Section 1


The dredging, plowing or churning up in any way of any of the flats with- in the City of Newburyport from which it is possible to take clams is hereby prohibited.


An Amendment to the Proposed Ordinance entitled. "An Ordinance Regulat- ing the Digging of Clams and Sea Worms and Control of Clam Flat Areas in the City of Newburyport", which proposed ordinance passed its first reading in City Council on June 6,1955.


Be it ordained by the City Council of the City of Newburyport as follows: Section 2, entitled "Permits" which reads as follows:


Section 2. Permits.


"Any legal resident of the City of Newburyport may be granted a permit for the digging of clams within the City of Newburyport. The fee for such permit shall be five ($5.00) dollars per year. Applications shall be made to the Board of Licensing Commissions for the City of Newburyport. Any legal resident of the City of Newburyport shall be granted a permit to dig sea worms within the City of Newburyport. Application for such permit shall be made to said Board of Licensing Commissions and there shall be no fee charged for such permit. The City Council may, at such time if it determines the number of permits granted to the legal resi- dents of the City of Newburyport to be insufficient for the proper work- ing of the shellfish area or the area for the digging of sea worms, grant upon written application, a permit to any inhabitant of the Commonwealth of Massachusetts. All permits granted hereunder shall terminate on the fifteenth day of July each year."

insufficient for the proper working of the shellfish area or the area for the digging of sea worms, grant upon written application, a permit to any inhabitant of the Commonwealth of Massachusetts. All permits granted hereunder shall terminate on the fifteen day of July each year."


Section 3. Legal Size of Clams


No person shall take or have in his possession, clams of less than two (2) inches in diameter to an amount of more than five (5%) percent of any batch.


Section 4. Authority of the Clam Constable


The Clam Constable of the City of Newburyport, with the approval of the City Council, shall have the authority to open, close and otherwise con- trol and restrict clam flats for the taking of clams and sea worms as he, with the said approval of the City Council, may deem necessary and desir- able, in accordance with Chapter 130 of the General Laws. Any area which may be closed or restricted for the taking of clams and sea worms in accordance with the foregoing provisions, shall be closed or restricted only after notice of such closing or restriction is posted in a conspic- uous place in such areas closed or restricted. The Clam Constable is authorized to presecute any person who violates the provisions of this Ordinance or any rules or regulations governing the taking of clams or sea worms in the City of Newburyport.


Section 5. Closing of Flats


Any flats where manual re-seeding is being undertaken, may be closed for the taking of clams or sea worms for such period of time as the Clam War- den, with the approval of the City Council, shall determine. Any person who shall dig clams or sea worms from flats in the City of Newburyport which have been closed or restricted by order, proclamation, rule or no- tice, as herein provided, the same having been posted or ordered to be closed for the taking of clams or sea worms, shall be punished as here- inafter described.


Section 6. Confiscation of Take.


The Clam Warden is hereby authorized to seize and confiscate clams or sea worms taken from areas in the City of Newburyport in violation of this Ordinance or amendments thereto in accordance with the provisions of the General Laws .


Section 7. Conformation to State & Local Law.


The holders of permits issued for the taking of clams and sea worms, shall be subject to the provisions of Chapter 130 of the General Laws as amend- ed, and all local rules and regulations pertaining thereto.


Section 8. Punishment for Violations.


Whoever violates this Ordinance or any rules or regulations made by the City Council concerning the taking or possession of clams or sea worms, shall be punished by a fine not exceeding Twenty ($20.00) Dollars. Any permit granted under this Ordinance may be revoked or suspended by the Board of Licensing Commissions for cause, after notice is given by the Board of Licensing Commissions and hearing granted to the holder of the permit. Said hearing shall be held within seven (7) days after written notice to the holder of the permit and such notice shall be given at least three (3) days before the date of hearing.

August 1, 1955 Be it Ordained by the City Council of the City of Newburyport as follows : Chapter 31, of the Revised Ordinances of the City of Newburyport is here- by amended by adding thereto Article 10 to be entitled, "Off-Street Park- ing Lots."


1. The following areas are hereby designated as Municipal Off-Street Parking Lots. Any person parking a vehicle in any of the following designated Lots shall be subject to the following rules and regulations governing said Lots.


2. a .. Person-The word "person" shall mean and include any individual, firm, co-partnership, or corporation.


2. b. Off-Street Parking Lots-The words "Off-Street Parking Lots" shall include any Municipal owned or operated parking area which is used and established by the City of Newburyport as an Off-Street Parking Lot, but it shall not include any parking on any street or way within the City. 2. c. No person shall park a motor vehicle for a period longer than eight hours on any day on the hereinafter designated Off-Street Parking Lot or as may hereinafter be fixed by Ordinance. This restriction shall apply seven days per week.


3. Off-Street Parking Lots: Kent Street Municipal Parking Lot, being that area bounded by Washington, Kent, Congress and Buck Streets, except- ing therefrom, the area set off for use for the Davenport School.


4. Whenever any motor vehicle shall be parked in said Off-Street Mu- nicipal Parking Lot, the owner or operator of the said vehicle shall. park within a space designated by the marking lines and before entering said parking space, shall obtain from the City Treasurer, or such persons as may be designated by him, a sticker. A sticker shall entitle a person

to park his vehicle in said Off-Street Parking Lot for a period of eight hours each day for one week. The week shall begin on Monday and termi - nate on Sunday. Each day shall be divided into three eight hour periods. Period one shall begin at twelve mid-night to eight A.M .; period two shall berin at eight A.M. to four P.M .; period three shall begin at four P.M.to twelve mid-night. The sticker issued by the City Treasurer shall indicate thereon which eight hour period a person may park his car each day.


5. The fee for such sticker shall be fifty (50g) cents per week. The City Treasurer shall receive all moneys from the sale of said stickers, and credit the same to the account required by Law.


6. Any person who violates any provision of this Ordinance shall be subject to the following penalties.


First violation during the calendar year --- warning Second violation during the calendar year --- fine $1.00 Third violation during the calendar year --- fine $2.00 For each violation thereafter during the calendar year $5.00 per violation.
