Extracts from Ordinance Concerning Licenses. GUNPOWDER AND EXPLOSIVE COMPOUNDS:


SEC. 10. No person shall keep or deposit any gunpowder within the city unless it is well secured in tight casks or can- isters; 'or keep or deposit more than fifty pounds of gunpowder in any shop, store or other building which is within the dis- tance of twenty-five rods from any other building; or keep or deposit more than twenty-five pounds of gunpowder in any shop, store, or other building, which is within the dis- tance of ten rods from any other building; or keep or deposit more than one pound of gunpowder in any shop, store or other building which is within ten rods of any other building, unless it is well secured in copper, tin or brass canisters, holding not exceeding five pounds each, and closely covered with copper, brass or tin covers. But the foregoing provisions shall not apply to magazines for the storage of powder at quarries. The License Committee may license persons to sell gunpowder. Every such license shall set forth the name of the person licensed, and the building or place in the city where the busi- ness may be carried on, and shall have the provisions of this ordi- nance relating thereto printed thereon, and there shall be paid there- for a licence fee of the sum of two dollars. The place of business named in such license shall not be changed without the consent of the License Committee.


No person shall keep for sale or sell any gunpowder within the city without a license from the License Committee.


Every person so licensed to sell gunpowder shall keep a sign over the outside of the principal entrance from the street of the building in which the powder is kept, on which shall be printed in capitals the words "Licensed to keep and sell Gunpowder;" and every person owning or keeping gunpowder above the quantity of five pounds within the city shall forthwith notify the Chief Engineer of the Fire Department where the same is kept, and shall comply with any di- rections of said Engineer respecting the part of the building assign- ed by him for its future keeping or storage.


No person, except he be on military duty in the public service of the United States or of this Commonwealth, shall keep, have or possess, in any building, place or vehicle, within one rod of a dwell- ing house, any explosive coumpound other than gunpowder in quan-

tity exceeding one-fifth of a pound, and in larger quantities dynamite, nitro-glycerine, guncotton and other high explosives, must be stored in magazines located in such places as the Board of Health may direct. But for use in quarries and for blasting purposes dynamite and other high explosives may be removed in necessary quantities day by day from the storage magazines.


The License Committee may license any suitable person to keep, store and sell such high explosive compounds other than gunpowder in accordance with the foregoing provisions. Any member of the Po- lice or Fire Department may enter the building or premises of any person licensed to sell explosive compounds, and examine and ascer- tain if the laws, rules and regulations relating thereto are strictly ob- served, and an alarm of fire may cause the explosives compounds there deposited to be removed or destroyed, as the case may require. The License committee may license any suitable person to keep for sale and sell any of the fireworks called rockets, bombs, Roman candles, crackers, squibs or serpents and colored fire. Such licensee shall pay for the license the sum of two dollars. No person shall within the city, sell or offer for sale, or have in his possession with intent to sell, any toy pistol or toy cannon in which explosive compounds are used, or of which such compounds form a part, without a license. The License Committee may license any suitable person to keep for sale and sell such toy pistols and cannons as aforesaid. Such licensee shall pay for the license the sum of two dollars. No person shall keep for sale or sell in any building within the city any camphene, naplıtha, burning fluid, or other similar explosive or inflammable fluid without a license from the License Committee who may grant such licenses. Such licensee shall pay for the license the sum of two dollars. Any person violating any of the provisions of this section shall forfeit and pay for each offence a sum not exceeding twenty dollars.
