Voted, That the town of Melrose hereby accepts the proposition of Mrs. Edward C. Cabot of Brookline, Mass., as contained in her letter of July 6, 1891, addressed to the board of Selectmen, presenting to said town certain land for a public park with the conditions therein expressed, that the town build and make the road as indicated on a plan drawn by Walter C. Stevens, and accept it as a town way and that the town provide perpetual care of said public park, and call the gift "Sewall Woods" in honor of the memory of our late respected citizen, Hon. Samuel E. Sewall.
Voted, Unanimously, that the thanks of the town be pre- sented to Mrs. Cabot.
Art. 2. Water.
Report of the board of Water Commissioners read and presented by the chairman after which it was voted.
That the town of Melrose, the city of Malden and the town of Medford concurring in the exercise of the power granted to said city and said towns, by Chapter 160 of the Acts of the Commonwealth of Massachusetts, of the year 1870, and by Chapter 388 of the Acts of the year 1887 ena- bling said city and towns in conjunction to take by purchase or otherwise, lands, water and water rights for the purposes specified in Section 2 of said Chapter 160 and in said Chap- ter 388, by virtue of said power and in the exercise thereof in concurrence with said city of Malden and town of Med- ford, doth hereby join said city of Malden and town of Med- ford in taking and holding for the purposes specified as aforesaid, and in conjunction with said city of Malden and town of Medford by virtue of the power so granted and for the purposes specified in Section 2 of said Chapter 160, and in said Chapter 388, doth hereby take and will hold the fol-

lowing described lands, water and water rights, to wit :- 57 descriptions of lots of land, all of which are duly entered upon the Town Records, Book 3, pages 422-462 inclusive, and in the Middlesex Registry of Deeds (So. Dist.) refer- ence being made to plans, also entered for record in said registry.
Exceptions :
Reserving and excepting so much of each of the lots of land above described as is embraced within the limits of any town way or county road.
And the Water Commissioners of the town of Melrose are hereby authorized and directed in conjunction with the Wa- ter Commissioners of said city of Malden and town of Med- ford to file in the Registry of Deeds for the Southern Dis- trict of the County of Middlesex within sixty days from the taking of said lands, water and water rights, a descrip- tion of the lands, water and water rights so taken, suffi- ciently accurate for identifying the same.
Standing of vote upon the above. Total number of per- sons voting, 197. Aff. 153, neg. 44. More than two thirds of the number of votes being affirmative, it was declared a vute by the Moderator, as stated.
Voted, That the Water Commissioners of the town of Melrose in conjunction with the Water Commissioners of the city of Malden and town of Medford be and hereby are given full power to purchase in behalf of said town of Mel- rose, for said city and towns any, or all of the land in the vicinity of Spot pond this day taken by said town of Mel- rose in conjunction with said city of Malden and said town of Medford at such price as may seem best to said Water Commissioners or to settle the damages for the taking of any or all of the land thus taken on such terms as may seem best to

said Commissioners, the expenses of such purchases or set- tlements to be borne equally by said town of Melrose and by said city of Malden and town of Medford, and the sum of twenty thousand dollars is hereby appropriated for said above purposes, said sum to be borrowed and funded in bonds to be issued for that purpose, and the Treasurer of the town is authorized to borrow in behalf of the town said sum of money pending the issuance of bonds as aforesaid.

Article 3.
Voted, Unanimously, that the Water Commissioners of the town of Melrose in conjunction with the Water Com- missioners of the city of Malden are hereby authorized on behalf of said town of Melrose to purchase in conjunction with the said city of Malden, two undivided third parts of land, water and water rights on the shore of Spot pond hereinafter described, owned by the town of Medford, so that said land, water and water rights shall be held in com- mon by said city of Malden and said towns of Melrose and Medford for the purposes specified in Chapter 160 of the Acts of the Commonwealth of Massachusetts of the year 1870 and in Chapter 388 of the year 1887; and in the deed of purchase it may be provided that the town of Medford may use and occupy a strip of said land at some point between the present Gate House lot of said town of Med- ford and Forest street in said Medford not exceeding 300 feet in width, for high service station and appurtenances.

Melrose are hereby authorized to enter into such agree- ment with the city of Malden and town of Medford respect- ing the lands on the shores of Spot pond occupied by each of the three municipalities in severalty for gate house and pumping station as they shall deem desirable.
Art. 8. Spot pond brook.
Voted, That the Town Treasurer be authorized to borrow the sum of $3,100 for the purpose of widening the culverts and dredging Spot pond brook. Vote unanimous.
Art. 6. Town Hall.
Voted, That the Town Treasurer be directed to borrow or take from moneys now in hand and not otherwise ap- propriated, a sum not to exceed $1000 to defray the ex- pense of repairs upon the Town Hall building, provided the income from said building for the year ending De- cember 31, 1891, is not sufficient.
Art. 5. Inspection of buildings.
Voted, That the town accept and adopt the provisions of Chapter 104 of the Public Statutes, which relate to the inspection of buildings so far as the same are applicable to towns.
Voted, To amend Article 7, town By-Laws by adding the following section to be known as Section 14 :
Every building or structure hereafter built in the town shall have foundations resting upon the solid ground or up- on concrete piles or other durable structure. The founda- tion walls shall be built of stone extending through sufficiently to bind the walls inside and outside. All under-

pinnings above grade, whether of brick or stone, shall be laid in one-half cement mortar.
Art. 7. Tool shed.
Voted, That the Town Treasurer be directed to borrow, or take from moneys not otherwise appropriated, the sum of $300 to defray the expense of building a shed, for the pro- tection of town property, in rear of Russell hose house or in such other location as the Selectmen may deem advisable, and that the Selectmen be instructed to remove the rubbish, debris, carts, stones, etc., lying around the rear of the Town Hall lot.
Voted, To adjourn sine die.

NOV. 3, 1891.
To either of the Constables of the Town of Melrose, in the County of Middlesex: GREETING.
In the name of the Commonwealth of Massachusetts, you are hereby required to notify the inhabitants of the town of Melrose, qualified to vote in elections and town affairs to meet at the Town Hall, on Tuesday, the third day of No- vember, A. D. 1891, at 7 o'clock, a. m., then and there to act on the following Articles, viz .:
Article I. To bring in their votes for State and County Officers and for and against certain articles of amendment to the Constitution in form and manner as prescribed by law.
All ballots are to be furnished by the Commonwealth and will be distributed at the polls by officers duly appointed.
Polls to be kept open until 4.30 p. m.

Art. 2. To choose a Moderator to preside for the tran- saction of town business.
Art. 3. To see if the town will accept the jury list as revised.
Art. 4. To see what action the town will take in regard to building a school house on the west side of the B. & M. railroad at the Highlands, on petition of George J. Bicknell and others.
Art. 5. To see if the town will grade Hillside avenue and concrete the gutters upon the same, and authorize the treas- nrer to borrow such money as may be deemed necessary, on petition of Charles C. Barry and others.
Art. 6. To see if the town will accept a street running from Melrose street, northerly to Franklin street, as laid out and extended by the Selectmen, a part of said street having been known heretofore as Auburn street, and authorize the Treasurer to borrow money for the building of the same.
Art. 7. To see if the town will build a highway, as ordered by the County Commissioners, which extends from Perkins street westerly to the boundary line be- tween Stoneham and Melrose and authorize the Treasurer to borrow money for the same.
Art. 8. To see if the town will authorize the Treasurer to borrow one thousand dollars for the support of the poor, by request of the Overseers.
Art. 9. To see if the town will authorize the Treasurer to pay all necessary expenses which may be incurred from January I, to April 1, 1892, in anticipation of the annual ap- propriations of the year, and also authorize the payment of certain bills necessarily contracted in excess of the appro- priation for contingent expenses for the current year, and for the insurance of town property.
Art. 10. To see if the town will appoint a committee to

take in consideration the amounts necessary to be raised and appropriated for the expenses of the year 1892, and re- port at the annual meeting in March next.
Art. II. To see if the town will accept of the provisions of Chapter 370, of the Acts of the year 1891, entitled, "an act to enable cities and towns to manufacture and distribute gas and electricity," and pass any votes in connection there- with which may be deemed expedient.
Art. 12. To hear and act upon the reports of committees and for the transaction of any other business which may legally come before the meeting.
And you are directed to serve this Warrant by posting at- tested copies thereof at the Town Hall, each of the Post Offices and Depots in the town, not less than seven days be- fore the day appointed for said meeting, and by leaving printed copies of the Warrant at the dwellings of the legal voters before the day of meeting.
Hereof fail not, and make due return of this Warrant, with your doings thereon, to the Town Clerk, at the time and place of said meeting.

Report of committe appointed February 16, 1891, to revise the water-rates accepted.
Voted, To amend the report by changing the amount to be charged for additional faucets from $2.00 to $1.00 each and that a discount of five per cent. be allowed on all payments for water rates paid previous to, or by March Ist in each year.

Voted, That the Finance Committee be instructed to in- clude in their appropriations the following items as submit- ted by the Board of Water Commissioners, viz .: 160 hydrants, at $20 per hydrant ; ornamental and drinking fountains, $200; public buildings at regular rates; watering streets, $200.

A report submitted by the Water Commissioners relating to water rates and the income therefrom with recommenda- tions was unanimously accepted.
The following resolve was passed unanimously, expressed by a rising vote :
Resolved, By the citizens of Melrose in town meeting as- sembled, that the heartfelt sympathy of the town goes out to our distinguished fellow-citizen, Hon. Charles F. Loring, and we trust that his sufferings may be speedily alleviated and his accustomed health restored.

Award of Commissioners.
The undersigned, Ebenezer R. Hoar, William C. Endicott and John E. Sanford, appointed by the court upon the above entitled petition as the Commissioners under Section 13 of Chapter 439 of the Acts of the year 1889, to determine the proportion in which the several cities and towns named in said Act shall annually pay money into the treasury of the Commonwealth for the term of five years next following the year of the first issue of the scrip or certificates therein named, for the purposes therein set forth, and to perform all other duties and to exercise all powers imposed or conferred by law upon the three Commissioners whose appointment is provided for by said Section 13 of said Act, -- as appears by the copy of the order of said court hereto annexed, - have attended to and completed the duty thus assigned to them, and do now report to the court:

That we, the said Commissioners, appointed a time and place for hearing all the parties interested in the matters submitted to our determination, and gave due notice there- of to the Attorney-General (who replied that he did not think it necessary for the Commonwealth to appear), and to the Treasurer of the Commonwealth, and to the Board of Metropolitan Sewerage Commissioners, and to each of the cities and towns named in the act aforesaid; and that all of said cities and towns, by their respective officers, solicitors or counsel, have attended at the time and place appointed for such hearing, or at the adjournments thereof, with such witnesses and evidence as they have seen fit to produce, and have been heard by all of us sitting together as fully as they or any of them have desired. Said public hearings were held, with the assent of all parties, at the State House in the city of Boston, on the twenty-first day of July, the fifteenth, eighteenth, twenty-ninth and thirtieth days of September and the sixth and seventh days of October, 1891.
