Article 37. To see if the Town will vote to purchase a truck or trucks for the Highway Department and to appro- priate, grant, borrow or otherwise provide a sum of money to pay for the same, or do or act.

Article 38. To see if the Town will vote to construct a sidewalk on West Plain Street on the southerly side from Lake Road to Ridgefield Road, or do or act.


Voted not to construct a sidewalk on West Plain Street.


Article 39. To see if the Town will vote to accept Maiden Lane and Park Lane as the same have been laid out and filed by the Selectmen, work to be done under the Betterment Act, to take by right of domain such land as may be necessary for doing said work; appropriate or borrow money to pay for the same, or otherwise act thereon.


Voted that the matter be referred to the Planning Board. Voted not to return to Article 3.


Article 40. To see whether the Town will vote to exclude all married women from the present teaching staff in the public schools of the Town of Wayland; to exclude the hiring of any married women in the future, and take any further action thereon.


Voted that the matter be referred to the School Committee.


Article 41. To see what sum, if any, the Town will vote to transfer from available funds to meet any of the appropria- tions made under the foregoing articles.


Voted unanimously to pass over the Article.


Voted to dissolve the Meeting 10.30 P. M.

VOTES ENACTED AT THE SPECIAL TOWN MEETING, SEPTEMBER 5, 1934

Pursuant to the following warrant the inhabitants of the Town of Wayland met this day and did the following business.


Article 1. To hear the reports of the Town Officers, Agents, and Committees, and act thereon.

Article 2. To see if the Town will raise and appropriate a sum of money for notices of meetings, or do or act.


Voted unanimously that the Town appropriate the sum of $50.00 for Notices of Meetings.


Article 3. To see if the Town will vote to amend the vote passed pursuant to Article 1 of the Warrant for the Special Town Meeting held on Wednesday, December 27, 1933, by striking out the figures "$100,000" and inserting in place thereof the figures "$106,000", so that said vote as amended shall read as follows :


VOTED : That there be raised and appropriated the sum of $106,000 for the construction and original equipment and furnishings of a high school building, including archi- tect's fees, grading, and any and all other expenses incident to the completion of said building ready for occupancy, subject to obtaining a Federal Grant under the National Industrial Recovery Act.


Voted unanimously that the Town amend the vote passed pursuant to Article 1 of the Warrant for the Special Town Meeting held on Wednesday, December 27, 1933, by striking out the figures $100,000 and inserting in place thereof the figures $106,000, so that said vote as amended shall read as follows :


Voted: That there be raised and appropriated the sum

of $106,000 for the construction and original equipment and furnishings of a high school building, including archi- tect's fees, grading, and any and all other expenses incident to the completion of said building ready for occupancy, subject to obtaining a Federal Grant under the National Recovery Act.


Article 4. To see if the Town will ratify and confirm the acts of the Board of Selectmen in petitioning for and obtaining a grant of money from the Federal Government under the National Industrial Recovery Act and will authorize the appli- cation of said grant either to the construction costs or to the payment of any part of the indebtedness heretofore authorized for this purpose, provided that the entire cost shall not exceed a total of $106,000.


Voted that the Town does hereby ratify and confirm the acts of the Board of Selectmen in petitioning for and obtaining a grant of money from the Federal Government under the National Industrial Recovery Act, and that the Town does here- by authorize the application of said grant either to the con- struction costs or to the payment of any part of the indebted- ness heretofore authorized in connection with said grant, pro- vided that the entire cost of the project shall not exceed a total of $106,000.


Article 5. To receive a report of the Planning Board on the adoption of zoning by-laws by the Town in accordance with the provisions of Chapter 40 of the General Laws and amend- ments thereto, and take any action relative thereto.


Voted that the map which is made a part of the proposed zoning by-law be amended so as to show in a business district so much of the land in Wayland now owned by John H. Ben- nett as lies both within 300 feet of the northerly side line of State Road East and within 900 feet of the westerly side line of Plain Road.

Voted unanimously that the report of the Planning Board be accepted and that the zoning by-laws presented to this meet- ing by the Board following a public hearing held in accordance with the provisions of Chapter 40, of the General Laws, and amendments thereto, be hereby adopted, with the following corrections :


Section IV. Existing Buildings, thirteenth line corrected so as to read "at least 75%."

Section V. paragraph (i), last line ; corrected so as to read "garages and stables as hereinafter provided."


Section XI. third paragraph, second line; corrected so as to read "adequate sketch and written description of the lot in- cluding existing buildings thereon", etc.


Article 6. To see if the Town will appropriate and assess an additional sum of money for Public Welfare, or do or act.


Voted that the Town appropriate $5,000 an additional sum of money for Public Welfare.


Article 7. To see if the Town will appropriate and assess an additional sum of money for Soldiers' Relief, or do or act.


Voted that the Town appropriate $700 an additional sum of money for Soldiers' Relief.


Article 8. To see if the Town will appropriate and assess the sum of two hundred dollars ($200.00) to be expended in connection with Emergency Relief Administration projects.


Voted unanimously that the Town appropriate the sum of two hundred dollars ($200.00) to be expended in connection with Emergency Relief Administration projects.


Article 9. To see if the Town will appropriate and assess the sum of four hundred and eighty four dollars and ninety cents ($484.90) for Highway and Bridges, or do or act.


Voted that the Town appropriate $1,081.90 for Highway and Bridges, the amount in excess of $484.90 to cover the cost of pipe, etc., in connection with the drainage project.


Voted to dissolve the meeting at 9.50 P. M.

Section 105B provides that whoever uses any trap or other device for capture of fur bearing animals, which is not designed to kill such animal at once or to take it unhurt and which is likely to cause continued suffering to an animal caught therein, shall be fined fifty dollars, but traps or other devices for pro- tection of property, set not more than fifty yards from any building, cultivated plot, or enclosures used for rearing poultry

or game birds, to the use of which the presence of vermin may be detrimental, are excluded from the application of this section.


Section 105C provides for the submission to the voters at a municipal election in any city or town upon petition, of the question of whether the operation of section 105B shall be sus- pended or if it has been already suspended, of the question whether it shall again be operative in such city or town.


Section 114A provides that the Commissioner of Conserva- tion may suspend the operation of section 105B for a period not exceeding thirty days within any specified territory under the control of his department.


The law also provides for the submission, by the selectmen to the voters at a special town meeting in the current year, upon petition, of the question as to whether the provisions of section 105B shall be suspended in any town ; and which was approved by both branches of the General Court by vote not recorded, be approved ?

A Recount of votes cast at the State Election November 6, 1934, for Congressman was requested and the same was made by the Registrars, November 17, 1934. Mr. Casey lost one vote in Precinct 2 but the vote for Mr. Foss remained the same : Casey 454 and Foss 704 votes.

A Recount of votes cast at the State Election November 6, 1934, for Secretary was requested by the State and the same was made by the Registrars, December 12, 1934. Mr. Santos- uosso lost one vote and Mr. Richards gained one in Precinct 1 : Burke 7, Cook 763, McGlynn 2, Richards 15, Santosuosso 397 and Taylor 5.
