Article 18. To see if the Town will appropriate for pay- ment of interest due in 1935 on Water Main Extension Notes the sum of $1,725.00, same to be taken from "Water Receipts Reserved for Appropriation" in 1934, or do or act.

Article 19. To see if the Town will vote to authorize the Treasurer, with the approval of the Selectmen, to borrow money for municipal purposes, under authority of and in accordance with the provisions of Chapter 49 of the Acts of 1933, as amended by Chapter 313 of the Acts of 1934, or take any action thereto.


The Finance Committee recommends the approval of this article as requested by the Treasurer.


Article 20. To see if the Town will accept the following bequest : $5,251.67 received from the Trustees under the will of Marshall Russell to be designated and always known as the "Russell Fund," and to be held in trust forever; the income only to be used for the relief and aid of the deserving poor, who are residents of said Town, and of the Protestant faith, or do or act.


The Finance Committee recommends the approval of this article.


Article 21. To consider and act upon the question of amending the by-laws of the Town by substituting for Articles 1 to 9 of the present by-laws, Articles 1 to 8 inclusive substan- tially as proposed by the committee appointed by the Board of Selectmen as authorized by the vote of the Town to consider

the revision of the Town by-laws, the report of which com- mittee is printed in the annual town report for the year ending December 31, 1934, or do or act.


The Finance Committee recommends considera- tion of this article.


Article 22. To see if the Town will vote to construct a sidewalk on West Plain Street on the southerly side from Lake Road to Edgewood Road or any portion thereof, to relieve unemployment : appropriate and assess a sum of money to pur- chase materials; and that the work proceed provided that the Emergency Relief Administration labor can be procured.


The Finance Committee recommends the approval of this article, providing it can be done under the provisions of the Betterment Act with the labor provided by the Emergency Relief Administration.


Article 23. To see if the Town will appropriate and assess a sum of money to be used in connection with E. R. A. projects.


The Finance Committee recommends the appro- priation of $9,000.00 to be administered by the Selectmen and the Chairman and Clerk of the Finance Committee.


Article 24. To see if the Town will vote to appropriate and assess a sum of money for the relocation and reconstruction of a portion of Concord Road, according to plans to be recom- mended by the County engineers.


In view of the certainty of a much higher tax rate this year and this requiring a large expenditure for something which does not have to be done this year, the Finance Committee recommends that the article be passed over.


Article 25. To see if the Town will appropriate and assess a sum of money to install a fireproof vault in the Town Hall, or do or act.


It is estimated that the adoption of this article would require an expenditure of $1,700.00. Inas- much as three of our most important departments now have safes and another is expected to have one this year for their current records, the Finance Committee recommends that this article be passed over this year.

Article 26. To see if the Town will appropriate and assess a sum of money not exceeding $1,000.00 to purchase a piece of land to be used for burial purposes, to enlarge the Lake View Cemetery, said piece of land now supposed to be owned by the heirs and demises of the late Edward Dammers; said piece of land adjoins the North East boundary of Lake View Cemetery and is described as follows :- Starting at a point of the North- easterly corner of present Lake View Cemetery and running approximately 152 feet on unaccepted way, thence at right angle to said way approximately 238 feet in a westerly direction to point of beginning, or do or act.


The Finance Committee recommends that this article be passed over as it has been informed that the property cannot be secured for the amount stated.


Article 27. To see if the Town will authorize or instruct the Board of Selectmen to petition the General Court for legis- lation, giving the Board of Selectmen full authority over the waters of Dudley Pond, and control over all fishing, boating, bathing, skating and other recreational activities in or on Dudley Pond and the shores thereof, or do or act.


The Finance Committee recommends that this authority be granted.


Article 28. To see if the Town will appropriate and assess a certain sum of money for the establishment and maintenance of outdoor swimming baths on the shore of Dudley Pond for the purpose of affording the inhabitants of the Town oppor- tunities to swim and receive instruction in swimming, and for the acquiring of the necessary land for public parking places in connection therewith, or adjacent thereto, and for other municipal purposes, and will authorize the Board of Selectmen to acquire the necessary land for such purposes by eminent domain or otherwise, as it may to them seem necessary and proper, or do or act.


The Finance Committee is opposed to this article unless the necessary land can be had without expense to the Town and the labor be provided by the Federal Emergency Relief Administration.


Article 29. To see if the Town will appropriate and assess a certain sum of money to be expended under the supervision of the Planning Board for the purpose of completing the study of

highways leading to and in the vicinity of Dudley Pond, or do or act.


The Finance Committee has recommended a gen- eral appropriation for the Planning Board, con- sequently recommends that this article be passed over.


Article 30. To see if the Town will appropriate and assess a certain sum of money to be expended under the supervision of the Planning Board for the purpose of having prepared an adequate plan for the alteration, repair and relocation of Syca- more Road and Hawthorne Road, or any portion of either, in order that the necessary steps may be begun looking to the ultimate acceptance of said roads by the Town, or do or act.


This plan has already been prepared by the Plan- ning Board so this article is unnecessary and should be passed over.


Article 31. To see if the Town will accept as public ways, the private ways known as Sycamore Road and Hawthorne Road or any portion of either, and acquire any necessary land by eminent domain or otherwise; and appropriate and assess a sum of money to be expended to relocate and repair any por- tions accepted, or do or act.


The Finance Committee is opposed to this article unless the necessary land can be had without ex- pense to the Town and the work be done subject to the provisions of the Betterment Act and the labor be provided by the Federal Emergency Relief Administration.


Article 32. To see if the Town will appropriate and assess a certain sum of money to be expended under the supervision of the Planning Board for the purpose of having prepared an adequate plan, for the alteration, repair and relocation of Pine Ridge Road, in order that the necessary steps may be begun looking to the ultimate acceptance of said road by the Town, or do or act.

Article 33. To see if the Town will appropriate and assess a sum of money for materials to construct a shed to house Highway equipment, or do or act.

The Finance Committee recommends an appro- priation of $350.00 for materials.


Article 34. To see if the Town will authorize the Surveyor of Highways with the approval of the Board of Selectmen, to sell, trade, or otherwise dispose of the International 11/2-ton truck, or do or act.


The Finance Committee recommends the approval of this article. This truck is four years old and has been driven over 40,000 miles. It is now in need of tires and some mechanical work.


Article 35. To see if the Town will vote to purchase a truck for the Highway Department, and to appropriate, grant, borrow or otherwise provide a sum of money to pay for the same, or do or act.


The Finance Committee recommends the approval of this article and an appropriation not exceeding $752.00.


Article 36. To see if the Town will appropriate and assess a sum of money to gravel Clay Pit Hill Road, or do or act.


The Finance Committee recommends that this article be passed over.


Article 37. To see if the Town will authorize the Board of Assessors to employ counsel and expert valuers, to assist them in contesting appeals from the decisions of Wayland's Assessors, and appropriate and assess a sum of money not exceeding $500.00 for that purpose, or do or act.


The Finance Committee recommends that this article be passed over.


Article 38. To see if the Town will appropriate and assess the sum of $1,100.00 to purchase fire hose, or do or act.


The Finance Committee recommends the approval of this article.


Article 39. To see if the Town will appropriate and assess a sum of money for the purchase of a piece of fire apparatus to replace the old Reo truck now in service in the Cochituate station, or do or act.


The Finance Committee recommends that the pur-


chase of this apparatus be postponed to some future time.


Article 40. To see if the Town will extend the water main

from Brown's corner on Concord Road, down Oxbow Road, a distance of 1400 feet to the residences of Edgar Cain, Nickelas Gain and George N. Sherman ; appropriate and assess a sum of money therefor, or do or act.


The Finance Committee recommends that this matter be referred to the Water Department for their consideration as an E. R. A. project.


Article 41. To see if the Town will appropriate and assess a sum of money for the purchase, from Harold E. Draper of Wayland, of a set of twenty-four (24) original tracings of plans and profiles of about forty-six thousand (46,000) feet of roads in and around Wayland center, or do or act.


The Finance Committee does not recommend the


adoption of this article this year.


Article 42. To see if the Town will appropriate and assess the sum of $350.00 to be expended by the Board of Health, under the direction of the School Committee in support of a Dental Clinic for the school children of Wayland.


The Finance Committee recommends the approval of this article.


Article 43. To see what sum, if any, the Town will vote to transfer from available funds to meet any of the appropria- tions made under the foregoing articles.


The Finance Committee recommends such action


as may be suggested by the Town Treasurer.


And you are required to serve this Warrant by posting copies thereof, attested by you, at the Town Hall, at each Post Office in Town, and at the Legion Hall at Cochituate, seven days, at least, before the time of holding said election.


Hereof, fail not and make due return of this Warrant with your doings thereon to the Town Clerk on or before March 4, 1935.

REPORT OF THE FINANCE COMMITTEE


The Finance Committee has experienced great difficulty in arriving at decisions for its recommendations this year. It believes that a tax rate of $25.00 per thousand dollars of present valuation is as much as should be borne by property, but exist- ing conditions make it impossible to adhere to this policy this year. Conditions such as overdrafts from last year by various departments amounting to $3,282.30 will add approximately fifty-five cents to the tax rate.


Demands on our Welfare Department and for Old Age Assistance and Soldiers' Benefits continue tremendously heavy. It is to be earnestly hoped that these needs and demands may decrease, as the general effect on the recipients is humiliating or demoralizing and it is discouraging to the struggling home owners and taxpayers. These departments and our share of E. R. A. expenditures represent approximately $8.00 of the tax rate.


About $13,000 was spent last year by the Town and about $25,000 by the Federal Government on various emergency pro- jects throughout the Town for the purpose of providing employ- ment. Considerable of this work had to be undertaken quickly and without much planning. The Finance Committee is of the opinion that more advance planning should result in a greater return of benefits to the Town for the money to be expended in the current year, consequently it has recommended an increase of the appropriation for the Planning Board in the hope that this Board may be of greater assistance to those having charge of this work.


Uncollected water rates as of January 1st, 1935, amounted to $8,445.78 ; uncollected taxes as of January 1st, 1935, amounted to $98,929.50. Tax titles recorded from April 30th to Decem- ber 31st, 1935, amounted to $18,587.51. The expense of tax sales and tax title takings is increasing as is the amount of Tax Sale Property in the possession of the Town which removes it from the Assessors' list of taxable property.

Officials and department heads responsible for the spending of money and all recipients of aid or employment should not forget for one minute that that money is being provided with the greatest of difficulty and sacrifice on the part of a majority of the taxpayers. If this Committee may be pardoned for a little sermonizing it feels that now as never before is a time when the utmost efficiency in planning and doing work should be practiced and a conscientious day's work be given for every day's pay received. To resort to the vernacular, see that your neighbor or friend-the taxpayer "gets a break." Let economic wisdom and fairness supercede all political expediency.


The Finance Committee believes that much could be accom- plished by monthly joint meetings of the Town officials, com- mittees and department heads for consideration and discussion of Town affairs and it respectfully suggests to the Selectmen that they take the initiative in the matter and inaugurate such meetings as soon as possible.

The Finance Committee recommends that the unexpended balances in the following accounts be transferred to Excess and Deficiency Account :

The Finance Committee recommends that all expenses due to the collection of dog taxes and care of unlicensed dogs be paid from Police Department Expense Account.


The tax rate is based on the revenue assessed and received from all sources, assuming the amounts to be received to be similar to last year the Finance Committee estimates that its recommendations will make a tax rate of $28.00 per thousand dollars of assessed valuation.

REPORT OF BY-LAW COMMITTEE


The Committee appointed by the Board of Selectmen in accordance with the vote under Article 4 of the meeting of November 20, 1933 has given careful consideration to the questions submitted to it. It gathered together copies of the by-laws of various towns, giving particular attention to by- laws of towns, the by-laws of which were particularly recom- mended by the Attorney General's Office. Careful considera- tion was given to these by-laws of other towns and suggestions were requested from various town officers and fellow citizens. The Committee feels that it has not become necessary for our town to adopt the elaborate by-laws deemed necessary by some of the suburban towns. The Committee has felt, however, that the first nine articles of the present by-laws need substantial revision and it is therefore recommending the adoption of eight articles as drafted by the committee in substitution for articles 1 to 9 of the present by-laws. These proposed articles are submitted with this report and are believed by the committee to be adequate to cover all the needs of the town on the subjects dealt with in those articles for years to come. It is believed that the provisions of the by-laws are so simple and easily understood that it is not necessary to make special explanation thereof. The date of preparing town reports and of filing reports has been somewhat advanced in order to assist the Finance Committee. A definite number, namely one hundred, has been adopted as a quorum for town meeting. Otherwise little has been done to change the provisions of the present by-laws, except to make clearer, more easily understood, and more fully applicable many of the principles already appearing in the present by-laws and a slight attempt has been made to strengthen the hands of the police.


It is unanimously recommended by the Committee that these by-laws as submitted be substituted for the present articles 1 to 9.

By-Laws of the Town of Wayland


ARTICLE 1. TOWN MEETINGS, NOTICE THEREOF AND WARRANTS THEREFOR.


Section 1. In the annual town meeting in which there is precinct voting the matter of the election of town officers and the determination of such matters as by law are required to be elected or determined by official ballot shall be in order only on the first Monday of March in each year, and all other business shall be in order only at a meeting held on the follow- ing Wednesday at 7.45 o'clock in the afternoon.


Section 2. Service of the warrant for the annual election and the annual town meeting shall be made by posting attested copies thereof at the Town Hall, at the voting place in Cochit- uate, and at each post office in the town seven days at least before the time appointed for such (election or) meeting and of the warrant for each special town meeting by delivering a copy thereof to each registered voter or by mailing a copy thereof to each such voter addressed to his or her residence seven days at least before the time appointed for such meeting.


Section 3. All articles for insertion in the warrant for the annual town meeting must be presented in writing to the Board of Selectmen in accordance with law on or before January 10th or such earlier time as may be fixed by the Board of Selectmen, and all such articles for special town meetings must be so presented at least twenty-one days before the date set for such meeting.
