seriousness of the injury, and the length of the disability sustained by the Plaintiff, so the court increased the judgment to One Thousand ($1000.00) Dollars. The other actions which were disposed of in the Superior Court were cases of Margaret K. Spaulding and Prescott L. Spaulding vs The City of Newburyport Ad damnum Four Thousand ($4000.00) Dollars. These last two referred cases were decided in favor of the City of Newburyport. The cases of Arthur E. Perley vs The City of Newburyport, and the City of Newburyport vs Arthur E. Perley, Et al., were heard before an auditor sitting for the Superior Court at the District Court in Newburyport. The Plaintiff Perley sued the City of Newburyport for Ten Thousand ($10,000.00) Dollars, claiming damages as a result of contract for renovation at the High-School. Auditor found that the City sustained no damage in its case, and found for the Plaintiff Perley in his case against the City of Newburyport in the sum of Twenty-Five Hundred ( $2500.00) Dollars. The findings of the auditor had not been confirmed by the court. Among the new cases in which the City is involved is the case of William A. DeLong and Grace R. Griffiths vs Joseph Gallagher and Peter Genna, as Police Officers for the City of Newburyport. This action was brought against these two officers as a result of an accident which occurred on or about September 8, 1955, on route 110 in Salisbury. The Ad damnum in this action commenced in the Lowell District Court is in the sum of Ten Thousand ($10,000.00) Dollars.


In addition to the matters which are pending in the court, both tne claims against and for the City of Newburyport, there were numerous claims presented to the City for defective sidewalks. Several of these smaller claims I recommended to the City Council that they be settled, and all of them were for varying amounts. None of which involved any large sun of money. In addition, there were several claims resulting from damage done by City Vehicles which were settled. There were also several claims against the City which I recommended to the Council; but there was no liability on the part of the City, and the parties involved. have been given leave to withdraw their claims.
